TAIDI EXTOLS NBA KADUNA, ILE-IFE ON LAW WEEK

FEATURED

GOODWILL MESSAGE TO CHAIRPERSON AND MEMBERS OF NIGERIAN BAR ASSOCIATION ILE IFE BRANCH ON HER 2022 LAW WEEK WITH THE THEME: EXPLORING THE LAW AS A CATALYST TOWARDS A TRULY FEDERAL STATE”

I felicitate with the Chairperson and Members of Ile Ife Branch of the Nigerian Bar Association on her 2022 Law Week.

The programme is focusing on the very important and very controversial aspect of our existence as a nation fondly referred to as ‘Federation,’ when some say we actually practice a military style unitary system where no matter the level of oppression you are expected to fall in line.
This system is the bane of our development as it promotes over dependence on revenue from the centre and leaves unaccountable streams of revenue to be exploited for personal use.

It is my firm conviction that we can get it right by engagements such as this and by continuing the sort of discourse aimed at fashioning a truly federal state where equity and justice prevail.

I am delighted that this discussion is holding at the ‘source’ of the great O’dua heritage and hope the outcome will be the foundation of a true federation.

GOODWILL MESSAGE TO NIGERIAN BAR ASSOCIATION KADUNA BRANCH ON HER 2022 LAW WEEK

I felicitate with the Chairman, Law Week Organising Committee and Members of the Nigerian Bar Association (NBA) Kaduna Branch on the occasion of the 2022 Law Week on the theme: “Expanding the Frontiers of Legal Practice”.

At independence, legal practice in the Nigerian parlance connotes litigation. However, overtime, other areas of practice of law evolved in response to the emerging dynamics of society.

In the 21st century there abound relatively new areas that are either dominated by expatriates who have no right of audience under our law or where we have very few members with expertise to shine in those areas.

There is therefore the need to equip ourselves with the requisite knowledge on diverse and emerging areas of law so that we put a permanent wedge on incursion from foreigners under whatever guise or shade.

This law week affords us the platform to interrogate the challenges bedevelling our ability to diversify into emerging practice areas and stem the tide of pervasive external incursion into our legal space. I therefore challenge participants to take advantage of this platform to discover solutions for our overall benefit.

I wish distinguished participants a rewarding experience and fruitful outcome.

The Nigerian Bar Association (NBA) Women Forum Treasurer, Safiya Balarabe has sent a goodwill message to NBA Jalingo Branch wishing the branch success in their ongoing 2022 Annual Law Week holding between May 11-13, 2022 with the theme, “Legal Practice in a Volatile Democracy; the Nigerian Experience.”

The goodwill message reads:

GOODWILL MESSAGE BY SAFIYA BALARABE TO THE JALINGO BRANCH ON THE OCCASION OF THEIR 2022 ANNUAL LAW WEEK CELEBRATION

“The distinguished Chairman, Executive Committee and Branch Members of the Jalingo branch,

“Permit me to use this medium in conveying my highest regards to your dear branch on the occasion of your 2022 Annual Law Week themed: ‘Legal Practice in a Volatile Democracy; the Nigerian Experience’.

“We have many challenges as legal professionals, but the challenge of lack of respect and regard for the person of a law in the course of his lawful duties is perhaps one of the most disturbing! We are always inundated with bizarre news of brutalization of lawyers by security personnel and the like. We know too well that this ugly practice in engendered by the weak institutions of state leading to a very volatile democracy where might is right and opposed to the rule of law.

“To this end, it gladdens my heart that you have chosen to centre your theme on this very broad and important aspect of our legal career and I look forward to positive changes arising from discussions and recommendation from the speakers at the event.

“I wish you a successful Law Week celebration. Thank you and God bless”

Meanwhile, Gadzama was also hosted to a reception by some members of the NBA Ilorin Branch led by the past Chairman of the branch, Mr. M. I. Akande.

Below are statements made available to CITY LAWYER.

IT WAS ALL SMILES AS MEMBERS OF GOMBE BAR ROAR SUPPORT FOR THE PRESIDENTIAL ASPIRATION OF JOE-KYARI GADZAMA, OFR, MFR, SAN

The breaking of fast (Iftar) with the learned silk Joe-Kyari Gadzama, SAN with his entourage: Mela Audu Nunghe, SAN, Mohammed Monguno,Esq., Steve Abah,Esq. (Vice Chairman NBA SPIDEL), Chief S.T Panwal, Esq. (Former chairman Pankshin Branch), Abubakar Abdulhamid Bununu,Esq. (Attorney General of Bauchi State), M.A Tsuwa,Esq., U.B Babayo,Esq., (Secretary of NBA Bauchi Branch),Samson Gotom, Esq. (Former chairman YLF Jos branch and current secretary NBA Jos branch), Loretta Challa,Esq. (Treasurer, NBA Jos Branch), G.R Ayuba,Esq.(Former NBA Secretary, Gombe Branch), Jerry Musa Ombugadu, Esq. The Iftar was anchored by Luka Haruna, Esq., a seasoned lawyer with a thriving practice under the name and style of L. A. Haruna & Co. in the heart of Gombe State, and a mentee of Chief Joe-Kyari Gadzama, SAN.

In his opening remark, he pronounced Chief Joe-Kyari Gadzama, SAN as a man who is not just competent but most credible leader who has shown commitment and dire desire to secure the future of the bar in all ramifications through different endeavors and landmark activities. He recognized the fact that acclaimed Silk is an employer of labour in his hometown, Nigeria at large, Africa and beyond its shores.

“If one man can accomplish all these feat, we all can support him and become another J-K Gadzama, SAN and even better,” he concluded.

Steve Abah, Esq. who is the Vice Chairman of NBA SPIDEL, praised Chief J-K Gadzama, SAN as a man who qualifies to speak to the conscience of lawyers and people in Nigeria, Africa and the world.

Steve Abah, Esq., the Vice Chairman of NBA SPIDEL, gave a narration on the transparency and accountability showcased by Chief J-K Gadzama, SAN in 2005, who was the first chairman of the Conference Planning Committee amongst many others to produce bank statements of the funds accrued and disbursed in the organization of the conference. So rare!

J-K Gadzama, SAN is indeed a man whose pedigree has no equal in the Nigerian Bar. He is omnipresent as far as legal practice and integrity is concerned.

“Chief Joe-Kyari Gadzama,SAN is a household name of outstanding qualification because he has set the records and broken unthinkable records as a mentor, trainer, man of value and epitome of excellence,” he added.

I am not here to shower accolades on the learned silk because of my acquaintance with him, but I am here on my honour, and my word is my bond.

J-K Gadzama, SAN is not a new name, it is a name registered in the hearts and lives of Nigerians. It is nowhere written that a person shall be chastised for projecting his interest or aspiration, provided that it is fair and just.

Learned Silk is a global team player and a non-generationalist deserving of all the love and support needed to put him in any position…”

He spoke laudably about J-k Gadzama,SAN and concluded his speech by urging distinguished lawyers present to bolster up and identify themselves with a man who needs no introduction.

“Because of his worthiness and commitment to the bar and the Judiciary, the Body of Benchers appointed him as Chairman of the mentoring committee of the Body of Benchers. His nature has earned him the titles of Order of the Federal Republic of Nigeria (OFR), and Member of the Order of the Federal Republic of Nigeria (MFR).

“He has been recognized traditionally in Nigeria by the people of different regions as the Sarduana of Uba, Okwuluora of Ukpo, and the Bobajiro of Akure and many more titles to come…” J-K Gadzama, SAN has proven himself and that is enough, he added.

Abubakar Mohammed, Esq., past Chairman of Bauchi Branch and Deputy Director of Ministry of Justice described himself as an embryo in the legal profession in comparison to Chief Joe-Kyari Gadzama, SAN. He encouraged lawyers to secure their future by standing with eminent Silk.

The Attorney General of Bauchi State, Abubakar Abdulhamid Bununu, Esq. pledged to go anywhere Chief J-K Gadzama, SAN, travel with with him, be with him, reserve nothing and promote the brand of learned silk.

He prayed for God to see Chief J-K Gadzama, SAN through every endeavor, for good people to identify themselves with the only sure leader, for kind hearted individuals to rise and rally around learned silk, good health and for the Almighty God to expose the schemes of the wicked.

Chief Joe-Kyari Gadzama, SAN in response to words of wisdom spoken about him and the future of the Bar, recognized all leaders for their outstanding contributions towards his aspiration, thanked lawyers and the majority of young lawyers who were at Iftar with him.

Revered Silk brought to bare the backwardness and struggles of the North-East and indulge them to show loyalty to the future of the Bar by adhering to the Nigerian Constitution 1999 (as amended), NBA Constitution, and God almighty, as these three are pillars upon which he stands.

He notably said “…a leader is not a leader until he listens to his people…”. He emphasized on service which is the roadmap to greatness as the greatest amongst them all is a servant. Learned Silk implore lawyers at Gombe and supporters from other States to synergize their talents and key into the vision that comes with the assurance of fulfillment.

“My word is my bond, I have a track record of fulfilling all my promises and have evidence of same”. He concluded.

Mela Audu Nunghe, SAN heartily showed gratitude to all the lawyers gathered to recognize the presence of Chief Joe-Kyari Gadzama, SAN.

He marveled at the number of people gathered to listen and interact with J-K Gadzama, SAN and his entourage. He expounded on the need to tag and be moved by reality by surrounding themselves with a man whose record speaks volumes about his capacity. “J-K Gadzama, SAN knows it and has it all at his fingertips.”

He pledged his support and that of his establishment to the course of Chief Joe-Kyari Gadzama, SAN.

He said the last prayers.

Chief Joe-Kyari Gadzama,SAN is indeed not out to merely do the business of law. But he is out in order to enable the Nigerian Bar to live more amply, with greater vision, with a finer spirit of hope and achievement.

ASPIRANTS BEAT DEADLINE, SUBMIT NOMINATION FORMS

Many aspirants have scaled the first hurdle in their quest to clinch positions in the forthcoming Nigerian Bar Association (NBA) elections into the General Council of the Bar and the National Executive Council.

Virtually all the aspirants who CITY LAWYER predicted in its earlier report would join the race confirmed that they had submitted their nomination forms. Aside from Linda Rose Bala and Ede Asenoguan whose close aides confirmed their submission, the other aspirants confirmed the submission of their nomination forms to CITY LAWYER.

There are strong indications that many aspirants submitted their nomination forms yesterday, even as there may be a few new entrants during the elections. Former NBA Welfare Secretary, Mr. Joshua Enemali and longstanding NBA rapporteur Anne Agi told CITY LAWYER that they have submitted nomination forms to vie for a position in the Bar Council, even as Mr. Churchill Aniekwena of NBA Barnawa Branch said he has joined the race for Welfare Secretary. Another new entrant to the race is global President of African Women Lawyers Association (AWLA), Mandy Asagba who is gunning for the post of 3rd Vice President while impeccable sources told CITY LAWYER that Mr. Maximus Ugwuoke of NBA Enugu Branch is also vying for the post of Welfare Secretary.

Below are some of the aspirants who CITY LAWYER had confirmed submission of their nomination forms.

PRESIDENT
The battle for the NBA Presidency remains a three-legged tussle between Chief Joe-Kyari Gadzama SAN, Mr. Yakubu Chonoko Maikyau SAN and Mr. Jonathan Taidi. While Gadzama is the Chairman of the Nigerian Bar Association Security Agencies Relations Committee (NBA-SARC), Maikyau is the Chairman of the NBA Welfare Committee. On his part, Taidi is the immediate past NBA General Secretary.

GENERAL SECRETARY
Aside from the presidential race, the election for the post of General Secretary is poised to be between five gladiators. While Messrs Adesina Adegbite, Desmond Yamah, Ewenode William and Collins Ogiegbaen confirmed submission of nomination forms to CITY LAWYER, Ede Asenoguan’s confidante told CITY LAWYER that he submitted his nomination form yesterday.

FIRST VICE PRESIDENT
Zoned to the “Northern Zone,” Idris Doko Muhammad of NBA Lagos Branch confirmed submission of nomination form while an unimpeachable source confirmed that Linda Rose Bala has submitted her nomination form for the race for the pivotal seat of NBA First Vice President. Calls to Messrs Yakubu Saleh Bawa and Liman Salihu received no response. Bala is former NBA Legal Adviser while Bawa is current Chairman of NBA Jos Branch. On his part, Salihu is former Chairman of NBA Lokoja Branch

SECOND VICE PRESIDENT
The post of Second Vice President has been ‘micro-zoned’ to the Core East by the influential Eastern Bar Forum (EBF). Among those who confirmed submission of nomination forms to CITY LAWYER are the immediate past NBA Bwari Branch Chairman, Mr. Clement Chukwuemeka (aka “Democrats”); his NBA Owerri Branch counterpart, Mr. Damian Nosike, and Dr. Gerald Abonyi, pioneer NBA Obollo-Afor Branch Chairman. Mr. Anthony Chukwurah of NBA Gwagwalada Branch and Mr. Finian Eze  Ndukwu of NBA Mbaise Branch also told CITY LAWYER that they have joined the race for Second Vice President.

THIRD VICE PRESIDENT
Zoned to the “Western Zone” comprising Egbe Amofin O’odua and Midwest Bar blocs, CITY LAWYER can confirm that at least three aspirants are now in the race. While former NBA Ota Branch Chairman, Mr. Isaac Omuta Ogbah and Mr. Promise Ademi-Akpeto confirmed submission of their nomination forms to CITY LAWYER, unimpeachable sources told CITY LAWYER that AWLA global President, Mandy Asagba has also joined the race.

TREASURER
Among the aspirants who have confirmed submission of nomination forms to CITY LAWYER are former NBA Assistant Publicity Secretary, Mr. Chuks Mbamala of NBA Enugu Branch; current NBA Epe Branch Vice Chairman and NBA-SPIDEL Committee Treasurer, Funmi Adeogun; former Vice Chairman of NBA Lafia Branch and current Treasurer, NBA Women Forum (NBAWF), Safiya Balarabe as well as Caroline Ladidi Anze-Bishop, former Vice Chairman and former NEC Representative, NBA Bukuru Branch.

WELFARE SECRETARY
Immediate past NBA Assistant Secretary, Chinyere Obasi and former NBA Barnawa Branch Welfare Secretary, Mr. Churchill Aniekwena have confirmed submission of nomination forms for the post of Welfare Secretary. Meanwhile, impeccable sources told CITY LAWYER that Mr. Maximus Ugwuoke of Enugu Branch has now joined the race. CITY LAWYER also reliably gathered that NBA Welfare Committee member and co-opted NEC member, Mr. Auta Nyada has submitted his nomination form.

PUBLICITY SECRETARY
This is a tripodal race between the immediate past Assistant Publicity Secretary, Mr. Habeeb Akorede Lawal; current NBA Welfare Committee Secretary, Ogaga Emoghanre, and the latest entrant, Mr. Felix Chukwuma Ashimole (aka Che Oyinatumba), a former NBA Bwari Branch Secretary and former Member of NBA Anti-Corruption Committee. All three aspirants have confirmed submission of nomination forms to CITY LAWYER.

ASSISTANT GENERAL SECRETARY
This race may present a crowded field of aspirants. The aspirants who have confirmed to CITY LAWYER that they submitted nomination forms are the current NBA Ikorodu Branch Secretary, Mr. Oluwaseun Aka; incumbent NBA Ilorin Branch Vice Chairman, Mr. Dhikrullah Adewale Balogun; Mr. Daniel Kip of Calabar, and Mr. Oseme Peremene Anthony, former NBA Idemili Branch Chairman.

ASSISTANT PUBLICITY SECRETARY
This may be a straight fight between Mr. Charles Ajiboye who also contested for the position during the last election and Mr. Akachukwu Nwoye, current NBA Gwagwalada Branch Secretary. Both aspirants told CITY LAWYER that they have submitted their nomination forms for the election.

GENERAL COUNCIL OF THE BAR
Among those itching to represent the Bar at the Bar Council are former NBA Welfare Secretary, Mr. Joshua Enemali and Ms. Anne Agi; current NBA Aba Branch Vice Chairman, Mr. Victor Onweremadu who may have jettisoned his initial quest for the position of Welfare Secretary, and Mr. Femi Onakoya of NBA Lagos Branch.

CITY LAWYER also gathered that many aspirants including some senior advocates have shown serious interest in slugging it out for a place in the General Council of the Bar.

GADZAMA STORMS NBA CALABAR, UYO BRANCH LAW WEEK

The Nigerian Bar Association, Calabar Branch popularly christened as the Doyen Bar of the NBA held its Annual Law Week recently with the theme, “We the People: An Agenda for National Consciousness”.

Speaking on the theme of the Law Week, the Chairman of the NBA Securities Agencies Relations Committee (NBA-SARC), Chief Joe-Kyari Gadzama (SAN), who was represented by Nella Andem Rabana (SAN), described security and education as twin factors which determine the level of development in a society. He explained that a society’s advancement is proportional to the level and kind of education and security architecture prevalent in that society.

Using Nigeria as a case study, Gadzama said that the parts of the country with the most incidences of insecurity are the Northern regions which are by far the most deprived of formal education. He outlined recommendations to better the situation of the country as it relates to both security and education.

Meanwhile, the Uyo Branch of the NBA also held its Annual Law Week from the 24th of March to the 1st of April, 2022. The Law Week which was christened “The Advent of Ibom Deep Seaport and the Prospects of Maritime Law Practice in Nigeria” heralded several insightful deliberations on the need for an all-inclusive approach in the development and sustainability of a standardized Maritime practice in the country. In the course of the Annual Law Week, several ideas were posed and resolutions made towards the fulfilment of this mandate.

According to a statement, “The Law Week also had other highlights including the Annual Dinner and Sit-out session. The event indeed all-round glamorous but even more thrilling was the crowning stroke; the farewell brunch courteously organized for the illustrious patriot of the Nigerian Bar, Chief Joe-Kyari Gadzama, SAN.

“The Executives and Members of the NBA Uyo Branch saw to it that their ‘in-law,’ in person of the Learned Silk J-K Gadzama, SAN was given a treat to several local delicacies before bidding him farewell.

“The Learned Silk whilst thanking them for the warm hospitality reiterated his unwavering support and commitment to the affairs of the Branch and prayed that such harmony, peace and innovation continued to coexist amongst the Members and Executives alike.

“It was a memorable, enjoyable and refreshing experience for all attendees.”

HARASSMENT: AKPATA WRITES EFCC CHAIR, ISSUES ‘CEASE AND DESIST’ DEMAND

Nigerian Bar Association (NBA) President, Mr. Olumide Akpata has again risen in defence of Nigerian lawyers through a ‘cease and desist’ letter to the Economic and Financial Crimes Commission (EFCC).

In the searing letter obtained by CITY LAWYER and titled “ASSAULT OF OFFICIAL(S) OF THE NIGERIAN BAR ASSOCIATION BY OPERATIVES OF THE EFCC AND RELATED INCIDENTS OF UNPROFESSIONALISM AGAINST LAWYERS: A DEMAND FOR INVESTIGATION, IMMEDIATE ACTION AND CESSATION,” Akpata stated that he was “constrained” to write the anti-graft Chairman over the alleged assault on NBA Makurdi Branch Chairman, Mr. Justin Gbagir and “the recurring unwholesome and unprofessional conducts by officers and operatives of the EFCC against members of the legal profession in Nigeria who are lawfully discharging their professional responsibilities.” The letter was copied to Attorney General of the Federation & Minister of Justice, Mr. Abubakar Malami SAN.

In the 15-paragraph long letter dated June 10, 2021 but received by the EFCC on 15th June, 2021, the NBA President noted that he was “credibly informed that Mr. Gbagir visited the Makurdi office of the EFCC on 8th June 2021 to facilitate the release of one Ms. Aver Shima (“Ms. Shima”), who is a law officer in the employ of the Benue State Ministry of Justice. Ms. Shima had apparently been detained by the EFCC on an allegation that she gave legal advice to the Chairman of the Benue State Universal Basic Education Board that allegedly culminated in the latter signing a document which is reportedly the subject of investigation by the EFCC. Since the merits of the detention of Ms. Shima for providing legal advice is now, as I understand it, already the subject of independent investigation, I shall refrain from commenting on Ms. Shima’s treatment.”

Turning to the alleged manhandling of Gbagir by EFCC operatives, Akpata said: “Infuriated by this turn of events, the Honorable Attorney-General, the Solicitor General and the Special Adviser to the Governor who had all come to intervene in the detention of Ms. Shima left the premises. Suffice to state that Mr. Gbagir who suffered severe hurt and sustained various degrees of injury had to be hospitalized at the Benue State University Teaching Hospital, Makurdi.”

In a damning indictment of the EFCC operatives, the NBA President described their conduct as “uncultured,” saying: “I assume that you will agree, Mr. Chairman, that if this level of uncultured behaviour could be exhibited by EFCC operatives in the presence of the strong delegation accompanying Mr. Gbagir, who in his own right is a Bar Leader, then the potential fate of other lawyers and citizens who interface with the EFCC in that zone is better imagined than experienced.”

Also in a veiled displeasure over the conduct of the EFCC leadership and its controversial press statement over the assault, Akpata said: “When we both spoke about this incident on 9th June 2021, you understandably expressed shock at this development and promised to investigate same. I have no cause yet to believe that you would personally renege on that promise. However, I have seen certain reports in the media credited to the EFCC Media and Publicity team which denied and largely distorted the facts. In fidelity to honesty and good order, I trust that you and I can agree that the statement credited to the EFCC media head, to the extent that it represents the official position of the EFCC, is premature and antithetic to your pledge to investigate the issue.

“It is pertinent to add that both before and after reading the EFCC statement, I spoke to the Attorney-General of Benue State and other well-meaning senior lawyers who witnessed the incident, and their narrative is entirely consistent with the position of Mr. Gbagir. I have no reason to doubt or disbelieve their narrative and it now behooves on the EFCC to show that it can rise above board and properly investigate the excesses of its own staff.

Turning to the issue of harassment of lawyers by EFCC operatives, Akpata lampooned the operatives for “the high level of unprofessionalism, crass abuse of power and inhumane treatment” which they “have exhibited, and continue to exhibit, at different times when dealing with lawyers at various offices of the EFCC across the country.” According to him, “Verifiable instances abound of lawyers who have been, or are being, harassed, arrested, and detained for either providing legal advice to, or preparing transaction documents for, their clients. There are also other instances, where lawyers are simply denied access to their clients in custody or continuously maltreated, frustrated, intimidated and demeaned by EFCC operatives. The NBA is more than willing to make further representations to you and provide proof of such unsavory developments including recent instances where we have had to intervene on behalf of our members who were unjustly harassed or detained by the EFCC.”

Noting however that this state of affairs precedes the current EFCC leadership, Akpata warned that the situation “is totally unacceptable and, if not checked, will increasingly paint the Commission in a negative light, raise serious concerns about the modus operandi of the Commission and undermine her relationship with critical stakeholders.”

He noted that “the current state of the relationship between lawyers and the Commission, which ordinarily ought to be harmonious, collaborative and symbiotic, is unhealthy and continues to deteriorate. For inexplicable reasons, the relationship is characterised by the wanton harassment and assault of members of the legal profession who, by their calling, are mandated to provide legal advisory and support services to suspects in the custody of the Commission or those who are otherwise under investigation.” Akpata then warned that “This debasing treatment must cease forthwith.”

In a three-point demand, the NBA President wrote: “It is in view of the foregoing that I therefore formally request you to use your good offices to investigate this complaint expeditiously and thoroughly in the interest of justice and ensure that all operatives complicit in the very unfortunate incident are disciplined in line with extant service rules and applicable laws. The NBA will be constantly following up with you in this respect, as we will no longer endure or tolerate the incessant harassment of our members by EFCC operatives while such lawyers are lawfully discharging their duties.

“You may recall that one of the cardinal pillars of your mandate upon your assumption of office was to reposition the Commission and make it a reputable anti-corruption agency that boasts of the finest of personnel. I dare say that achieving this laudable objective would necessarily include weaning the Commission of officers and personnel whose conduct, taken individually or in the aggregate, are bound to undermine the image of the Commission.

“As you continue to settle into office, I urge you to look into these issues carefully with a view to resolving them holistically and avoiding a recurrence. We are indeed expectant that there will be no repeat of incidences such as those complained about in this letter. Lawyers dealing with the Commission must and should be accorded the respect and dignity that they deserve when acting on behalf of their clients. Under your leadership, you must intervene and take steps to ensure that this is the case at all offices of the Commission across the country.”

Below is the full text of the letter:

10th June 2021

The Executive Chairman
Economic and Financial Crimes Commission
EFCC Headquarters
Plot 301/302, Institution and Research Cadastral District
Jabi, Abuja

Attention: Mr. Abdulrasheed Bawa

Dear Sir,

ASSAULT OF OFFICIAL(S) OF THE NIGERIAN BAR ASSOCIATION BY OPERATIVES OF THE EFCC AND RELATED INCIDENTS OF UNPROFESSIONALISM AGAINST LAWYERS: A DEMAND FOR INVESTIGATION, IMMEDIATE ACTION AND CESSATION

  1. I am constrained to write to you over (a) an unfortunate incident which occurred on 8th June 2021 involving some operatives of the Economic and Financial Crimes Commission (the “EFCC” or the “Commission”) at its Makurdi Zonal office, and Mr. Justin Gbagir (“Mr. Gbagir”), a senior member of the Nigerian Bar Association (“NBA”) who is also the Chairman of the Makurdi Branch of NBA; and (b) the recuring unwholesome and unprofessional conducts by officers and operatives of the EFCC against members of the legal profession in Nigeria who are lawfully discharging their professional responsibilities.

The Unfortunate Makurdi Incident

  1. I have been credibly informed that Mr. Gbagir visited the Makurdi office of the EFCC on 8th June 2021 to facilitate the release of one Ms. Aver Shima (“ Shima”), who is a law officer in the employ of the Benue State Ministry of Justice. Shima’s treatment.
  1. As we understand from the sequence of events, when Mr. Gbagir arrived at the EFCC zonal office in the company of other senior members of the Benue State Ministry of Justice, including the State Director of Public Prosecution, the delegation was refused entry into the offices of the EFCC and was subjected to humiliating and degrading treatment by the security operatives manning the gate of the EFCC on the rather specious ground that they were “agitators” who had come to protest. It took the intervention of the Senior Special Assistant to the State Governor and the arrival of the Attorney-General and the Solicitor-General of the State before the delegation was allowed access into the facility.
  1. It is our further understanding that when Mr. Gbagir was introduced to the EFCC zonal head (Mr. Kazeem Oseni) by the Solicitor-General of the State as the Chairman of the Makurdi Branch of the NBA, Mr. Gbagir was denied all courtesies on the ground that he was an “agitator”. Perplexed and embarrassed, Mr. Gbagir sought to excuse himself from the office of the zonal head only to be swarmed by an army of operatives of the EFCC, who brutally manhandled Mr. Gbagir and pushed him out of the premises. Of particular note and concern is the fact that eyewitness accounts confirm that the actions of the EFCC operatives were carried out with the tacit consent of the zonal head, at best, or based on his express instructions, at worst.
  1. Infuriated by this turn of events, the Honorable Attorney-General, the Solicitor General and the Special Adviser to the Governor who had all come to intervene in the detention of Ms. Shima left the premises. Suffice to state that Mr. Gbagir who suffered severe hurt and sustained various degrees of injury had to be hospitalized at the Benue State University Teaching Hospital, Makurdi.
  1. I assume that you will agree, Mr. Chairman, that if this level of uncultured behaviour could be exhibited by EFCC operatives in the presence of the strong delegation accompanying Mr. Gbagir, who in his own right is a Bar Leader, then the potential fate of other lawyers and citizens who interface with the EFCC in that zone is better imagined than experienced.
  1. When we both spoke about this incident on 9th June 2021, you understandably expressed shock at this development and promised to investigate same.
  1. It is pertinent to add that both before and after reading the EFCC statement, I spoke to the Attorney-General of Benue State and other well-meaning senior lawyers who witnessed the incident, and their narrative is entirely consistent with the position of Mr. Gbagir. I have no reason to doubt or disbelieve their narrative and it now behooves on the EFCC to show that it can rise above board and properly investigate the excesses of its own staff.

Other egregious conducts of EFCC operatives against legal practitioners

  1. Chairman, whilst the above represents the isolated experience of Mr. Gbagir, it is an opportune time to bring to your attention the high level of unprofessionalism, crass abuse of power and inhumane treatment that operatives of the EFCC have exhibited, and continue to exhibit, at different times when dealing with lawyers at various offices of the EFCC across the country. Verifiable instances abound of lawyers who have been, or are being, harassed, arrested, and detained for either providing legal advice to, or preparing transaction documents for, their clients. There are also other instances, where lawyers are simply denied access to their clients in custody or continuously maltreated, frustrated, intimidated and demeaned by EFCC operatives. The NBA is more than willing to make further representations to you and provide proof of such unsavory developments including recent instances where we have had to intervene on behalf of our members who were unjustly harassed or detained by the EFCC.
  1. This state of affairs, which admittedly precedes your appointment to superintend the EFCC, is totally unacceptable and, if not checked, will increasingly paint the Commission in a negative light, raise serious concerns about the modus operandi of the Commission and undermine her relationship with critical stakeholders. As you know, the role of lawyers is critical to the actualisation of the Commission’s foundational objectives. As a law enforcement agency that is established to be responsible and accountable to the citizenry, one would expect that lawyers will continue to be your partners in progress who should feel welcome and accommodated by the Commission and its operatives.
  1. Regrettably, the current state of the relationship between lawyers and the Commission, which ordinarily ought to be harmonious, collaborative and symbiotic, is unhealthy and continues to deteriorate. For inexplicable reasons, the relationship is characterised by the wanton harassment and assault of members of the legal profession who, by their calling, are mandated to provide legal advisory and support services to suspects in the custody of the Commission or those who are otherwise under investigation. This debasing treatment must cease forthwith.

Conclusion

  1. It is in view of the foregoing that I therefore formally request you to use your good offices to investigate this complaint expeditiously and thoroughly in the interest of justice and ensure that all operatives complicit in the very unfortunate incident are disciplined in line with extant service rules and applicable laws. The NBA will be constantly following up with you in this respect, as we will no longer endure or tolerate the incessant harassment of our members by EFCC operatives while such lawyers are lawfully discharging their duties.
  1. You may recall that one of the cardinal pillars of your mandate upon your assumption of office was to reposition the Commission and make it a reputable anti-corruption agency that boasts of the finest of personnel. I dare say that achieving this laudable objective would necessarily include weaning the Commission of officers and personnel whose conduct, taken individually or in the aggregate, are bound to undermine the image of the Commission.
  2. As you continue to settle into office, I urge you to look into these issues carefully with a view to resolving them holistically and avoiding a recurrence. We are indeed expectant that there will be no repeat of incidences such as those complained about in this letter.  Lawyers dealing with the Commission must and should be accorded the respect and dignity that they deserve when acting on behalf of their clients.  Under your leadership, you must intervene and take steps to ensure that this is the case at all offices of the Commission across the country.
  1. While I look forward to an expeditious investigation of the unjust treatment of Mr. Gbagir and a general refocusing of the approach of the EFCC in its dealings with lawyers, please accept, Mr. Chairman, the assurances of my highest consideration.

Yours faithfully,

OLUMIDE AKPATA

President

NBA DUTSE MEMBERS DEFY USORO, INAUGURATE NEW EXCO

BY EMEKA NWADIOKE

The Nigerian Bar Association (NBA), Dutse Branch has inaugurated a new Executive Committee to pilot its affairs, notwithstanding the appointment of a Caretaker Committee for the branch by NBA President, Mr. Paul Usoro SAN. With Mr. Garba Abubakar as the newly elected Chairman, the new Executive Committee was sworn-in by Mr. Sule Umar, a Notary Public.

Speaking after assuming office as the incumbent branch chairman, Abubakar alleged that acolytes of an influential Bar Leader and former Jigawa State Attorney-General & Commissioner for Justice have been destabilizing the branch, adding that the branch would no longer tolerate such meddlesomeness. Abubakar warned the Bar Leader to stay away from the branch or risk having legal action taken against him.

Noting that the peaceful disposition of the outgone Executive Committee – of which he was the Secretary – must not be taken for cowardice, Abubakar alleged that the Bar Leader is not a member of the branch by virtue of Article 13 (4) of the NBA Unified Bye Law for branches, adding that he has “no visible place of practice and residence in the whole Jigawa State.”

The Dutse Branch helmsman warned that the branch would henceforth take steps to stem the alleged meddlesomeness of the Bar chieftain, adding that “In the very unlikely event that he refuses or rather neglects to stop tempering with the peaceful nature and wellbeing of the branch, I would have no further option than to activate the provisions of the relevant laws with a view to restoring the peaceful nature of the branch, and when that is done, the whole world will know where the truth lies as the truth is always on the side of the oppressed.”

He however extended an olive branch to all branch members to join his administration in moving the branch forward, saying: “I am using this medium to extend the hand of friendship and cooperation to those who have any issue or feel offended by any activities of the Branch Executive. It is indeed time to forget our past and go ahead for the progress of our Branch.”

Reeling out his roadmap for the next two years, Abubakar said he would “continue from where my predecessor stopped in the area of fostering unity among members, mentorship for young lawyers as well as capacity building. I will further continue from where the former Executive stopped in the area of partnership with various government agencies and other development partners for the benefit of our branch.

“We will in particular pay much attention to the following areas:

  • Human Capital Development and Welfare Programs.
  • Promoting of All-inclusive Bar.
  • Promoting mandatory continuing legal education.
  • Mentorship scheme and capacity building for young lawyers.
  • Promoting rule of law and good governance.
  • Provision for pro bono legal service for indigent, aged and victims of rape.
  • Creating synergy and collaboration between the branch and any development partners for the development of the branch.”

Speaking earlier, the former branch chairman, Mr. Bashir Usaini outlined the achievements of his administration, noting that while he met only N300,00 in the branch coffers, “I am leaving NBA GTB Account with the sum Two Million Five Hundred and Twenty Five Thousand Naira (N2, 502,500) only.” He urged the members “to support the incoming executive for collective success and peaceful relationship.”

Usoro had in a statement by NBA General Secretary, Mr. Jonathan Gunu Taidi, dissolved the Election Committee set up by the NBA Dutse Branch and constituted a three-member Caretaker Committee to handle the affairs of the branch upon the expiration of the tenure of the branch Executive Committee on 29th June, 2020.

But the branch members argue that the letter appointing the Caretaker Committee was belated and of no consequence, having been delivered after conclusion of the branch elections, with certificates of return issued to the winners.

DEMOCRACY DAY: ‘ELECTORAL BANDITRY FUELS INSECURITY, POVERTY’ – OJUKWU

Leading lawyer and former Deputy Director of the Nigerian Law School, Prof. Ernest Ojukwu SAN has take a hard look at Nigeria’s democractic journey, warning that “We can only celebrate the 2020 democracy day as democracy aspirations, dreams and hopes for Nigeria.”

In a press statement made available to CITY LAWYER to mark this year’s Democracy Day, the former Nigerian Bar Association (NBA) presidential candidate observed that “electoral banditry has provided the impetus for seriously failed governance on human rights, damaged judiciary, poverty and insecurity,” adding that “What plays out especially at our State and local government levels are massive corruption and executive lawlessness.”

The full text of the statement is below:

We have not done well as a nation with regards to elections and rule of law. Our leaders and politicians have paid lip service to the tenets of democratic principles. There has not been any general elections that has not been hijacked by individuals and groups backed by governments through massive rigging, thuggery and brigandage. The same scenario plays out at party primaries. That culture of stealing and rigging elections has also permeated our other segments of society such as the Nigerian Bar Association at both the National and branch elections.

Many organisations and professional groups have also been enmeshed in rigging election as a way of life in Nigeria including elections of students unions. The Nation has not bled so much as it has in terms of failed democracy as we have witnessed especially since 2004 when we made the first effort to conduct a civilian to civilian transition elections. Our electoral umpire has largely colluded with our bandit political leaders and party men to foist on Nigeria a culture of dishonesty and fraud in the electoral process. We can hardly say that the leaders that emerge through these fraudulent elections were chosen by the people. And that is why they have hardly represented our interests. And because the electoral system and processes were stolen as a matter of course, it has been impossible to use democratic platforms provided in the constitution to check the excesses of mis-governance including recall of elected representatives at all levels.

This singular act of electoral banditry has provided the impetus for seriously failed governance on human rights, damaged judiciary, poverty and insecurity. What plays out especially at our State and local government levels are massive corruption and executive lawlessness. It is a shame that governance has not worked well in Nigeria since the return to civilian rule in 1999. We can only celebrate the 2020 democracy day as democracy aspirations, dreams and hopes for Nigeria.

‘You Have Not Been Fair to Us,’ Olanipekun Tells Mahmoud

Early signs that the forthcoming Annual General Meeting (AGM) of the Nigerian Bar Association (NBA) will be explosive emerged yesterday as former NBA President, Chief Wole Olanipekun warned the Mr. Abubakar Mahmoud SAN-led NBA to shelve any plan to amend the association’s controversial constitution.

In a letter dripping with angst and discomfiture, the go-to lawyer expressed disappointment at the situation, adding that the NBA President had “not been fair” to the past NBA presidents and secretaries who admonished him to shelve the constitutional amendment project.

Below is the full text of the statement:

2nd August, 2018

Mr. A. B. Mahmoud, SAN
The President,
Nigerian Bar Association,
NBA House,
Plot 1101, Muhammadu Buhari Way,
Central Business District,
F.C.T. Abuja.

Dear Mr. President,

RE: AMENDMENT TO THE NBA CONSTITUTION
First and foremost, may I extend my professional and brotherly courtesies to you as our/my President.
You would recall that at the last meeting of past Presidents and Secretaries of the Nigerian Bar Association (NBA) called at your instance at Fraser Suites, Abuja on Friday, 20th July, 2018, you brought up, amongst others, your proposed amendments to the NBA constitution and apprised us of the far-reaching amendments being proposed by you on the eve of your departure, as the President of the foremost professional association in Nigeria. After a very extensive discussion on your proposals, and considering the depth and implications of such amendments, the meeting advised that you should shelve and/or put the proposals on hold, and allow your successor-in-office do further consultations on them, both at the National Executive Committee (NEC) and general levels and platforms, in order to adequately weigh the pros and cons of the proposed amendments before passing same. It was on this note that the meeting closed, and you did not disagree with the wise counsel.

Surprisingly, a notice or plan/intention to amend our constitution, as proposed and tabled by you at the meeting has now been sent out, and I must confess, I am in receipt of same, to the effect that the proposed amendments will be presented at the Annual General Meeting (AGM) of the NBA. I am taken aback by this development, and I kept on wondering why you ever brought up the topic at our meeting of Friday, 20th July,2018, if you knew you would not respect our opinion. Mr. President, you have not been fair to us, to put it mildly. As a person, I protest this attitude and action of yours. Needless reminding you, Mr President that the same meeting resolved a lot of burning issues to your advantage and satisfaction.

As agreed at the said meeting Mr. President, may I again advise and counsel that you put on hold the proposed constitutional amendments. No one possesses the monopoly of wisdom, and it is only courteous that you also respect the objections raised to some of your amendments at the meeting, despite the fact that some of us saw the proposals for the first time just at the meeting. No leader, however brilliant, industrious, good-intentioned or pragmatic can ever resolve all the problems of his association, society or country in his life time or within his tenure. You cannot be an exemption. Please let us learn from history; and be reminded that amendments to the NBA constitution should no longer be randomly done. I dare say that the proposed amendments, in some material particulars, will turn out to be an ill-wind, which will bring or blow in no fresh breath. You are advised not to force the amendments on our beloved Association at the AGM, which, with much respect, might be constituted in such a way that the attendees would not readily understand or appreciate the unending conundrum we will be plunged into if the amendments sail through. And in case you insist on going ahead to present the amendments at the AGM, can you be gracious enough, as a lawyer and leader, to circulate this letter of mine to the AGM.

Allow me to copy this letter to the past Presidents and Secretaries of the NBA.
Once again, Mr. President, accept my high regards.

I remain,

Your colleague and predecessor-in-office,

Chief Wole Olanipekun, OFR, SAN, LL.D, FCIArb., FNIALS.
