LAWYER SEEKS RETRACTION OF REPORT ON US-BASED NIGERIAN

A Lagos-based lawyer, Mr. Kelvin Olu has demanded a retraction of an online post against his client, Mr. Toyosi Stephen Akure, a United States based Nigerian entrepreneur.

In a Pre-Action Notice to one M/s Adeola Abiodun Adebayo titled “NOTICE OF DEFAMATION ON THE PERSON OF MR TOYOSI STEPHEN AKURE AND DEMAND FOR RETRACTION NOTICE THROUGH PUBLIC NOTIFICATION,” the Solicitor alleged that Ms. Adebayo “maliciously misrepresented our Client in the public glare, by deliberating infusing false, dishonest and untrue assertions against him into the minds of right thinking members of the society.

We act as Solicitors to Mr Toyosi Akure (herein referred to as our Client) and it is on his firm instruction that we write you this letter.

Our Client informed us on the 5th day of September, 2022 that you published a blog post opinion, piece through your personal Snap chat account with the name “Kiki” which you control and handle in person. Your publication on the blog which has several pictures, telephone contacts and several other personal details of our Client was extended to other platforms wherein you mentioned and brought the attention of our Client and the public at large thereto.

The trend which you created in the online public domain bearing the pictures, contact and other personal details of our Client repeatedly represented / presented him to the public as a fraudster, a man with no value, a gigolo and one with an outright moral decadence. The intention of your post could be deduced from its face value.

The post that you published is defamatory and not in any way true. In effect, you have maliciously misrepresented our Client in the public glare, by deliberately infusing false, dishonest and untrue assertions against him into the minds of right thinking members of the society in an attempt to ridicule / shame and make the general public to hate and scorn our Client.

The message that was directed to the entire public sends a wrong signal to the world at large. We also wish to inform you that the resuscitating solemnization of our Client is at the verge of termination due to the statement directed to our Client.

It is pitiful that individuals as yourself abused the constitutional freedom of speech and expression. Hence, expressions that do not have basis or justification will not be condoned and tolerated whatsoever.

In effect, you have maliciously misrepresented our Client in the public glare, by deliberating infusing false, dishonest and untrue assertions against him into the minds of right thinking members of the society.

DETENTION: POLICE CHIEF BEGS LAWYER, GADZAMA C’TE INTERVENES

Under-fire Commissioner of Police in-charge of Force Intelligence Bureau (FIB) Annex, Lagos, Mr. Salisu Gyadi Gyadi has apologized to senior lawyer, Mr. Ayodeji Odukale for his detention alongside his client.

CITY LAWYER had yesterday reported that Odukale was detained on the orders of Gyadi for allegedly coming late to a scheduled meeting to resolve a charge of “threat to life” arising from a matrimonial dispute.

Following the CITY LAWYER report, the Chief Joe-Kyari Gadzama SAN-led Nigerian Bar Association (NBA) Security Agencies Relations Committee (NBA-SARC) has waded into the matter.

Odukale told CITY LAWYER that Gadzama had telephoned him and asked him to write formally to the committee stating his grievances and demands, adding that the NBA-SARC also dispatched respected former Deputy Inspector General of Police Taiwo Lakanu to investigate the matter.

The senior lawyer, who was admitted to the Bar 31 years ago, stated that following Lakanu’s intervention, Gyadi had called him severally to apologize for the debacle, saying that he was “surprised and worried when I heard about your detention by my officers.”

The police chief stated that he came to grip with the full picture of the matter during a “marathon party interview,” adding that “our main aim is to see that the parties settled.” He expressed a desire to meet with the senior lawyer “one on one” to “dialogue” with him and personally apologize over the debacle.

Odukale thanked CITY LAWYER for putting a spotlight on his plight, saying that many lawyers and non-lawyers had called to sympathize with him. “I am happy that as a result of the report, NBA finally rose to the occasion,” said Odukale.

He stated that while he had acknowledged Gyadi’s remorseful posture, he was in the process of writing formally to NBA “to ensure that the apology is formalized and secure assurances that no lawyer or citizen for that matter will suffer the same fate that befell me and my client.”

Odukale had told CITY LAWYER that his ordeal started when he accompanied his client to a meeting with Gyadi, adding that immediately the duo entered the meeting room, Gyadi said he would “personally sign” their detention order for coming late to the meeting.

In a post he made on a lawyers’ platform, the senior lawyer said: “Good evening colleagues, I want to bring an unfortunate incident to our attention especially as there is a meeting tomorrow (today). I went for a meeting with a victim of domestic violence to meet with the commissioner of Police Force Intelligence Bureau, Kam Salem building, Obalende on Wednesday. The commissioner said we came late for the meeting and ordered that we be detained at Alagbon. Because you normally drop your phone before entering, l left my phone in the car. As a result, I could not communicate with the outside world. Somehow, I managed to get information across to my wife who tweeted NBA Lagos and NBA National. Unfortunately, to the best of my knowledge, till today there has been no response from the NBA. It seems the NBA cares little about members in distress and this arbitrary use of power. What if we had a medical situation warranting administration of medicine every hour? So NBA would now rush and come and pay condolence visit?”

He said that the matter revolved around a domestic violence complaint incidented by his client at the Domestic and Sexual Violence Response Team (DSVRT), adding that the team referred the matter to the Adeniji Adele Police Station. He stated that a police team from the station visited the suspect, and that the suspect turned around to levy a charge that he and his client brought “thugs” to threaten him. Odukale added that “threat to life” is not an offence known to Nigeria’s jurisprudence.

POLICE DETAIN SENIOR LAWYER FOR ‘LATENESS’, GADZAMA VOWS TO WADE IN

A 57-year-old senior lawyer, Mr. Ayodeji Odukale has been detained at Force Criminal Investigation Bureau, Alagbon, Lagos for allegedly coming late to an appointment with the police.

Odukale, who was admitted to the Nigerian Bar 31 years ago, told CITY LAWYER that he was detained overnight in a cell without food or medical attention on the order of Mr. Salisu Gyadi Gyadi, Commissioner of Police, Force Intelligence Bureau (FIB) Annex, Lagos.

According to Odukale, Gyadi ordered his detention alongside his client on the ground that they “kept him waiting” and came late to a meeting over an allegation of threat to life brought by a complainant.

He told CITY LAWYER that his ordeal started when he accompanied his client to the meeting, adding that immediately the duo entered the meeting room, Gyadi said he would “personally sign” their detention order for coming late to the meeting. He said that the police chief did not allow them to speak.

Asked whether he posted bail before his release, he said: “No; nothing like that. The CP just ordered our release, saying that it was a civil matter between husband and wife! It means I was detained for nothing. That is why NBA absolutely needs to make a statement on this matter to say that you do not detain people for nothing. That they invested an officer with power to detain citizens does not mean it should be deployed arbitrarily. What is more, I came innocently to the station even without an invitation. I was not aware of any time set for the meeting. I could have died from the shock of my detention or had a stroke. I was dumped there without anyone even bothering to know whether I was dead or alive. In fact, the operatives at Alagbon told me that the detention order was signed in red ink, saying that it was an indication that the signatory wanted us to be dumped in the worst of the dungeons!”

Responding to the charge of neglect by NBA, the Chairman of the NBA Security Agencies Relations Committee (NBA-SARC), Chief Joe-Kyari Gadzama SAN told CITY LAWYER that he was not aware of the matter. His words: “I have been away to Katsina and unreachable because of bad weather and network. I’m on transit now. We have all shared responsibility as (NBA-SARC) committee members. I can’t remember seeing his message. Text me his number and one of our committee members will get across to him.”

Though CITY LAWYER contacted Mr. Olumuyiwa Adejobi, the Acting Police Public Relations Officer (PPRO) on the matter, he was yet to respond at press time.

SOWORE: GADZAMA COMMITTEE VOWS TO FREE DETAINED LAWYER

The Chief Joe-Kyari Gadzama SAN-led Nigerian Bar Association Security Agencies Relations Committee (NBA-SARC) has vowed to take urgent steps to ensure release of Mr. Abubakar Marshal, a lawyer remanded at Kuje Correctional Centre for allegedly standing as surety for firebrand human rights activist, Mr. Omoyele Sowore.

In a statement made available to CITY LAWYER, the committee frowned at the arrest and prosecution of the embattled lawyer, saying “that the Area Courts in the FCT cannot assume criminal jurisdiction” over a matter dealing with whether a suspect has jumped bail.

The committee assured that it is “presently taking urgent steps to ensure the immediate release of Mr. Marshal and that any defaulting party, be it the bench, the bar or any security agency alike, is appropriately sanctioned.”

It said that the arrest and remand of Mr. Marshal at the Kuje Correctional Centre “is a manifestation of gross impunity and conspicuous disdain for rule of law and the due process of law. Further to which we presently encourage anyone with useful information and/or evidence as regards all the facts and circumstances surrounding Mr. Marshal’s incarceration to urgently reach out to the NBA-SARC, to aid in the attainment of justice.”

STATEMENT OF THE NIGERIAN BAR ASSOCIATION – SECURITY AGENCIES RELATIONS COMMITTEE (NBA-SARC) ON THE ARREST OF MR ABUBAKAR MARSHAL

Dear Colleagues,

1. In keeping with the mandates of the NBA-SARC, the Committee has taken cognizance of online media reports which inter-alia suggest that an Area Court sitting in Kabusa in the Federal Capital Territory of Abuja has ordered that a legal practitioner, Mr. Abubakar Marshal, be remanded in Kuje Correctional Centre till Tuesday, March 8, 2022, on the premise of filing a lawsuit on behalf of one Mr. Omoyele Sowore against one Mr. Ned Munir Nwoko.

2. Conversely, the NBA-SARC is further aware of contrary reports in some quarters that the police only arrested Mr. Marshal, who stood as Mr. Sowore’s surety for bail, when Mr. Sowore jumped bail. These contrary reports further claim that after Mr. Marshal on February 24, 2022, assured the Police of producing Mr. Sowore on the next date, being February 25, 2022, slated for continuation of investigation, neither Mr. Sowore nor Mr. Marshal was in attendance at the Police Station on the said date.

3. Assuming without conceding that Mr. Marshal stood surety for Mr. Sowore who allegedly jumped bail, the FCT High Court in the case of Gladys Chukwu v. Hon Gambo Garba FCT/HC/M/4499/19 and Barr. Anugo Ifeanyi Chuwu v. The Grand Khadi Sharia Court of Appeal & 2 Ors, FCT/HC/CV/2107/14 have held that the Area Courts in the FCT cannot assume criminal jurisdiction, and the instant circumstance is not any different.

4. We, therefore, unreservedly condemn this present illegality and are presently taking urgent steps to ensure the immediate release of Mr. Marshal and that any defaulting party, be it the bench, the bar or any security agency alike, is appropriately sanctioned. Indeed, the arrest and subsequent remand of Mr. Marshal at the Kuje Correctional Centre is a manifestation of gross impunity and conspicuous disdain for rule of law and the due process of law. Further to which we presently encourage anyone with useful information and/or evidence as regards all the facts and circumstances surrounding Mr. Marshal’s incarceration to urgently reach out to the NBA-SARC, to aid in the attainment of justice.

5. While we continue to call for collective support, please be reassured that all efforts are in top gear towards ensuring that justice prevails and that necessary sanctions are meted out to anyone found wanting in the present circumstances. It cannot be business as usual for injustice anywhere, is a threat to justice everywhere.

TAIDI MOURNS, AS GUY IKOKWU GOES HOME TODAY

Immediate past Nigerian Bar Association (NBA) General Secretary, Mr. Jonathan Gunu Taidi has described deceased senior lawyer, Chief Guy Ikokwu as “a prominent legal practitioner, past President of Otu Oka-Iwu Lagos, Bar Leader and member of Lagos Branch of the Nigerian Bar Association,” saying that he lived an impactful life.

In a statement made available to CITY LAWYER, Taidi who is believed to be eyeing the post of NBA Presidency at the forthcoming NBA National Officers Elections, said that he received with “shock” the news of the passing of Ikokwu and recalled “the passion with which he followed up on issues affecting the well-being of Members of Otu Oka-Iwu in particular and those who sought his intervention generally.

“His death is a painful loss to his immediate family, Otu Oka-Iwu community and the Lagos Branch of the NBA.

“We all must be comforted by the fact that he lived an impactful and fulfilling life, and may God comfort his family, colleagues and friends while granting his soul eternal rest.”

Ikokwu will be buried today in his home town Oba in Anambra State.

‘HOW I WAS BULLIED BY ICPC OVER CLIENT’S PETITION AGAINST NCC,’ BY LAWYER

A Lagos based lawyer, Mr. James Ononiwu of Whitedove Solicitors has told CITY LAWYER how he was “bullied” by operatives of the Independent Corrupt Practices & Other Related Offences Commission (ICPC).

An SOS which trended on social media earlier today read: “James Obianuju Ononiwu, Principal partner of Whitedove Solicitors, arrested on the strength of a Complaint by the PA to the DG of NCC over a Petition he wrote for his client COSON.”

Narrating his ordeal to CITY LAWYER, Ononiwu said that “It was tough today with them but they eventually let me go but insisted I go to their headquarters in Abuja.”

He confirmed that his arrest was in connection with a petition he wrote on behalf of his client, the Copyright Society of Nigeria (COSON), adding: “They tried to bully me but I resisted and I also tried to bully them.

“They said I wrote a petition against someone that they investigated and found to be false. I told them I wrote the petition on behalf of my clients and that there was no reason to arrest me, that they should arrest the client if they found out that the information was false. But they refused.

“They didn’t read my rights to me; the next thing they said was that they will not let me go until I meet one stringent bail condition. I then asked them if I was under arrest; they said ‘Yes.’

“I further asked them to show me the petition I wrote that brought me to ICPC but they didn’t have it. They now said I had to be taken to Abuja to answer questions. I refused to write any statement or anything.”

On how he was let off the hook, the lawyer said: “They asked me to go but should report at the headquarters on another day they would send to me.”

Though the commission could not be reached for comment at press time, the incident may be viewed as a dent on the commission, especially since the advent of its Chairman, Prof. Bolaji Owasanoye SAN who has brought many reforms to the anti-graft agency.

VOX POPULI FOUNDATION APPOINTS LAWYER AS D-G

Vox Populi Foundation for Leadership, a non-governmental organization has appointed Prince Chukwudi Oli as its Director-General. The Foundation has also appointed Mr. Olasunkanmi Emmanuel Oluwabiyi, a young lawyer, as its Administrative Officer.

Vox Populi Foundation for Leadership, a non-governmental organization duly registered with the Corporate Affairs Commision recently appointed Prince Chukwudi Oli, Esq as its Director-General. The Foundation is poised with attaining excellence in the society through influencing and advocating for good governance as well as contributing positively to the society. The group is comprised of legal practitioners both young and old as well as distinguished men and women with the common goal of nurturing leaders.

The Chairman, Board of Trustees of the Foundation, Chief Joe-Kyari Gadzama, SAN in a statement emphasized the need for the younger generation to be actively involved in the affairs of governance and administration; and also fielding them in leadership roles. BREAKING NEWS: NNAMDI KANU DISTANCES IPOB FROM KILLINGS, URGES CALM

The leader of the pro self-determination group, Indigenous People of Biafra (IPOB), Mazi Nnamdi Kanu has distanced the group from the ongoing killings in the South East and “pleaded that everyone should remain calm and peaceful,” his lawyer, Mr. Maxwell Opara has said.

In a statement he made available to CITY LAWYER following his visit to Kanu today, Opara also stated that Kanu also broke down in tears on hearing of the killing of renowned surgeon, Dr. Chike Akunyili.

According to Opara, “Mazi Nnamdi Kanu was traumatized by the disturbing sad news of the incessant killings of innocent persons in the South East and frowned at all attempt by the enemies who link IPOB with the killings of the innocent persons. He cried and prayed to God to raise his anger on those who killed Dr. Chike Akunyili and others. In my presence MNK broke down in tears while still praying. But in all, he pleaded that everyone should remain calm and peaceful.”

The fiery lawyer also said that the attitude of the Department of State Services (DSS) to visitors has changed considerably after his outcry on the treatment meted to him during his last visit, adding that “the DSS have learnt to be treating their visitors especially Lawyers with respect and decorum.”

His words: “Having heard about the court process I filed against them together with the condemnation and embarrassment from the members of the public, may I inform you that the DSS have learnt to be treating their visitors especially Lawyers with respect and decorum. I went to the DSS Headquarters today 30th September, 2021 to visit my client Mazi Nnamdi Kanu, I was surprised how they treated me and other visitors with decorum and respect without harassment and abuse. We shall continue to seek redress for our right whenever it’s violated.”

CITY LAWYER recalls that Akunyili, husband of deceased former Director-General of the National Agency for Drug Administration and Control (NAFDAC), Prof. Dora Akunyili, was killed yesterday around Onitsha after attending a memorial event in her honour.

There has also been a spate of killings especially in Anambra State in the run-up to the November 6, 2021 Governorship Election, even as IPOB spokesman Emma Powerful had issued a statement denying that IPOB has any links with the killings.

‘NNAMDI KANU WEPT OVER MY TREATMENT BY DSS,’ SAYS LAWYER

A lawyer to the embattled leader of the Indigenous People of Biafra (IPOB), Mazi Nnamdi Kanu has told CITY LAWYER that Kanu broke down in tears over his alleged humiliation by the Department of State Services (DSS) during his visit to his client at DSS Headquarters, Abuja.

Narrating his ordeal in the hands of the secret service agency, Mr. Maxwell Opara told CITY LAWYER that he was almost stripped naked while attempting to have an audience with the self-determination activist.

According to Opara, “When MNK (Kanu) saw me (his lawyer) looking like awaiting trial inmate he felt so bad and started shedding tears, ‘that his lawyer is subjected to such degrading treatment simply because he came to visit him.’”

The fiery lawyer said that he had to console Kanu, adding: “I calmed him down and told him that I will personally narrate this to the whole world and as well address court on this issue in next court sitting. This is a country that claimed to practice democracy.”

“It’s good I narrate this ugly incident to everyone to hear and circulate.

“Yesterday being 30th August, 2021, at about 3 to 4pm Nigerian time, I Maxwell Opara Esq went to DSS Headquarters Abuja to visit Mazi Nnamdi Kanu in line with the order of court that gave directives to some members of his legal team and family members to be visiting him every Monday and Thursday.

“Though I have been going there but yesterday after the normal screening, I was taking to another office where I was forced to remove my suit jacket, shoes & stockings, belt, medicated eyeglass, wedding ring, pen and plain sheet of paper which I wanted to use to record some of information MNK will give in preparation of his defense and applications we may be filing in court.

“I asked the officers who issued this order that lawyers should be subjected to this level, he said that the order is from above. I told them that I will never subject myself to that, they said then I am not ready to see MNK. Then due to the necessary need for me to see MNK, I had no option than to comply. I was given an ordinary slippers with my hands holding my trousers because my belt has been taken away from me.

“When MNK saw me (his lawyer) looking like awaiting trial inmate he felt so bad and started shedding tears, ‘that his lawyer is subjected to such degrading treatment simply because he came to visit him.’

“I calmed him down and told him that I will personally narrate this to the whole world and as well address court on this issue in next court sitting. This is a country that claimed to practice democracy.

“We shall continue to fight against injustice. I believe order lawyers in the legal team will narrate the same experience. Ahead ahead unstoppable!!! God is in control and in him we trust.”

The DSS is yet to respond to the lawyer’s claims.

ALLEGED REMAND ORDER: IN DEFENCE OF ENUGU MAGISTRATE, BY LAWYER

Following a trending ruling of an Agbogugu Magistrates Court presided over by His Worship, Ezeobi Ngozi Anidi (Mrs) which allegedly ordered a remand of one F. C. Okeke Esq, counsel for the accused person, MARY BASSEY GODWIN, ESQ. x-rays the proceedings and concludes that the entire saga is designed to smear the hard working jurist, adding that no lawyer was remanded in custody or mistreated

THE TRUE FACTS OF THE FABRICATED ORDER TO ARREST A LAWYER PURPORTEDLY ISSUED BY AN ENUGU MAGISTRATE CIRCULATING (IN) THE SOCIAL MEDIA

The complainant who claimed to be an only child of her parents, told the court on giving evidence that her father made her promise not to forfiet (sic) her father’s name in order to secure the family name.

Upon the death of her father, her mother married a woman into the family to bear children. The accused is said to be the produce of the said marriage.

Upon hearing, the complainant told the court she received a call from Lagos that her step-brother had demolished the house she built and has demolished her father’s house. She rushed down to the east and saw it was true. She went to the police station and made a formal complaint and the matter was brought to court.

Upon the commencement of proceedings, the complainant prayed the court that she was stranded and had no place to sleep each time she came to the village praying the court to allow her have a room in her father’s house pending the determination of the suit that her brother would not allow her into her father’s house any more.

The court gave a ruling ordering the brother to open a room for the sister pending the determination of the suit.
The court’s ruling was based on the Supreme Court case of Ukeje v Ukeje, the judgement of Honourable Justice Olabode Rhodes-Vivour (which now grants women from the Eastern part of Nigeria a right to inheritance).

The accused’s counsel appealed the ruling to the High Court Agwu, Enugu State. The High court upheld the judgement of the lower court and sent the case back to the magistrate court.

The magistrate then gave an order for the accused to make a room available to the complainant. In December 2020, the matter came up again before the magistrate. The court was informed that the accused had not carried out the order of court.

The magistrate again instructed the accused to carry out the order of the court or face a contempt charge. Yet again, the Accused did not carry out the order of the court. The accused told the court he would not give up a room for his sister. The court then ordered for the arrest of the accused who was in contempt of court for disobeying the order of court.

The accused was remanded in prison custody. At the next adjourned date, the complainant informed the court that the accused was not in prison custody and had been going about town bragging that his money is speaking and remains untouchable.

The court issued a warrant of arrest repeatedly and was told by both counsel and the prosecutor that they were unable to locate the accused. The complainant at the following hearing informed the court that the Accused was in the village.

On the 16th of March the matter came up .The court yet again asked if the accused has been seen, the counsel for the accused said no. The court yet again asked the counsel for the accused if he was aware that the accused is at large. Counsel for the accused, after a short silence told the court that the accused was sick.

After this revelation, the court addressed the other lawyers in court who immediately rebuked the counsel for the accuses (sic) and asked him to apologise to the court. Counsel for the accused pleaded with the court and undertook that by the next adjourned date, he will work with the police to produce the accused. The magistrate then issued a bench warrant for the arrest of the accused.

After that hearing, the spurious and fabricated document emerged on social media in an attempt to intimidate the court.

Enugu State Commissioner of Police, Mr. Muhammad Aliyu and the officiating DPO, Mr. John Igele, have both confirmed that the order to arrest a lawyer circulating on social media is a fabrication. It never existed nor was any lawyer arrested.
