As we count down to the 2026 Ciarb Nigeria Branch Annual Conference, we are pleased to spotlight Session 3: “Arbitrating Disputes at the Intersection of FX Controls, Capital Mobility, and Sovereign Power.”
When capital crosses borders, where does regulation end and arbitration begin?
Foreign exchange controls, restrictions on capital movement and the exercise of sovereign regulatory powers can raise complex questions for investors, businesses and States. As these competing interests come into play, arbitration can become a critical forum for examining the balance between investment rights and a State’s authority to regulate its economy.
This session will explore the challenges that arise when capital mobility, investment protection and sovereign powers intersect, and consider how international arbitration responds when financial and regulatory interests collide.
Leading the conversation are:
Aisha Ado Abdullahi, FICMC — Moderator
Agada John Elachi, SAN, Ph.D.
Foluke Akinmoladun
Etigwe Uwa, SAN, FCIArb
Edem Ekeng
Bringing together perspectives on investment, financial regulation and international arbitration, the panel promises a thoughtful discussion of issues that are increasingly relevant to cross-border investment and dispute resolution.
If you are interested in international arbitration, investment disputes or the relationship between State regulation and investor protection, this is a session you will not want to miss.
