INVITATION TO ATTEND TRAINING ON INTEGRATING ALTERNATIVE DISPUTE RESOLUTION IN MANAGING LABOUR DISPUTES

The Nigerian Chambers of Commerce Dispute Resolution Center (NCC-DRC) has invited members of the NBA to her upcoming training on “Integrating Alternative Dispute Resolution (ADR) in Managing Labour Disputes.”

The details are as follows:

Venue: Dele Oye Hall, Abuja Trade and Convention Center, Km-8, Umaru Musa Yar’Adua Expressway, Airport Road, Lugbe, Abuja.
Time: 11:00am
Training Fee: N50,000 per individual

The training is designed to equip participants with practical knowledge and skills in integrating Alternative Dispute Resolution (ADR) mechanisms in the negotiation of Labour disputes. As organizations navigate the complexities of workplace conflicts, the integration of ADR techniques has proven to be an effective and efficient means of resolving disputes, fostering better relationships, and improving overall organizational productivity.

The content of the training is tailored to address the unique challenges faced in negotiating disputes between the Federal Government, Labour Unions, and other Institutions.

The NCC-DRC boasts of a faculty comprised of seasoned professionals and experts in the field of Alternative Dispute Resolution (ADR) and labour relations.

LAGOS POLICE CHIEF LAUNCHES PDSS ADVISORY COMMITTEE

CP Lagos Inaugurates the Lagos State Police Duty Solicitors Scheme (PDSS) Advisory Committee

The Lagos State Commissioner of Police in conjunction with the Legal Aid Council with support from the RoLAC 2 program and Duty Solicitors Network (DSN) on the 31st January, 2024 inaugurated the Police Duty Solicitors Scheme Advisory Committee in Lagos State.

The State Coordinator, Legal Aid Council, Mrs. Iyabo Akingbade said PDSS is an intervention conceptualized to protect the rights of suspects and detainees through the provision of early legal advice and representation at the police stations. This intervention decongests our courts and correctional facilities.

The Scheme has the effect of improving the image of the Police, improves the effectiveness of legal aid service delivery and encourages the respect for human rights.

Mrs. Akingbade said that the PDSS Advisory Committee’s Mandates are to: review, advice and resolve any issue affecting the effective implementation of the scheme in the State; Compile annual report to be submitted to the IGP; engage in advocacy and training for both the Police and the Duty Solicitors, and prepare regulations to guide it’s operational activities. She said though members of the Committee renders free service, they should see their duties as a service to the nation and to humanity and therefore be committed.

The police commissioner, Mr. Adegoke Fayoade while inaugurating the Committee, pledged his continued support and promised that the police will continue to respect and protect the rights of all citizens in accordance with the law and due process.

The Chief Judge of Lagos State was represented by the Deputy Chief Registrar, Admin who delivered his lordship’s goodwill message and commended the CP Lagos for formalizing PDSS within the State.

The State Coordinator of the National Human Rights Commission also commended the police commissioner for inaugurating the Committee and promised to continue in their resolve to protect the rights of all citizens.

NBA Lagos and Ikorodu branches also took turns to commend the police commissioner on the epoch-making event.

The State Program Director of the RoLAC 2 program, Mrs. Ajibola Ijimakinwa promised that RoLAC 2 will continue to support the committee for better access to justice and justice delivery in the State.

NBA 2023 CPC CREATES HISTORY WITH ITS FIRST-EVER LIVE SPORTS FIXTURES DRAWS EVENT

In an epic stride towards integrating sporting events into the Annual General Conference of the NBA, history was made today with the first-ever Sports Fixtures Draws for this year’s AGC. The event took place at the NBA National Secretariat in Abuja, with AUTA NYADA skillfully anchoring this phenomenal and historic occasion.

Spectators were captivated by the remarkable composure and welcoming address of the Chairman of the TCCP, Mazi Afam Osigiwe SAN, as he officially declared the draws open.

This hybrid event kept lawyers from across the country engaged for over two hours as they eagerly witnessed the fixtures draw. A significant highlight of this year’s sporting event is the inclusion of Lawyers living with disabilities, who will be participating in the table tennis event for the very first time.

The sports fixtures draws demonstrate that this year’s Annual General Conference is breaking new ground as an all-inclusive event. The public’s anticipation for the conference has reached unprecedented levels.

COURT AWARDS N127 MILLION AGAINST EMERALD ENERGY

The National Industrial Court has awarded N127 million against Emerald Energy Resources Limited for breach of contract of employment with its former Consultant, Mr. Emeka Igweze.

In a judgment obtained by CITY LAWYER, the court granted all three reliefs sought by the former employee as argued by his lawyer, Chief Emeka Okwuosa of Messrs The Chancery Associates.

The court held that the defendant-company had not presented any evidence to disprove the facts placed before the court by the plaintiff, adding that “in the absence of any proof that said emails are not original, absence of contrary proof that the calculations in the said documents were incorrect and an admittance of same by Defendants (sic) witness, I have no recourse but to hold that the Defendant is indebted to the Claimant in the sum of N127,066,872.90 (One hundred and twenty seven million, sixty-six thousand, eight hundred and seventy-two Naira, ninety kobo) being his accrued salary arrears and benefits due to him at retirement.”

Justice Gwandu held that “Based on the foregoing, I hereby hold that the Claimant’s reliefs 1-3 succeed and are hereby granted accordingly (without the 21 %).”

The claimant had brought the claim seeking “A declaration that the claimant is entitled to his full terminal benefits in the sum of N127,066,872.90 (One hundred and twenty seven million, sixty-six thousand, eight hundred and seventy-two Naira, ninety kobo) upon his voluntary disengagement/resignation from the defendant company effective from 8th July, 2018, having worked for the defendant company from 3rd January, 2005 to 8th July, 2018 (an interrupted period spanning nearly 15 years pursuant to the defendant’s belated notice of computation of the claimant’s terminal benefits dated 15th November 2018 ….”

The claimant also sought “An order directing and compelling the defendant to pay the claimant the total cumulative sum of N127,066,872.90 (One hundred and twenty seven million, sixty-six thousand, eight hundred and seventy-two Naira, ninety kobo) representing his full terminal benefits upon his voluntary disengagement/resignation from the defendant company from 8th July, 2018 with interest at the rate of 21% per annum until the entire judgement is liquidated.”

SENATORS, NBA, NGIGE, FALANA DISAGREE ON NEW LAW SCHOOL CAMPUSES

The Council for Legal Education, Nigeria Bar Association (NBA), Body of Benchers and some Senators have rejected a proposal by the Senate to create additional six Nigerian Law School campuses in the country.

They made their views known during a public hearing on a bill that seeks to establish one campus of the school in each geopolitical zone of the country organised by the Senate Committee on Judiciary, Human Rights and Legal Matters, in Abuja.

The Bill titled: “Legal Education (Consolidated etc, Amendment) Bill 2021,” was sponsored by Senator Smart Adeyemi, representing Kogi West.

The Senators that opposed the Bill were Ike Ekweremadu (Enugu West) and Seriake Dickson (Bayelsa West).

However, Senators that supported the Bill include Smart Adeyemi, Abiodun Olujimi (Ekiti South) and Kashim Shettima (Borno Central).

They argued that the establishment of the proposed six law schools will greatly enhance access to legal education in the country.

While Ekweremadu warned against any attempt to politicise the establishment of Law School campuses in Nigeria, Dickson urged his colleagues to tread cautiously.

Ekweremadu said: “The establishment of new campuses or Law Schools should be left at the discretion of the Council for Legal Education that is empowered by the Act that established it in 1962”.

On his part, NBA President Olumide Akpata (SAN) said the move was unnecessary as the existing six campuses of the school were grossly underfunded before the intervention of the Rivers State Government that built a well-equipped campus in Port Harcourt.

“With required infrastructure, the existing law schools across the country are enough to accommodate thousands of law students graduating from the various universities.

The Chairman of the Council for Legal Education, Emeka Ngige SAN, said the council is 100 per cent opposed to the move to create the six additional law schools.

Ngige said the position of the Council was informed by the deplorable condition of most of the existing ones due to gross underfunding.

“For instance, the deplorable condition in which students at the Yenagoa law campus are studying is worse than what prisoners in Ikoyi Prison are experiencing,” Ngige said.

He told the lawmakers that they will shed tears if they visit some of the existing campuses and see the deplorable conditions in which students and lecturers are living.

“The move by the Senate through this bill is more or less subtle usurpation of the functions of the Council for Legal Education.

“Any need for establishment of a new law school campus, is by law, to be routed through the Council for Legal Education as exemplified by the Rivers Model,” he stressed.

But activist-lawyer Femi Falana, SAN, supported the establishment of additional six law school campuses in all the geopolitical zones.

THE NATION reports Falana as saying: “It is important to clarify certain facts: the Council for Legal Education Act, was enacted in 1962 for the creation of one law school.

“Nowhere in the Act was it provided that we are going to have a multi-campus institution; it is important for our colleagues to realise that in 1999, we had six batches of students who had no place to go, they contacted me and I had to go to court.

“The law building of the law school in Lagos had already been sold to a businessman who wanted to turn it into a hotel when the school moved to Abuja.

“It was only one campus not until I went to court and we got an injunction restraining the government from selling the law school in Lagos.”
