Justina Ego Amanda Demechi Asagba is a detribalized, courageous, passionate, dependable and Result oriented, Nigerian lawyer, Human Rights Activist, Private Prosecutor, Mediator and Notary Public. She graduated from the Ambrose Ali University Ekpoma (formerly Bendel State University) and was called to the Nigerian Bar in 1990. She is a woman of many parts who sees law as a tool for social engineering for national development particularly as it relates to access to justice, eradication of injustice, corruption, poverty and inequality. To achieve this, lawyers must be equipped and motivated to fulfill their professional calling.

She worked with leading law firms of Ajumogobia, Okeke, Oyebode & Co, Akinola Aina & Co, and Sanya Ayeni & Co. She is currently the Managing Partner of Amanda D Asagba Chambers, an ever growing law firm. She is a member of NBA Ikeja branch (Excellent Bar) where she has served in many committees including Insurance Committee, Human Rights Committee, Continued Legal Education Committee, Disciplinary Committee, Legislative Advocacy Committee among others. She served in the Human Rights Committee of the NBA national and as a co-opted member of NBA NEC. She holds LLM in International Law and Diplomacy and Masters in Divinity (M.Div). ISAAC OGBAH EXTOLS NBA KADUNA ON LAW WEEK

The theme ” Expanding The Frontiers of Legal Practice” of the Kaduna Branch Law Week is a topic of the season as most lawyers are still recovering from the pandemic, and there need to be a way out for lawyers to get back on their feet.

The Legal profession over the years has grown so wide into different aspects of Law and we as Lawyers shouldn’t just stereotype ourselves to Litigation, drafting of Deeds alone. There are so many untapped resources in this business of law which legal practitioners should be averting their eyes to and which can be a gold mine if properly utilized.  

As Napoleon Hill said in one of his famous quotes, “The way of success is the way of continuous pursuit of Knowledge.” 

I celebrate the leadership and members of NBA Kaduna Branch in the occassion of their Law week. I wish each members a fruitful deliberations even as I pray for peace and security within and outside Kaduna State.

‘WHY WE DID NOT DISQUALIFY MAIKYAU’ – ECNBA

The Electoral Committee of the Nigerian Bar Association (ECNBA) has given reasons why it did not disqualify one of the leading presidential candidates, Mr. Yakubu Maikyau SAN from contesting the forthcoming NBA Elections.

In a letter obtained by CITY LAWYER and addressed to embattled Bar aspirant, Mr. Kayode Bello who wrote a petition to the electoral committee seeking the disqualification of the senior lawyer, the ECNBA ruled that it “has no jurisdiction over the complaint, as the subject matter of the petition is pending before the Legal Practitioners Disciplinary Committee (“LPDC”) the competent statutory body for adjudication.”

Dated May 27, 2022 and titled “2022 ELECTIONS OF NATIONAL OFFICERS OF THE NBA – RESOLUTION OF PETITION DATED 2 MAY 2022,” the electoral committee referred to Bello’s petition dated May 2, 2022 “and the response to the petition received from Mr. Yakubu Chonoko Maikyau, SAN, FCIArb (“the Respondent”) dated 12 May 2022.”

In the letter which was copied to Maikyau, the electoral umpire noted that Bello had “requested that the ECNBA disqualifies the Respondent from contesting for the office of the President of the Nigerian Bar Association (NBA).”

The ECNBA stated that it “has considered the petition and the response to same,” adding that aside from the jurisdictional hurdle which it was unable to surmount, “the power of the ECNBA to disqualify a person who wishes to contest for an office shall only crystallizes (sic) after a conviction of crime by a court of competent jurisdiction or if the candidate is found guilty of misconduct or professional impropriety by the LPDC by virtue of Part VII(e) and (f) Second Schedule of the Constitution.”

Sounding the death knell on Bello’s petition, the electoral committee wrote: “Consequently, your petition fails.”

In a petition addressed to the ECNBA Secretary and copied to CITY LAWYER, Bello had urged the ECNBA “to suspend the candidature of Mr. Y. C. Maikyau as the NBA presidential Aspirant, pending the determination of the disciplinary case against him at the Legal Practitioners Privileges Committee (LPPC) for his misconduct.”

Restating his grouse, Bello wrote: “In summary, Mr. Y.C. Maikyau who stands as presidential aspirant for the office of the NBA President in the forthcoming NBA election has lied to the LPPC that I did not show up at the Nigerian Law School for my Bar Final examination and he has used his office and position as the Senior Advocate of Nigeria to frustrate the reconciliation process between the Council of Legal Education and myself (Kayode Bello).

“The fact that Mr. Y.C. Maikyau lied to the LPPC that I did not or refused to show up for my Bar final examination in 2017 is/was tantamount to perverting justice and conspiracy to disobey the order of the Court.”

Maikyau however denied all the allegations in his response to the electoral body.

‘REVERSE MY UNREASONABLE DISQUALIFICATION,’ ASHIMOLE BEGS APPEAL C’TE

RE: 2022 ELECTIONS OF NATIONAL OFFICERS OF THE NBA AND NBA REPRESENTATIVES TO THE GENERAL COUNCIL OF THE BAR – NOTICE OF DISQUALIFICATION.

1. The email of disqualification was received in my spam today, 28th day of May 2022.

2. That I am contesting for the office of Publicity Secretary and duly completed a nomination form in that respect and not the office of Assistant General Secretary as indicated in the disqualification letter.

3. That on May 10th May, 2022, I was invited for a Zoom meeting for further screening. At this Zoom meeting, I did not meet any Committee member but was interrogated by two ladies, who told me that my sealed form had been opened in my absence, no video of the opening made or shown to me.

4. They informed me that 2021 Local Due Receipt of my 1st nominator, Mr. Mohammed lyorember Tsav, the immediate past chairman of NBA Bwari, my Branch, did not attach local Branch Due of 2021.

5. That my response was that I am shocked at this and asked the ladies, what should I do in the circumstance? They told me that the Committee will get back to me.

6. That I re-sent the said mysteriously missing due to the Committee via info@ecnba.ng. The copy of the email is annexed as F1.

7. That ECNBA did not reply my email, did not send me any letter, did not send any SMS or WhatsApp message to me.

8. That ECNBA instead forwarded me a petition by one Mr. Kayode Bello, a law school drop out. I responded to the said petition but ECNBA, did not communicate to me the outcome of my response to Mr. Bello’s petition.

9. That I never received any letter of disqualification from ECNBA when other candidates received or were cleared.

10. That on 27th May,2022, I sent an email to ECNBA asking what is my status, whether I am qualified or not, having not received any letter from ECNBA.

11. ECNBA merely sent me a copy of the reply they sent to Mr. Bello telling him that his petition had no merit and was dismissed.

12. That today 28th May, 2022 after I wrote to ECNBA on 27th May, complaining of the list “List of Properly Nominated Candidates” ECNBA sent me an email, of notice of disqualification for the office of Assistant General Secretary, dated 20th May, 2022, giving me 7 days to appeal to Appeal Committee.

Dear Sir, It is against equity and good conscience to disqualify me as Assistant General Secretary contender instead of the post of Publicity Secretary, which I am eminently qualified for.

13. That the disqualification sent to me is mischievous and not in compliance with the NBA Constitution and Electoral Guidelines published by ECNBA. That the non-submission of receipt of a nominator who paid is not a constitutional condition to disqualify me as my nominator paid as when due like me.

14. I hereby humbly pray to you the Appeal Committee, to reverse this unjustifiable, uncalled for, unreasonable decision of ECNBA to disqualify me for an office I did not apply for.

15. I further pray that you compel ECNBA to declare me as qualified, fit and proper candidate for the office of Publicity Secretary and not Assistant General Secretary as contained in the letter of disqualification sent to me, having met all requirements and re-submitted Mr. Mohammed lyorember Tsav’s mysteriously 2021 local due, which I duly submitted along with other documents in a properly sealed envelope.

ASF FRANCE SECURES RELEASE OF DETAINEE AFTER 11 YEARS

PRESS RELEASE

Following strategic litigation by Avocats Sans Frontières France (Lawyers without Borders France), a High Court in Lagos ordered the release of a young man who had been held in the Nigerian prison for over 11 years without trial.

The Nigerian Correctional Service (NCS) data on the Summary of Inmate Population by Convict and Persons Awaiting Trial as of October 4, 2021, revealed that the facilities hold 37% more inmates than it is designed to and that over 70% of the prison population consists of pretrial detainees. The report also revealed that the average period of pre-trial detention in Nigeria was nearly four years. The work of ASF France in the field reveals that many detainees are held for much longer, as in this case of Maxwell Dele* who had been arbitrarily detained for over 11 years, reflecting both an overburdened justice system and structural problems between Nigeria’s state and federal justice systems.

In his case, officers of the Nigeria Police Force were on the hunt for a certain individual called Mr. James Idem* whom they believed was responsible for an armed robbery operation. Mr. Maxwell Dele happened to be a shop owner and neighbour to Mr. James in Ikorodu market, Lagos. During the search for Mr. James, Maxwell was asked by the police officers to provide information on the whereabouts of Mr. James and when Maxwell* couldn’t provide those answers, he was arrested for armed robbery.

Mr. Maxwell was handed over to the Sagamu Road Police Station, from where he was transferred to SARS Ikeja, Lagos where he was hanged and tortured. Maxwell Dele was also forced to sign an already written statement on the 6th of October 2011, the same day he was charged for armed robbery at the Magistrate Court 17, Ikeja, Lagos. Maxwell Dele remained in the Medium Security Custodial Centre, Kirikiri, Lagos and never appeared in court again for the next 11 years.

Avocats Sans Frontières France intervened in this case through the pro-bono legal aid component of its European Union (EU) & Agence Française de Développement (AFD) funded SAFE project – “Strengthening the National Actors Capacities and Advocating for Ending Severe Human Rights Violations in Nigeria project”, targeted at addressing human rights violations of torture, extra-judicial killings and arbitrary detention. ASF France tendered an application to the Lagos State High Court on behalf of the detainee, particularly seeking for the unconditional or conditional release, citing the instances of torture, violation of their fundamental human rights, their rights to personal liberty and freedom of movement, provided under the sections 35 and 41 of the constitution of the Federal Republic of Nigeria 1999 as amended. The application was successful at the High Court of Lagos State.

The Country Director of Avocats Sans Frontières France in Nigeria, Angela Uwandu Uzoma-Iwuchukwu speaking after the judgement said “Loosing 11 years of one’s life to a systemic irregularity is an unimaginable suffering, nothing would ever be able to make up for this loss. The practise of routinely charging suspects with serious offenses in order to have them remanded in prison indefinitely, with little or no effort to prosecute the case needs to stop”.

The SAFE project is being implemented in Nigeria by Avocats Sans Frontières France in partnership with the Nigerian Bar Association (NBA) and the Carmelite Prisoners Interest Organization (CAPIO).

FRIENDS OF CHIEF JOE KYARI GADZAMA, SAN HOST THE MONTHLY MEETING OF THE NBA OWERRI BRANCH, THE HEARTLAND BAR.

At the beautiful city of Owerri, Imo State, members of the NBA Owerri branch, the Heartland Bar gathered at the NBA House Owerri for their monthly meeting ably hosted by the friends of Chief Joe-Kyari Gadzama, SAN, which was described by many in attendance as the second coming of the man they fondly called J-K Gadzama in a short period.

At the meeting of the branch, members in attendance deliberated on the business of the day as it affects the branch within the State and metropolis of Owerri.

The friends of Chief Joe Kyari Gadzama, SAN, who was ably represented by Chief Prince Chukwudi Oli, the Director-General of Vox Populi and other great bar men of the Owerri branch including Victor Nwogu, Esq., Mr Ezeala Esq. and Mr Nwakaeti Esq., lighted up the venue of the meeting with an appearance of sort to add to the creme de la creme of personalities of the Heartland Bar.

During the deliberations of the meeting, members were greeted to the Goodwill messages from the friends of Chief J-K Gadzama SAN which they received with interest and rapt attention as if they were listening to the voice of Chief J-K Gadzama, SAN in person.

At the end of the branch meeting, members were treated to a variety of delectable meals ranging from local delicacies to varieties of continental dishes. As part of fun at the event, members danced to the tune of different musical tones and had a lot to drink to the satisfaction of the members who stayed till the very end of the occasion.

Members gave their different testaments to the true character and personality of the learned Silk, Chief Joe Kyari Gadzama SAN whose array of personalities was a projection of his social capital.

Chief Joe Kyari Gadzama SAN is a consummate and quintessential Bar Man and a true Nigerian. He holds the traditional title of “Okwuluora of Ukpo” which means the mouthpiece of the people in Igbo language, which is a honour well deserved.

Also in attendance at the meeting of the heartland bar were revered members and elders of the bar such as Messers’ Onochie Onwuegbuna Esq., Principal Partner ( Zeran Legal), M. O. Nlemedum Esq, and Soronnadi Njoku, both former Attorneys General of Imo State, and other very senior lawyers. In attendance equally are Chief C.U. Ekomaru and J.C. Uwazuronye both of whom spoke glowingly of the person of Chief J-K Gadzama SAN.

Others in attendance at the meeting were the Chairpersons of FIDA Owerri branch and Young Lawyers Forum (YLF), Owerri branch.

It is my firm conviction that we can get it right by engagements such as this and by continuing the sort of discourse aimed at fashioning a truly federal state where equity and justice prevail.

I am delighted that this discussion is holding at the ‘source’ of the great O’dua heritage and hope the outcome will be the foundation of a true federation.

I felicitate with the Chairman, Law Week Organising Committee and Members of the Nigerian Bar Association (NBA) Kaduna Branch on the occasion of the 2022 Law Week on the theme: “Expanding the Frontiers of Legal Practice”.

At independence, legal practice in the Nigerian parlance connotes litigation. However, overtime, other areas of practice of law evolved in response to the emerging dynamics of society.

In the 21st century there abound relatively new areas that are either dominated by expatriates who have no right of audience under our law or where we have very few members with expertise to shine in those areas.

There is therefore the need to equip ourselves with the requisite knowledge on diverse and emerging areas of law so that we put a permanent wedge on incursion from foreigners under whatever guise or shade.

This law week affords us the platform to interrogate the challenges bedevelling our ability to diversify into emerging practice areas and stem the tide of pervasive external incursion into our legal space. I therefore challenge participants to take advantage of this platform to discover solutions for our overall benefit.

I wish distinguished participants a rewarding experience and fruitful outcome.

The theme: ‘Democracy, Electoral process and the paradigm of change in Nigeria’ is nothing short of apposite. Democracy in its true form portends that elected officials rule with transparency and are accountable to the people from whom they obtained legitimacy. Our Electoral Act though recently amended, still has a long way to go if we truly desire to enhance democracy in government; thus enabling a fully participatory system.

Progress is impossible without change, hence there must be a paradigm shift from the extant arrangement wherein the very people who are to be represented have no say in whom is presented to them for voting. This is necessary to wipe out the totality of the kleptocratic elites that have hindered our country’s development. . Conclusively, as you conclude your Law Week celebration, I strongly believe that you will leave no stone unturned in doing justice to this theme and drive home the all important need for change in our political system. The NBA, Yenagoa branch hosted a dinner on Saturday, May 28, 2022 in celebration of their 2022 law week at the DSP Alamieyeseigha Memorial Banquet Hall, Yenagoa, Bayelsa State.

Learned Silk, Joe-Kyari Gadzama, SAN was in attendance at the dinner as he was to deliver the dinner talk at the event. According to Helen Keller, “alone we can do so little; together we can do so much”. In that wise, a group of lawyers from the NBA, Port Harcourt branch accompanied the Learned Silk who is a presidential aspirant of the NBA to the dinner. The lawyers who accompanied the Learned Silk to the dinner include: Mr. Nyesom Chinda; Mr. Victor Agala; Mrs. Anthonia Osademe, vice chairman of NBA, Port Harcourt branch; Ms. Sophia Ugwuorah; Ms. Sarah Apia; Mr. Ebuka Samuel; Mr. Akuro T. The Learned Silk was duly recognized as a distinguished guest at the dinner by the MC and chairman of the occasion, Mr. Kemasuode Wodu, SAN.

“I am a son of the soil for some of you who may not be aware and I am always happy to come back home. I consider this opportunity a great honor and privilege and I am grateful to the leadership and all members of the branch who found me worthy to deliver the dinner talk” the Learned Silk said while expressing his gratitude to the branch. His dinner talk was compendious but it is worthy to note that no stone was left unturned as he touched on the relevant areas in relation to the topic.

At the end of his dinner talk, he implored the older generation of lawyers to create room for mentorship programs for young lawyers. He saluted the branch for the success achieved with their 2022 law week and urged them to keep up with their efforts towards ensuring the growth of the branch and the Bar.

Notable Personalities who were at the dinner include: Hon. Justice Kate Abiri, Chief Judge of Bayelsa State who was ably represented by Hon. Justice M.A Ayemie of the Bayelsa State High Court, a classmate of the Learned Silk at the Nigerian Law School; Hon. Justice Daniel Ayah, President, Customary Court of Appeal, Bayelsa State, a classmate of the Learned Silk at the Nigerian Law School; Hon. The dinner provided a great atmosphere for networking as the lawyers from the yenagoa branch and other neighboring branches interacted with one another while feasting on the delicious meals served and taking sips from their drinks.

FRIENDS OF J-K GADZAMA, SAN AND THE LEARNED SILK DANCED THE NIGHT AWAY AT THE BAYELSA STATE GOVERNMENT HOUSE

Friends of J-K Gadzama, SAN who belong to the NBA, Yenagoa branch organized an outdoor poolside party for the Learned Silk and his guests at the Bayelsa State Government House. The party took place on Saturday, May 28, 2022 immediately after the branch’s dinner at the DSP Alamieyeseigha Memorial Banquet Hall.

The Learned Silk noted that the party was an opportunity to network and unwind. He definitely had a good time as he was seen dancing with his good friend, Hon. Nimi Walson Jack, past general secretary of NBA; Mrs. Anthonia Osademe, vice chairman of NBA, Port harcourt branch; Mr. Ukumbiriowei Saiyou, chairman of NBA, Yenagoa branch and other young and senior lawyers who attended the event.

A reliable source informed us that the party turned out well as more than 150 lawyers who had big smiles on their faces partied with the Learned Silk as a show of their support to his NBA Presidential ambition. The dance floor was busy; drinks and chops were also provided for all those who attended.

With so much happiness, the Learned Silk thanked the branch for the selfless service he received throughout his stay. He also thanked his guests from the NBA, Port Harcourt branch who came all the way to attend the dinner and party with him.

‘THERE IS NEED TO COMPILE WELFARE NEEDS OF LAWYERS,’ SAYS MAXIMUS UGWUOKE

Ikechukwu Maximus Ugwuoke frontline candidate for National Welfare Secretary position of the NBA has advocated the need to curate the welfare needs of members of the NBA across the 125 branches of the bar. He made the observation in his felicitation to the various branches of NBA that held their monthly meeting last week, namely, NBA Portharcourt, Nsukka, Oji River, Okigwe, Abakiliki, Ahoada, Gwagwalada and Anaocha Branches of the bar.

According to him “I have observed in the course of my visit to various branches of the NBA across the country that the welfare needs of members of the NBA vary from one branch to another even though some of the needs are central to all the branches of the bar. For the welfare needs of Lawyers in Nigeria to be adequately addressed, there is need to curate these needs from one branch to another taking into account the peculiarities of the welfare need of each branch . Given the opportunity to serve the bar as the National Welfare Secretary curating the welfare needs of the 125 branches of the NBA is the way to go. This will be achieved through a publicized email address where this welfare needs will be complied, analyzed and made available to the President of NBA to enable him have adequate data required for his effective and efficient decision making around the welfare of lawyers. This is top notch in my Maximum Welfare vision for the bar.
The issues discussed by the members of the bar during their monthly meetings that held simultaneously in various branches of the bar last week, some of which I participated, underscore this point. I really commend the members of the following branches of the bar that held their monthly meeting last week and the branch leaders for the capacity they have demonstrated in providing leadership to the bar; the NBA Portharcourt Branch led by Nyekwere, Nsukka bar led by Ugo Fed Ukwueze, Oji River Bar led by Seth Nwokolo, Okigwe bar led by Ndeme Romi, Abakiliki Bar led by Ogbonnaya Okorie, Ahoada Bar led by Alili Kipe Morris and the Gwagwalada and Anaocha Branches of the bar.

I pray that God shall endow them with greater wisdom to continue to pilot the affairs of their branches especially at this critical period when many of them are in their transition process.”

The Body of Senior Advocates of Nigeria (BOSAN) has elected a new Executive Committee to superintend its affairs. This was a major highlight of its Annual General Meeting/Elections held yesterday at the Nigerian Law School, Lagos Campus.

According to a statement made available to CITY LAWYER by the BOSAN Secretariat, while renowned chartered arbitrator, Mr. Olumide Sofowora, SAN emerged as the new Secretary of the body, replacing longstanding former Secretary, Mr. Seyi Sowemimo SAN, Mr. Oladipo Olasope, SAN was elected as the Assistant Secretary.

Former Ogun State Attorney-General & Commissioner for Justice, Mrs. Abimbola Akeredolu, SAN emerged as the new Treasurer while leading maritime lawyer and President of the Women’s International Shipping and Trading Association (WISTA-NIG.), Mrs. Jean Chiazor Anishere, SAN was elected as the Financial Secretary. Mr. Abdul Mohammed SAN is the new Programming and Publicity Secretary.

The new executives were inaugurated by the presiding Chairman, Chief Wole Olanipekun, SAN who also doubles as the Chairman of the Body of Benchers.

The Electoral Committee of the NBA (ECNBA) however dismissed a petition by embattled Bar aspirant, Mr. Kayode Bello, saying that he “failed to provide sufficient evidence” in support of his petition.

However, there is a cloud of uncertainty on whether the aspirant actually received the notice of disqualification from the ECNBA. The aspirant vigorously denies receiving any email from the electoral committee.

CITY LAWYER investigation indicates that while the ECNBA actually dispatched an email to the aspirant, there may have been an error in the email address.

It was gathered that while the aspirant’s correct email is oyimnatumba92@yahoo.com, the Notice of Disqualification was actually sent to oyimnatumba29@yahoo.com.

A source at ECNBA headquarters vowed that the error was “an honest mistake,” adding that “There is no foul play. Our Secretary is trying her best in dispatching correspondence. A mistake can happen.”

Giving reason for disqualifying the aspirant, ECNBA had stated that Ashimole’s Nominator did not provide evidence of payment of his Branch Dues for 2021, even as CITY LAWYER gathered that the aspirant failed to provide a satisfactory answer to the irregularity at the further screening interview with the electoral committee.

It was unclear at press time whether the aspirant would appeal his disqualification.

NBA AHOADA BRANCH ENDORSES PRESIDENTIAL AMBITION OF CHIEF JOE-KYARI GADZAMA, SAN AT THE MONTHLY MEETING FOR MAY

The NBA Ahoada branch, Rivers State held its monthly meeting on Friday, May 27, 2022. The branch extended invitations to eminent members of the Bar such as Chief Joe-Kyari Gadzama, SAN amongst many others. While some of the invitees could not attend the meeting, Chief Joe-Kyari Gadzama, SAN and other aspirants were in attendance at the meeting.

The branch specially designed a banner which was strategically placed to welcome only Chief Joe-Kyari Gadzama, SAN and his entourage to the branch. Mr. Morris Kipe Alali, Esq., the chairman of the NBA, Ahoada branch personally welcomed the Learned Silk and gave him an opportunity to address members of the branch. The Learned Silk thanked the branch for the hearty and elaborate welcome he received.

“This is not my first time here. I was here several years ago and I will be here again” Chief Joe-Kyari Gadzama, SAN said while informing members of the branch that Rivers State is home to him as he is an adopted Rivers State man.

“Collectively, we can work together to improve the Bar and take smaller branches to the next level,” Chief Joe-Kyari said while commending the branch for their rapid growth.

He urged members of the branch to actively participate in initiating ideas that positively affect the branch and the Bar at large. The Learned Silk who has proven that mentorship of young lawyers is very dear to his heart through the Hon. Justice Chukwudifu Oputa JSC (Rtd) Mentoring Program of J-K Gadzama LLP, noted that he shall continue to take steps that are directly aimed at bettering the legal profession, particularly capacity building for the young lawyers.

Members of the branch wildly applauded at the end of the Learned Silk’s address to the branch. The chairman endorsed and stated that the branch shall support the Learned Silk with his NBA Presidential ambition. The leadership of the branch and other members of the branch joined the Learned Silk while he was taking pictures with the banner made for him by the branch.

NBA YLF, ISIOKPO BRANCH HONORS CHIEF JOE-KYARI GADZAMA, SAN WITH AN AWARD FOR HIS REMARKABLE CONTRIBUTION TO THE LEGAL PROFESSION

On Friday, May 27, 2022, the NBA YLF, Isiokpo branch organized a one-day seminar with the theme, “Contemporary Areas in Legal Practice: Challenges & Prospects for Young Lawyers” at the OCJ Okocha Bar Centre, High Court Complex, Isiokpo, Rivers State.

The Keynote Speakers at the event were: Chukwuka Ikwazom, SAN, Partner at Aluko & Oyebode; Dr. Hon. Cashmia Ofurum; Mr. Ogbonna Goodluck Ogbom, Esq.; and Mr. Nweke Prince Nweke, Esq. They all delivered justice to the theme of the seminar as they selected different areas of law to concentrate on such as: entertainment law, financial technology, land law, intellectual property law and several other emerging areas of law. Other distinguished guests who were at the event include: High Chief Lukeman Ihua, past chairman, NBA, Isiokpo branch and Hon. Churchill Wosu, pioneer chairman, NBA, Isiokpo branch.

Chief Joe-Kyari Gadzama, SAN who was a guest speaker at the event was introduced to the audience by DCN Promise Uche Ichegba, incumbent chairman of the NBA, Isiokpo branch. Mr. Goodluck Ogbonda, chairman of the NBA YLF, Isiokpo branch presented an award on behalf of the branch to the Learned Silk for his selfless contribution to the legal profession.

We could tell that the Learned Silk was overwhelmed with excitement as the award was being presented to him. He expressed his immense gratitude to both the leadership and members of the branch. He noted that he was encouraged by the creativity of the NBA YLF, Isiokpo branch. He commended both the past and present leadership of the branch for the growth of the branch and noted that they had done a good job with the younger generation of lawyers in the branch.

Furthermore, he urged all present to take steps towards the development of the Bar as that duty remains a collective one. He implored the older generation of lawyers to participate in improving the welfare and remuneration for young lawyers. He saluted the incumbent president of the NBA, Mr. Olumide Akpata and the president of the NBA Remuneration Committee, Mr. Anthony Nwaochei for the steps taken by the administration to improve the remuneration for the legal profession. He reiterated the point made on specialization for young lawyers by Mr. Chukwuka Ikwazom, SAN. He urged the young lawyers present to center their legal practice around two to three areas of law as this shall influence the success of their legal practice.

JOE-KYARI GADZAMA SAN ATTENDS THE 2022 LAW WEEK FOOTBALL MATCH FINALS OF THE NBA, YENAGOA BRANCH

The Learned Silk and a group of other lawyers attended the final football match organized by the NBA, Yenagoa branch for their 2022 law week between Wuku FC and Ambaowei FC.

The Learned Silk who attended the football match between the two teams at Joseph Beredugo International School received a positive reception from members of the branch.

This is the second match of the NBA, Yenagoa law week that the Learned Silk has witnessed in his short visit to Bayelsa State. Yesterday, he witnessed the match for third place between Dambo FC and Ayabowei FC wherein Dambo FC emerged as the winner with a score line of 2-1.

The Learned Silk’s interest in the football game is not out of place as he is indeed a fervent supporter of the game and an energetic sportsman. Recently, he sponsored his football team, Gadzama FC during the 2022 Abuja Lawyers’ League where the team came in third place at the league. He is the chairman of Gadzama FC; incumbent vice chairman of the Bar and Bench Golf Tournament; a trustee of Hon. Seriake Dickson Golf and Country Club in Yenagoa and also, a member of the Bayelsa State Sports Committee headed by His Royal Majesty, King Alfred Diete-Spiff.

Ambaowei FC came out victorious with a win of 4-2 over Wuku FC. The Learned Silk congratulated both teams and took pictures with the players and other members of the branch who were present at the game. The chairman of the branch, Mr. Ukumbiriowei Saiyou and members of the branch received the Learned Silk as one of their own and thanked him for his show of interest in the activities of the NBA, Yenagoa branch.

Recall that on the 14th of April, 2022 in furtherance of my deep commitment to galvanize the Bar to live up to its challenges and the even more grievous challenges bedeviling our nation, I made a commitment and that commitment has now been certified as fit and proper by the Electoral Committee of the Nigerian Bar Association (ECNBA).

‘ROLE OF LAWYERS IN NATION BUILDING,’ BY TAIDI

The major goals of any given nation are: to promote the wellbeing of its citizens, develop strong institutions, strengthen its sovereignty, gain traction in the world map and engender a sense of patriotism in her citizens. All of these can conveniently be subsumed into the concept of nation building.
Nation building undeniably hangs on the strings of the rule of law, without which there is no environment for growth. In turn, the rule of law is guarded by the ministers at the temple of justice (lawyers and judicial officers) who must ensure that at every point in time, there is compliance with laid down rules. And since judicial officers are first lawyers before they ‘ascend’ to the bench and since they wield ultimate power in interpreting the letters of the law, they are without a doubt an integral part of nation building.

SPECIFIC ROLES AND IMPACT OF LAWYERS AND JUDICIAL OFFICERS IN NATION BUILDING
Under this subhead, we will attempt to outline certain key and specific roles lawyers-cum-judicial officers play in nation building. It is important to state that the roles herein are subsumed under the major role of upholding the principles of the rule of law. The roles are hereunder enumerated: 1. Lawyers are duty bound to Treat Civil Cases as Purely Civil.

There are a plethora of criminal cases in our courts today that are purely or majorly civil in nature. These cases mostly border on debt recovery, wherein facts are skewed to present a case of obtainment with false pretense so as to bring same under the purview of criminal law. These cases are handled by lawyers who are supposed to be ministers in the temple of justice, but as we have seen so many times, the desire to cash out often outweigh the lawyer’s duty to advise a client on the best legal route to take in seeking redress. Many have argued that this system is the fastest means of recovering debts, and while this may have some level of truism; it however contributes in destroying our legal system by creating a certain level of uncertainty, which in turn creates room for monumental arbitrariness. No nation can grow where there is such uncertainty regarding its legal practices.

2. Duty of Lawyers to Turn Down cases Aiding and Abetting Money Laundering by Government Officials and Private Individuals Alike

It is safe to state that no major act of money laundering is possible without the aid of a lawyer whether before or after the fact. The thieving mind either seeks counsel on how best to pull off the ignoble act or how to sustain it without suspicion. Lawyers are frequently directly involved in this dishonorable act by accepting laundered money labeled as legal fees. We are well aware that this arrangement is perhaps one of the safest ways to conceal laundered money since the lawyer’s account is seen as sacrosanct. The courts have even given judicial backing to this fact since it nullified the classification of the lawyer’s account as one over which the Special Control Unit against Money Laundering can beam its searchlight. Without doubt, this judicial step is a noble one which moreover confers respectability on the person of the lawyer. It resonates with pride and underlines the high esteem with which lawyers are regarded. It is however sad that rather than live up to this perception, we take advantage of same to destroy the country all the more. No nation can develop where such acts continue unabated. Thus, if every lawyer can choose to do better in this regard, we can begin to chart a sustainable course for nation building.

3. Duty by Lawyers to Desist From Undue Delay and Frustration of Cases In Court
as justice delayed is justice denied. There can be no serious talk of nation building when the general notion is that a tortoise would probably finish touring the world before a case in a Nigerian court would come to a conclusion. Lawyers in a bid to buy time employ delay tactics to frustrate cases over which they are well aware their clients have no legal rights. Series of excuses are proffered to obtain unreasonable adjournments. As ministers in the temple of justice, we ought to defend or prosecute cases in court with the aim of doing justice regardless of whose interest we are representing. If a client is well in the wrong, we are duty bound to advise him accordingly to explore settlement options or take the necessary steps for the speedy dispensation of the case. The funny thing about unconscionable delay tactics is that we are all victims of it. The argument you proffer in court today will come back to haunt you tomorrow in a separate matter. All of these create in the minds of the citizens a diminished sense of confidence in the judiciary, thereby leading to increased use of self-help, or rather jungle justice, which is inimical to nation building.

4. Duty by Lawyers to Uphold the Rights of the Undefended

One of the noblest ways to adequately express the gift of advocacy is to as much as possible stand for people whose rights are trampled on and have no one to fight for them. As lawyers, we owe it a duty to the society as a measure of our goodwill and ‘giving back,’ to take deserving cases in this regard, prosecute or defend these to their logical conclusions. Any wrong that goes unaddressed is a dent on the rule of law which has its toll on nation building.

5. Duty by Lawyers to Advise Government Officials and Institutions Appropriately
A lawyer is trained to always uphold the rule of law and to be bold in doing same. The travesty of government officials on whose watch or at whose behest the rule of law is greatly bastardized and left unchecked, is sadly often aided by lawyers in both government and private practice who are determined to earn their fat fees at the detriment of the soul of the nation. This is a major stumbling block to nation building. We have witnessed time and again the impunity with which orders of court are disobeyed by government officials. I am of the strong opinion that these government officials are not being properly advised by the legal personalities saddled with the responsibility to so do. We have had situations where Attorney Generals have been sent to prison for the failure of governments to obey court orders. This sort of thing is a dent on the legal profession. Where a governor or elected government official fails to obey orders of court, the A.G ought to resign in protest to protect the rule of law. This will to a large extent send the right signal and foster a sense of confidence in the legal profession which remains the last hope of the common man.

6. Duty by Lawyers to When Necessary Institute Public Interest Suits in Defense of the Rule of Law
Similar to the point made previously on the duty of lawyers to take up pro bono cases, is the duty of lawyers, especially the NBA, to take it upon themselves to champion the cause of true nation building by being in the forefront of challenging any act of government or individuals that threaten the collective goodwill of the nation. This duty is codified in the NBA constitution through the Section on Public Interest and Development Law. I must commend this section of the NBA for its work thus far, but there is still much to be done.

7. Duty To Appoint Judicial Officers Who Would Always do Justice Without Fear or Favour
One corrupt judge is perhaps more dangerous than 10 armed men, for he can throw the innocent into prison and free as many guilty people that can bribe their way to unmerited judgment. In the same vein, a judge who applies sentiments in adjudicating on matters will hardly ever reach just conclusions. To this end, it is important that the necessary appointing authorities, as a matter of duty and patriotism, place on the seats of adjudication only people with proven track record of integrity and grit in the dispensation of justice.

Closely related to the above is also the need for judicial officers to be up and doing in terms of the time frame within which cases in their courts are dispensed with. They should always stand firm in curbing the antics of lawyers who try to delay the cause of justice.

We have enumerated few specific roles by lawyers and judicial officers alike in contributing to nation building. It is hoped that as we progress as a nation, we will see the need as legal practitioners to embrace this all important duty. Away from the legal duties lawyers must perform in promoting nationhood, we must also be up and doing in our civic duties to the state.

CHIEF JOE-KYARI GADZAMA, SAN JOINS THE YOUNG LAWYERS’ FORUM, NBA, PORT HARCOURT BRANCH FOR BREAKFAST AT LANDMARK HOTEL

Chief Joe-Kyari Gadzama rounded up his stay in the garden city of Port Harcourt with a lavish breakfast organized by the Young Lawyers’ Forum, NBA, Port Harcourt branch at Landmark hotel, Port Harcourt, Rivers State.

The young lawyers informed the Learned Silk that this was another way of expressing their gratitude to him for the prominent role he plays in advancing the legal profession for young lawyers through the Hon. Justice Chukwudifu Oputa JSC (Rtd) Mentoring Program organized by J-K Gadzama LLP.

The Learned Silk, who is currently the chairman of the Mentorship Committee of the Body of Benchers was elated as the show of love from young lawyers and other members of the NBA, Rivers State contributed to his pleasant and fruitful stay in Port Harcourt, Rivers State.

With smiles on their faces, the lawyers enjoyed their breakfast as various food items were on display in the restaurant at Landmark hotel. They also had a round table discussion with the Learned Silk which afforded them the opportunity to brainstorm on ideas and discuss salient issues affecting the Bar. The Learned Silk encouraged the lawyers and urged them to keep up the good work.

Nimi Walson Jack Jack, past general secretary of NBA; Mr. Kingsley Nyesom Chinda; Mrs. Cordelia Eke; past secretary of NBA, Port Harcourt; Mr. Ezechimenum Adums, welfare chairman of NBA, Port Harcourt branch (YLF); Mr. Victor Agala; Mr. Tamunokuro Akuro George; Mr. Adebayo Williams; Mr. David Ameh; Ms. Dorcas Gibson; Mr. Ebuka Samuel; Ms. Nerissa Obiecheton; Ms. Sophia Ugwuorah; Mr. Nwaiwu Patrick; Mr. Akuro Enoch; Mr. Godsent Elenwa; Mr. Williams Abayomi; Ms. Ruth Itama; Ms. Goodness Keneboh; Mr. Randolph Fiberesima; Ms. Harmony Chikodili; Mr. Obinichi Ugo; Mr. Augustine Obed Emeka; Wejinya Anwuri; Evidence Asite Agwor amongst many others.

CHIEF JOE-KYARI GADZAMA, SAN; SON OF THE SOIL, HON. NIMI WALSON JACK AND OTHERS ATTEND THE MONTHLY MEETING OF THE NBA, OKRIKA BRANCH

The NBA, Okrika branch held its monthly meeting on Thursday, May 26, 2022 at the popular borokiri neighborhood in Port Harcourt, Rivers State.

Mr. Selema Alamina Walton, vice chairman of the Eastern Bar Forum (EBF) and Mr. Edward Ofori, Esq., the social secretary of the branch ushered the Learned Silk; Hon. Nimi Walson Jack, past general secretary of the NBA; Tamunokuro Akuro George, Esq.; Dafenone Akpomudiare, Esq.; Hillary Ayebaifie Ojeke and others into the meeting. The members of the branch were filled with delight as the Learned Silk and his team made their way into the meeting.

The chairman of the branch, Mr. Emmanuel Eremia, Esq., formally introduced the Learned Silk to members of the branch after warmly welcoming him and his team to the meeting. The chairman of the branch gave the Learned Silk an opportunity to address members of the branch.

While addressing them, the Learned Silk informed members of the branch that he is the pioneer chairman of both NBA-SPIDEL and NBA-SARC. He mentioned that he is looking forward to an all inclusive bar where smaller branches who have been cast aside will be able to take a seat at the Bar. Indeed, this statement made by the Learned Silk captured the hearts of many members of the branch as they nodded in response. His passion for the welfare of young lawyers was brought to fore as he spoke on the essence of mentoring young lawyers to ensure that the legal profession is left in safe hands. He noted that service is the pathway to greatness and as such, the NBA needs a leader who is true to himself and true to all members of the NBA. He gave all glory to God as he mentioned that the grace of God is the foremost factor responsible for his tremendous growth in the legal profession.

Mr. Kalada Nonju, Esq., past chairman of the branch rendered the vote of thanks. He thanked the Learned Silk, Hon. Nimi Walson Jack and other members of the team for gracing the meeting with their presence. Most importantly, he stated that the name “J-K Gadzama” is a household name which requires no introduction as the reputation of the Learned Silk precedes him. He noted that the branch shall account for 99.9% of the votes in support of the Learned Silk’s NBA Presidential ambition.

A son of the soil and past general secretary of the NBA, Hon. Nimi Walson Jack spoke to the credibility of the Learned Silk. He thanked the branch as he recognized the role they played towards pushing him to the NBA national in the past. He assured members of the branch that the Learned Silk is truly a man of his words as they have remained friends for a long time. He noted that the judiciary and the legal profession in Nigeria are currently plagued with certain challenges and as such, the NBA is in need of a leader who can stand up to the current “madness” being faced by the legal profession in the country. He rounded up his speech by stating that although Chief Joe-Kyari Gadzama, SAN is not “mentally mad”, he has “mad ideas” that can be utilized in addressing the current challenges faced by the Bar. Also, Mr. Ogaga Emoghwanre, publicity secretary of NBA, Benin branch was present at the branch’s meeting.

Group photographs were taken at the end of the meeting and members of the branch had the opportunity of exchanging pleasantries with the Learned Silk.

Sadly, over the years, the huge potentials have been dwarfed by so many harmful legacies including: epileptic power supply, poor infrastructure, low productivity, poverty and insecurity, all bequeathed to us by several years of deceptive and inept leadership.

As you grow, learn to reverse the mediocrity that has become our bane. Grow up with determination and the will to do the right thing so that generations after you will respect how you refused to continue on the deplorable path that was handed to you.

ECNBA RELEASES LIST OF CANDIDATES, CLEARS GADZAMA, MAIKYAU, OTHERS

The Electoral Committee of the Nigerian Bar Association (ECNBA) has released the list of candidates for the forthcoming NBA National Elections.

As earlier reported by CITY LAWYER, all the three presidential aspirants were cleared by the electoral committee. These are Chief Joe-Kyari Gadzama SAN, Mr. Yakubu Chonoko Maikyau SAN and Mr. Jonathan Taidi.

Aside from the presidential candidates, three candidates were cleared for the post of 1st Vice President while only three aspirants were also cleared for the post of 2nd Vice President.

Two aspirants will slug it out for the post of 3rd Vice President while four candidates will battle for the post of General Secretary.

Assistant General Secretary has four candidates while three candidates will battle for the Treasurer position. On the other hand, Welfare Secretary has five candidates while Publicity Secretary has only two candidates. The same number of candidates will battle for the post of Assistant Publicity Secretary.

The position of NBA representatives for the General Council of the Bar has 22 candidates to do battle.

It was unclear at press time how appeals by some disqualified aspirants may affect the final list.
