NBA ELECTIONS: WINNERS EMERGE, AS LAGOS, ABUJA LEAD BATTLEGROUND BRANCHES

The Nigerian Bar Association (NBA), Lagos Branch has maintained its ranking as the beautiful bride for candidates in NBA Elections, grossing 10,640 of the 59,393 eligible voters for the NBA 2022 Elections. The branch added 3,918 more voters to its 6,722 tally in the 2020 elections.

Meanwhile, barring any hitches, some of the candidates in the ongoing election are deemed already elected. These include incumbent NBA 1st Vice President, Mr. John Aikpokpo-Martins; incumbent NBA Welfare Secretary, Mr. Kunle Edun; Egbe Amofin O’odua chieftain, Prof. John Akintayo as well as Messrs Agbaga Dennis Ejakpovwere, Israel Solomon Lagbamue and Olalekan Idowu Oladapo.

The winners are all NBA Representatives to the General Council of the Bar (GCB, Western Zone) who are deemed automatically elected given that each zone must produce at least six NBA Representatives to the GCB. Only six persons filed nominations from the zone.

Aside from NBA Lagos Branch, Abuja Branch is another battleground for candidates, taking the second position on the log with 8,959 members on the voters list, up from 2,862 in year 2020.

Other branches with substantial members on the voters list are Ikeja Branch with 4,905 voters, up from 2,751 in 2020 and Port Harcourt Branch which jumped from 1,847 in 2020 to 3,297 voters, bringing up the Top Four branches that have remained dominant over the last four NBA Elections except in 2018 when Ikole Ekiti Branch sensationally upstaged Ikeja Branch to the third position. The branch posted a meagre 43 voters on the log this year as against its 917 tally during the 2018 NBA Elections.

Branches that also have significant members on the voters list include Ibadan Branch (1,863), Owerri Branch (1188), Enugu Branch (915), Ilorin Branch (814), Kano Branch (796), Asaba (736), Kaduna Branch (667), Onitsha Branch (665), and Yenagoa Branch (657). Others are Makurdi Branch with 591 voters, Aba Branch (567), Bwari Branch (518), and Minna Branch (421).

Among the lightweight branches on the voters list are Ogoja Branch with 60 voters, Offa Branch (55), Ikole Ekiti (43) and Maiduguri Branch (30).

And in this wise, in compliance with the NBA amended constitution, where deserving cases arises for the creation of new branches of the NBA within the various Zones, I will work with the existing branch where the new branch(es) are to be created from as well as with lawyers of such locations where the new branches are to be created from so as to ensure that both the existing and new branch or branches to be so established are strengthened and are well funded”.

So let’s support and vote Isaac Omuta Ogbah to see to it that deserving new branches of the NBA are established in the coming years.

Hence if elected as the 3rd Vice President of the NBA I will ensure that the national leadership of the NBA as well as NEC revisit this issue with a view at working out ways to see to the fruition of this NEC resolution long passed but awaiting action to be taken on it”.

Let us therefore vote Isaac Omuta Ogbah as the next 3rd Vice President so we can see the establishment of Lawyers’ Microfinance Bank for the benefit of all lawyers.

On Sunday, June 19, 2022, the Friends of Joe-Kyari Gadzama SAN organized a Dinner Party which hosted the members of the Kaduna Bar, alongside the amiable Chief Joe-Kyari Gadzama SAN, and the teeming members of his eminent entourage some of whom are from the NBA Abuja Branch, the NBA Kano Branch, the NBA Kafanchan Branch, the NBA Zaria Branch, the NBA Funtua Branch, the NBA Katsina Branch and the NBA Suleja Branch, amongst others.

Also in attendance were eminent members and Bar leaders from the Kaduna Bar such as Ustaz Yunus Usman, SAN, Mr. Sani Katu SAN and Mr Tajudeen Oladoja SAN. Others were Mr. M.T Muhammed (the Chairman NBA Kaduna Branch), Ms Julie Ariahu Esq, Ms. Juliet Agada Esq, Mr. Musa Kakaki Esq, Mr. Maxwell Kyon (Secretary, Kaduna Branch), Mr. Ahmed Abdulrazaq Idowu Esq, Mr. Mustapha Haruna (the PRO NBA Kaduna Branch).

The entourage from the NBA Kano Branch included the amiable Mr. Sunusi Musa Esq, Mr. A.A. Sani Esq. Miss Hadiza Nasir Ahmed Esq. Mr. Adamu Ishaq Esq, Mr. Nura Yusuf Garba, amongst others. Mr. Hassan Sherif Esq, a young lawyer from the NBA Abuja Branch was also a part of the Chief Gadzama’s entourage.

From the NBA Katsina Branch, was Mr. S.Y Wurma (the Past Secretary). From the NBA Suleja Branch were Mr. Muhammad Hassan Adamu Esq, Mr Nasiru Usman Esq (YLF Chairman NBA Suleja Branch), Sagir Salisu, Abraham Favour Esq and Nasiru Saidu.

Members of the NBA Kafanchan Branch present include Mr. W.D. Kadina (a Bar Leader), Adams Nathan, C. Abba Esq, Luka Maza Junior, Audu Bobra, N. R. Yam, Ankuma Yem.

Speaking at the Events was Uztaz Yunuz Usman SAN who noted that Chief Joe Kyari Gadzama is “totally qualified” and that “Kaduna is known for always choosing the best” and that if Chief Joe-Kyari Gadzama becomes the next President, he “should continue to be a Leader and not a Ruler”. Mr. Mohammed Sani Katu SAN gave a remark welcoming the Chief Gadzama and his entourage to Kaduna State and its branch of the NBA. Mr. Tajudeen Oladoja SAN also extended his felicitations and was ever happy to offer words of advice and encouragement to especially the younger members of the Bar present, thereafter welcoming Chief Joe-Kyari Gadzama SAN. The Chairman NBA Kaduna Branch, Mr. M.T Muhammed also gave his remark, welcoming the Chief Gadzama amiably to the Kaduna Bar.

Members of the Chief Gadzama’s entourage also gave their remark. Mr. Mohammed Monguno, the Former Attorney-General Borno State and former Chairman of NBA Maiduguri Branch emphasized that J-K has a track record of consistent service to the Bar, having served in numerous capacities, including as Pioneer Chairman, NBA-SPIDEL (2006-2010), Pioneer Vice-Chairman NBA SLP, Pioneer Council Member, NBA-SBL, Former Chairman, NBA- Abuja [Unity Bar] (2002-2004), Pioneer Chairman and the NBA- Security Agencies Relations Committee amongst several others.

Senior lawyer Mr. Sanusi Musa noted that Chief Joe-Kyari Gadzama SAN is a prepared candidate. Mr Sunusi advised in his ever-charismatic manner that members of the Branches present should “follow person wey sabi road” that of all candidates, “na J-K sabi road pass” and that his antecedents speak for him. Mr. Sunusi further urged that at such a critical time as this, the NBA cannot afford to have leaders that do not know what Bar leadership is all about.

Mr. A. A. Sani, Esq. a senior lawyer from the NBA Kano Branch enumerated the numerous selfless contributions of Chief Gadzama to the development of the legal profession in Nigeria. He cited that Chief Gadzama had over the years been consistent in his quest at improving the capacity of lawyers through continuing legal education, especially for the young lawyers through his Annual Lectures currently in its 13th Edition and Mentoring Programs currently in its 7th edition.

Mr. Samson Audu, the immediate Past Chairman of the NBA Kaduna Branch was especially emphatic in his remarks about Chief Gadzama. He noted that the Chief Gadzama had paid his dues and was especially a friend of the NBA – Kaduna Branch having actively participated consistently in the Branch’s previous activities over the years.

Ms. Julie Ariahu Esq, the Vice-Chairperson, Kaduna Branch, International Federation of Women Lawyer (FIDA), also appreciated Chief Gadzama, and thereafter welcomed him and his entourage.

Just before addressing the gathering, Chief Gadzama took a bow, felicitated and appreciated everyone for such a warm reception and thereafter gave a remark which earned him several ovations, cheers and applauses from the members of the NBA Branches present. Chief Gadzama particularly noted that though other candidates for the position of the NBA- Presidency may be qualified, he was the prime candidate for the job and the candidate to beat being the primus inter pares amongst his other fellow contestants.

Chief Gadzama thereafter treated everyone present to prime vintage dance steps much to the amazement of all. “Young at heart”, he called himself. He dance for hours tirelessly and far into the night with everyone and anyone, male and female, old and young, entrenching further, even on a lighter note, the mantra he preaches: “An All-Inclusive Bar”.

NBA BRANCHES SET TO BATTLE ABIA CJ OVER DIRECTIVE

A recent directive by the Chief Judge of Abia State, Justice Onuoha Ogwe to judges in the Abia State Judiciary to deny audience to lawyers without original copies of the new Abia State High Court (Practice and Procedure) Rules, 2021 may cause a fresh rift with Nigerian Bar Association (NBA) branches in the state.

The directive obtained by CITY LAWYER and addressed to Nigerian Bar Association branches in the state noted that “lawyers have refused to purchase the new High Court Rules, while some photocopied the Rules for use in court.”

Dated June 16 and signed by the Chief Registrar of Abia State High Court, Mr. V. C. Okey-Nwokeukwu, the circular warned: “The Hon. Chief Judge directs that as from the date of this letter, any lawyer that appears in our High Court without his copy of the High Court Rules shall not be granted audience.”

CITY LAWYER investigation shows that lawyers in Abia State may be bracing for a battle with the state judiciary over the directive. A senior lawyer who spoke to CITY LAWYER on the controversy said that many lawyers in the state are “agitated” by the directive, adding that they view it as “insulting and degrading.”

He said that while it is inappropriate for lawyers to photocopy the Rules as this may infringe copyright laws, “I can tell you that the directive will be ignored by most lawyers. Also, no judge can enforce that directive. On what basis will they do so? It is not compulsory for any lawyer to go to court with any Rules of court. It is optional. More importantly, it is payment of Bar Practising Fee that accords a lawyer audience in court, not possession of any court rules.”

On his part, the Chairman of NBA Umuahia Branch, Mr. Oliver Amuzie told CITY LAWYER that he is in receipt of the letter, adding that “I am aware that other branch chairmen in the state have just received their copies of the letter.”

He said that the branch chairmen would discuss the matter this weekend with a view to have a common position on it. “I am already reaching out to my brother-chairmen on the issue,” he said. “We have a common platform and we would soon arrive at a resolution on the matter.”

Apart from Umuahia and Aba, the other NBA branches in Abia State are Isiala Ngwa, Ohafia, and Ukwa.

CITY LAWYER gathered that the ongoing boycott of courts by lawyers under the aegis of NBA Aba Branch may not be unconnected with the controversy surrounding the new Rules.

It is recalled that the branch had in a resolution dated 10th June, 2022 and signed by Messrs Bertram Faotu and Chinedu Nwaozuzu, its Chairman and Secretary respectively, ordered its members to boycott the court of Justice C. U. Okoroafor.

The branch leadership said that “the resolution was arrived pursuant to the learned Justice’s continued show of absolute disdain for proper judicial conduct and particularly his blatant refusal to use and or allow lawyers to rely on and or use the Abia State (Practice & procedure) Rules, 2021 in his court on the erroneous premise that there was no High Court Civil Procedure Rules in existence in Abia State.”

CITY LAWYER investigation showed that the jurist had allegedly taken the position that the signing of the Abia State (Practice & procedure) Rules, 2021 was defective, given that it bears the name of the former chief judge of the state.

It was gathered that though the current chief judge had ‘corrected’ the defect through a Practice Direction, Justice Okoroafor does not permit the use of the Rules in his court, leading to a face-off with NBA Aba Branch.

AKPATA STORMS NBA ILE-IFE FOR LAW WEEK

Ikechukwu Maximus Ugwuoke frontline candidate for National Welfare Secretary position of the NBA has advocated the need to curate the welfare needs of members of the NBA across the 125 branches of the bar. He made the observation in his felicitation to the various branches of NBA that held their monthly meeting last week, namely, NBA Portharcourt, Nsukka, Oji River, Okigwe, Abakiliki, Ahoada, Gwagwalada and Anaocha Branches of the bar.

According to him “I have observed in the course of my visit to various branches of the NBA across the country that the welfare needs of members of the NBA vary from one branch to another even though some of the needs are central to all the branches of the bar. For the welfare needs of Lawyers in Nigeria to be adequately addressed, there is need to curate these needs from one branch to another taking into account the peculiarities of the welfare need of each branch . Given the opportunity to serve the bar as the National Welfare Secretary curating the welfare needs of the 125 branches of the NBA is the way to go. This will be achieved through a publicized email address where this welfare needs will be complied, analyzed and made available to the President of NBA to enable him have adequate data required for his effective and efficient decision making around the welfare of lawyers. This is top notch in my Maximum Welfare vision for the bar.
The issues discussed by the members of the bar during their monthly meetings that held simultaneously in various branches of the bar last week, some of which I participated, underscore this point. I really commend the members of the following branches of the bar that held their monthly meeting last week and the branch leaders for the capacity they have demonstrated in providing leadership to the bar; the NBA Portharcourt Branch led by Nyekwere, Nsukka bar led by Ugo Fed Ukwueze, Oji River Bar led by Seth Nwokolo, Okigwe bar led by Ndeme Romi, Abakiliki Bar led by Ogbonnaya Okorie, Ahoada Bar led by Alili Kipe Morris and the Gwagwalada and Anaocha Branches of the bar.

I pray that God shall endow them with greater wisdom to continue to pilot the affairs of their branches especially at this critical period when many of them are in their transition process.”

CHIEF JOE-KYARI GADZAMA, SAN JOINS THE YOUNG LAWYERS’ FORUM, NBA, PORT HARCOURT BRANCH FOR BREAKFAST AT LANDMARK HOTEL

Chief Joe-Kyari Gadzama rounded up his stay in the garden city of Port Harcourt with a lavish breakfast organized by the Young Lawyers’ Forum, NBA, Port Harcourt branch at Landmark hotel, Port Harcourt, Rivers State.

The young lawyers informed the Learned Silk that this was another way of expressing their gratitude to him for the prominent role he plays in advancing the legal profession for young lawyers through the Hon. Justice Chukwudifu Oputa JSC (Rtd) Mentoring Program organized by J-K Gadzama LLP.

The Learned Silk, who is currently the chairman of the Mentorship Committee of the Body of Benchers was elated as the show of love from young lawyers and other members of the NBA, Rivers State contributed to his pleasant and fruitful stay in Port Harcourt, Rivers State.

With smiles on their faces, the lawyers enjoyed their breakfast as various food items were on display in the restaurant at Landmark hotel. They also had a round table discussion with the Learned Silk which afforded them the opportunity to brainstorm on ideas and discuss salient issues affecting the Bar. The Learned Silk encouraged the lawyers and urged them to keep up the good work.

CHIEF JOE-KYARI GADZAMA, SAN; SON OF THE SOIL, HON. NIMI WALSON JACK AND OTHERS ATTEND THE MONTHLY MEETING OF THE NBA, OKRIKA BRANCH

The NBA, Okrika branch held its monthly meeting on Thursday, May 26, 2022 at the popular borokiri neighborhood in Port Harcourt, Rivers State.

Mr. Selema Alamina Walton, vice chairman of the Eastern Bar Forum (EBF) and Mr. Edward Ofori, Esq., the social secretary of the branch ushered the Learned Silk; Hon. Nimi Walson Jack, past general secretary of the NBA; Tamunokuro Akuro George, Esq.; Dafenone Akpomudiare, Esq.; Hillary Ayebaifie Ojeke and others into the meeting. The members of the branch were filled with delight as the Learned Silk and his team made their way into the meeting.

The chairman of the branch, Mr. Emmanuel Eremia, Esq., formally introduced the Learned Silk to members of the branch after warmly welcoming him and his team to the meeting. The chairman of the branch gave the Learned Silk an opportunity to address members of the branch.

While addressing them, the Learned Silk informed members of the branch that he is the pioneer chairman of both NBA-SPIDEL and NBA-SARC. He mentioned that he is looking forward to an all inclusive bar where smaller branches who have been cast aside will be able to take a seat at the Bar. Indeed, this statement made by the Learned Silk captured the hearts of many members of the branch as they nodded in response. His passion for the welfare of young lawyers was brought to fore as he spoke on the essence of mentoring young lawyers to ensure that the legal profession is left in safe hands. He noted that service is the pathway to greatness and as such, the NBA needs a leader who is true to himself and true to all members of the NBA. He gave all glory to God as he mentioned that the grace of God is the foremost factor responsible for his tremendous growth in the legal profession.

Mr. Kalada Nonju, Esq., past chairman of the branch rendered the vote of thanks. He thanked the Learned Silk, Hon. Nimi Walson Jack and other members of the team for gracing the meeting with their presence. Most importantly, he stated that the name “J-K Gadzama” is a household name which requires no introduction as the reputation of the Learned Silk precedes him. He noted that the branch shall account for 99.9% of the votes in support of the Learned Silk’s NBA Presidential ambition.

A son of the soil and past general secretary of the NBA, Hon. Nimi Walson Jack spoke to the credibility of the Learned Silk. He thanked the branch as he recognized the role they played towards pushing him to the NBA national in the past. He assured members of the branch that the Learned Silk is truly a man of his words as they have remained friends for a long time. He noted that the judiciary and the legal profession in Nigeria are currently plagued with certain challenges and as such, the NBA is in need of a leader who can stand up to the current “madness” being faced by the legal profession in the country. He rounded up his speech by stating that although Chief Joe-Kyari Gadzama, SAN is not “mentally mad”, he has “mad ideas” that can be utilized in addressing the current challenges faced by the Bar. Also, Mr. Ogaga Emoghwanre, publicity secretary of NBA, Benin branch was present at the branch’s meeting.

Group photographs were taken at the end of the meeting and members of the branch had the opportunity of exchanging pleasantries with the Learned Silk.

I heartily congratulate the Chairman and Members of the Nigerian Bar Association Ikot Ekpene Branch on the occasion of her 2022 Bar Week between 8th – 12th May, 2022.

The theme of the law week: “Strengthening the Pillars of Democracy Through Effective Legislation” is aptly chosen given the gap between our laws and their implementation.

The frequency with which our laws undergo review is a testament to their ineffectiveness. There is therefore the urgent need to enact legislation that will fill the obvious gaps in the polity and thereby promote good governance.

I urge all participants to take advantage presented by this opportunity and come up with recommendations that will discourage the sort of ineffective legislations that have held us back for so long.

The Chairman of the Nigerian Bar Association (NBA) Security Agencies Relations Committee (NBA-SARC), Chief Joe-Kyari Gadzama SAN has felicitated with NBA Lagos and Kano branches on their Law Week programmes. The chartered arbitrator also commended Young Lawyers Forum Owerri Branch on their 2022 Summit which held between March 17 and March 19, 2022.

Nostalgically, I recall how I started my Lagos office as far back as 1996 at no 10, Ribadu Road, Ikoyi which eventually gave birth to the Abuja Office in the year 2000 where I was elected chairman of the Unity Bar in 2004 and grew up to be the Pioneer Chairman of NBA-SPIDEL in 2006. I remain eternally grateful to the Premier Branch of Nigeria’s Commercial Headquarters for grooming me to be their Ambassador at the administrative Headquarters of our beloved country.

I must sincerely commend the initiative of the organizers of this event for the choice of theme: “Democracy and Legal Order: Shaping the Future” which I consider apt. The need for a true democracy is an issue that remains perpetually centric to the growth of any given society. The judiciary should be independent of the other arms of government to effectively deliver its delicate task of administering justice. Indeed, the preservation of our democracy is fundamental to the sustenance of our legal profession and the Nation, Nigeria. What better way can the future be shaped? I believe that as a united front, we can secure the future of our legal practice and Nigeria by advocating for the supremacy of our laws and the equality of all men before the law.

I urge my colleagues to participate effectively, cross-fertilize ideas whilst addressing issues that affect distinguished members of this great branch by contributing your quota to the promotion and development of your branch, legal practice and Nigeria as a whole. ‘PLAY CRUCIAL ROLES IN NBA, BRANCHES,’ GADZAMA URGES LAWYERS

The Chairman of the Nigerian Bar Association (NBA) Security Agencies Relations Committee, Chief Joe-Kyari Gadzama SAN has urged lawyers to play crucial roles in the growth of the legal profession.

Speaking as a Special Guest of Honour at the February monthly meeting of the Surulere Lawyers’ Forum (SLF), Gadzama who is also the Chairman of the Mentoring Committee of the Body of Benchers for Young Lawyers, urged the members to encourage unity among lawyers.

Surulere Lawyers’ Forum Elder, Chief J-K GADZAMA, SAN presides over 2022 annual cutting of Valentine Cake.

It was a joyous homecoming for Chief Joe-Kyari Gadzama, SAN when he attended the February monthly meeting of the Surulere Lawyers’ Forum (SLF) on February 16, 2022 as an elder and oldest member of the Forum. Recall that Chief Gadzama, SAN was formerly admitted as a member of SLF last year after the Forum welcomed him with open arms.

It is important to state that SLF whose membership cuts across tribes and tongues in Nigeria was founded in 2006 by its pioneer Chairman, Hon. (Chief) V. U. K. Iyanam (former Attorney-General and Commissioner of Justice, Akwa-Ibom State) and consists of legal practitioners who live and or practice within Surulere. SLF is one of the well-coordinated and organised lawyers’ fora in Nigeria and has been growing in leaps and bounds since its establishment.

In his remarks at the meeting, Chief Gadzama, SAN encouraged members to be united in the pursuit of the goals and objectives of SLF as the Forum can achieve a lot when in unity. He also implored them not to relent in playing their critical roles in the affairs of the Nigerian Bar Association both in Lagos State and at National level. The elder statesman was thereafter invited to coordinate the cutting of cake in celebration of members whose birthdays fall within the month of love.

JUSUN STRIKE: NBA DIRECTS LAWYERS TO STORM GOVS’ OFFICES TOMORROW

The Nigerian Bar Association (NBA) has directed its members to storm Governors’ Offices tomorrow to press home the demand for financial autonomy for the judiciary. The move is in apparent solidarity with the Judiciary Staff Union of Nigeria (JUSUN) which embarked on a nationwide strike to press home its demand for financial autonomy of the Nigerian Judiciary.

In a press statement personally signed by the NBA President, Mr. Olumide Akpata, the association asked all NBA branches “to effectively mobilize their members and pay visits to their respective State Governors at the Government Houses on Monday, 19th April 2021 to press home the demand for implementation of financial autonomy for the Judiciary. At the visit, NBA Branches in each State are to present a joint written demand to their State Governor requesting full compliance with existing legislative instruments and court judgments on the financial autonomy of the Judiciary.”

Noting that the demand for financial autonomy “is legitimate, constitutional and is in the best interest of the Judiciary as it is one of the key parameters for enthroning independence of the Judiciary and fostering democracy,” the NBA also directed the branch chairmen “to ensure that these visits are embarked upon, every subsequent Monday, until there is full compliance with this demand that is aimed at strengthening our democracy and the dispensation of justice. We trust that our members will give the leadership of their respective branches all the support that they require to achieve this much needed victory for our justice system.”

The move is coming on the heels of stalled efforts to amicably resolve the impasse, a situation bemoaned by the lawyers’ association which stated that “With these developments and the recent actions and utterances of officials of some of the State Governments, it has become apparent that most of the State Governments are not ready or willing to implement the constitutional provisions which grant financial autonomy to the Judiciary.”
