ELECTIONS: UBANI URGES AFRICAN COUNTRIES TO DEPLOY TECHNOLOGY

The Chairman of the Nigerian Bar Association Section on Public Interest and Development Law (NBA-SPIDEL), Dr. Monday Ubani has urged African countries to deploy technology in order to enable the populace to elect quality leaders that will turn around its fortunes.

Ubani spoke while presenting a paper as a Panelist at the ongoing African Bar Association (AfBA) Conference in Lilongwe, Malawi.

The session, which was chaired by Dr. Samson Osagie, former Minority Whip in Nigeria’s House of Representatives, had its theme as “Good Governance: Firming up the pillars of Good Governance in Africa – Building strong institutions as a critical factor.”

The NBA-SPIDEL helmsman stated that for the African continent to throw up the kind of leadership that will resolve its myriad of challenges, “the electoral system must be re-engineered and sanitized through reduction of human interference in the process. What that means is that technology should replace the human interface in certain critical areas of our electoral system.”

He gave example of Nigeria’s new Electoral Act 2022 which identified accreditation and collation as areas where destructive disruption occurs, saying that “The new Act has deployed technology in those critical areas and the consequence is that Bimodal Voters Accreditation System (BVAS) and transmission of results from the polling units to INEC server are now part of the substantive law and Electoral Guidelines in the country.”

Ubani pointed out that Nigeria has utilized the new Electoral Act in two recent elections at the State level “with positive effect,” adding that “It is almost a hundred per cent reflection of the mandate of the majority in favour of those who were elected.”

He observed that the new Act “has rekindled peoples’ interest in the electoral process and eliminated voter apathy that has been the bane Nigeria’s democratic experience,” noting that deployment of technology in the electoral systems in Ghana, Nigeria, Kenya, Malawi and Kenya “has led to opposition parties securing victory at the polls, a practice that was hitherto a taboo on the continent.”

The top Bar Leader urged African countries to sustain full deployment of technology in all aspects of the electoral process including registration, accreditation, voting, collation and announcement of results, adding that the teething problems associated with such deployment “will be overcome through effective governance.”

According to the leading human rights lawyer, “The African continent has every reason to push for the deployment of technology in the electoral process for therein lies our salvation for the enthronement of the kind of leadership that Africa requires to drive the continent to development and progress.

“It is my extrapolation and I hope we all shall buy into this, and go back home with this idea that our policy makers, lawmakers, and the executives must agree to the wholesome application of technology in our electoral process.”

USE TECHNOLOGY TO TACKLE COURT DELAYS – TAIDI

Former Nigerian Bar Association (NBA) General Secretary, Mr. Jonathan Taidi has advised stakeholders in the justice sector to deploy technological tools to combat delay in the hearing of cases.

Speaking at the recent Law Week of NBA Ota Branch with the theme, “Technology & Administration of Justice: Present Day Realities,” Taidi noted that the coronavirus pandemic has wrought a new way of doing things especially in the administration of justice.

His words: “Sadly, the poor state of infrastructure, such as the deplorable state of our roads, epileptic electricity supply, and the inhuman sanitary condition across the country has imposed upon us the urgent need to embrace technology in order to enhance the administration of justice.

“Our political leaders use scarce resources as excuse to justify their inability to provide the much needed infrastructure. This is unacceptable in the face of the huge recurrent expenditure expended on the political class to the detriment of the vast population.

“Before the Covid-19 pandemic we were all witnesses to how long it took to conclude cases in our courts. Timeliness has been imposed by the 1999 Constitution of the Federal Republic of Nigeria (as amended) as part of the culture of dispensation of justice. Let us fashion out a way to commence and conclude cases speedily not through constitutional amendments, but by deploying technology.

“While the pandemic has brought great challenges to our practice, the Ota Law Week is proof that as a body we are determined to rise to these challenges.”

AKPATA CARPETS ECNBA, SAYS ELECTIONS WON’T BE FREE, FAIR

A leading presidential candidate in the forthcoming Nigerian Bar Association (NBA) Elections, Mr. Olumide Akpata has raised alarm over what he called “looming disenfranchisement of voters and possible manipulation” of the elections, saying the operations of the Electoral Committee of the NBA (ECNBA) is bedeviled by “general opacity.” In a three-page letter to the electoral committee, the former NBA Section on Business Law (NBA-SBL) Chairman urged the electoral body to urgently address these concerns to reassure stakeholders.

In the three-page letter titled “Urgent need to avert the looming disenfranchisement of voters and possible manipulation of the forthcoming NBA 2020 elections,” Akpata who is a Founding Partner at TEMPLARS, a tier-1 law firm, commended the electoral committee “for its good intent and efforts towards conducting credible 2020 elections into the national offices of the NBA.”

He however said he was constrained “to register respectfully my reservations concerning the persistent issues affecting the voters’ register and verification process.” He identified three major factors that may imperil the elections, including “seriously flawed final voters’ list,” “frustrating and cumbersome verification process,” and “opacity regarding the technology and modalities for the elections.”

In a damning rebuke of the electoral body, Akpata frowned on what he termed the “general opacity regarding the conduct of the forth-coming elections,” adding that while he is keen to see that the elections are free, fair and transparent, “The realities surrounding the electoral process presently, with respect, do not suggest that this would be the case, as I explain below.”

According to him, the final voters register as published by the ECNBA is fraught with “tell-tale duplicity of names,” adding that “whilst the final voters’ list contains both duplicated and apparently non-existent names, I am informed that it omits a significant number of NBA members who paid their BPF and Branch Dues on time.”

On the verification exercise, Akpata stated that it “appears to have the effect of preventing prospective voters from exercising their franchise,” adding that “In many cases, it takes days for verification emails to be sent whilst some members simply do not get verified no matter how many times they try.”

Akpata stated that it is “more distressing” that the NBA portal on which the verification exercise is to be conducted appears not to be secure and can be easily manipulated.” He said that a report from an IT consultancy firm recruited by him to assess the vulnerability of the NBA portal “shows clearly that the portal is extremely porous,” adding that the portal “has serious vulnerabilities which could be exploited by anyone to manipulate the process in favour of or against particular candidates.”

He noted that lack of information on specific modalities for the elections is “quite disturbing,” adding that “the ECNBA needs to address the point publicly now.” Noting that the 2018 election “raised many valid concerns which must be avoided this time around,” Akpata warned that “Anything short of a fully transparent, free, fair, credible and user-friendly electoral process in the forthcoming elections would thoroughly offend the collective sensibilities of the members of the NBA which the ECNBA was constituted to serve.”

He demanded that the electoral body should publish “a complete and accurate list of eligible voters in the forthcoming elections” as well as release the statement of account from Access Bank Plc evidencing NBA members who met the March 31 deadline for payment of Bar Practising Fee.

Akpata also asked the ECNBA to “simplify and secure” the verification process and disclose the technology to be deployed for the elections, the IT vendor and measures put in place to secure the voting portal.

Suggesting that the electoral committee jettison its insistence on  a Nigeria registered IT company as vendor for the elections, Akpata stated that most professional associations including NBA Lagos Branch had deployed “technology service providers that specialize in electronic voting.” He urged the ECNBA to “adopt this standard” to ensure free and credible elections.

‘NBA Will Promote Electoral Integrity,’ Says Mahmoud

Internet Fraudster Bags One Year Jail Term

The Economic and Financial Crimes Commission, EFCC, on Wednesday, May 30, 2018, secured the conviction and sentencing of an Internet fraudster, Oluwatobiloba Badejo, before Justice O.A. Williams of the State High court sitting in Ikeja, Lagos.
