EXCLUSIVE: ‘THERE’S NO PEACE PACT, MAIKYAU, GEN SEC STILL USURPING MY OFFICE,’ SAYS NBA TREASURER

The crisis rocking the Nigerian Bar Association (NBA) Executive Committee is far from over as the embattled NBA Treasurer, Caroline Anze-Bishop has distanced herself from the highly publicized ‘peace pact’ between the squabbling NBA National Officers.

CITY LAWYER recalls that NBA witnessed perhaps the most chaotic Annual General Meeting (AGM) in recent history when the National Treasurer alongside the NBA Second Vice President Clement Chukwuemeka and Third Vice President Amanda Demechi-Asagba argued that NBA President, Mr. Yakubu Maikyau SAN was impeding the performance of their constitutional roles.

But NBA had announced in a Press Statement that it had hammered out a truce between the National Officers, saying: “The President of the Nigerian Bar Association (NBA), Mr. Yakubu Chonoko Maikyau, OON, SAN has announced the reconciliation of the national officers of the NBA following the disagreements that emerged during the last Annual General Meeting of the NBA.”

Quoting Maikyau, the statement read: “We have allowed ourselves to become ministers of reconciliation such that all the challenges and the differences we had within our Exco, have by the special grace of God today, been reconciled. And the first place we would go to after that reconciliation is this occasion…we give God all the glory, and the process of reconciliation was not difficult, it was seamless.”

The statement added: “The reconciliation of the national officers took place at the meeting of the National Executive Committee of the NBA, presided over by the NBA President, who had in attendance all the national officers of the Association. Rising from the meeting, members of the Executive Committee resolved to put their differences aside and re-dedicate themselves to the service of members and the lofty objectives of the NBA.”

But Anze-Bishop told CITY LAWYER that nothing could be farther from the truth. Responding to the public statement, she said: “I saw the statement just like you did, that we resolved. Resolved what? And who’s ‘We’? The AGM Saga was an open public show and so was my rejoinder, and I expect a public response by Mr. President to those issues and nothing less.”

Giving a hint that nothing has changed since the highly publicized face-off at the AGM, Anze-Bishop stated that her role is still being usurped. Her words: “My job is still being done by the G. S. and Mr. President, so (the) status quo remains the same and a few exaggerated words won’t cover it.

“I am not in a boxing ring with anyone so it’s baseless to claim we’ve (whoever that is) reached a truce. The National Officers physically met on the 19th and 21st of October but I only joined virtually on Saturday, the 21st, the second day. With the exception of the 1st VP perhaps, every other National Officer pointed out that Mr. President carries on by himself regardless of our presence or roles as National Officers.”

Hinting that the face-off between her and the NBA President may still rear its ugly head at the forthcoming NBA National Executive Council (NBA-NEC) meeting, Anze-Bishop said: “I equally reiterated to him (Maikyau) and the EXCO that the same scenario of the AGM with me will repeat itself at NEC because nothing has changed even as at now, and I will report no falsehood. Mr. President only responded that we will meet at the next meeting of 28th November and discuss these issues. Is that how a ‘resolution’ is done? as I hear being peddled around?”

CITY LAWYER recalls that Anze-Bishop had washed her hands off the financial statements presented to the AGM, saying she would not endorse them as she was not privy to the preparation of the statements. The AGM ended abruptly, without adopting or approving the financial statements.

Noting that she “always looks forward to an excellent working relationship with Mr. President,” the NBA Treasurer however told CITY LAWYER that “The issues I tabled before the AGM are yet to be resolved,” adding that “the status quo remains the same the same.”

She described the NBA public statement as “a most inspiring and proactive statement capable of giving an exquisite makeover or face lift to the worst of scenarios I would humbly imagine. So, Bravo!”

Tracing the crisis to the “abundance of little or no regard for National Officers and their Constitutional duties/Offices inter alia,” Anze-Bishop told CITY LAWYER that “A consideration of Romans 13:7 and upholding the provisions of our Constitution especially with regard to the sacredness of the duties of each officer and drawn boundaries between one Officer and the other, or between one Officer and others inter alia will certainly help to set things aright in my modest view.”

# REDEFINING THE FINANCIAL PRUDENCE OF THE BAR

CHALLENGES AND REMEDIES

Section 5(g)( i- xiii) Constitution of the Nigerian Bar Association 2015( as amended in 2021) spells out the duties and from those duties, I won’t be wrong to say that the Treasurer has the highest duties to perform and therefore must have the capability and capacity to discharge the onerous task.

Challenges
1- ( Sec 5g- vi) we hardly see a report of Treasurer where it states what the Association has invested its money on in consistent with applicable laws.

Solution
Investment is my priority, this will be done by presenting some investment schemes to the President and the other NATIONAL officers for deliberations and decision making.
If you take time to read my Lectures on FINANCIAL INVESTMENT TITLED * THE THREE SERVANTS* which comes out in series everyday, you would know that the best thing you can do as a servant of the master is to increase the wealth committed into your hands.

2- Another challenge is that duty in Section 5g- v
Compilation and circulation of a list of members who have paid or are in default in respect of their Practicing Fees and take steps to circulate such list at the Annual General Meeting, the NEC, various Heads of Courts in the country, CAC and such statutory bodies…

Solution
It is only when you know the intention of the drafters of the Constitution that you would be able to know what this particular provision intends to achieve. However, I could deduce two purposes:

i. To generate more revenue for the Association because those that their names appeared in default list would most likely do the needful

ii. To disallow those that didn’t pay an audience at the various places mentioned for it to be circulated.

Solution
I could hear someone say * stamp and seal* has achieved that…
You are right to some extent it has increased the number of lawyers paying their Practicing Fees just but it has not REDUCED QUARKS MASQUERADING AS ADVOCATES…because we have fake stamp and seal all over…which is another challenge the Bar is facing.

* I would prefer a situation where such publication would be done on Website where the General Public will have access to information on list of lawyers who are dormant or inactive (not Certified to practice), suspended or struck off the Roll of Advocates and those who are active and Certified to practice EVERY YEAR.

My experience in KENYA and ETHIOPIA made me understand that publication in public domain informs the General Public on lawyers to deal with YEAR IN YEAR OUT, increase the revenue of the Law Societies and also help guard against the public falling into the hands ✋ of FAKE * LEARNED FRIENDS * IN corridors of Justice.

3- Section 5g-iv shall be in constant touch with the Branches to ensure that all members of the Branches pay their annual pf as and when due.

Solution
We are now in technology age where things are done seamlessly. A whatsapp group can be created for that purpose to achieve this duty that has so long been neglected, probably because they think, if you don’t pay, you loose the benefits but if done would create a kind of bonding and sense of belonging.

At this juncture, I must commend this administration for proper accounting of the Association’s funds which in my opinion the next administration could do better.

You should not slouch or slack.

We should maximize the use of our talents not for our own selfish purposes, but to honour the master. We know that we work in a fallen world. Because of the curse of sin, our work will be difficult. But we should feel satisfaction and joy from doing our best with what master has given us in the place where his providence puts us, seeking to succeed in order to honour him.

Remember the lesson in part 7 is that ‘The owner of talents must be familiar with his servants’ work, know their track record and must be able to trust them accordingly with his property. 

The servants demonstrated their understanding of the owner’s goals and their investment mandate by investing the talents “at once.”

The servants’ knowledge of the long-term investment, time horizon, confirmed by the master’s journey, combined with the act of immediately investing the talents indicates their understanding of the time value of money.

The servants went about investing according to their abilities, undoubtedly with different strategies, and among the different asset classes.

Lesson: A servant must understand the time value of money for example, the dollar had an average inflation rate of 5.6% per year between 2020 and today, producing a cumulative price increase of 11.71%.

The owner of the talents demonstrates trust in his servants and in the principles of modern portfolio theory already at work in the first century. Effective management includes allocation, diversification, and weighting of the talents among different strategies and asset classes.

The owner, preparing for a journey, maintained investment goals for his talents. He must have been familiar with his servants’ work, knew their track record, and trusted them accordingly with his property.

The owner selected three stewards and weighted the talents investment according to the stewards’ abilities: e.g 62.5% to the lead servant, 25% to the second, and 12.5% to the third respectively.

The servants diversified the talents through investing, trading, and in savings.

Lesson: The owner of talents must be familiar with his servants’ work, know their track record and must be able to trust them accordingly with his property.

Remember the lesson in part 4 is that ‘People are not endowed with identical or necessarily equal gifts.’

At the same time, the talent was taken from the third servant being given to the one with ten talents. Equal worth does not necessarily mean equal compensation.

Some positions require more skill or ability and thus are compensated accordingly. The two servants who did well are rewarded in different amounts. But they are both praised identically. The implication of the is that we are to use whatever talents we’ve been given to the best of our ability and when we have done that, we are on an equal playing field with other faithful, trustworthy servants.

Remember the lesson in part 2 is that you should not give your talent to someone that will do nothing with it.

The severe consequences to the unproductive servant, far beyond anything triggered by mere business mediocrity, tell us that we are to invest our talents and, not waste them.

The particular talent invested in the parable is money.
It depicts investing, not hoarding, as a godly thing to do if it accomplishes godly purposes in a godly manner.
In the end, the master praises the two trustworthy servants with the words, “Well done, good and trustworthy slave”
In these words, we see that the master cares about the results (“well done”), the methods (“good”), and the motivation (“trustworthy”).

He assesses the stewardship of his servants. He evaluates them according to how faithful each was in making wise investments of his money to obtain profit.

Lesson: master is interested in making wise investments of his money to obtain profit.

The gifts we have include skills, abilities, family connections, social positions, education, experiences, and more. The point of the parable is that we are to use whatever we have been given to serve humanity.

The return expected of us is commensurate with the gifts we have been given. The servant who received one talent was not condemned for failing to reach the five-talent goal; he was condemned because he did nothing with what he was given.

Lesson: Don’t give your talent to someone that will do nothing with it.

“It is on this note that I commend the YLF Executives and members of the Effurun branch on their upcoming Summit tagged “Young & Brave: Taking the lead for a better legal society”. Themes of this nature are the backbone of the reassurance and confidence expressed above; to the effect that same resonate a resolve and a desire to take the mantle of leadership and take the Association to greater heights. It begins now, and this set of young lawyers are already in the forefront!

LAW OFFICERS ASSOCIATION OF NIGERIA (LOAN) V. MINISTER OF LABOUR AND PRODUCTIVITY & 3 ORS: SAFIYA BALARABE EXPRESSES SOLIDARITY WITH LOAN

“I wish to express my solidarity with the Law Officers Association of Nigeria (“LOAN”) on its suit against the Hon. Ministry of Labour and Productivity and 3 Ors., seeking to enforce its rights to be registered as a Trade Union in Nigeria.

“LOAN is within its rights in seeking to be registered under the relevant laws and I am confident that the court will give full force to this right. I am aware that the matter came in court today wherein LOAN’s application for leave to amend its processes was granted and the case adjourned to 15/6/22. I shall remain in close observance of the suit as it progresses.

“God bless LOAN, God bless the NBA and God bless Nigeria.”

SAFIYA BALARABE, NBA WOMEN FORUM TREASURER, HAILS MUSLIMS ON EID

The Nigerian Bar Association (NBA) Women Forum Treasurer, Safiya Balarabe has urged Muslims to “hold fast” to the tenets of the Ramadan month.

Said Balarabe: “My fellow Muslim brethren, As-salaam alaikum.

“We are witnessing yet another celebration of our Islam faith, having undergone a rigorous 30-day period of communion with Almighty Allah, wherein we fasted and prayed in deep retrospect of our lives.

“Today as we celebrate the breaking of the fast, thanking Almighty Allah for sustaining us throughout the period, we should by every means hold fast the core tenets of the Ramadan period as entrenched in the teachings of the Holy Quran and championed by the Holy Prophet Muhammad (PBUH). This is necessary especially as our dear nation is faced with myriads of social, moral and economic problems. We as Muslims must indeed be the shining light and herald a positive turnaround for our dear nation.

“I wish us all Eid Mubarak. May Almighty Allah continue to bless and protect us all the days of our lives, Ameen.”
