‘AFAM OSIGWE IS PASSIONATE ABOUT YOUNG LAWYERS,’ SAYS AGU

“Any young lawyer who wishes to succeed should look at the life of our principal, Mazi Afam Osigwe, SAN because he is a bridge between the Benchers and non-Benchers (because he is a life bencher also), between senior advocates and non-senior advocates, between the national officers and non-national officers, and between the old lawyers and young lawyers.

My first contact with him was in 2021 when he came for the Enbar Law Week. I was called by Chinaecherem Nwubani to go and pick him from the airport here in Enugu. My first interaction with him was about the welfare of young lawyers which he spoke so passionately about.

As we interacted, it became clear to me that the universal suffrage we enjoy today as young lawyers was an idea he packaged and sold to the then president, Augustine Alegeh, SAN when he was the general secretary of the Bar.

With what I know about Mazi Afam Osigwe, SAN, if he is elected the president of the Bar, he is going to run a proactive Bar where the interest of everybody will be carried along especially the young lawyers.

Our principal has consistently shown his love for young lawyers. And that I’m sure that anyone who knows him knows that he is so passionate about the young lawyers.”

WHY WE SHOULD VOTE  AFAM OSIGWE SAN FOR PRESIDENT, NIGERIAN BAR ASSOCIATION

Let me use this opportunity to request our collective support and vote for Mazi Afam Josiah Osigwe, SAN, as the President of the Nigerian Bar Association (NBA) in the forthcoming election slated for July 20, 2024.

Interestingly, this year marks 10 years since I first interacted with this eminent, cerebral, brilliant, and ebullient man. Anything I say is from personal experience and not hearsay. In fact, I have admired Mazi Afam Osigwe since my undergraduate days, and to date, I thank God for bringing him into my life.

My relationship with Mazi Afam Osigwe SAN, has shown me how much young lawyers can achieve if we can encourage more mentorship and foster a better relationship between the old and young lawyers in our great profession.

Mazi Afam Osigwe SAN epitomizes the ‘catch them young’ mentality. You can hardly come across young lawyers, young graduates or undergraduates who have not encountered Mazi Afam Osigwe, SAN, or who have not been inspired to greatness by him, and this is not politically motivated.

To sustain the gains of the profession, there should be a bridge, between the old and young members and that bridge is Mazi Afam Osigwe, SAN. He is respected, adored, and honoured across board. No one else, as far as this election is concerned, comes close.

Mazi Afam Osigwe is not just exceptionally brilliant but also smart and hardworking. I have always wondered how he manages to churn out and execute brilliant ideas. It only shows one thing – he understands his assignment in life and keeps preparing ahead.

Without fear of contradiction, Mazi Afam Osigwe, in my honest view, understands truly how a lawyer should be treated and how a lawyer should act. He seizes every opportunity to make meaning of this. Of course, we cannot forget that he was the General Secretary of our great Association from 2014 to 2016, and instrumental in bringing various innovations we enjoy today.

The administration he served as General Secretary is reputed (uncontroverted) as one of the best in the history of the NBA. The universal suffrage, stamp and seal, lawyers’ insurance, NBA building, revamping of the ICLE, etc., came into existence through his collective effort with the then-President Augustine Alegeh, SAN; very few persons can claim such national impact in the affairs of lawyers in Nigeria. We have seen Mazi do it both at the Branch and National levels. He remains the best hand now.

Mazi Afam Osigwe is not just fearless but also daring. I have seen him confront national issues in the country without fear or intimidation. At least, to the best of my knowledge, he has no political leaning and would not spare anything to ensure the rule of law and good governance are protected in the country.

It is not in doubt that, as lawyers, we have a huge assignment to the general public. He represents the kind of approach we put forward. With the current abuse and debasement by our political leaders, we need a proactive, fearless, and responsible President. No other person but our indefatigable, distinguished, and eminent Mazi Afam Josiah Osigwe SAN (the Golden Boy). Let me stop here for now.

Verily, it will be sympathetic for us to still tie ourselves to the cleaves of the Cliché, that it is “TOO EARLY TO RAISE CONCERNS” about the leadership styles of our present crop of NBA “leaders”.

In a nation where leaders sleep in taverns of comfort, with their protruded bellies stuck to the Western world and their anuses farting on the already fainted masses, our NBA should stand out!

In our country where the executive is self-bedeviled with barons and baronesses of incompetence, sleeping over the cries of security and people-oriented programmes, our NBA should stand out!

In a same nation where our Judiciary is wrapped in a life-draining executive imposition and dependence, hence churning out godforsaken lapses in Orders, Rulings and decisions; yet again, our NBA should stand out!

But comfort is not on my side upon a careful and objective perusal of the scorecard of our NBA, as at the peak of it lies the fates of young lawyers hanging upon the balance of excessive charges for NBA AGC 2024 (#50,000 for Young Lawyers)

Some of the notable factors that have already badly affected young lawyers financially and in general wellbeing within the span of one year include:

* Young lawyers are earnestly still suffering the adverse effect of End-SARS, kidnapping, unknown gunmen, desecration of our courts by security agents, Boko haram, et al, where wanton destruction was unabated and courts were also victims of vandalism; by extension, most courts did not sit, and young lawyers were wrapped within the devil and the deep blue sea! So many tales of young lawyers who could not afford house rents and many more! Such a paradox!

* The JUSUN AND NLC strike often come with glorified consequences. No! Not to the striking workers, but the usual grasses (young lawyers) suffering, badly, for the untoward fight of the two elephants..

* How about Transportation fare to and from the AGC??

* Accommodation during the conference?

* This year’s conference is radically different from previous ones usually held as Young Lawyers will journey to the extravagant city of Lagos in a period in which young lawyers will neither toil nor moil in the courts since they have no other trade than the legal profession. Where will these young ones get these fees from?

How many young lawyers can afford #15,000 in a country where economy is in yonder, desert, asylum and near-perpetual hades, let alone #50,000?

Behold, the amount should be reviewed or varied to affordable sum of #15,000

Our NBA President should brace up, be pro-active and live up to the expectations. Let posterity beckon on this administration with right-hand.

This is also a clarion call on the young lawyers to be vigilant and watchful of the candidates and would-be national officers they vote in July NBA 2024 Elections.

WHO IS SABASTINE ANYIA, CANDIDATE FOR NBA FIRST VICE PRESIDENT ?

Sabastine Anyia hails from Wula town, Boki LGA of Cross River State. He is the 3rd child of his parents, Mr. Matthew Akabor Anyia and Mrs. Veronica Aluo Anyia, who where teachers by profession.

He attended St John’s Primary School Wula, John Paul De II Junior Seminary Ogoja and Buentsebe secondary school Wula. He finished his secondary school education in 1992, he was offered admission to the University of Calabar in 1993 to read political science but he turned it down, as his dream was nothing but to study law. He got admission to read law in University of Maiduguri 1995/96 academic year, graduated 2001 went to Nigerian law school, Abuja 2002/03.

He did his NYSC in Anambra state, with Amazing Grace Chambers and was retained thereafter. He got his Master of Laws in 2011 with Nnamdi Azikiwe University, AWKA. After 5 years of tutolish with Sir H.A. Ejim, his principal; he then opened his own office S. U. Anyia and CO.

He has served Nigerian Bar Association, Aguata branch in various capacities: He was elected Public Relation Officer (PRO) Aguata branch, Young lawyer’s chairman, Financial Secretary of the Branch, Welfare Secretary of the Branch, Secretary General of the Branch and Chairman of the Branch. He has also served as the chairman of the 8 branches of the Nigerian Bar Association Anambra State.

During his tenure as NBA Chairman of Aguata branch he built a bar centre for the branch and gave it taste of the art furnishing. He also built other structures to generate income for the branch, he launched the maiden bar journal for the branch, he eradicated fake lawyers from the branch, he arrested and prosecuted people using NBA stickers who are not lawyers in there vehicles.

As Chairman of Chairmen in Anambra state, he introduced football competition among the 8 branches to foster love and unity. He believes in justice and fair play. He is an apostle of an egalitarian society.
The immediate past governor of Cross River State professor Ben Ayade appointed him special adviser on legal matters, but he respectfully declined the appointment because the environment was not conducive for him to give out his best, there is no point accepting an office because of money without the enabling ambiance to give your best.

Every office he has ever occupied, he always introduced positive changes, he is a man with lots of ideas. Sabastine believes in being accountable to the people he’s elected to serve. He See’s every office entrusted to him as an opportunity to serve the people, it is on this note that he has received the following awards:

‘TOBENNA EROJIKWE LOVES NIGERIA AND THE LAW’ – ORJI UKA

TOBENNA EROJIKWE
The Candidate for NBA President Who Loves Nigeria and the Profession

It was in September 2018 that I first experienced my disdain for the Nigerian political class. This was the month in which I embarked on my postgraduate studies in the United Kingdom. This was not my first time outside the shores of Nigeria, but it was the first time I had been out of the country for a sustained period of time and therefore my first time seeing a well-oiled system at work.

The biggest marvel and the most potent source of my indignation was the London Underground Rail System. Each time I got into one of those Tube Stations, I found myself asking whether our leaders do not see this when they travel abroad and why it had not occurred to them to replicate the system at home. For me, one true test of a true Nigerian leader, whether at the Federal or at the State level, is the ability to study what works in these “saner clines” and replicate the same back home. After a few weeks of moaning, I advised myself to face my studies so that I do not develop depression.

This might seem totally unrelated, but as we, Nigerian lawyers prepare to go to the polls to elect the next President of our influential Association, I am pleased to note that one of the three candidates vying for that exalted office has passed this MY TEST of a true Nigerian leader and he has in more ways than one, demonstrated his love for our dear country Nigeria, and the legal profession in particular. That candidate is Tobenna Erojikwe.

Some of the words with which Tobenna is most commonly associated are Ideas, Integrity, Principle, Self-Sacrifice and above all, Capacity.

I had encountered Tobenna before, but we only really became close after I returned to Nigeria in January 2020, and I met him in his capacity as the Director General of the Olumide Akpata Campaign for the NBA Presidency. This was at the time when the first question I faced from almost every person I encountered after my return to Nigeria was, “why did you?” So, I guess that the first thing that drew me close to Tobenna was when I discovered that he was called to the Bar in Nigeria 2000, travelled to England where he practiced as a Solicitor for a period of 10 years then voluntarily returned to Nigeria to continue his law practice as a Solicitor. Meanwhile, I was there for less than 2 years, as a Student and yet friends and family wanted to kill me for returning to Nigeria.

As Campaign DG, Tobenna exhibited, and brought to the campaign, a level of organisation that I was completely unaccustomed to. His leadership style, clarity of thought and principled stands were as refreshing as they were risky, considering that “this is Nigeria.” I remember one day that I got into an argument with him over style – yes, we frequently argued not just with Tobenna but also with OLU – and he said to me, “Orji, we have to do things differently.” When I asked about the potential consequences of doing things differently, he replied, “Don’t worry, we will win with a landslide.” You can tell that I no longer argue that much with him.

His love for the profession was also demonstrated throughout the presidency of Mr. Olumide Akpata from 2020 to 2022. The pivotal role that Tobenna, or “Onwa,” as OLU fondly calls him, played throughout that administration, at no expense to the Association is well documented and merits no rehashing. Ideas in action.

When you play such a central role in the emergence of a transformational President like Mr Akpata, I want to believe that, at the very least, you thereby become entitled to have a say in what office you would occupy or what role you would play in the administration. If I were to take a guess, there was no chance that I would have predicted that Tobenna would be appointed as the Chairman of the NBA-ICLE, which was at the time, frankly speaking, a moribund body. We have all seen how Tobenna transformed the ICLE to the extent that it has in the past few years been the poster child of the Association, and that is putting it modestly. Capacity in action.

Before then, however, Tobenna served as the Chairman of the Conference Planning Committee for the 2022 NBA Annual General Conference. It is probably easy for detractors to reference the debacle over the conference bags but for us who were members of that Planning Committee, we still beam with pride over the way and manner in which Tobenna and his Team, with yours truly serving as the Chairman of the Venue Sub-Committee, transformed bare land at the Eko Atlantic City into a Conference Village in a matter of weeks; or the world class Opening Ceremony at Eko Hotel where Chimamanda Adichie exposed Tobenna as “Iniesta” in the words of @AfamDeluxo and this is not to talk of the insightful sessions, the quality of the Conference Bags, the meals and other attractions.

Even the Conference Bags issue, and I apologise if it appears that I am dwelling on it, was nothing but a clear case of what could go wrong when one insists, and rightly so, on doing things right, not cutting corners, and ensuring that the people get the best that they deserve. Where other people in Tobenna’s shoes would have folded or reclined into oblivion as a result, Tobenna rose like a phoenix from the ashes and ensured that he kept his promise of delivering the Conference Bags to the destinations of ALL Conferees anywhere in Nigeria, at no expense to them. Integrity in action.

One truth I must say openly about Tobenna today is that at no time, during the Olumide Akpata Presidency did it appear to me that he was remotely interested in contesting for the office, and perhaps because he was not. At least not at the time. My reading of the situation is that that administration gave him a front row seat and he realised that if the programmes and policies introduced during that administration were to be sustained, he needed to throw his hat into the ring, even at the expense of his practice and personal life. Self-Sacrifice in action.

In the course of the current campaign, Tobenna has demonstrated that he is a man of principle. He repeatedly reminds his supporters and followers of the rationale behind his candidacy and ensures that they do not engage in mudslinging even when provoked. Tobenna has been tested and he has remained steadfast to his principles. Principle in action.

In ending, I have worked closely with Tobenna since he returned to Nigeria and have experienced him demonstrate his love for Nigeria and the profession, countless times, but on this occasion of the 2024 Democracy Day in Nigeria, I will limit myself to the above instances. It is for this and other reasons that I have no hesitation in publicly declaring my support for Tobenna as President of the Nigerian Bar Association. I have had the privilege of seeing his programme of action and I was filled with pride and hope. Tobenna showed me that it was not a taboo to return to Nigeria, introduce the ideas and skills you learnt abroad, and contribute to the growth and development of the country and the legal profession. He has demonstrated his love for this country, and I am sure that if you set your own personal test, Tobenna is sure to pass it with flying colours. Happy Democracy Day.

I condemn the abduction of Mr. Ejike Ugwu, a distinguished and active member of the Nigerian Bar Association, Enugu Branch. It has now been six harrowing days since Mr. Ugwu was forcibly taken by unidentified men around the Emene area on the outskirts of Enugu. The alarming rate at which lawyers have become targets for abduction by gunmen calls for serious concern. Over the last few months, there have been confirmed reports of lawyers being abducted across the country. In some instances, they are gruesomely murdered; others are fortunate to return alive but not without parting with substantial sums of money, often raised from friends, associates, and in some cases, members of the NBA branch of the abductee. These incidents across the country are a recipe for crisis that requires immediate and sincere action from all levels of government and society.

Lawyers, who are the voice of the voiceless, have become targets for gunmen. This is worrisome and requires the concerted efforts of all, especially the Government, which is constitutionally responsible for protecting the lives and properties of its citizens.

This abduction of our colleague is condemned in the strongest terms. If this worrying trend of abducting lawyers is an attempt at silencing us or stifling the legal profession, the criminals are in for a shock because the resolve of the Nigerian lawyer is as strong as ever to defend the rule of law.

This reprehensible act is a stark violation of Mr. Ugwu’s fundamental human rights and an affront to the entire legal community. This incident is deeply troubling, and the growing insecurity plagues our country. The abduction of any individual, let alone a member of our esteemed association, is intolerable and must be met with swift and decisive action.

I call on the authorities to intensify their efforts to locate Mr. Ugwu and ensure his safe return. The security agencies must employ all necessary resources and strategies to bring the perpetrators to justice. We demand immediate action to ensure the safe return of Ejike Ugwu, Esq., and adequate measures to ensure the safety and security of lawyers as we go about our legal responsibilities to our clients, for which we have sworn an oath to uphold.

My thoughts and prayers are with Mr. Ugwu, his family, and members of the Nigerian Bar Association, Enugu Branch, during this traumatic period.

ENUGU LAWYER SPENDS DAY 6 IN KIDNAPPERS’ DEN

A lawyer who is believed to be an active member of the Nigerian Bar Association (NBA), Enugu Branch (ENBAR) is spending the sixth day in the hot embrace of his captors, CITY LAWYER can report.

Mr. Ejike Ugwu was whisked away to an unknwon destination by gunmen believed to be kidnappers around Emene in the outskirts of Enugu.

An impeccable source who confirmed the incident told CITY LAWYER that the kidnappers had made contact with his family and demanded for ransom. A ranking member of the branch also confirmed the incident.

In a post titled “IMPORTANT NOTICE FROM DAVID NGWEE CAMPAIGN ORGANIZATION,” one of the candidates in the forthcoming NBA Enugu Branch Elections, Mr. David Ngwee said he was suspending his campaign as a mark of respect for the embattled lawyer.

In the post obtained by CITY LAWYER, Ngwee wrote: “Learned Colleagues. Information reaching me by 6 pm today is that one of our dear friend and respected colleague; Ejike Ugwu Esq was kidnapped and has been in the custody of the Assailants/hoodlums since Saturday, 8th day of June, 2024.”

He stated that “while we pray believing God for his rescue, we condemn in a very strong term such evil act of man’s inhumanity to man, and suspend with immediate effect any form of our campaign either through publications of our campaign materials through WhatsApp or text message till further notice. Every member of DAVID NGWEE SUPPORT GROUP is called upon to abide by this directive.”

CITY LAWYER recalls that some lawyers have recently fallen into the hands of kidnappers. Lawyers under the aegis of Nigerian Bar Association (NBA) branches in Anambra State embarked on a strike recently to deplore the menace.

The one-day boycott of courts was to press home their demand for release of their colleague, Mr. Chukwubuikem Azoro, the Secretary of NBA Idemili Branch who was whisked away by gunmen at Abagana around 8:30 pm last Saturday. The lawyers vowed not to defend kidnap suspects until further notice.

DEFAMATION: NATIONAL INSTITUTE OF MARKETING SLAMS N300M SUIT ON AGENCY

The National Institute of Marketing of Nigeria (NIMN) has brought a N300 million lawsuit against Marketing Edge Publications Limited.

In a counter-claim against a lawsuit originally filed by Marketing Edge and its Publisher John Ajayi against the institute and its President, Mr. Idorenyen Enang, the Institute is asking the court to award N300 million to it as general damages for alleged defamation by the duo.

According to court papers filed by a leading law firm on Defamation Law, EMMANUEL UMOREN & CO., NIMN is seeking “General Damages in the sum of N300,000,000.00 (Three Hundred Million) for the damages done to the reputation of the Counterclaimant.”

Aside from seeking interest at the rate of 10 % on the judgment sum from date of judgment till judgment is fully liquidated, the counter-claimant also sought “An Order directing the Defendant to the Counterclaim to retract all its libelous publications on its website, Instagram, Facebook and other social media handles against it.”

The Institute also asked the court to grant it the following reliefs:
1. “An Order directing the Defendant to the Counterclaim to publish in at least 5 National Dailies including Thisday Newspapers, The Sun Newspaper, Vanguard Newspapers, The Nation Newspapers and Daily Trust Newspapers forthwith, an apology to the Counterclaimant, The President and members of the Council of the Institute, and all registered members of NIMN.

2. “A Perpetual Injunction restraining the Defendant to the Counterclaim, its CEO and alter ego Mr. John Ajayi fnimn, their agents, assigns or any other person acting for and on its behalf from further defamatory publications against the 1st Defendant/Counterclaimant, its President, Council members and registered members of NIMN.”

Setting its case against the claimant, NIMN stated that sometime in November 2023, the duo published an online article with the alleged defamatory title which read: “NIMN panics over membership decline, plans phoney programmes to hood wink public.” It stated that the report was published on the Claimant’s website “and other social media channels.”

NIMN wrote that “the above stated headline portrays the Counterclaimant as a fraudulent regulatory Institute running fraudulent programmes to deceive and defraud members of the public.” The Institute argued instead that it is a creation of the Federal Government of Nigeria with its mandate set out in the National Institute of Marketing Act of Nigeria, 2003, Act No. 25.

Outlining its mandates as set out in the enabling law, NIMN stated that it “has not carried out any activities for it to be so portrayed to the members of the public as a deceitful and fraudulent Institute.”

It stated that the Claimant and its publisher “thereafter threw all cautions to the wind and went to town with several malicious and defamatory publications against the Defendant Counterclaimant and the President of NIMN Mr. Idorenyen Enang with damning headlines to totally destroy their characters and started cyber bullying them.”

The Institute stated that aside from another report titled “Idy Enang: Who will tame the bull in the China’s Shop?” the Claimant “in a bid to totally destroy its image” again posted another report titled “NIMN IN THE GRIP OF UNDERTAKERS”.

It stated that the report “portray the Counterclaimant (NIMN) to be in the hands of thieves and that its resources, properties and funds are being stolen by its Administrators.

“That there is no iota of truth in the allegations of the Defendant to the Counterclaimant as the allegations are malicious, reckless and inconsiderate of the integrity of the Institute and its administrators.

“The Counterclaimant states that it is an Institute that has well over 1,000 Registered Members, several affiliates in several countries in the World and these publications have put a major dent to its reputation and that of all members of the National Institute of Marketing of Nigeria.”

Relations between the Institute and the Claimant soured when Marketing Edge published “rating-based claims” around November 4, 2023 stating that it “has unveiled Nigeria’s Top 10 Digital Marketing professionals for the year 2023, owing to their outstanding resilience, dedication and innovation in a year marked by tough and challenging economic conditions …”

NIMN had written to query the entity on the rating-based claims, arguing that, the agency not being registered by the Institute, is precluded from practicing, assessing and testing by “rating based claims” marketing professionals. It added that 17 of the 20 persons selected by the Claimant-agency as the 20 best Marketers in Nigeria “were not registered to practice Marketing in Nigeria in breach of the clear provisions of the Act.”

NIMN also wrote a petition to the Nigeria Police Force “to invite the Police to investigate the flagrant breach of the provisions of the Act by the Claimant and its purported 17 awardees that are not members of the Institute.”

No date has been fixed for hearing of the matter.

‘THE MAZI AFAM OSIGWE THAT I KNOW,’ BY KAINE ANANWUNE

Anyone who knows the recent political history of the NBA would appreciate the struggles that culminated in Paul Usoro‘s (SAN) NBA Presidency in 2018. In the buildup to that election, Mazi Afam Osigwe, SAN, young as he was at the Bar, and not being a Senior Advocate of Nigeria at the time, deared to aspire to become the 29th president of the NBA. As fate would have it (or men would), Afam was disqualified from the race thus not making the final list of candidates.

The year 2017 marked my very first direct and personal encounter with Mazi Afam Osigwe, SAN. Although Mazi Osigwe, SAN had struck a very cordial relationship with most of the Bar Branches in Anambra State; yet, very many of the Bar Leaders in Anambra State at the time were not much impressed with Mazi’s quest for the NBA Presidency as at 2017/2018. We did not support him then. We campaigned against him as well. At the end of it all he was disqualified and we all came back home.

Despite the obvious aversion for his ambition at the time, I learnt certain invaluable lessons from Mazi Osigwe’s (SAN) disposition and mien before, during and after his disqualification from the 2018 NBA presidential race. I would illustrate these lessons with my 3 distinct encounters with Mazi Afam Osigwe, SAN.

Lesson No. 1: ​In the year 2017, at the heat of the merciless campaign we mounted against his candidacy, Mazi Osigwe found time to attend my wedding ceremony here in Anambra State even with the full knowledge of the fact that I was opposed to his ambition and candidacy. I was not only taken aback by his personal attendance at my wedding, I was also impressed with his guts and his large heartedness. Although after the wedding ceremony, I still went on professing support for another candidate other than Mazi. From this episode, Mazi Afam Osigwe, SAN taught me that our personal and professional relationship as lawyers must at all time take very high precedence over our political differences. Bar politics must be divorced from bitterness.

Lesson No. 2: Upon his disqualification from the 2018 NBA Presidential race, Mazi Afam Osigwe accepted his fate with equanimity as though nothing untoward had happened to him. When we expected him to “go to court” to challenge his disqualification, Mazi Osigwe disappointed us. Mazi Afam Osigwe not only went back home; he apparently went back to squarely face his law practice and he took silk (on 14th December, 2020) barely 2 years after his disqualification from the NBA Presidential race in 2018. From this episode, when Mazi Afam Osigwe accepted his disqualification, he taught me loyalty to the Bar. Causes within the Bar must be resolved at the Bar and not necessarily in the Courtrooms. Mazi Afam Osuigwe’s (SAN) from this episode also taught me the need to be focused in one’s law practice. Despite getting involved with bar politics, Mazi Osigwe, SAN never for once lost sight of his basic calling as a legal practitioner. He was dedicated to his Law practice as buttressed by the fact that he took the revered silk before the biological age of 50.

Lesson No. 3: Shortly after the rank of Senior Advocate was conferred on Mazi Afam Osigwe, SAN; sometime in the year 2021, I met Mazi aboard an Air Peace flight from Anambra to Abuja. We exchanged pleasantries and enjoyed our flight. Upon arrival at the Nnamdi Azikiwe International Airport, Abuja, while I was still contemplating on how I would part with about N10,000 for taxi fare into Abuja town; Mazi Osigwe, SAN not only generously offered me a ride in his chauffeur driven SUV, he also patiently waited for me to clear out my baggage from the airport carousel. I rode with him in his SUV as his driver took me to my specific destination. For the umpteenth time, I was amazed at his large heartedness, patience and humility as I imagined how many distinguished colleagues who had adorned silk would find it unconscionable to give a lift to an “ordinary lawyer”. From this episode Mazi Afam Osigwe taught me patience and humility.

CONCLUSION:
My friendship with Mazi Afam Osigwe, SAN blossomed till this date despite our past differences. I reckon him as a fine gentleman who has been consistent in his affable character. He is such that any smart, young and ambitious lawyer could look up to.

SABASTINE ANYIA HAILS NIGERIANS ON DEMOCRACY DAY

I celebrate June 12th with mixed feelings because the said date is very significant to my life. Whereas it’s a special day for democracy in our land when we remember our leaders like M. K. O. Abiola and other distinguished Nigerians who laid down their lives for democracy to strive, for me, it’s the day my dear mother departed from this sinful and odd world, not fighting for democracy to strive but fighting to convert souls to the Almighty.

As I mourn for our our departed leaders and my dear mom, I pray for a better country where Tribe, Tongue and Religion will not be a consideration for appointment or employment. A country where every Nigerian will be proud of being a Nigerian, merry and reside in any part of the country without discrimination. Where you are elected based on what you can offer and not where you are from. This is the Nigeria of my dream. It’s possible and it will come to pass.

I salute this day specially and I call on God Almighty to look down with mercy on our dear country with the eyes of favour and love. Above all, may He heal our land and grant our leaders the forthrightness to do what is right, not minding who ox is gored. I pray for the souls of our departed leaders and that of my beloved mother; may the souls of all the faithful departed through the mercy of God rest in peace.

Again, Nigerian Lawyers are set to elect their choice of candidates for the various national offices of the Nigerian Bar Association (NBA), in the next few weeks. Over the last few election cycles, the electoral process has been trailed with criticisms and post-election complaints and appeals, sometimes ending up in tedious litigation in court, to the extent that following the 2018 election cycle, two Lawyers were actually arrested and charged to court by the EFCC, for offences bordering on cybercrimes to allegedly rig the election. This year presents another opportunity, for the NBA to prove the integrity of its electoral process. Onikepo Braithwaite and Jude Igbanoi linked up with Oluseun Abimbola, SAN, former Attorney-General of Oyo State and the Chairman of the 2024 Electoral Committee of the Nigerian Bar Association (ECNBA), who confirmed the ECNBA’s determination to deliver a rancour free and fair election to Nigerian Lawyers this year

Elections into the national offices of the Nigerian Bar Association (NBA) are just a few weeks away. Exactly when will the elections hold? As the Chairman of the Electoral Committee of the NBA (ECNBA), what level of preparedness can you assure Nigerian Lawyers of?

The NBA 2024 Elections into National offices, and as representatives of the NBA on the General Council of the Bar holds Saturday 20th July, 2024. Preparations are on and in top gear. We have, in line with the Constitution, issued over the last several weeks, necessary guidelines and notices in respect of compliance steps for candidates and members, while other compliance guidelines will still follow. Our Technical Support Consultant is in place after a competitive bid process, and they have since been working with us in preparing for the election. We have cleaned up the database of voters, and recently published the list for members’ eligible to vote for verification. We have again, after a competitive bid process involving technical and financial reviews, with the assistance of our Technical Support Consultant, made a selection of the election service provider, and have commenced a secured review and preparation of the voting platform. I would say we are on course with preparations for the elections.

The issue of the process of selection and choice of IT Provider for the balloting has remained contentious. One of the Presidential candidates has alleged that the process of picking the IT Provider for the election has always been opaque, and not open for scrutiny. How did you handle this challenge, for this year’s election?

The Constitution does provide for the process to follow in the selection of the various expert providers, and it is transparent. It requires us to post a bid invitation, which we did by our issuance and publication of a Request For Proposals, both for the Technical Service Consultant (which we did first), and for the Election Service Provider which recently concluded. Upon preliminary review of submitted proposals, we had narrowed down to a shortlist which was published on the NBA and ECNBA websites, and is still there as released. This was followed by a technical review of the shortlisted organisations and a financial review, before we selected the eventual companies as Technical Service Consultant and Election Service Provider. There was nothing opaque about the selection process.

We had bids from local and foreign entities, consortia, etc, before narrowing down our choice based on several parameters including capacity, experience, expertise, cyber-security offerings, etc. Every step we took is open to scrutiny, and were transparently executed. It is necessary to point out that while the Constitution mandates the ECNBA to publish the list of Shortlisted entities for Election Service Providers for comments by members of the Association, it does not require us to submit the individual bids received to members of the Association. Where we received enquiries on any issue relating to the appointment of the Election Service Provider, we promptly responded.

Controversies have trailed the last few elections, from the disqualification of candidates by ECNBA to allegations of malpractice here and there through the IT Platform. What guarantee can you give to Lawyers this time around, that the voting platform is fully reliable and there is no way to manipulate it, and that the elections will be free, fair and credible?

First of all, understand that an election is a contest with contenders. This presupposes that a winner and loser will emerge in accordance with stated provisions of Statutory instruments, and that carries with it, its own sometimes negative energy, and biases even when there are no smoking guns. Disqualification of candidates, whether by this ECNBA or previous ones, is usually for stated reasons pursuant to the provisions of the Constitution, the Regulations and Guidelines. Disqualification of candidates either by previous ECNBAs or ours in the current exercise, is therefore, no exception, in terms of the energy it generates. Disqualified candidates all have justifications as to why they believe they should not have been disqualified, and again that sentiment is not strange in the circumstance of an electoral contest. That is why there is an appeal process engaged by such disqualified candidates and that was recently concluded, with parties demonstrating candour by accepting the outcome.

The ECNBA extended the date for voter verification. Lawyers hope that the compilation of the Voters List will be hitch-free this year, unlike in the past where Lawyers were unable to vote, because though they found their names on the Preliminary Voters List, their names did not appear on the Final Voters List. Can you assure Lawyers that nothing like that will happen this time around?

By all means all qualified voters who paid their Bar Practicing Fees (BPF) between 1st January and 31st March, 2024 would have been captured on the NBA portal at the time of payment, and should make the list of voters. It is important to point out that, because the system for the payment of the BPF was done through the NBA portal after each member had verified his details, the system automatically generates a List of all persons who made payment between the 1st of January and 31st of March, 2024. The verification exercise that the ECNBA required members to do is that of their phone numbers and emails, since those are the means by which they would receive their authentication codes to vote. Verification was extended, to allow members check that their details are correctly captured on the Voters list (especially their phone/email contacts). Once the verification process ends, the corrections submitted by members would be certified and uploaded on the list, before the final Voters list is uploaded for the elections. We are doing the utmost and meticulously reviewing this to avoid any glitch, so there is no missing data during uploads. Names will not be missing in this election. The only names not on the Voters list, are those who did not pay for their Bar Practicing fees in 2024 within the regulated period. Some members who paid after 31st March have been trying to verify their names and found it missing, and we received various complaints by emails, calls from many, some even abusive for no just cause, when they only paid their statutory BPF fees in April, after the regulatory period. We are taking time to explain though, to all in this category, and we seize this opportunity to advice our members again, that the regulatory period that qualifies you for privileges of the Bar, including the right to vote and be voted for, is paying your BPF as at when due, that is, 1st January to 31st March of the year.

With just a few weeks to elections, your Committee is yet to lift the ban on election campaigns. What informed the decision not to lift the ban in good time, as has been the practice in the past? How and when will the candidates be able to effectively reach their supporters and canvass for votes within such a short period?

No time is fixed by the NBA Constitution, for campaign to start. However, the electoral process and logistics of planning and regulating the stages of same, demand that some activities are desirable to be concluded or commenced (as the case may be), before the ban on campaigns can be lifted.

Secondly, we must remind ourselves that ours is a professional body, not a political party campaign with the full blown partisanship campaigns. I always say that for Bar elections, all candidates belong to the same party called the Nigerian Bar Association; hence, they must observe the same standards and principles for campaign. Our Constitution spells out the strict limits of what is allowed, and it does not necessarily require the open country campaign in political circles; so, there is plenty of time indeed, to campaign before the election.

We have issued to candidates guidelines that should govern their campaigns among other things, and in any case, the ban has now been lifted. Of utmost importance is to ensure all persons observe and maintain the decorum, nobility and professional culture the legal profession is associated with. We should not lose that to partisan politics, even in our campaigns. This is the clear spirit that governs the letters of the NBA Constitution.

Some candidates who were disqualified have gone to Press, asking their supporters to support another candidate. Does this not amount to campaign?

It is regrettable that those who live in glass houses, throw stones at it sometimes. If such persons were to still be candidates, they may qualify to be disqualified. It is a simple regard for our rules, guidelines and Constitution we simply ask all candidates and supporters for, and that is not onerous to comply with. That act was jumping the gun, without the ban on campaign being lifted yet.

We urge our dear candidates and supporters, to stick to the rules of the game please. We want a clean contest, no puns, strict compliance with our rules and Constitution, and let’s set a standard for what a seamless, rancour free and fair elections should be.

It appears that there is a need for voter-education, as many older Lawyers who are neither computer literate or internet savvy, always have challenges casting their votes online. Should Lawyers expect some tutorial on the step-by-step process of casting their ballot in the election?

By all means, there will be voter education, by physical visits across regions, and also DIY video posts, etc to guide voters on the steps and process to casting their ballot. Indeed, we have started this with the clear instructions for the verification process of the Voters list, which made it a simple 3 step “do it yourself” process that anyone could easily follow. We intend to simplify the voting process, in our continuing releases.

After the elections, what is the appeal process, if and when any appeal arises?

There is already set up a National Officers Elections Appeal Committee in place, which will determine any resulting appeals that may arise. We intend to have clean polls, that even those who may lose will have no need to appeal if the process is transparent for any objective mind to see. We, on our part, will conduct a post-election audit nonetheless with our Service Providers, and issue a report of same in furtherance of our resolve to give assurance to the integrity of the process.

What would you say have been your greatest challenges in this important assignment, so far?

Nigeria has had an integrity deficiency in many sectors, processes, institutions and systems. We read narratives from a few amongst our colleagues as to whether this year’s election process will be seamless and free of the recurrent claims of interference, and we do understand those sentiments in our Nigerian environment where elections of any sort have generated such emotions.

We are doing our utmost to disabuse the minds of even the greatest sceptic, by ensuring the integrity of our systems, processes, and procedures. We are scientifically conducting a thorough integrity test of the voting platform, and have same duly certified.

I only wish to assure our colleagues and members, to trust that this year’s election shall be void of those challenges. We have insisted in the process of selection of the Election Service Provider, that in spite of our technical assessment, they provide certified attestation of the integrity of the voter platform which they have happily significantly enhanced over the last two years. Nevertheless, ECNBA will still, in line with its constitutional mandate, give further assurance to stakeholders by hopefully having a reputed global third party, conduct vulnerability assessments and tests on the voting platform to assure all of the processes and eventual outcome.

We thank all the candidates for their cooperation so far, and appeal to them to ensure full cooperation all through the process to the end. We also appreciate the cooperation of our dear members and distinguished colleagues for their engagement with the process so far, and continue to assure them all that we shall, by the grace of God, deliver on our mandate, a free, fair and transparent elections 2024.

The controversy trailing the reconstitution of Body of Benchers standing committees by its Chairman, Chief Adegboyega Awomolo SAN has taken a new twist as the immediate past Chairman of the elite body, retired Justice Mary Odili has washed her hands off appointment of former Nigerian Bar Association (NBA) President, Mr. Augustine Alegeh SAN as the Appointment Committee chairman.

CITY LAWYER had in an excusive report noted that Alegeh disagreed sharply with the recent reconstitution of the Body of Benchers committees by Awomolo and vowed that he remained the chairman of the Appointment Committee.

Law and Society Magazine reports that following Odili’s denial, Awomolo issued a query dated 3rd June, 2024 to the Secretary of the Body of Benchers, Mr. Daniel Tela, asking him to respond to Odili’s assertion.

Part of Odili’s her letter reads: “It is with great shock to read the contents of the letter which in effect means that I, as outgoing chairman of the Body of Benchers, authorized the said appointment. I could not have embarked on such an appointment of Augustine Alegeh SAN as Chairman of Appointment Committee for the following reasons:

1. I had made it known to the administration that I had no interest in reconfiguring the Appointment Committee during my tenure.

2. I could not have embarked on such a process on the day I chaired the last meeting of my tenure, which meant that the appointment would not be presented to the House for approval before the letter to the candidate.

3. I would not have entered into the restructuring of the Appointments Committee without reference to the Vice Chairman with whom I worked as a team.”

In an elaborate defence, Tela insisted that all the instructions he received from the five different Chairmen he had served as Secretary of the Body were mostly oral. Asserting that it was the secretariat which always raised letters based on the verbal, SMS or WhatsApp instructions of the Chairmen as that of Justice Odili appointing Alegeh Chair of Appointments Committee, Tela wrote: “It is rare to see a written instruction.”

Setting out his defence, the embattled Benchers’ scribe also wrote: “Regarding the appointment of Committee members, I wish to clarify that the Secretariat acts only on the directives of the Chairman issued orally or in writing. I say this on my honour. The Secretariat sometimes makes suggestions to the Chairman who is the final authority. In the instant case, I suggested to the then Chairman, Hon. Justice Mary U. Peter-Odili, CFR, JSC (Rtd), DSSRS, that the Chairman of the Benchers Appointment Committee should come from the Bar, given that the previous Chairman had served two consecutive terms from the Bench. Mr. Augustine Alegeh, SAN, being a Life Bencher and past President of the Nigerian Bar Association was subsequently appointed as Chairman, based on the verbal approval of the Chairman.

“May I state for the record that the above appointment is not the first to be done based on verbal communication or via SMS. There are other Chairmen and members of Committee whose appointments were made on the basis of such verbal communication. That is why the steps taken on the appointment of Mr. Alegeh, SAN and other members of the Committee was not strange.

“Prior to this, I verbally drew the attention of the immediate past Chairman to the expiration of the tenure of the Chairman, Benchers Appointment Committee, Hon. Justice Umaru Abdullahi, CON and some of the members wherein it was agreed that they be notified of the expiration of their tenure, some having served beyond the stipulated tenure. Letters were issued notifying the following of the expiration of their tenure as members of the Benchers Appointment Committee having been appointed on the 8th of February, 2018: Hon. Justice Umaru Abdullahi, CON, Chief Albert Akpomudje, SAN, lchie L.M.E. Ezeofor, Hon. Justice Oyebola Ojo. This means their tenure ought to have expired on the 5th of February, 2024 having served two (2) consecutive terms.

“I further suggested to the Chairman the need to replace the Benchers whose tenure have expired. I specifically suggested that the nominees to serve on the Committee should be Life Benchers in view of the peculiar function of the Committee.

“Following the above suggestion, the Chairman requested for the list of members of the Body of Benchers which I forwarded through her PA via WhatsApp. The Chairman, through her PA nominated Hon. Justice K. B. Akaahs, OFR, Hon. Justice P.A. Galumje, Hon. Justice A. N. Nwankwo and Mr. D. D. Dodo, OFR, SAN. The list was sent to me via WhatsApp.

“I drew the attention of the Chairman through her PA on WhatsApp that Mr. Dodo, SAN was already a member of two (2) Standing Committees of the Body, and based on the Body of Benchers Regulations (as amended), no Bencher shall serve on more than two (2) Standing Committees of the Body which the PA responded that she will get back to me. Subsequently, the PA sent me the name of Hon. Justice Uzo Anyanwu as replacement for Mr. Dodo, SAN.

“It is for the foregoing reason that Hon. Justice P. A. Galumje attended the meeting of the Benchers Appointment Committee held on 22nd May, 2024 and today he remains a member of the Committee.

“I wish to emphasize that I have always acted in good faith and in accordance with the directives of the Chairman. I have never unilaterally appointed any Bencher to serve in any Committee, and I cannot do so. My loyalty to the Body and its leadership remains unwavering, even in the face of differing opinions or challenges.

“Sir, you may recall that by a letter dated 16th April, 2024, I forwarded the list of members of the Committees of the Body indicating the date of appointment of each Committee member as requested. The names of the aforementioned Benchers were included on the list, particularly at page 5. (Copy attached for ease of reference). Sir, if l was not directed, how could I have included their names on the list of the Benchers Appointment Committee which I forwarded?

“Sir, you may further recall my observations to you on the 26th of April, 2024 regarding the reconstitution of the Committees of the Body where I expressed some concerns and reservations and also mentioned the appointment of the Chairman of the Benchers Appointment Committee.

“However, I still followed your directives being the Chairman and knowing you have the final say and issued appointment letter to Prof. Yusuf 0. Ali, SAN as Chairman of the Benchers Appointment Committee as well as other Benchers appointed into various Committees as reconstituted. God forbid that a day will come when the Secretariat will refuse to carry out the directives of the Chairman of the Body on account of the manner in which the directives was issued.

“I must state that most instructions given to the Secretariat to act are done orally. It is rare to see a written instruction. As a matter of fact, it is the Secretariat that usually raises a Memo for the Chairman’s approval not the other way round. There are several instances where such memos have been raised or letters written to a Chairman for his information and further directives or necessary action and the response comes either orally or via SMS or WhatsApp messages. Out of respect and in line with the usual practice, the Secretariat carries out the directives. With the recent development, should the Secretariat only act upon written directives given to it for the records? To my mind, the answer should be yes. This way, the records will speak for itself.

“I have received oral directives from various Chairmen on several occasions which were duly carried out. This include the issuance of appointment letters to Hon. Justice Ejembi Eko and Hon. Justice Sidi Bage as members of the Body of Benchers in October, 2023 under the chairmanship of the immediate past Chairman, the circulation of the list of reconstituted Committees to all members on 29th April, 2024, the directive that appointment should be for a period of two (2) years and issuance of letters to Benchers who objected to their removal from Committees informing them of their continued membership of the particular Committee. I have also received oral directives regarding changes to meeting dates, Call to Bar ceremonies and Traditional Law Dinners.

“Permit me to state for the record that after the incidence that took place on the on the 22nd of May, 2024 during the meeting of the Benchers Appointment Committee wherein both Prof. Yusuf 0. Ali, SAN and Mr. Augustine Alegeh, CON, SAN claimed to be the rightful chairman of the Committee, I thought it wise to mention to the immediate past Chairman about the embarrassing situation for two (2) reasons; first because the list of nominees for appointment as Benchers which My Lord the then Chairman recommended for appointment was brought up in the course of the meeting and adjourned for consideration on the 26th of June, 2024.

“Secondly, to draw My Lord’s attention to the fact that Mr. Alegeh, SAN who was appointed during her tenure and Prof. Ali, SAN appointed under the leadership of the current Chairman were laying claim to the position of Chairman of the Committee and expressed my worries about the effect of such incident on the image of the Body. I made this call on the 23rd of May, 2024. In response, My Lord thanked me for the information and also told me not to allow anything disturb me, stating that they will sort themselves out.

“To my mind, after the report of the incident, the question as to how Mr. Alegeh, SAN and Prof. Ali, SAN were both appointed to chair the Committee would have risen. But none. On the contrary I was told not to allow anything disturb me and that they would sort themselves out.

“I was shocked that by a letter dated 3rd June, 2024 I was issued a query alongside the letter written by the immediate past Chairman dated the same 3rd June, 2024 denying knowledge of the appointment of Mr. Alegeh, SAN. I placed a call to My Lord to find out if the letter actually emanated from her and I was surprised to receive a response to the effect that she tried reaching out to me earlier but I was not picking and she had to put together the letter and does not want anything to do with the issue of the Appointment Committee as it was not her position. I reminded my Lord of our discussion on the issue and the subsequent correspondence but my Lord maintained her position. The conversion ended with a plea that I should ‘find a way to help Awomolo’.

“I said I have been doing so, but with the content of the letter, I kept wondering how? At the detriment of my integrity, reputation and career, because the content of the letter is damaging to my person. I have been pondering on the import of the statement. I have never and will never work against the interest of any Chairman nor betray the trust reposed on me.

“I have been inundated with calls on the fact that that the immediate past Chairman did not authorized nor approved the appointment and that I have been queried. I am still wondering how the letter got to the public space.

“May I further state that since my assumption of office, this is the first time I am receiving a query from any Chairman of the Body regarding actions I took in good faith and based on approval given by the Chairman.

“I am concerned about the negative impact of recent events on the Body’s image and integrity, it has been a major distraction for me in the smooth operation of the Secretariat. I pray that these events wiII soon come to an end, and I remain committed to advising and guiding the Chairman with honesty and integrity.

“I have always ensured that the image of the Body and that of the leadership is always protected by not making certain comments and actions public even when it sometimes portrays me and the Secretariat in bad light. My loyalty to the Body and its leadership at all levels remains intact.

“In my humble view, what is most important at this stage is finding a solution rather than blame game. It is never too late to make things right for the good of the Body.

Meanwhile, Awomolo has asked the Federal High Court in Lagos to dismiss the suit filed by Alegeh challenging his removal as Chairman of the Appointment Committee. The Benchers Chairman argued that Alegeh has no legal right over the affairs of the Body of Benchers, and that appointments are not rights but privileges.

The crisis rocking the leadership of the Nigerian Bar Association (NBA) came to a head at the weekend with the Second Vice President, Mr. Clement Chukwuemeka asking NBA President, Mr. Yakubu Maikyau to resign.

In a memorandum to the NBA President obtained by CITY LAWYER and dated 17th May, 2024, Chukwuemeka reeled out a litany of complaints against Maikyau and asked the NBA President to suspend all National Officers and function as “sole administrator and chief Executive President of NBA” or resign.

The memorandum was titled “NOTICE OF CONTINUED BREACH OF NBA CONSTITUTION, URGENT NEED TO RETRACE STEPS AND/OR RESIGN” and copied to NBA Trustees, National Executice Council (NEC) members, NBA AGM, and National Officers among others.

Describing Maikyau as “an oppressor and demoralizer,” the Second Vice President stated that upon resignation, Maikyau should hand-over to the First Vice President “to pilot the affairs of the Bar more proactively for the remaining days of our tenure.”

His words: “As the Second Vice President, I have painstakingly cogitated about the happenings and, I have come to the conclusion to request from you to openly jettison other National officers through your usual resolution and take over the management of the Association alone as a sole administrator and chief Executive President of NBA, since you cannot recognize our presence in your decisions, in the event you renege from suspending the entire National officers, I hereby demand that you quietly tender your resignation to pave way for the 1st Vice President to pilot the affairs of the Bar more proactively for the remaining days of our tenure as you have failed in all fours as a leader that supposed to accord deserving respect to your fellow National officers rather has proven to be an oppressor and demoralizer. The choice is yours to take.”

He berated Maikyau for adopting an “autocratic style of leadership,” adding that this “may be bequeathed in worse form to our successors with a hollow and divided NBA at this rate.”

Chukwuemeka recalled forums including the NBA Annual general Meeting (AGM) where he bemoaned that Maikyau had “hijacked/paralysed” his office as Second Vice President and “deliberately took and handed over my responsibilities to your appointed aides on branch affairs thereby breaching section 9(5)(c) (ii)(iii) of NBA constitution as amended which explicitly.”

Citing several alleged breaches of the NBA Constitution, the Second Vice President stated that Maikyau had sidelined the National Officers and continued to run the association as “THE EXECUTIVE PRESIDENT OF NBA” and on the basis of “lawlessness.” He alleged that unlike past NBA Presidents, branches were created and caretaker committees appointed “without any regard nor recourse to the Vice Presidents in charge of same regions.”

Drawing a parallel between the NBA President and Germany’s disgraced Adolf Hitler, Chukwuemeka wrote: “Adolf Hitler was not authoritarian and fascist when he rose to power; he was a normal person and activist, his autocratic style manifested when he could not take advice from any one. Outside NBA you are a jolly good fellow, but since you assumed this position as the President of NBA, you have muscled your way around it through the Executive tendencies’ you have ascribed the name and functions of that office. It will be safe herein to refer you as THE EXECUTIVE PRESIDENT OF NBA going forward.”

The fiery Bar Leader hacked back at the controversy that trailed Maikyau’s qualification to run for NBA Presidency, saying “there were numerous Bar men that were far more qualified than you, but the then ECNBA refused to look at the direction of the constitutional provision of mandatory NEC membership attendance or micro zoning, and hence, paved way for you to pilot the affairs of this noble association.”

Chukwuemeka stated that National Executive Committee meetings have “become a mirage ranging from consistent inconclusiveness of Exco meeting and frequently flouting the compulsory monthly meetings with impunity hence violating the tenets of Section 9(6) of the NBA constitution 2015 as amended in 2021.”

Saying he ought to be appreciated as a staunch critique of Maikyau’s “malnourished policies,” Chukwuemeka stated that the goodwill “hitherto enjoyed has long evaporated and your self-doubting attributes now causes you to feel so insecure and would rather not have other National Officer especially the Vice Presidents to be seen or heard.” He also alleged that the NBA President had sidelined other National Officers and ran the association “with your Aids (sic) and your preferred National officers.”

He knocked Maikyau for allegedly polarizing the Bar and turning a blind eye to the welfare of lawyers, saying that this has turned young lawyers into “Keke NAPEP” (tricycle) drivers and bouncers. His words: “I learnt that various established firms approached you and were willing to take responsibility of paying the young lawyers the stipulated allowances, giving room to accommodating so many young lawyers as possible. Sir, why haven’t these IGBA BOI programme taken off, and lawyers drawing from the access to finance Scheme enabled?”

He accused Maikyau of “hobnobbing with government” and stated that “under your watch we have failed as leaders and the focal voice of the voiceless!”

On the controversial dissolution of the Executive Committee of the NBA Section on Public Interest and Development Law (SPIDEL), he wrote: “The only Section empowered by the constitution (SPIDEL), which helps in this regard and to our overall benefit, despite our intervention before the NEC meeting at Jos to allow a sleeping dog to lie peacefully, you obstinately went ahead to carry out such an unsupported mission without any Exco support except yourself and suspended the leadership of SPIDEL through NEC, in clear and utter disregard to the National Officers: this is grievous and unpardonable as you have only succeeded in making a mockery of the NBA, the NEC is not to be blamed because they (sic) assemblage of our colleagues composed as NEC sees you as the voice of the National officers.”

The National Officer also stated that “the entire Bar sees us as the worst tenure of the NBA to ever existed,” adding that “lawyers are murdered, kidnapped and humiliated yet no concrete stand by the Association is seen other than long and belated letter writing skills showcased on each occasion.”

The NBA President is yet to respond to the letter.

KELVIN IORZENDA WINS NBA MAKURDI SECRETARY POLL

The Nigerian Bar Association (NBA) Makurdi Branch election has produced Mr. Kelvin Iorzenda as the new Secretary of the branch.

The election which was keenly contested between the senior lawyer and Mr. Ogizi Valentine saw Iorzenda emerging victorious. It was the only position that was contested for during the election which held today.

At the end of voting which held at the Bar Foyer in Makurdi, Iorzenda polled 73 votes from a total of 153 eligible voters to emerge winner while Ogizi received 64 votes.

The post of Branch Chairman went to Mr. Terna Yaji who was unopposed.

The new Executive Committee will be inaugurated on Wednesday.

BREAKING: TOBENNA EROJIKWE WRITES ECNBA, RAISES ALARM ON DATA SECURITY, OTHERS

Mr. Tobenna Erojikwe, a leading candidate in the forthcoming Nigerian Bar Association (NBA) presidential election, has raised serious concerns over some issues relating to the election.

In a letter obtained by CITY LAWYER and dated 8th June, 2024, Erojikwe who is also the Chairman of the NBA Institute of Continuing Legal Education, warned that there are potential infractions and lapses that could undermine the credibility of the forthcoming elections.

Addressed to the ECNBA Chairman, the letter is titled “SUNDRY ISSUES AND CONCERNS RELATING TO THE 2024 GENERAL ELECTIONS OF THE NIGERIAN BAR ASSOCIATION.”

While commending the electoral umpire for its “speedy response” to his earlier concerns on the election, Erojikwe stated that the latest letter concerns issues which he finds “disconcerting.”

Noting that guidelines for the election are set out in the NBA Constitution are “sacrosanct” and designed to provide certainty and “eliminate post-electoral conflicts,” Erojikwe stated that “it saddens me to inform you that certain provisions of the Constitution which are critical to the Election have not, and are not being, complied with.”

Failure to provide voting guidelines and a voter list
Erojikwe highlighted the ECNBA’s failure to issue guidelines for electronic voting at least 60 days before the election date, as stipulated by the NBA Constitution. “As of today, the guidelines for electronic voting have not been released. Even more so, members of the association have not been apprised of the platform, if any, to be used for the electronic voting,” he wrote.

Additionally, the candidate pointed out that the ECNBA has not published the full list of eligible NBA voters at least 45 days before the election, as required by the Constitution. “Again, counting from the tentative date of the election, this requirement ought to have been fulfilled no later than June 5, 2024,” Erojikwe stated.

Noting that an electoral process ought to be transparent and collaborative, he stated that it is “disheartening” that this has not been the case.

Data Security Concerns in the Voter Verification Process
Erojikwe also raised alarm as to alleged security vulnerabilities in the ongoing voter verification process. According to his him, “anyone (whether a member of the association or not) can alter the details of any member on the portal simply by having access to the other member’s SCN (Supreme Court Number).”

This current security infrastructure, Erojikwe warned, not only poses data privacy issues but also raises “a very glaring concern regarding malicious alteration of voter information and tampering with the voting process.”

Call for Transparency and Safeguards
In light of these issues, Erojikwe has called upon the ECNBA to take immediate steps to address the concerns and ensure a credible electoral process. His recommendations include:

  • Promptly publishing voting guidelines and the electronic voting platform in compliance with the Constitution.
  • Allowing candidates and stakeholders to scrutinize the integrity of the process and platform.
  • convening a meeting of candidates and stakeholders to discuss challenges and provide assurances about the ECNBA’s preparedness.
  • Implementing measures to safeguard unauthorised access to members’ data during and after the verification exercise.
  • Actively warding off any external interference or involvement in the electoral process.

Erojikwe urged the electoral umpire to “take steps to speedily address the issues in this letter,” adding that he was desirous to provide “any further assistance that you may require.”

The ECNBA is yet to respond to the letter as at the time of this report.

At the recent Knowledge Sharing Session of the Nigerian Bar Association (NBA) Osogbo Branch meeting, Tobenna Erojikwe, the Chairman of the Governing Board of the NBA Institute of Continuing Legal Education (NBA-ICLE), delivered a thought-provoking discourse on the multiple pillars required to enhance the remuneration and earning capacity of lawyers in Nigeria.

Tobenna Erojikwe’s address focused on the critical need to protect the legal profession’s practice space from encroachment, emphasising the importance of well-ordered training and developing a regimen that ensures Nigerians habitually patronise Nigerian lawyers. His insightful remarks underscored the NBA’s pivotal role in enforcing the provisions of the Legal Practitioners Act (LPA), the Local Content Act, and other legislation that safeguards the earning capacity of Nigerian legal professionals.

HOW AFAM OSIGWE ENDEARED HIMSELF TO NBA ANAOCHA BRANCH

NBA, Anaocha Branch as the 108th branch of the Nigerian Bar Association is amongst the youngest, yet one of the most vibrant branches.

Anaocha Branch was created at the twilight of the administration of Chief Okey Wali, SAN in April, 2014 while Chief Emeka Obegolu, SAN held sway as the then General Secretary of NBA.

At the official inauguration of NBA Anaocha Branch on 1st May, 2014, Mazi Afam Osigwe, SAN was amongst the retinue of guests who honoured our branch with their esteemed presence. From the days of our humble beginning at the Chief Magistrate Court, Neni, Mazi Afam Osigwe, SAN has been very consistent in fostering a cordial relationship with NBA, Anaocha Branch. The list of all guests and attendees who graced the said inauguration ceremony is still available till date as it forms a part of our history as a Branch.

NBA Anaocha Branch has immensely benefited from the wealth of knowledge/experience of Mazi Osigwe, SAN. I would illustrate this with just one example. Sometime in the year 2017, barely 3 years after the inauguration of Anaocha branch, we had this inclination to embark on the construction of our Bar Center Project. Then we had 2 options: either to approach the Chief Judge of Anambra State for a free parcel of Land within the then High Court Complex which was under construction at Agulu; or to source/purchase a fresh parcel of land independent of the High Court/Judiciary. Of course the first option (approaching the Chief Judge) was far easier to accomplish and some of our bar leaders also reckoned that it would be a thing of prestige to have our Bar Center appointed within the court precinct as obtainable in other older branches. The argument as to where to cite the Bar Center coalesced into a very tensed debate which lingered for months and almost threatened the peace of our fledgling branch. As fate would have it, in one of our monthly meetings then in the year 2017, Providence brought Mazi Osigwe, SAN to our meeting at the Neni Magistrate Court and thereupon, Mazi became privy to the raging “Bar-Center debate”. Mazi Osigwe SAN gave us a very simple advice to the effect that: an efficient Bar must be divorced from the control of the State; that citing our bar Center within the Court premises would be tantamount to submitting our independence to the judiciary. Shortly after this episode there was a JUSUN strike and the Chief Magistrate Court, Neni (Our meeting Venue) was locked up by the striking judiciary staff. This singular event made us to fully appreciate the advise of Mazi Osigwe SAN.

NBA Anaocha Branch would later cite her Bar Center on a privately acquired parcel of land generously donated to the Branch by Chief Emeka Obegolu, SAN. In his usual manner, Mazi Afam Osigwe was physically present in Obeledu, Anaocha Local Government Council in the year 2018, when the ground breaking ceremony of the bar Center was undertaken.

Upon completion of the project;s on 11th February, 2022 when the Bar Center (Chief Charles E.N Obegolu Bar Center) was commissioned by Mr. Olumide Akpata, the 30th President of the NBA, Mazi Afam Osigwe, SAN again honoured our branch with his dignified presence. Though he may have forgotten the advice he gave to us in 2017, but the accruing benefits are profound, far reaching and enduring till this day.

The friendship between with Mazi Osigwe SAN and NBA, Anaocha Branch goes beyond “bar politics” as Mazi has not only attended, but also actively participated in nearly all the special events organized by our branch to which he was invited.

Very recently, precisely on 19th October, 2023, NBA Anaocha Branch had a memorial lecture in honour of Chief Charles E.N Obegolu (the gentleman in whose name our Bar Center was christened); Mazi Afam Osigwe alongside other eminent senior lawyers of Anambra extraction were invited to X-ray and discuss practice and procedures on how to leverage the new Multi Door Court House Law of Anambra state, 2022 towards a time-efficient justice delivery in our jurisdiction. While some other invited guests/discussants preferred to send proxies and apologies, Mazi Afam Osigwe, SAN attended by himself and made a robust presentation and recommendations which were highly commended by the Chief Judge of Anambra State alongside other guests and participants.

During my time as the Chairman of The Committee of Chairmen of NBA Branches in Anambra State (October- December, 2021), I was opportune to interact with my other Chairmen of the respective NBA Branches in Anambra State, then I learnt that Mazi Osigwe, SAN also enjoys a formidable goodwill from the other 7 Branches of NBA in Anambra State. In the words of Mazi Osigwe, SAN, “no NBA Branch is a small Branch”; he accords respect and due recognition to all the branches and nurtures the friendly relationship he has built with the respective branches over the years. Hence he is a household name that needs no introduction.

One of the indelible reasons why Mazi Afam Osigwe would forever be remembered and cherished by all is the fact that his tenure under the administration of Augustine Alegeh, SAN gave a voice and a vote to every practicing lawyer in Nigeria. The universal suffrage which we all enjoy in the NBA was made possible by the Alegeh/Osigwe Administration (2014-2016).

NBA ELECTION: ‘MY DISQUALIFICATION BREACHES NBA CONSTITUTION BUT …,’ – EDE ASENOGUAN

Bar Leader and aspirant for the post of Nigerian Bar Association (NBA) Second Vice President, Mr. Ede Asenoguan has queried his disqualification from the race, saying it leaves much to be desired.

In a statement obtained by CITY LAWYER and titled “THE 2024 NIGERIAN BAR ASSOCIATION (NBA) ELECTIONS: MY EXPERIENCE,” Asenoguan berated the Electoral Committee of the NBA (ECNBA) for disqualifying him based on grounds not stipulated by the NBA Constitution.

He also poked holes in the decision of the NBA National Officers Appeals Committee (NBA-NOEAC) upholding his disqualification, saying: “Yet despite having acknowledged the attachment of the said receipt of payment of BPF for 2024, the Appeals committee in their RESOLUTION of my Appeal held:

“The appeal committee finds that there is no evidence of payment of annual Bar Practicing Fee for year 2024 for this candidate. This is a prerequisite for a valid nomination. The only evidence of payment by candidate was the receipt for payment for stamp and seal made on the 4th day of March 2024 and not payment for BPF 2024.”

Describing the reasons advanced for his disqualification as “unsettling,” the former NBA Benin Branch Chairman wrote: “On-going through my own nomination forms, it was discovered that my receipt for the 2024 BPF was not attached and what was attached was the receipt for the payment for 2024 NBA stamp and seal. Surprising as this appeared to be, my representative who was on ground, had a duplicate copy of what was submitted and immediately showed and offered the ENCBA official my said 2024 BPF receipt as not only proof of the payment but also its availability on the spot. The ENCBA official refused to collect the receipt despite all entreaties from my representative to do so ….”

He stated that the ECNBA imported a ground not set out in the NBA Constitution to disqualify him, saying: “It is pertinent to note that what the ECNBA disqualified my candidacy for was “failure to attach” my 2024 BPF receipt and not failure to pay. It is further noteworthy that there is no provision in the NBA constitution that provides for disqualification of a candidate for election on grounds of “failure to attach” a receipt of payment. The constitution only requires that candidates and their nominators must have paid their dues as and when due and only punishes for failure to pay.”

He queried the screening process adopted by the electoral committee, saying: “By the above constitutional provision, it is clear that ECNBA lacks the power to disqualify a candidate unless the candidate specifically breaches a constitutional provision. I did not breach any constitutional provision, it is logical to pause and ask – what is the essence of screening done by ECNBA? Are they not supposed to verify receipts of payment submitted by candidates? Or once a receipt is attached, it is deemed as paid as and when due?”

Saying that he has only opted to set the records straight for posterity, he however stated that he would not litigate the matter. His words: “While I have no doubt in my mind that I have been unfairly treated and unconstitutionally disqualified from this year’s election, I have decided not to challenge this decision unfair as it may seem, not because of lack of courage or capacity to do so, but out of respect for our Noble and Respectable Association. An Association that has come under severe attacks by many in recent times. Even by highly placed members to such an extent that its very foundation is shaking. God forbid that I contribute to this in any way.”

THE 2024 NIGERIAN BAR ASSOCIATION (NBA) ELECTIONS: MY EXPERIENCE

In my desire to serve our dear Association as a national officer in the capacity of the 2nd vice president in the 2024 round of NBA elections, l obtained, filled and submitted the nomination form for the said position. This was after due consultations with my family, friends, colleagues, and teeming supporters across the country who believed and encouraged my candidacy for the said office.

The Electoral Committee of the Nigerian Bar Association(ECNBA) announced the date for the official opening of the nomination forms and invited prospective candidates or their representative to the event. I was represented on the said occasion.

On-going through my own nomination forms, it was discovered that my receipt for the 2024 BPF was not attached and what was attached was the receipt for the payment for 2024 NBA stamp and seal. Surprising as this appeared to be, my representative who was on ground, had a duplicate copy of what was submitted and immediately showed and offered the ENCBA official my said 2024 BPF receipt as not only proof of the payment but also its availability on the spot. The ENCBA official refused to collect the receipt despite all entreaties from my representative to do so; the ECNBA official said we would hear from them. I never heard from them until the ECNBA released the list of Candidates cleared for the election on 3rd May 2024. In the said publication my name was listed under the category of “DISQUALIDIED”. I equally got a mail wherein the reason for my disqualification was communicated to me. The reason communicated to me was:

“that you failed to attach to your Nomination Form evidence of your paid Bar Practicing Fees as at when due for 2024, rather what was attached was a receipt for the payment of N3,000.00 made on the 4th of March 2024 for Stamp and Seal”

“It is in view of your failure to fulfil the requirement of the constitution detailed above and the Guidelines for the election as contained in ECNBA Notice NO 3, that the ECNBA disqualified your candidacy for the position of 2nd vice president in the forthcoming 2024 NBA General Elections.”

Attached hereto are copies of the mail and notice of ECNBA.

It is pertinent to note that what the ECNBA disqualified my candidacy for was “failure to attach” my 2024 BPF receipt and not failure to pay. It is further noteworthy that there is no provision in the NBA constitution that provides for disqualification of a candidate for election on grounds of “failure to attach” a receipt of payment.

The constitution only requires that candidates and their nominators must have paid their dues as and when due and only punishes for failure to pay. This is as provided for in the Part VIII (f) of the 2nd Schedule to NBA constitution 2015 as amended which provides:

“The powers of the ECNBA to disqualify a person who wishes to contest for an office shall only be for the grounds specifically contained in this constitution”

By the above constitutional provision, it is clear that ECNBA lacks the power to disqualify a candidate unless the candidate specifically breaches a constitutional provision. I did not breach any constitutional provision, it is logical to pause and ask – what is the essence of screening done by ECNBA? Are they not supposed to verify receipts of payment submitted by candidates? Or once a receipt is attached, it is deemed as paid as and when due? Especially now that confirmation is by a click of a button? Or is the requirement of attachment of receipt as stated by ECNBA in her notice No. 3 dated 11th March 2024 superior or override the clear provision of part VIII (F) of the 2nd schedule to the constitution?

MY APPEAL EXPERIENCE
ECNBA published their list of cleared candidates on the 3rd of May 2024. Even though the National Officers Election Appeals Committee (NOEAC) had been constituted, it was yet to issue a statement or guidelines on how the disqualified candidates wishing to appeal their disqualification could do so as at the time the ECNBA published their list.

The Appeals committee eventually published their statement/guidelines on the 6th of May 2024. I submitted my appeal to the committee via email as required by the committee on the 7th of May and I got an acknowledgement of the receipt of my appeal on the 8th of May 2024.

I attach herewith my appeal as was submitted and the mail trail of my communication with the Appeals committee.

The Appeals committee sent me their decision on the 16th of May 2024. In their Decision, my Appeal was dismissed. The said Decision is attached hereto.

MY CONCERNS WITH THE DECISION OF THE APPEALS COMMITTEE
First, I have earlier stated very clearly that I submitted my appeal on the 7th and received an acknowledgement of receipt of my appeal on the 8th of May 2024. So I am at a loss that for some inexplicable reason the Appeals committee stated in their said Decision that my appeal was filed on the 9th of May 2024 when I had received an acknowledgement from them on the 8th of May 2024. Were they referring to someone else’s appeal? Or they acknowledged my appeal before l filed it?
Again in the Decision under, “DOCUMENTS ATTACHED TO APPEAL,” the no 1 document listed is:

“1. A copy of receipt showing payment for Bar Practicing Fee dated 4th March 2024 for the candidate”

Yet despite having acknowledged the attachment of the said receipt of payment of BPF for 2024, the Appeals committee in their RESOLUTION of my Appeal held:

“The appeal committee finds that there is no evidence of payment of annual Bar Practicing Fee for year 2024 for this candidate. This is a prerequisite for a valid nomination. The only evidence of payment by candidate was the receipt for payment for stamp and seal made on the 4th day of March 2024 and not payment for BPF 2024”

It is for this reason that the appeals committee dismissed my appeal and affirmed my disqualification by ECNBA. Even though I am unable to grasp what is playing out, both by ECNBA and the NOEAC as regards their decision to disqualify me, the reason advanced for the disqualification is most unsettling against the backdrop of S 4(1) (b) and (c) of the NBA constitution on the privileges of paying BPF as and when due. Upon my receipt of the decision of the appeals committee I immediately sent a mail seeking clarifications on 2 issues to wit: (1). How my appeal was claimed to have been submitted on 9th as against 7th of May 2024 and acknowledgement of same was received on the 8th. (2). How after listing the receipt of a copy 2024 BPF receipt paid on the 4th of March 2024, they still came to the conclusion that they cannot find evidence of my payment of 2024 BPF.

The said email is attached and to which mail I never got a response.

CONCLUSION
While I have no doubt in my mind that I have been unfairly treated and unconstitutionally disqualified from this year’s election, I have decided not to challenge this decision unfair as it may seem, not because of lack of courage or capacity to do so, but out of respect for our Noble and Respectable Association. An Association that has come under severe attacks by many in recent times. Even by highly placed members to such an extent that its very foundation is shaking. God forbid that I contribute to this in any way.

I believe that the Association is bigger than all of us as members and deserves our support and sacrifices to continue to ensure its growth and strengthening. I consider it inappropriate and an acceptance of the false claims/conclusions reached by ECNBA and NOEAC that I did not pay my BPF for 2024, for me to keep quiet and not dispute their claims even if not for the purpose of the 2024 NBA elections but for truth and posterity sake. Failure to pay disqualifies a candidate not just from being voted for, but also from voting in the election. Here I am, qualified to vote having paid 2024 BPF but disqualified to be voted for, allegedly for not paying the same 2024 BPF. I believe we can do better.

I therefore wish to use this medium to thank my friends, colleagues, numerous supporters and sympathisers for their faith in me, tremendous support and encouragement and to assure you all that this setback will only inspire in us the continuous desire to pursue and see an NBA where truth, fairness and justice for her members is sacrosanct and the courage and wherewithal to pursue and defend the Rule of Law in our society is uncompromised. This is but just a bend and not the end of the road.

We humbly pray the ECNBA to graciously extend the verification of voter’s data for the 2O24, NBA general elections to enable majority of her members who were unable to do so before the closure of the said exercise to respectfully do so.

WINNERS EMERGE IN THE ‘NONSO AZIH LEGAL ESSAY CONTEST 2024’

Winners in The ‘Nonso Azih Legal Essay Contest have been announced. The competition delved into the intricacies of the recent legal services bilateral agreement between Nigeria and the UK and was open for participation to Nigerian lawyers in their first 5 years of practice.

Aminat Tijani (called to the Bar in 2024) clinched the 1st Prize, impressively scoring 366 out of 400 and securing a reward of N250k. Following closely, Chinaza Eneh (called to the bar in 2024) claimed 2nd place with a score of 365, earning a cash prize of N150k. Gbolarin Oloyede (called to the bar in 2024) secured the 3rd spot with a commendable score of 312 and will be rewarded with N100k.

Speaking on the essay competition, Mr. Azih, who is the Principal Counsel at Azih & Azih Legal Practitioners, a Lagos based dispute resolution, maritime, and commercial law firm, said: “The aim is to nurture legal research skills among young lawyers and law students, fostering self-development, and enhancing legal practice in Nigeria.

LAWYER, NONSO AZIH NOW KNIGHT OF SAINT JOHN INT’L

A senior lawyer and Principal Counsel at Azih & Azih Legal Practitioners, a Lagos based dispute resolution, maritime, and commercial law firm, Mr. Nonso Azih has been inducted into the Ancient and Noble Order of the Knights of St. John International (KSJI).

BENCHERS: HAIRAT BALOGUN RAPS AWOMOLO, JB DAUDU REJECTS APPOINTMENT

The flurry of complaints over the recent reconstitution of standing committees of the Body of Benchers continued at the weekend with Life Bencher and pioneer female Chairman of the Body of Benchers, Mrs. Hairat Ade-Balogun saying there was a “grievous error” in the exercise.

Often regarded as the conscience of the Bar, Ade-Balogun also, who is currently the Chairman of the elite Elders Committee, stated that Body of Benchers Chairman, Chief Adegboyega Awomolo SAN had “set up the committees like an Executive Chairman,” saying however that the embattled chairman could not assume such a role.

Meanwhile, former Nigerian Bar Association (NBA) President, Mr. Joseph Daudu SAN has rejected his appointment by Awomolo as a member of the Security and Safety Committee.

In a terse three-paragraph letter dated 18th May, 2024 and addressed to the Secretary of the Body of Benchers, Daudu, a Life Bencher, said he was rejecting the offer “for compelling personal reasons.”

He wrote: “I am in receipt of your letter dated the 8th of May 2024 on the above subject appointing me as a member of the Security and Safety Committee.

“Regrettably, I am for compelling personal reasons unable to serve or accept to serve as a ‘member’ of a Security and Safety Committee of the Body of Benchers.

“Accordingly, please notify the Chairman of my decision.”

In her more elaborate three-page letter obtained by CITY LAWYER and dated 14th May, 2024, Ade-Balogun, who was also the pioneer Attorney-General of Lagos State, stated that she has “detected that a grievous error in the establishment of the committees (was done) without the participation of the entire membership of the Body in a General Meeting.”

Continuing, Ade-Balogun, who is reputed as a stickler for ethical conduct, wrote: “You have set up the committees like an Executive Chairman which you cannot assume you (sic) as the action is clearly outside the RULES AND REGULATIONS OF THE BODY.

“It is more worrisome that the committees are not in any way to perform the primary statutory functions of the Body of Benchers.

“These functions as you are well aware are that the Body of Benchers shall be responsible for the CALL TO BAR of graduates of Universities in Nigeria or of foreign Universities who have been admitted and passed through to the relevant Course with the Nigerian Law School. And DISCIPLINE of erring members of the Bar whose names are on the Roll.”

Turning to the longstanding issue of backlog at the Nigerian Law School, the octogenarian and pioneer female NBA General Secretary berated the Body of Benchers, saying that “It would seem to me that the Body has abandoned its responsibility for merely the tasks of keeping up existence as a Government Institution with no particular functions.”

Noting that her question as to the number of university graduates who are yet to be admitted to the Nigerian Law School remains unanswered, Ade-Balogun urged the body to review the admission of students of “Correspondence Colleges” vis-a-vis their university counterparts.

“I am challenging the Body to kindly deal with this matter as an EMERGENCY,” she wrote, warning that some of the affected graduates may be parading as practitioners “out of frustration.”

The Body of Benchers leadership is yet to respond to the flurry of complaints regarding the reconstitution exercise.

NBA APPEAL C’TE: STAKEHOLDERS WANT MAIKYAU’S APPOINTEE REMOVED FOR BIAS

Controversy is trailing the appointment of Mr. Dennis Okwakpam as the Alternate Chairman of the Nigerian Bar Association (NBA) Branch Elections Appeal Committee (East).

CITY LAWYER recalls that the NBA leadership last week unveiled members of the branch and sections elections appeal committees.

No sooner had the news hit the legal community than some stakeholders query Okwakpam’s appointment, alleging that he is a Leader of the influential Integrity Group which is openly backing the candidacy of some candidates in the forthcoming NBA Port Harcourt Election scheduled for June 27, 2024.

As evidence, one of the stakeholders told CITY LAWYER that Okwakpam led the candidates to the General Meeting of Okrika Born Lawyers (OBL) on March 3, 2024 where “he not only presented kola on behalf of the select candidates but also campaigned vigorously for votes on their behalf.”

The stakeholders say that they cannot get justice against “Okwakpam candidates” if they are to appeal any decision of the Branch Electoral Committee. “Justice must not only be done but must be seen to have been manifestly done,” a stakeholder told CITY LAWYER. “We already know what the verdict will be if we are to come against any of Okwakpam’s candidates at the Appeal Committee. There is clearly no level playing field.”

The stakeholders urged NBA President, Mr. Yakubu Maikyau SAN to redress the situation by reconstituting the committee.

When contacted, Okwakpam stated that the appointment to the committee was made last year, saying those querying his appointment may have made u their mind to “scuttle” the election or appeal its outcome.

His words: “The appointment was made last year, not recently. Please find out how the panels work. Nobody participates in the resolution of any petition from his branch. Every member of the panel is from the zone and petitions can only challenge decisions of an Electoral committee. For anyone to complain about the membership of an Appeals Panel, means that they have resolved to go to the Appeals Panel no matter what happens.”

Pressed that the issue turns on fair hearing than whether a candidate decides to appeal, Okwakpam said: “That’s my point, do they have any petition before the Panel. What is the obsession with my membership of the Panel, when complaints do not go directly to the Panel. Note something, anybody who wants to scuttle an election will hang onto anything. They will do anything to win by default. I advise these people to focus on persuading voters to vote for them at the polls.”

Asked whether he is a Leader of the Integrity Group, he denied the claim, saying: “Absolutely not.” He sought the identity of the stakeholders, saying: “Who are these people really? You will be surprised that most members of the PH branch are actually members of the (Integrity) group.”

CITY LAWYER recalls that a similar controversy trailed the appointment of Ms. Huwaila Muhammad as the Secretary of the Electoral Committee of the NBA (ECNBA) even as she has been cleared to contest the chairmanship of NBA Kano Branch.

DEAN OF LAW, PROF. OHURUOGU FOR BURIAL TODAY

Eminent Law scholar and former Dean of the Faculty of Law, BAZE University, Prof. Chris Chijioke Ohuruogu will be buried today in his Akabo, Owerri, Imo State home.

According to a statement by the family, funeral service will hold today for the highly decorated legal scholar at 11 o’clock at Saint Andrew’s Anglican Church, Akabo, Owerri, Imo State.

Meanwhile, Service of Songs for the departed Law teacher held on Tuesday, 4th June, 2024 at GRA, Enugu.

Ohuruogu has been renowned as a Lawyer, Law Teacher and Consultant. He attended the University of Ife (now Obafemi Awolowo University) for his Bachelor of Law degree and received a Master of Laws degree from the University of Lagos. He attended the Nigerian Law School and was called to Bar in 1989. He was a Visiting Scholar and Teaching Fellow at the Human Rights Institute, Columbia University Law School, New York, USA between 2002 and 2003.

He is an alumnus of several international institutions and programmes including the Forced Migration and Human Rights Law Programme at the American University in Cairo (then under Barbara Harrell-Bond OBE); the International Law Programme of the Human Rights Institute of the University of Pretoria in South Africa; the International Institute of Human Rights in Strasbourg, France; International Institute of Humanitarian Law in San Remo, Italy, and the Center for the Teaching of Human Rights Law (CIEDHU) in Strasbourg France, among others.

The law scholar was a prize winner and recipient of several Fellowship and Scholarship awards, including being the first recipient of the C. S. Ola’s Prize for the Best Graduating Student in the Law of Taxation (Obafemi Awolowo University; Summer Institute of the United Nations Institute for Training and Research (UNITAR) New York, and the Columbia University in New York (June 2004).

Ohuruogu was a growth-minded, visionary lawyer and law professor with over 30 years of experience in elevating law department performance, curriculum development, strategic planning, and instructional design for a variety of courses.

He is reputed as a relationship-driven leader with a proven track record in professional development, programme development, and cross-functional team building. He was highly motivated to utilize interpersonal skills and passion to impact organizations through a dynamic leadership. He practised law fully for nine years before venturing into academics.

He was a Senior Consultant with Access to Justice, and delivered key insights for the EU-Funded and British Council/Rule of Law, Anti-Corruption (ROLAC) implemented programme delivered by Access to Justice.

Aside from his stint at Columbia University Law School, Human Rights Institute (August 2002-May 2003) as a Visiting Scholar & Human Rights Teaching Fellow, Ohuruogu was a Professor and Dean of Law at Benson Idahosa University between 2007 and 2013.

He was a Senior Lecturer in Law at Enugu State University of Science and Technology (2004-2007) and Lecturer at Lagos State University (1997-2004). Between 2014 and 2016, the eminent Law Teacher was a Professor of Law at the College of Law, Afe Babalola University (ABUAD).

Renowned as a highly cerebral legal scholar, Ohuruogu received many honours and awards during his illustrious career. These include the UNITAR Scholarship for the 2004 Summer Institute, New York, USA; International Institute of Human Rights’ Scholarship for 35th training session, France, 2004; International Institute of Humanitarian Law Award for 28th training course (2003); ICRC Scholarship for Humanitarian Law for University Teachers (2004); Good Governance Program Scholarship to attend the International Law Course at the University of Pretoria (2005); Scholarship to attend the 43rd Academy of American and International Law (May 28 to June 30 2006) Texas, USA, and Xiamen Academy of International Law Full Scholarship (July 2009).

A member of many professional bodies, the popular Law teacher has also served Nigeria in several capacities, including Member, Federal Government Visitation Panel to the University of Jos, 2014-2017 and 2018-2021; Facilitator at conferences of the ECOWAS Court of Justice since 2018; Member, Board of Trustees, Obafemi Awolowo University Law Alumni; Member, Committee of Experts on International Humanitarian Law in consultation with the ICRC (Nigeria) since 2009), Member, Committee of Experts on Statelessness, in consultation with the UNHCR (Abuja), and Member, Advisory Board, Nigerian Law School Alumni Association, Class of 1989.

I profoundly thank you all for your unwavering solidarity and commitment towards my candidacy for the Nigerian Bar Association Presidency.

Despite the recent developments resulting in my inability to proceed with my presidential candidacy, my commitment to the development of the NBA remains unshaken. In this vein, after extensive consultations with my team and supporters, we have made a collective decision to wholeheartedly endorse another highly qualified candidate. This candidate not only shares the same vision and values for the advancement of the Nigerian Bar as captured in my Manifesto but also embodies them in his every action.

After careful consideration and for the progress of our beloved Association, we are thrilled to announce our support for Chukwuka Ikwuazom, SAN, for the office of the President of the NBA. Chukwuka Ikwuazom, SAN, exemplifies the integrity, maturity, and professional excellence that befit the high office of NBA president. We are convinced he will apply these shared values to create a more progressive, effective, efficient, inclusive, and transparent Bar. We will collectively rally behind Chukwuka Ikwuazom, SAN, to realise our collective vision.

CORDELIA EKE, NWOKE, OTHERS SET FOR NBA PH ELECTIONS

Gladiators are getting set for the June 27, 2024 election of the Nigerian Bar Association (NBA) Port Harcourt Branch.

Already, the John Synger-led Branch Electoral Committee has published the manifestos of all the candidates cleared for the crucial election. NBA Port Harcourt is one of the major voting blocs in NBA Elections.

Among those cleared for the chairmanship race is Mrs. Cordelia Eke, a Bar Leader and former Secretary of the Electoral Committee of the NBA (ECNBA); Ms. Felicia Tubolayeofori Nwoke, and Mr. Geoffrey Joseph.

Others candidates whose manifestos were also published by the electoral umpire are Ezechimenum Adums, Chijioke Amadi, Modupe Babalola, Elijah Briggs, Kelechi Chinule, and Mary Samuel. Others are Cleopas Esu, Atonye Ezekiel-Hart, Francis Ibekwe-Allagoa, Emmanuel John, Nnenda Kejeh, Obumneme Nwoye and David Onyema.

On her qualification for the coveted position of Chairman, Eke, who as pioneer female Secretary is gunning to emerge as pioneer Branch Chairman, wrote.: “My name is Cordelia Uwuma Eke (née Adikema). I earned my LL.B from Rivers State University and LL.M from the University of Kent, UK, and hold multiple professional certifications. I’ve practiced law since 1995, focusing on criminal litigation, dispute resolution, and advocacy for women and children. Now, as a Director at Rivers State Ministry of Justice, I continue to champion legal practice and citizen rights.

“I envision an NBA Port Harcourt Branch leading in digital innovation and fostering a cosmopolitan spirit for all members’ welfare and professional growth. Our branch will proactively identify opportunities, championing equal access to advance legal practice and stand as a beacon of excellence in the legal community.”

On her part, Nwoke wrote: “I am a consummate Bar Man and has (sic) served both the Bar and FIDA in various capacities. I aspire, with a deep sense of responsibility, to lead the Nigerian Bar Association Port Harcourt Branch, as Chairperson, and humbly solicit your support and votes.”

Another chairmanship candidate, Mr. Joseph wrote: “My name is Geoffrey O. A. Joseph Esq., I was called to the Bar in December 1991. Thereafter, I participated in the Voluntary Natioonal Youth Service Corps programme. After my youth service, I became a member of the Port Harcourt Branch OF THE Nigerian Bar Association and have remained an active member since then. I have been attending Brancg meetings and other activities of the Branch.”

‘GOD FORBID BODY OF BENCHERS RUN ON INDIVIDUAL’S WHIMS,’ – LIFE BENCHER

A Life Bencher and former Attorney-General of Akwa Ibom State, Mr. Uwemedimo Nwoko SAN has described the renaming of Body of Benchers Complex Management Committee which he chairs as “unlawful,,” adding that he remains the Chairman of the committee.

In a letter obtained by CITY LAWYER and addressed to Mr. Daniel Tela, Secretary of the Body of Benchers,  Nwoko stated that the elite body “is a creation of statute and must operate within the latitude of its Regulations.”

Hinting on the recent reconstitution of standing committees of the body by its Chairman, Chief Adegboyega Awomolo SAN, Nwoko wrote in the letter dated 31st May, 2024: “God forbid, and may the day never come when we would jettison the Regulations and operate according to the whims and caprices of an individual.”

Recalling his invitation by the Benchers’ scribe to a meeting of the rechristened “Infrastructure Development and Management Committee,” Nwoko noted that at an earlier meeting of chairmen and vice chairmen of the new committees summoned by Awomolo, “I did unequivocally register my protest and rejection of the unlawful changes.

“Recall further that at the said meeting of 10th May, 2024, I unequivocally but with great respect told the Chairman that he had no powers under the Benchers Regulation to dissolve any standing Committee or change the name or appellation of any Committee to make it different from what is contained in paragraph 11(3) of the Body of Benchers Regulation.

“Recall in particular that I, without any equivocation, read out my appointment letter into the APPOINTMENT COMMITTEE dated 22nd November, 2022 which gave me a THREE YEAR TENURE and insisted that I remain a member of the Appointment Committee.”

He stated that Awomolo lacked the power to change the name of the Body of Benchers Complex Management Committee to “Infrastructure Development and Management Committee,” adding that “I insisted that the Body of Benchers Complex Management Committee remain intact and I remain the chairman of that Committee pursuant to the Regulations.

Nwoko stated that he was “surprised” to receive notice of the meeting “of that purported Committee,” adding that it is “an illegal contraption not known to law in the Body of Benchers.”

He urged the Benchers Secretary “to completely disregard whatever took place at that gathering,” saying that “Very soon I will call a meeting of the Body of Benchers Complex Management Committee in accordance with the law.”

CITY LAWYER recalls that former Nigerian Bar Association (NBA) President, Mr. Augustine Alegeh SAN had also discountenanced his removal as Chairman of the Appointment Committee, saying his tenure remains intact.

Former Plateau State Attorney-General and Commissioner for Justice, Mr. Edward Pwajok SAN had also heaped more pressure on the embattled Body of Benchers Chairman when he alleged that the reconstitution exercise was not only lopsided but that members of the Appointment Committee were being punished for refusing to rubber-stamp a list of bencher-nominees.
