INVESTIGATION: ‘NBA EXCO DIDN’T APPROVE SPIDEL CONFAB’ – NATIONAL OFFICERS

The controversial Nigerian Bar Association Section on Public Interest and Development Law (NBA-SPIDEL) Annual Conference which held recently at NBA House in Abuja may not have been formally presented to the NBA National Executive Committee for approval, CITY LAWYER can report.

CITY LAWYER investigation shows that NBA President, Mr. Yakubu Maikyau SAN may have held the planning and execution of the annual conference very close to his chest, only informing officers on a need-to-know basis.

At least four National Officers have vowed that Maikyau did not formally seek the approval of the the Executive Committee for the annual conference.

NBA Second Vice President, Mr. Clement Chukwuemeka told CITY LAWYER that “The 2nd Vice President, being a Democrat, can never disrespect any court ruling. I am not aware of any SPIDEL conference; we as EXCO have not discussed nor contemplated any issue in respect of any SPIDEL conference.”

Embattled NBA Treasurer Caroline Anze-Bishop echoed similar views, stating that “the NBA National Officers never met or decided to have any SPIDEL Conference yesterday. So please count me out of the shameful illegality that went down yesterday in our collective name.”

Assistant General Secretary Daniel Ayi-Kip stated that “the subsistence of such an (interim) order and the propriety of proceeding with the NBA-SPIDEL Conference in defiance to the said Order has never been a subject of any deliberation at the National Executive Committee level.”

On his part, incumbent Assistant Publicity Secretary Charles Ajiboye had penned a disclaimer on the conference following an election eve backlash which trailed his email to lawyers while announcing the conference.

According to Ajiboye whose political ambition may have taken a hit from the SPIDEL annual conference debacle, “I was not privy to the planning of the SPIDEL Conference nor was I served with the Court Order directing it not to hold.”

Efforts by CITY LAWYER to get the views of the NBA leadership on the claims by the National Officers proved abortive as NBA Publicity Secretary Habeeb Lawal did not respond to enquiries.

NBA General Secretary Adesina Adegbite, First Vice President Linda Bala and Third Vice President Amanda Asagba did not proffer any opinion on the controversy when contacted by CITY LAWYER.

It is recalled that the SPIDEL Annual Conference held on July 18 notwithstanding a Delta State High Court order barring the NBA from proceeding with the scheduled conference.

The factional NBA-SPIDEL Executive Committee that was dismissed by the NBA National Executive Council (NBA-NEC) during its quarterly meeting in Jos, had issued Form 49 processes against Maikyau and  Mr. Ben Oji, the Secretary of the NBA-SPIDEL Caretaker Committee, to show cause why they should not be committed to prison for disobeying a subsisting court order.

Form 48 processes were also issued against Lawal and Ajiboye among others for their alleged roles in facilitating the conference.

WHAT NBA NATIONAL OFFICERS ARE SAYING

CLEMENT CHUKWUEMEKA, SECOND VICE PRESIDENT

When the word EXCO is used by some persons, they are actually referring to the PRESIDENT of the Bar, and not National Officers.

The 2nd Vice President, being a Democrat, can never disrespect any court ruling. I am not aware of any SPIDEL conference; we as EXCO have not discussed nor contemplated any issue in respect of any SPIDEL conference. The few activities recently organized by the President of the Bar, no National Officer, except the Publicity Secretary, was notified of same.

Currently, the NBA is run by the President and the Publicity Secretary, and they have decided to continue with the same trajectory forever and ever. But I am happy that our tenure must come to an end in less than a month; if they like, they can seek for extension of tenure. For me, I am already  an outgoing National Officer.

Let it be known by all seniors and juniors at the Bar that I, Clement Chukwuemeka, the 2nd Vice President of NBA, do not and will never support impunity and disrespect to any court in the land. I made it known to all, in my last memo to the President, that I am not in support of the ordeal of SPIDEL being cooked and served by the President. And I am aware that other National Officers are not in support, too.

With all humility, I would like all lawyers to read the memo which is already online to appreciate my stand on all these issues.

NBA was given to a wrong hand indeed!

It is no longer news that the NBA President has been running our Association all by himself along with probably a few favourites on the Executive Committee.

The supposed National Executive Committee was only formally informed of the Court Suspended SPIDEL Conference yesterday on the National Officers platform by copy and paste method, courtesy of the duo of the Publicity Secretary and his Assistant and we (the other National Officers, I guess) were “invited” to join “virtually” as it was with the case of the NBA-SARC and NBA-NHI seminars this Tuesday and Wednesday. We equally saw the notice of the NBA-NHI event as pasted that same Wednesday morning on our National Officers Platform, and even when I queried the belated notice of the never before heard or discussed events, and followed up same with a notice of the Court Order, my query and caution was as usual met with deafening silence.

To answer your question straight, the NBA National Officers never met or decided to have any SPIDEL Conference yesterday. So please count me out of the shameful illegality that went down yesterday in our collective name. I took the pain of posting this same information of a subsisting order against the contemplated SPIDEL Conference after the Assistant Publicity Secretary’s invite was shared on our Official EXCO platform by his Boss and my intervention yet stands ignored. You can say that the SPIDEL Conference happened with the say-so of our dearly beloved President and  I am sure he has a solid reason for authorizing its occurrence even in the face of an order of Court; but feel free to simply overlook my harmless words Sir, seeing as I am neither the face or mighty voice of the Bar. I think though that we cannot keep changing the goalpost of our norms any time we like and just because we can, by a given privilege, do so. We also pride ourselves as Ministers in the temple of law and justice and now’s the time to demonstrate our mettle of servitude and let the Law take its rightful course ASAP. Selah!.

I have not been served any Court Order from the Delta State High Court barring the holding of the NBA SPIDEL conference and I have not sighted any. I only read on some blogs that an Order was obtained. Also, the subsistence of such an order and the propriety of proceeding with the NBA-SPIDEL Conference in defiance to the said Order has never been a subject of any deliberation at the National Executive Committee level. I am a proud member of SPIDEL but I am not an Executive of the Session. I cannot comment on this matter any further due to the foregoing. The Executives of the Session probably are in the best position to explain.

I must dissociate myself from the content of this morning’s email. It was already scheduled to be sent before the news of the Court Order. I was not privy to the planning of the SPIDEL Conference nor was I served with the Court Order directing it not to hold. The email was scheduled in accordance with instructions as demanded by my constitutional roles. However, I abstained from attending the SPIDEL conference on personal convictions, believing it is our responsibility as members of the NBA to uphold the sanctity of the courts regardless of circumstances.

TOBENNA EROJIKWE, NBA-ICLE TO TRAIN NORTHERN LAWYERS ON MINING LAW

TOBENNA EROJIKWE LED NBA-ICLE TO TRAIN LAWYERS IN NORTHERN NIGERIA ON MINING LAW AND PRACTICE

The Nigerian Bar Association Institute of Continuing Legal Education (NBA-ICLE), under the leadership of Tobenna Erojikwe, has announced that it will be providing free training on mining law and practice for lawyers practicing in and around Kaduna State and Northern Nigeria as a whole.

The training, which aims to equip participating lawyers with the necessary knowledge and practical skills to effectively advise on and handle mining and mining law matters, is scheduled to take place as part of the events marking Kaduna Bar Law Week, which commences on June 21, 2024. The mining law training in particular will take place at 10 a.m. on Tuesday, June 25, 2024, at the Sir Ahmadu Bello Memorial Foundation Hall, Race, Kaduna.

According to Tobenna Erojikwe, “The rationale for this training is that we have seen a significant upsurge in commercial mining activities around Northern Nigeria, and the companies that undertake these activities require lawyers who understand the industry to advise them, but the capacity to deliver is oftentimes lacking, thus forcing the clients to seek legal advice elsewhere, including outside Nigeria.”

He continued, “Our objective at the NBA-ICLE is to democratise knowledge as much as possible, deepen legal capacity across various subject areas, and enable lawyers to venture into new fields of practice so as to earn more from their practice. Litigation alone, which most lawyers are engaged in, would not do it. It is for this reason that we are targeting different zones across the country and taking trainings that are relevant to their respective jurisdictions directly to their doorsteps.”

“We believe that by providing this mining law training, we are not only equipping lawyers in the region with the necessary skills to tap into the opportunities presented by the mining industry, but we are also contributing to the overall economic development of Northern Nigeria,” Erojikwe added.

The training, which is being organised in partnership with the leadership of the Kaduna Branch of the NBA, will feature a distinguished panel of highly experienced and knowledgeable experts in the mining space. “We have assembled a team of seasoned professionals who have a deep understanding of the legal and regulatory framework governing the mining sector in Nigeria,” Erojikwe stated. “Participants can expect to receive practical insights and guidance that will position them to provide top-notch legal services to clients in this crucial industry.”

Erojikwe emphasised that the NBA-ICLE remains committed to its mission of continuous legal education and capacity building for lawyers across Nigeria. “This mining law training is just one of many initiatives we have planned for the year,” he said. “We are constantly seeking opportunities to collaborate with various stakeholders, including NBA branches, to deliver high-quality training programmes that are tailored to the specific needs of lawyers in different regions of the country.

LAGOS POLICE CHIEF LAUNCHES PDSS ADVISORY COMMITTEE

CP Lagos Inaugurates the Lagos State Police Duty Solicitors Scheme (PDSS) Advisory Committee

The Lagos State Commissioner of Police in conjunction with the Legal Aid Council with support from the RoLAC 2 program and Duty Solicitors Network (DSN) on the 31st January, 2024 inaugurated the Police Duty Solicitors Scheme Advisory Committee in Lagos State.

The State Coordinator, Legal Aid Council, Mrs. Iyabo Akingbade said PDSS is an intervention conceptualized to protect the rights of suspects and detainees through the provision of early legal advice and representation at the police stations. This intervention decongests our courts and correctional facilities.

The Scheme has the effect of improving the image of the Police, improves the effectiveness of legal aid service delivery and encourages the respect for human rights.

Mrs. Akingbade said that the PDSS Advisory Committee’s Mandates are to: review, advice and resolve any issue affecting the effective implementation of the scheme in the State; Compile annual report to be submitted to the IGP; engage in advocacy and training for both the Police and the Duty Solicitors, and prepare regulations to guide it’s operational activities. She said though members of the Committee renders free service, they should see their duties as a service to the nation and to humanity and therefore be committed.

The police commissioner, Mr. Adegoke Fayoade while inaugurating the Committee, pledged his continued support and promised that the police will continue to respect and protect the rights of all citizens in accordance with the law and due process.

The Chief Judge of Lagos State was represented by the Deputy Chief Registrar, Admin who delivered his lordship’s goodwill message and commended the CP Lagos for formalizing PDSS within the State.

The State Coordinator of the National Human Rights Commission also commended the police commissioner for inaugurating the Committee and promised to continue in their resolve to protect the rights of all citizens.

NBA Lagos and Ikorodu branches also took turns to commend the police commissioner on the epoch-making event.

The State Program Director of the RoLAC 2 program, Mrs. Ajibola Ijimakinwa promised that RoLAC 2 will continue to support the committee for better access to justice and justice delivery in the State.

NBA 2023 CPC CREATES HISTORY WITH ITS FIRST-EVER LIVE SPORTS FIXTURES DRAWS EVENT

In an epic stride towards integrating sporting events into the Annual General Conference of the NBA, history was made today with the first-ever Sports Fixtures Draws for this year’s AGC. The event took place at the NBA National Secretariat in Abuja, with AUTA NYADA skillfully anchoring this phenomenal and historic occasion.

Spectators were captivated by the remarkable composure and welcoming address of the Chairman of the TCCP, Mazi Afam Osigiwe SAN, as he officially declared the draws open.

This hybrid event kept lawyers from across the country engaged for over two hours as they eagerly witnessed the fixtures draw. A significant highlight of this year’s sporting event is the inclusion of Lawyers living with disabilities, who will be participating in the table tennis event for the very first time.

COURT AWARDS N127 MILLION AGAINST EMERALD ENERGY

The National Industrial Court has awarded N127 million against Emerald Energy Resources Limited for breach of contract of employment with its former Consultant, Mr. Emeka Igweze.

In a judgment obtained by CITY LAWYER, the court granted all three reliefs sought by the former employee as argued by his lawyer, Chief Emeka Okwuosa of Messrs The Chancery Associates.

The court held that the defendant-company had not presented any evidence to disprove the facts placed before the court by the plaintiff, adding that “in the absence of any proof that said emails are not original, absence of contrary proof that the calculations in the said documents were incorrect and an admittance of same by Defendants (sic) witness, I have no recourse but to hold that the Defendant is indebted to the Claimant in the sum of N127,066,872.90 (One hundred and twenty seven million, sixty-six thousand, eight hundred and seventy-two Naira, ninety kobo) being his accrued salary arrears and benefits due to him at retirement.”

Justice Gwandu held that “Based on the foregoing, I hereby hold that the Claimant’s reliefs 1-3 succeed and are hereby granted accordingly (without the 21 %).”

The claimant had brought the claim seeking “A declaration that the claimant is entitled to his full terminal benefits in the sum of N127,066,872.90 (One hundred and twenty seven million, sixty-six thousand, eight hundred and seventy-two Naira, ninety kobo) upon his voluntary disengagement/resignation from the defendant company effective from 8th July, 2018, having worked for the defendant company from 3rd January, 2005 to 8th July, 2018 (an interrupted period spanning nearly 15 years pursuant to the defendant’s belated notice of computation of the claimant’s terminal benefits dated 15th November 2018 ….”

The claimant also sought “An order directing and compelling the defendant to pay the claimant the total cumulative sum of N127,066,872.90 (One hundred and twenty seven million, sixty-six thousand, eight hundred and seventy-two Naira, ninety kobo) representing his full terminal benefits upon his voluntary disengagement/resignation from the defendant company from 8th July, 2018 with interest at the rate of 21% per annum until the entire judgement is liquidated.”

SAFIYA BALARABE, NBA WOMEN FORUM TREASURER, HAILS MUSLIMS ON EID

The Nigerian Bar Association (NBA) Women Forum Treasurer, Safiya Balarabe has urged Muslims to “hold fast” to the tenets of the Ramadan month.

Said Balarabe: “My fellow Muslim brethren, As-salaam alaikum.

“We are witnessing yet another celebration of our Islam faith, having undergone a rigorous 30-day period of communion with Almighty Allah, wherein we fasted and prayed in deep retrospect of our lives.

“Today as we celebrate the breaking of the fast, thanking Almighty Allah for sustaining us throughout the period, we should by every means hold fast the core tenets of the Ramadan period as entrenched in the teachings of the Holy Quran and championed by the Holy Prophet Muhammad (PBUH). This is necessary especially as our dear nation is faced with myriads of social, moral and economic problems. We as Muslims must indeed be the shining light and herald a positive turnaround for our dear nation.

SENATORS, NBA, NGIGE, FALANA DISAGREE ON NEW LAW SCHOOL CAMPUSES

The Council for Legal Education, Nigeria Bar Association (NBA), Body of Benchers and some Senators have rejected a proposal by the Senate to create additional six Nigerian Law School campuses in the country.

They made their views known during a public hearing on a bill that seeks to establish one campus of the school in each geopolitical zone of the country organised by the Senate Committee on Judiciary, Human Rights and Legal Matters, in Abuja.

The Bill titled: “Legal Education (Consolidated etc, Amendment) Bill 2021,” was sponsored by Senator Smart Adeyemi, representing Kogi West.

The Senators that opposed the Bill were Ike Ekweremadu (Enugu West) and Seriake Dickson (Bayelsa West).

However, Senators that supported the Bill include Smart Adeyemi, Abiodun Olujimi (Ekiti South) and Kashim Shettima (Borno Central).

They argued that the establishment of the proposed six law schools will greatly enhance access to legal education in the country.

While Ekweremadu warned against any attempt to politicise the establishment of Law School campuses in Nigeria, Dickson urged his colleagues to tread cautiously.

Ekweremadu said: “The establishment of new campuses or Law Schools should be left at the discretion of the Council for Legal Education that is empowered by the Act that established it in 1962”.

On his part, NBA President Olumide Akpata (SAN) said the move was unnecessary as the existing six campuses of the school were grossly underfunded before the intervention of the Rivers State Government that built a well-equipped campus in Port Harcourt.

“With required infrastructure, the existing law schools across the country are enough to accommodate thousands of law students graduating from the various universities.

The Chairman of the Council for Legal Education, Emeka Ngige SAN, said the council is 100 per cent opposed to the move to create the six additional law schools.

Ngige said the position of the Council was informed by the deplorable condition of most of the existing ones due to gross underfunding.

“For instance, the deplorable condition in which students at the Yenagoa law campus are studying is worse than what prisoners in Ikoyi Prison are experiencing,” Ngige said.

He told the lawmakers that they will shed tears if they visit some of the existing campuses and see the deplorable conditions in which students and lecturers are living.

“The move by the Senate through this bill is more or less subtle usurpation of the functions of the Council for Legal Education.

“Any need for establishment of a new law school campus, is by law, to be routed through the Council for Legal Education as exemplified by the Rivers Model,” he stressed.

But activist-lawyer Femi Falana, SAN, supported the establishment of additional six law school campuses in all the geopolitical zones.

THE NATION reports Falana as saying: “It is important to clarify certain facts: the Council for Legal Education Act, was enacted in 1962 for the creation of one law school.

“Nowhere in the Act was it provided that we are going to have a multi-campus institution; it is important for our colleagues to realise that in 1999, we had six batches of students who had no place to go, they contacted me and I had to go to court.

“The law building of the law school in Lagos had already been sold to a businessman who wanted to turn it into a hotel when the school moved to Abuja.

“It was only one campus not until I went to court and we got an injunction restraining the government from selling the law school in Lagos.”
