LAWYER ASKS COURT TO SACK EMEFIELE AS CBN GOVERNOR

An Abuja based senior lawyer, Mr. Tochukwu Ohazuruike has urged the Federal High Court to order Central Bank of Nigeria (CBN) Governor, Mr. Godwin Emefiele to resign.

In an Originating Summons brought by their Lead Counsel, Chief Chukwudi Oli of Oli & Partners pursuant to Sections 2, 8(4-5), 9 &11(2)(C) of the Central Bank of Nigeria Act, 2007; Section 84(12) of the Electoral Act, 2022; Section 6(6) of the 1999 Constitution of the Federal Republic of Nigeria (as amended), and under the inherent jurisdiction of the court, Ohazuruike, who is suing alongside Mr. Alieze Sunday Ekpa as plaintiffs, is praying for “AN ORDER mandating the 1st Defendant to cease holding office as the Governor of Central Bank of Nigeria by virtue of his acts of serious misconduct in filing Suit No. FHC/ABJ/CS/ 610 /2022 – GODWIN EMEFIELE VS INEC & AGF seeking interpretation of Section 84(12) of the Electoral Act, 2022, amidst other political participations and/or interests etc, while still serving as Governor of the Central Bank of Nigeria (CBN) as against the object/purpose of the 2nd Defendant and the minimum standard of duties imposed on him by virtue of Sections 2 and 9 respectively of the Central Bank of Nigeria Act, 2007 and in compliance with Section 11(2)(c) of the Central Bank of Nigeria Act, 2007.”

The defendants are Mr. Godwin Emefiele, Central Bank of Nigeria and Attorney General of the Federation.

The plaintiffs are seeking “AN ORDER directing the 2nd Defendant to cease recognising the 1st Defendant as Governor of Central Bank of Nigeria by virtue of his acts of serious misconduct in filing Suit No. FHC/ABJ/CS/ 610 /2022 – GODWIN EMEFIELE VS INEC & AGF seeking interpretation of Section 84(12) of the Electoral Act, 2022, amidst other political participations and/or interests etc, while still serving as Governor of Central Bank of Nigeria (CBN) as against the object/purpose of the 2nd Defendant and the minimum standard of duties imposed on him by virtue of Sections 2 and 9 respectively of the Central Bank of Nigeria Act, 2007 and in compliance with Section 11(2)(c) of the Central Bank of Nigeria Act, 2007,” and

“AN ORDER directing the 3rd Defendant to take all necessary steps in ensuring compliance that the 1st Defendant cease to be recognised by the Government of the Federal Republic of Nigeria as Governor of Central Bank of Nigeria by virtue of his acts of serious misconduct in filing Suit No. FHC/ABJ/CS/ 610 /2022 – GODWIN EMEFIELE VS INEC & AGF seeking interpretation of Section 84(12) of the Electoral Act, 2022, amidst other political participations and/or interests etc, while still serving as Governor of the Central Bank of Nigeria (CBN) as against the object/purpose of the 2nd Defendant and the minimum standard of duties imposed on him by virtue of Sections 2 and 9 respectively of the Central Bank of Nigeria Act, 2007 and in compliance with Section 11(2)(c) of the Central Bank of Nigeria Act, 2007.”

They are also asking for “AN ORDER OF PERPETUAL INJUNCTION against the 1st Defendant retraining him from further parading himself as Governor of Central Bank of Nigeria by virtue of his acts of serious misconduct in filing Suit No. FHC/ABJ/CS/ 610 /2022 – GODWIN EMEFIELE VS INEC & AGF seeking interpretation of Section 84(12) of the Electoral Act, 2022, amidst other political participations and/or interests etc, while still serving as Governor of the Central Bank of Nigeria (CBN) as against the object/purpose of the 2nd Defendant and the minimum standard of duties imposed on him by virtue of Sections 2 and 9 respectively of the Central Bank of Nigeria Act, 2007 and in compliance with Section 11(2)(c) of the Central Bank of Nigeria Act, 2007.

“AN ORDER OF PERPETUAL INJUNCTION against the 2nd Defendant, its Board of Directors, agents, servants, privies etc from recognising and/or allowing the 1st Defendant to continue to parade himself as Governor of Central Bank of Nigeria by virtue of his acts of serious misconduct in filing Suit No. FHC/ABJ/CS/ 610 /2022 – GODWIN EMEFIELE VS INEC & AGF seeking interpretation of Section 84(12) of the Electoral Act, 2022, amidst other political participations and/or interests etc, while still serving as Governor of Central Bank of Nigeria (CBN) as against the object/purpose of the 2nd Defendant and the minimum standard of duties imposed on him by virtue of Sections 2 and 9 respectively of the Central Bank of Nigeria Act, 2007 and in compliance with Section 11(2)(c) of the Central Bank of Nigeria Act, 2007.

“AN ORDER OF PERPETUAL INJUNCTION against the 3rd Defendant, his principal, appointor, agents, servants, privies etc from recognising or allowing the 1st Defendant to continue to parade himself as Governor of Central Bank of Nigeria by virtue of his acts of serious misconduct in filing Suit No. FHC/ABJ/CS/ 610 /2022 – GODWIN EMEFIELE VS INEC & AGF seeking interpretation of Section 84(12) of the Electoral Act, 2022, amidst other political participations and/or interests etc, while still serving as Governor of Central Bank of Nigeria (CBN) as against the object/purpose of the 2nd Defendant and the minimum standard of duties imposed on him by virtue of Sections 2 and 9 respectively of the Central Bank of Nigeria Act, 2007 and in compliance with Section 11(2)(c) of the Central Bank of Nigeria Act, 2007.

“AN ORDER awarding the sum of Ten Million Naira Only (N10,000,000.00) as cost of this action against the 1st, 2nd and 3rd Defendants in favour of the Plaintiff in this suit,” and

“AN ORDER awarding a 10% post judgment interest on the judgement sum of this suit against the 1st, 2nd and 3rd Defendants from the date of judgment till final liquidation.”

Supported by a 34-paragraph affidavit sworn by the senior lawyer, the plaintiffs are seeking “A DECLARATION that by the express provisions of Sections 2 and 8(4-5) of the Central Bank of Nigeria Act, 2007, the object, purpose and business of the Central Bank of Nigeria (2nd Defendant) has nothing to do with the provision of Section 84(12) of the Electoral Act, 2022 or engaging in any direct or indirect political activities in Nigeria vis-à-vis the duties and functions of the 1st Defendant as Governor of Central Bank of Nigeria.”

They are also asking for “A DECLARATION that the 1st Defendant’s suit filed in this Honourable Court on 5th May, 2022 in Suit No. FHC/ABJ/CS/ 610 /2022 – GODWIN EMEFIELE VS INEC & AGF seeking the interpretation of the provision of Section 84(12) of the Electoral Act, 2022 etc. while still serving as Governor of the Central Bank of Nigeria (CBN) does amount to engaging in activities contrary to the minimum standard of duties imposed on the 1st Defendant pursuant to the express provision of Section 9 of the Central Bank of Nigeria Act, 2007.

“A DECLARATION that the 1st Defendant’s act in filing Suit No. FHC/ABJ/CS/ 610 /2022 – GODWIN EMEFIELE VS INEC & AGF seeking interpretation of the provision of Section 84(12) of the Electoral Act, 2022, which preclude serving political appointees from been delegates or candidates in political parties’ congresses and/or conventions, amidst other political participations and/or interests etc, has exposed the 1st Defendant as partisan and interested in direct political activities in Nigeria, while still serving as Governor of Central Bank of Nigeria (CBN) contrary to the the express provisions of Sections 2, 8(4-5) and 9 of the Central Bank of Nigeria Act, 2007.

“A DECLARATION that the 1st Defendant is liable to acts of serious misconduct contrary to Section 11(2)(c) of the Central Bank of Nigeria Act, 2007, by virtue of his act of filing Suit No. FHC/ABJ/CS/ 610 /2022 – GODWIN EMEFIELE VS INEC & AGF seeking interpretation of Section 84(12) of the Electoral Act, 2022, amidst other political participations and/or interests etc, while still serving as Governor of Central Bank of Nigeria (CBN) as against the object/purpose of the 2nd Defendant and the minimum standard of duties imposed on him by virtue of Sections 2 and 9 respectively of the Central Bank of Nigeria Act, 2007,” and

“A DECLARATION that the 1st Defendant is liable to cease holding office as the Governor of Central Bank of Nigeria by the serious acts of misconduct constituted in his filing of Suit No. FHC/ABJ/CS/ 610 /2022 – GODWIN EMEFIELE VS INEC & AGF seeking interpretation of Section 84(12) of the Electoral Act, 2022, amidst other political participations and/or interests etc, while still serving as Governor of Central Bank of Nigeria (CBN) as stipulated under Section 11(2)(c) of the Central Bank of Nigeria Act, 2007.”

ADEKOYA RETIRES FROM AELEX, NGIGE HAILS LEGAL ICON

Pre-eminent senior lawyer and Bar Leader, Mrs. Funke Adekoya SAN is set to retire from AELEX, a leading Tier-1 law firm she co-founded with four partners almost 18 years ago. This is coming against the backdrop of her attainment of the age of 70 years.

Perhaps pre-empting her retirement, Adekoya wrote in July 2020 on Twitter: “Time flies when you’re having fun! Glad to have been a part of this dream. Looking forward (with some trepidation I must confess) to the next step in the strategy plan – retirement! Many more mountains to climb!! #Lawfirmmanagement. #Strategy. https://lnkd.in/eNhQybh.”

Meanwhile, the legal industry has been agog with effusive encomiums on the respected legal amazon and globally acclaimed arbitrator. Extolling the virtues of the former Nigerian Bar Association (NBA) First Vice President, the Chairman of the Council of Legal Education (CLE), Chief Emeka Ngige (SAN) described her as “a great Amazon at the Bar.”

According to Ngige, “I took interest in Mrs. Adekoya when she contested and was re-elected as the National Treasurer of NBA at the 1991 NBA Annual General Conference held at Owerri. Her Treasurer’s report shook the conference to its foundations. Since then Mrs. Adekoya has remained a beacon of conscience and integrity at the Bar.”

Not done with his lavish praise, Ngige said: “As the 1st Vice President under Chief Wole Olanipekun’s able leadership she proposed the introduction of Stamp and Seal by the NBA to check the activities of fake lawyers. She has also contributed immensely to the improvement in the standard of legal education when she served as a member of the Council of Legal Education. She did her utmost best to raise the Bar in the legal profession with the setting up of one of the best law firms in Africa.”

Concluding, the CLE Chairman and former NBA presidential candidate said: “As Madam Funke clocks 70 and retires from active legal practice, I join her numerous well wishers and brothers in wishing her a joyful birthday, many happier returns, sound health, greater heights and peace of mind! I am very proud to be associated with her.”

Adekoya is a founding Partner at the firm and heads the Dispute Resolution Practice Group. Appointed Notary Public in 1986 and elevated to the rank of Senior Advocate of Nigeria (SAN) in 2001, Adekoya has almost 50 years experience in Litigation and Arbitration. As a Litigator, she represents clients regularly before the Nigerian courts at all levels. She also provides expert opinions and has appeared as an expert witness on Nigerian law issues before the courts of England, United States and Turkey.

In the field of arbitration, she represents both local and transnational parties as counsel in domestic and international arbitration proceedings within Nigeria and abroad and has acted in numerous disputes as either party appointed Arbitrator, Sole Arbitrator or Presiding Arbitrator. She lectures regularly on arbitration law and procedure and has been approved by the Chartered Institute of Arbitrators as a Tutor at the Associate to Fellowship Course level.

A LLM graduate of the prestigious Harvard Law School, Boston, Massachusetts, Adekoya is regularly listed by leading global ranking entities as a go-to lawyer, especially in litigation and arbitration. She is ranked Band 1 (Dispute Resolution) by Chambers and Partners; Thought Leader (Arbitration) by Who’s Who Legal; “Most Outstanding Female Legal Practitioner” by Financial Standard Newspaper of the Year 2007, and “Most Outstanding Female Legal Practitioner” by Women Entrepreneurs African of the Year 2007 Network.

Reflecting on her service to the Sanctions Board of The World Bank Group, the board wrote that she “brought a wealth of knowledge and expertise to the Sanctions Board in the past years, ”adding that she “made deep contributions to the jurisprudence of the Sanctions Board and the World Bank Group’s anti-corruption agenda.”

Aside from being a former Chair of the NBA Section on Legal Practice (NBA-SLP), CITY LAWYER recalls that it was Adekoya – as Chair of an NBA Lagos Branch committee – who recommended litigation against the Central Bank of Nigeria (CBN) and Attorney General of the Federation when the Economic and Financial Crimes Commission (EFCC) sought to compel lawyers to make reports on their clients to the Special Control Unit against Money Laundering (SCUML). The recommendation was unanimously endorsed by NBA-NEC. Both the trial court and Court of Appeal gave judgement in favour of NBA. It is not clear whether any further appeal is pending on the matter.

Adekoya who is the President of International Lawyers for Africa (ILFA) is frequently appointed to arbitral tribunals, either as sole or party-appointed arbitrator conducting proceedings under the rules of the ICC, ICSID, UNCITRAL and LMAA. Arbitrations in which she has been involved range from disputes arising from gas sales agreements, oil rig supply contracts to joint ventures in construction and real estate.

Her recent appointments have been in disputes brought under the ambit of either a BIT or an investment agreement. She was most recently appointed by the State party as arbitrator in an investment dispute between the purchasers of a monopoly electricity producer and the State in one case and in another case, the dispute was between an investor alleging breach of a mining contract by a State and the subsequent cancellation of the investor’s mining licence. She also advises clients on award enforcement issues within Nigeria and leads the counsel team in arbitration-related litigation.

Adekoya is a Fellow and has achieved chartered arbitrator status at the Chartered Institute of Arbitrators, London and has served as the Chair of its Nigerian Branch. She was a founding Board Member of the Lagos Court of Arbitration (LCA) and a former member and a past Vice President of the Court of Arbitration of the International Chamber of Commerce (ICC) in Paris.

Her other memberships include the London Court of International Arbitration African Users Council and the Cairo Regional Centre for International Commercial Arbitration where she sits on the Board of Trustees. She is also a member and past Vice President of the Governing Board of the International Council for Commercial Arbitration, in addition to being a member of the African Users Council of the Singapore International Arbitration Centre. She is a member of the Arbitration Foundation of South Africa’s International Arbitration Rules Drafting Committee’s Advisory Board and the International Appointments Committee of the Scottish Arbitration Centre.

A Life Bencher, Adekoya is listed on various panels, including the ICSID Chairman’s Panel of Arbitrators; those of CIETAC, the Kigali International Arbitration Centre, the Lagos Regional Centre for International Commercial Arbitration and the Panel of Neutrals of both the Lagos Multi-Door Courthouse and the Nigerian Communications Commission (NCC).

She has been invited to conduct arbitration training courses in Accra, Ghana and Kigali, Rwanda and is a regular speaker on arbitration law and practice both within and outside Nigeria.

Adekoya holds both Nigerian and British nationality and in addition to her being called to the Nigerian bar, she is qualified as a Solicitor in England and Wales. The Nigerian Bar Association (NBA) President, Mr. Olumide Akpata has assured that the association will deploy both legislative advocacy and public interest litigation to secure the rights of women and children.

In a Press Statement he personally signed to mark this year’s International Women’s Day (IWD), Akpata said that “NBA will continue to play its role through focused legislative advocacy and, where necessary, public interest litigation with a view to achieving an egalitarian society that accommodates all and sundry, particularly women and girls.”

He decried the plight of women and girls as a “akin to a global pandemic,” adding that “All over the world, women are at the receiving end of policies, oftentimes conveniently anchored on culture and religion, which leave them short-changed. Also, in various theatres of conflict, women have continued to bear the heavier brunt of crises that are literally man-made. The recent events in Afghanistan and Ukraine are an eloquent albeit harrowing testament to this fact.”

Though he acknowledged “that we have in recent times recorded some measure of success in our efforts at fixing this anomaly,” he noted that “it is also true that there is still a lot of work to be done. In this regard, let me commend all women in civil society, the professions, academia and other segments of society who continue to sustain the tempo of this noble cause.”

STATEMENT OF THE NBA PRESIDENT OLUMIDE AKPATA ON THE OCCASION OF INTERNATIONAL WOMEN’S DAY 2022

Dear Colleagues,

On behalf of the Nigerian Bar Association (NBA), I join the global community in commemorating the International Women’s Day (IWD), 2022. The IWD is a day set aside by the United Nations to draw global attention to the plight of women and girls and to strive towards the attainment of an egalitarian society where circumstances of birth such as gender, will play no role in the socio-political relations of society.

The theme of this year’s IWD: Break The Bias, is very apt as it speaks to the need to dismantle the limiting barriers of patriarchy and other biases that have kept girls and women at the back seat of our national life. The recent events at the National Assembly, where syndicated Bills targeted at a more inclusive representation of women in politics and governance was opposed by a male dominated parliament, speaks volumes of the structural ramifications of this social menace.

With women and girls comprising almost half of our national population, ideas and policies that tend to limit their inclusion in our national life tantamounts to shooting ourselves in the foot, as a nation is only as good as the wealth of human resources it can leverage from its population irrespective of gender. Indeed, it is not for nothing that the framers of our Constitution have guarded against discrimination on grounds of gender, amongst other considerations, in Section 42(2) thereof. I daresay that this Section provides the moral and legal justifications for a gender balanced and inclusive society.

Whilst I have spoken to the plight of women and girls in the context of Nigeria, it is a fact of our existence that the situation we are confronted with is akin to a global pandemic. All over the world, women are at the receiving end of policies, oftentimes conveniently anchored on culture and religion, which leave them short-changed. Also, in various theatres of conflict, women have continued to bear the heavier brunt of crises that are literally man-made. The recent events in Afghanistan and Ukraine are an eloquent albeit harrowing testament to this fact.

Even as I acknowledge that we have in recent times recorded some measure of success in our efforts at fixing this anomaly, it is also true that there is still a lot of work to be done. In this regard, let me commend all women in civil society, the professions, academia and other segments of society who continue to sustain the tempo of this noble cause.

On our part, the NBA will continue to play its role through focused legislative advocacy and, where necessary, public interest litigation with a view to achieving an egalitarian society that accommodates all and sundry, particularly women and girls.

Finally, I congratulate all women and girls on this momentous occasion even as we continue in our struggle to dismantle the walls and prejudices of patriarchy and other biases that limit and short-change them.

RPC: ‘WE WILL SUE MALAMI IF BY NEXT WEEK ….,’ SAYS NBA

The Nigerian Bar Association Section on Legal Practice (NBA-SLP) has said that it would sue the Attorney-General and Minister of Justice, Mr. Abubakar Malami SAN if by next week he has not formally reversed the controversial amendment of the Rules of Professional Conduct for Legal Practitioners 2007.

This position was confirmed to CITY LAWYER by the Chairman of the section, Chief Ferdinand Orbih SAN who noted that its legal team is engaging Malami to resolve the impasse.

SLP’s immediate past Chairman, Mr. Oluseun Abimbola SAN also told CITY LAWYER that a lot of meetings were held during his tenure regarding the matter, adding that the new leadership is progressing the matter.

Orbih said that while Malami had denied authorship of the controversial RPC, SLP has demanded a formal retraction to be published in the federal gazette to stave off litigation on the matter.

His words: “The Attorney-General of the Federation was on television to disclaim the controversial Rules of Professional Conduct.

“However, we are aware that the RPC has been gazetted under his name. We have therefore informed the Honourable Attorney-General that a viva voce disclaimer of the RPC will not suffice in the circumstances.

“The NBA Legal Committee has decided to engage the AGF and afford him an opportunity to issue a proper disclaimer through a written instrument published in the gazette. We expect this to be done by next week.

“If at the end of the day this is not done, we will have no option than to carry out the mandate of the NBA to litigate the matter. Let me assure that this will not take long any more, as we have been on this matter for almost two years.”

CITY LAWYER had reported that Malami told a key justice sector stakeholder that the entire RPC saga was orchestrated by a director in his ministry, adding that a disciplinary panel had been set up to investigate the matter.

The NBA National Executive Committee had in a communiqué following its latest meeting in Abeokuta “expressed deep concern” at Malami’s disclaimer during the television interview, adding that “the statement of the AGF is rather curious considering that the purported amendment, which bears his signature, is contained in a Federal Gazzette which has been in circulation and in the public domain for over one year.”

The NBA Legal team is led by leading litigator, Mr. Sunday Ameh SAN. CITY LAWYER recalls that Ameh had mid last year written to the Inspector General of Police on behalf of Malami, urging the police chief to arrest SaharaReporters Publisher, Omoyele Sowore, over the newspaper’s reports exposing Malami’s alleged corruption-fuelled lifestyle.

FCTA APPOINTMENTS: LAWYER SUES BUHARI, CLAIMS BIAS

A human rights activist, Mr. Maxwell Opara has dragged President Muhammadu Buhari and the Minister of the Federal Capital Territory (FCT), Mallam Mohammed Bello before a Federal High Court in Abuja over an alleged violation of the Federal Character Act in the appointment of Permanent Secretaries, Executive Secretaries, Personal Aides, Directors and other staff of the Federal Capital Territory Administration (FCTA).

The suit marked FHC/ABJ/CS/1523/2021 has the FCT Minister, President of the Federal Republic of Nigeria, Attorney General of the Federation and the Federal Character Commission as defendants.

The plaintiff is seeking an order of the court directing the FCT Minister and other defendants to comply with the provisions of Sections 4(1)(a)(b) and 5 of the Federal Character (Establishment) Act in appointments in all cadres of posts in FCTA.

Opara, who formulated three issues for the determination of the court, also wants the court to declare that the Federal Character Commission (FCC) is empowered by law to formulate principles and guidelines for the application of the federal character principle of fairness and equitable distribution of all cadre of posts in the federal government of Nigeria and to ensure compliance to the said formula.

He also prayed the court to declare that the 1st to 3rd defendants are under obligation to comply with the provisions of Part 1, Section 1 to 9 and Part III, Section 4 and 5 of the guiding principle and formulae for distribution of all cadre of posts and in appointments into all cadre of posts into the Federal Capital Administration.

He prays for “A declaration that the recent appointment on. 23 of November, 2021 of Perm-Secs, executive secretaries and other staffers if FCTA by 1st to 3rd defendants clearly offends sections 4(1)(a)(b) and 5 of the Federal Character Commission (Establishment, etc) and provisions of Part 1, sections 1 to 9 and Part III, section 4 and 5 of the guiding principle and formulae for distribution of all cadre of posts made pursuant to section 4(1)(a) of the Federal Character Commission (Establishment, Etc) Act and accordingly the said appointments are void”.

In a 20-paragraph affidavit deposed by the plaintiff, he said recently, the FCT Minister in conjunction with other defendants appointed political, ministerial and other staff of FCTA against the Federal Character principle.

According to REFLECTION, Opara alleged that the appointments as done by the FCT Minister favoured people who are mostly from the northern part of the country.

No date has been fixed for the hearing of the suit which was filed on December 1, 2021.

SAN AWARDS: ‘PROF. TORIOLA OYEWO IS A CEREBRAL LAWYER,’ SAYS EX A-G

In this moving tribute, former Oyo State Attorney-General & Commissioner for Justice, Mr. Mutalubi Ojo Adebayo goes down memory lane and submits that the coveted rank of Senior Advocate of Nigeria (SAN) could not have been bestowed on a more endearing and deserving person than 91-year-old Professor (Chief) Toriola Ajagbe Oyewo 

In my early years at the Bar, precisely in 1995, I was doing my pupillage in the commercial law firm of Dele Akinmusuti & Co, then situated at 23, Mogaji Are Street, Off Ring Road , Ibadan, Oyo State of Nigeria.

A notable client of the law firm referred a brief to me and I was paid a very handsome professional fee which was then the equivalent of my 7 (seven) months salary . I put in my very best into the drafting of the certorari process that I filed before the High Court of Justice, Ibadan.

The person who referred the case and the client to me is a very wealthy client who had confided in me that the client was a very dear side-kick of his and that I must do all within my capacity to render useless and ineffectual the kangaroo customary court judgement obtained by her landlord to eject her from a coded property he got for the pretty damsel at Iyaganku GRA in Ibadan. The case financier also warned me that my Principal who is his friend must not know about the relationship between him and the beautiful client. That I so much understood because Mr. Dele Akinmusuti is a born-again Christian who will not tolerate such unholy escapade.

Faithfully, I kept that secret pact because the brief was very fat.

Professor Toriola Oyewo represented the party interested/respondent, the landlord in the case which was assigned to Hon. Justice John Olagoke Ige, of blessed memory. My Lord Ige was one of the finest Judges that had presided on the very rich and resourceful judiciary of Oyo State which bench is unarguably the best in the whole federation till date.

After we were granted leave to quash the judgement of the inferior court and the order of court together with the motion on notice was served on the landlord, the services of Professor Oyewo was retained to represent my Client’s adversary .

We were served with a counter-affidavit and we promptly responded by way of further affidavit.

On the 14th day that the matter was to be heard, Professor Oyewo applied to withdraw his counter-affidavit and same was struck out without any opposition by me. The court asked me to move my certiorari application , which I did and I also addressed the court extensively by citing several decided authorities in support of client’s case. That period was good years of oral advocacy because the present front-loading system of written addresses were not in use then.

“Besides being a cerebral and brilliant legal practitioner, he is an erudite teacher and a repository of political history, economics, localities, events and people. Professor Oyewo is also a first class Socialite who, till today, enjoys life to the fullest. The grace of God in his life is manifest in his good look and his good health. At 91 years of age, he still drives himself around till date. His memory of cases, history and anything under the sun is superb and second to none.”

When it got to the turn of Professor Oyewo, the learned Senior counsel informed the court, expectedly, that he was replying on points of law only. He attacked my case from the angle that the judgement of the inferior court could not be quashed by the high court on the ground of lack of jurisdiction upon which our case was not apparent on the face of the record of the customary court. The erudite Professor submitted further that the court could not take judicial notice that Iyaganku GRA is within the 10km radius of Mapo in the absence of expert evidence to that effect and that it is not a matter of assumption or conjecture by the court.

Mapo in Ibadan is accepted to be the centre of Ibadan and any property within its 10 kilometres radius is held to be within the urban area of Ibadan. Prof. Oyewo asked the Judge rhetorically if the court would allow me to turn My Lord into a land surveyor overnight. Furthermore, that I did not exhibit my Client’s rent receipt for the court to be satisfied and convinced that the rental value of the property was outside the jurisdiction of the customary court.
The court adjourned the matter for ruling after the addresses of both of us had been taken.

In a well considered ruling delivered by the court, my certiorari application was dismissed as the court agreed entirely with Professor Oyewo. I became devastated the following day when my client and her financier came to meet me in the chambers that the lady had been ejected from the premises by the Bailiffs of the Oke-Are Grade C Customary Court, thus bringing to an abrupt end my fat retainership.

I took the aftermath of the case too personal because I refused to greet or acknowledge the greetings of the eminent Senior counsel whenever we met at any of the numerous clubs that he also frequented. I was always, politely, turning down Prof’s offer, politely though, to pay for my meals and or drinks whenever we met. He was fond of telling me jokingly that my behaviour was strange to both the traditions at the Bar and Ibadanland, yet I didn’t yield my ground due to my youthful exuberance at that time.

There was a thaw in our relationship in 2001 when some colleagues and myself met the learned Professor at a popular restaurant in Basorun, Ibadan. My friends had accompanied me there to woo a lady who had became a nut too hard to crack for me. The lady snubbed us that evening and insulted us to the hearing of Chief. I was more than surprised when Prof beckoned to the lady to come over and told her that she cannot get a better suitor anywhere in Nigeria than this promising and brilliant colleague of his (he referred to me as his colleague). As if we were all dreaming, the lady melted immediately and agreed to follow us to a night club that day. Lo and behold, she did. What followed thereafter is best left for my readers’ imagination.

That singular act endeared me to Professor Oyewo and we became very close thereafter to the extent that he gave me complimentary copies of the numerous books that he wrote and he still does that till date.

Besides being a cerebral and brilliant legal practitioner, he is an erudite teacher and a repository of political history , economics, localities, events and people . Professor Oyewo is also a first class Socialite who, till today, enjoys life to the fullest. The grace of God in his life is manifest in his good look and his good health. At 91 years of age, he still drives himself arround till date. His memory of cases, history and anything under the sun is superb and second to none.

My joy knew no bound when I was asked by Senator Abiola Ajimobi of blessed memory, the former Governor of Oyo to represent him and the state at Prof’s 80th birthday on which occasion that I narrated the story of the case highlighted above for the first time. The learned Professor, his bosom friend, High Chief Akinnola (now of blessed memory), the Lisa of Ondo Kingdom and all the guests at the event rolled in laughter on hearing the account.

Professor has since become a father-figure to me, a mentor, a role model and a great teacher. Chief M.K. Amusan-Awolesu, a big brother to me and one of the bosom friends of Senator Abiola Ajimobi later informed me that Professor Oyewo had been his mentor since his childhood and that no week will pass without Prof personally checking on him and his family till date.

The news of Professor Toriola Oyewo being one of the recipients of the coveted rank of Senior Advocate of Nigeria at advanced age of 91 along with my Partner, Kazeem Adekunle Gbadamosi Esq. who, perhaps, was a toddler when Prof was called to the Nigeria Bar, did not come as a surprise to me because Ebenezer Obey had long predicted in one of his evergreen musical albums in the 1970s, https://youtu.be/GOUOJeL4VGI where he sang of Chief that “Eye adaba wa gbe ire wa ko wa o”.

The award to Papa at 91 is the Privileges Committee of giving Prof his due , meritorious and well-deserved honour (ire and eye) in his ripe old age while still alive.

May the good Lord continue to preserve a legal encyclopedia, a quintessential gentleman and a Teacher of Teachers, Professor Toriola Ajagbe Oyewo of the Erunmu fame and a devoted Seventh Day Adventist for us all for many more purposeful years.

Even at 91 years, it is still appropriate for me to greet you Good morning, Professor Toriola Ajagbe Oyewo, SAN-Designate.
