MAIKYAU TO BE SWORN IN, AS GADZAMA BOWS OUT

Chief Joe-Kyari Gadzama SAN has again vowed not to appeal the recently concluded Nigerian Bar Association presidential election notwithstanding the resignation en masse of members of the NBA National Election Appeal Committee (NBA-NEAC).

This clears the way for senior lawyer, Mr. Yakubu Chonoko Maikyau SAN to be sworn in as the next NBA President, having been declared winner of the July 16, 2022 election by the Electoral Committee of the NBA (ECNBA).

In a press release made available to CITY LAWYER, Chief Chukwudi Oli, a close aide of the ranking Bar Leader, said that “The NBA-NEAC instant resignation is now of no moment and whatever bias this belated attempt aims at curing is long spent and overtaken by event since it is well outside 10 days from the announcement of the election results by the ECNBA within which petitions are to be filed before it.”

Signed by Oli, Director-General of J-K CampaignTeam, the statement noted that “the NBA-NEAC, as with all Standing Committees, is constituted by the President of the NBA, subject to ratification by the National Executive Council. Therefore, a reconstituted NBA-NEAC will no doubt still require the ratification of NEC to lawfully function.”

According to Oli, “If anything, the instant resignation buttresses premeditated and predetermined objectives; for how best can it be explained that the instant resignation is coming well outside of the time limit the NBA-NEAC had itself stipulated in para 3.2 of its “GUIDELINES FOR HEARING AND DETERMINING COMPLAINT(S) FROM CANDIDATES IN THE 2022 NBA NATIONAL ELECTIONS.””

Titled “RE: RESIGNATION OF MEMBERS OF THE NBA NATIONAL ELECTIONS APPEAL COMMITTEE,” the Campaign Team chided the NBA-NEAC members for claiming that the earlier letter to NBA President, Mr. Olumide Akpata was penned by Gadzama, saying that “in the present instance and for clarity, the referenced letter of July 26, 2022, was even neither signed nor circulated by Chief Joe-Kyari Gadzama SAN on social media as alleged by the NBA-NEAC.

It also berated the NBA-NEAC members for the tone of their joint resignation letter, saying that “as legal practitioners and conscionable persons, we understand the virtue of being temperate in language and making variable assertions; and therefore make bold to say that expressing reservations about a process, especially in view of the manifest likelihood of bias, cannot and should not be misread as ‘unfortunate, and undeserving’ or ‘most uncharitable’, as was erroneously averred by the NBA-NEAC.”

The Campaign Team stated that “Considering that the notice of the constitution of the National Elections Appeal Committee for the NBA National Election was released on May 21, 2022, every member of the NBA-NEAC had ample notice to recuse themselves, especially where such member(s) has/have a preference as to candidate(s) in the national elections and have manifestly or tacitly, either by their actions and/or inactions, exhibited such.

“We are ultimately charitable to the truth and our convictions for a better bar. It is in itself most uncharitable to refer to such conviction as uncharitable.”

RE: RESIGNATION OF MEMBERS OF THE NBA NATIONAL ELECTIONS APPEAL COMMITTEE

The letter dated July 30, 2022, from the NBA-National Elections Appeal Committee (NBA- NEAC) to the President of the NBA refers.

In the aforementioned letter, all 9 members of the NBA- NEAC have resigned their membership due to a letter of July 26, 2022, addressed to the NBA President, which the Committee has alleged was purportedly written and circulated on social media by Chief J-K Gadzama, SAN.

The NBA-NEAC also declared that the alleged “mischaracterization” ascribed to some members of the Committee is most “unfortunate, and undeserving”. It further alleged that the comments made by the learned silk in what it called the “globally circulated letter” was “most uncharitable” and thus that its “mass resignation” was due to their “indignation and principled opposition to the uncharitable comments and accusations of Chief J-K Gadzama, SAN”.

To put a method to this, we will be chronological:

1) Firstly, it is well within anyone’s rights to circulate whatever publication of substance they deem fit, in the present instance and for clarity, the referenced letter of July 26, 2022, was even neither signed nor circulated by Chief Joe-Kyari Gadzama SAN on social media as alleged by the NBA-NEAC. The referenced letter of July 26, 2022, was ably signed by Chief C.P Oli, the Director General, J-K Gadzama Campaign Team, and co-signed by Mr. O.E Oluwabiyi, the Admin Officer of the J-K Gadzama Campaign Team, and further addressed to the President of the NBA, with the NBA-NEAC in copy. Words and actions should not be arrogated without recourse to factual stream of events. Posterity is always kind to the truthful.

2) Secondly, as legal practitioners and conscionable persons, we understand the virtue of being temperate in language and making variable assertions; and therefore make bold to say that expressing reservations about a process, especially in view of the manifest likelihood of bias, cannot and should not be misread as “unfortunate, and undeserving” or “most uncharitable”, as was erroneously averred by the NBA-NEAC. We are ultimately charitable to the truth and our convictions for a better bar. It is in itself most uncharitable to refer to such conviction as uncharitable.

3) Considering that the notice of the constitution of the National Elections Appeal Committee for the NBA National Election was released on May 21, 2022, every member of the NBA-NEAC had ample notice to recuse themselves, especially where such member(s) has/have a preference as to candidate(s) in the national elections and have manifestly or tacitly, either by their actions and/or inactions, exhibited such.

4) The NBA-NEAC instant resignation is now of no moment and whatever bias this belated attempt aims at curing is long spent and overtaken by event since it is well outside 10 days from the announcement of the election results by the ECNBA within which petitions are to be filed before it. If anything, the instant resignation buttresses premeditated and predetermined objectives; for how best can it be explained that the instant resignation is coming well outside of the time limit the NBA-NEAC had itself stipulated in para 3.2 of its “GUIDELINES FOR HEARING AND DETERMINING COMPLAINT(S) FROM CANDIDATES IN THE 2022 NBA NATIONAL ELECTIONS.”

5) Furthermore, under S.14 (1) (l) of the NBA Constitution 2015 (as Amended in 2021), the NBA National Election Appeal Committee is listed as a Standing Committee. By S.14 (3) (i) of the said Constitution, the NBA-NEAC, as with all Standing Committees, is constituted by the President of the NBA, subject to ratification by the National Executive Council. Therefore, a reconstituted NBA-NEAC will no doubt still require the ratification of NEC to lawfully function.

6) It is against these serious and all-important backgrounds that we restate our commitment to a better bar is as unwavering as the rock of Gibraltar. It is a job that must be done and rightly so.

EXCLUSIVE: NBA ELECTION APPEAL C’TE MEMBERS RESIGN EN MASSE, BLAST GADZAMA

All members of the Nigerian Bar Association Election Appeals Committee (NBA-NEAC) have resigned their appointment, citing a petition “circulated on social media by Chief J. K. Gadzama SAN, one of the presidential candidates in the recently-concluded National Elections of the Nigerian Bar Association.”

In a letter obtained by CITY LAWYER and dated 30th July, 2022, the erstwhile Appeals Committee members wrote: “Regrettably, we the members of the NBA-NEAC have taken the collective decision to resign our appointment in order to pave the way for you to constitute a new National Election Appeals Committee in which Chief J. K. Gadzama SAN would have enough confidence to ventilate his grievances against the conduct of the recently-concluded elections.”

Addressed to NBA President, Mr. Olumide Akpata, the signatories are Mrs. Funmi Roberts (Chairperson), Huwaila Mohammed Ibrahim, Dr. Rosemary Chinelo Chikwendu, Hubert Nwoye, Austin Ajineh (Secretary), Stephen Obajaja, Okey Ohagba, Grace Selre Mamswa and Mathew Egbadon.

The former NBA-NEAC members described as “most unfortunate and underserving (sic)” the “mischaracterization ascribed to some members of the Committee.”

They stated that many NBA-NEAC members refrained from voting during the election “all in an effort to ensure that the process would not in any way be tainted by accusation of bias,” adding however that Gadzama “has decided to take the innocuous act of liking a post that celebrates Children’s Day globally on 27th May, 2022, by Mrs Funmi Roberts, and ascribed bias into it.”

Perhaps admitting the culpability of one of its members, the signatories stated that “In the case of Ms Huwaila Muhammed Ibrahim, if Chief J. K. Gadzama SAN had filed an appeal before us and objected to her participating whilst same is being considered, she would have had to recuse herself,” adding that “this accords with best international practice.”

The NBA-NEAC members also stated that their findings revealed that Mr. Okey Ohagba “was never at any time the co-ordinator of the opposing aspirant (sic),” adding that “had Chief J. K. Gadzama SAN filed an appeal before the Committee and objected to his participation, he would also have recused himself.”

Saying that the “comments by learned silk in the globally circulated letter is therefore, most uncharitable,” the former Appeals Committee members however stated that “we hold the very strong view that the Nigerian Bar Association is greater than the sum total of all the members of the Committee, and it is the duty of all members of our Association to strive at all times to shield her from anything that would taint, not only her image, but also that of any process put in place by the Association.”

The former members stated that though the mass resignation would “cause great inconvenience” to Akpata and members of the NBA Executive Committee, “this is a time when our indignation and principled opposition to the uncharitable comments and accusations of Chief J. K. Gadzama SAN must give way to the greater good of our Association.

CITY LAWYER recalls that Gadzama’s close aides had in a letter to Akpata informed him that the former presidential candidate would not approach the NBA-NEAC for redress over the recent NBA Elections due to concerns on its neutrality.

In a letter made available to CITY LAWYER and signed by Messrs Chukwudi Oli and O. E. Oluwabiyi, the Director-General and Admin Officer respectively of Team J-K Gadzama SAN, the organization stated that “we wish to bring to your attention that our candidate, Chief Joe-Kyari Gadzama, SAN will not be exploring the option of approaching the Committee on the following grounds…”

Titled “RESERVATIONS ABOUT THE NBA NATIONAL ELECTIONS APPEALS COMMITTEE (NBA-NEAC),” Team J-K Gadzama SAN alleged that the Chairperson of the Committee, Mrs. Funmi Roberts is “more of a supporter of Yakubu Chonoko Maikyau, SAN by liking posts on LinkedIn.”

The organization also doubted the neutrality of former NBA National Officer and Appeals Committee member, Mr. Okey Ohagba, saying that he “was an active Coordinator in Port Harcourt for Y. C. Maikyau, SAN.”

Team J-K Gadzama SAN again alleged that another member of the Appeals Committee, Mrs. Huwaila Muhammed Ibrahim “actively and openly posted contents on her Facebook platform projecting Y. C. Maikyau, SAN.”

The organization stated that the “non-neutrality” of these members of the Appeals Committee “poses elements of bias by virtue of their active participation in the campaign activities of Y. C. Maikyau, SAN in the recently concluded National Elections which held on Saturday, 16th July, 2022.

“We sincerely believe that the aforementioned persons will not be able to discharge the duties of the Committee devoid of sentiments and biases and hence, present no guarantee of credibility and fairness in administering unbiased decisions and findings. We have attached some screen pictures of displays by these persons in support of Y. C. Maikyau, SAN during the period of campaign activities. Please see Annexure NBA1 and Annexure

“The refusal of the ECNBA to allow an election audit which would examine the Election/Result Logs and the platform for the election as requested by our candidate’s Agent, Andrew Agbo-Madaki in his letter dated Saturday, 16th July, 2022 further renders our cause a herculean task if not an impossible one before the Committee, whose duty is essentially factfinding.

The NBA is yet to respond to the allegations. Maikyau was declared winner of the election conducted on July 16, 2022 via electronic voting.

‘NBA ELECTION 2022 MOST SUSCEPTIBLE TO RIGGING,’ SAYS GADZAMA

One of the leading candidates in the just concluded Nigerian Bar Association (NBA) Elections, Chief Joe-Kyari Gadzama SAN has alleged that ElectionBuddy, the electronic voting platform deployed for the elections, “was highly vulnerable and most susceptible to electronic fraud, rigging and pre-programming of votes.”

In a statement made available to CITY LAWYER, Gadzama also stated that a report by his ICT consultant dated Monday, July 18, 2022 “also shows that there is a high likelihood that the system could be hacked and manipulated.”

He stated that “A follow-up report by my agent dated Wednesday, July 20, 2022 confirms that this occurrence was more than likely,” adding that “I have been advised that this is why the percentage score among all the three Presidential candidates remained within the same range from the commencement of voting till the end. This, as I have been advised, is not human behavior but mechanical.”

Gadzama stated that though one Mr. Mohammed Mustapha, an ICT specialist, had applied to act as the Technical Support Consultant (TSC) to the Electoral Committee of the NBA (ECNBA), “the ECNBA did not list his company as one that had applied; rather only two companies were listed before one was selected to provide the consultancy.”

PRESS RELEASE ON THE JUST-CONCLUDED NBA NATIONAL ELECTION

Introduction
As you may recall, the National Election of the Nigerian Bar Association (‘NBA’) was concluded on Saturday, July 16, 2022.

My utmost appreciation goes to the members of the Electoral Committee of the NBA (‘ECNBA’) who conducted our election. I respect each of them and commend their efforts. I equally salute all the contestants who vied for various positions.

Pre-Election
It is pertinent to state that before the conduct of the election, my agent – Mr Andrew Madaki tested the vulnerability of the website to conduct the election – electionbuddy.com. The report, which is attached to this release, shows that the website was susceptible to manipulation.

Thereafter, my agent and other agents present raised some of these concerns during the press briefing conducted by the ECNBA on the eve of the election.

Voting
During the conduct of the election, my agent discovered numerous irregularities and expressed same by a letter sent via email to the ECNBA at 2:00 pm. The same is attached to this release. In the email, he reported the frequent timeouts experienced by the site, lack of access to the backend of the server, lack of graphical representation of the results and ultimately requested to audit the election, which the ECNBA promised to provide immediately.

Post-Election
After the conduct of the election, my agent sent a reminder to the ECNBA on Sunday, July 17, 2022 to audit the election and discover if there were more irregularities but same has not been provided by the ECNBA.

After the conduct of the election, my agent engaged another IT specialist to test the server. The report of the specialist which was dated Monday, July 18, 2022 also shows that there is a high likelihood that the system could be hacked and manipulated. A follow-up report by my agent dated Wednesday, July 20, 2022 confirms that this occurrence was more than likely. I have been advised that this is why the percentage score among all the three Presidential candidates remained within the same range from the commencement of voting till the end. This, as I have been advised, is not human behavior but mechanical.

It is important to re-iterate that auditing the election will permit independent parties and agents to discover if there were any technical interferences to usurp the will of the electorate. This access is expected to have been provided immediately after the conclusion of the poll to prevent any party from tampering with the system.

Pre-Qualification of Technical Consultant to ECNBA
On Friday, June 24, 2022, I invited numerous IT specialists to advise me. One of them was Mr Mohammed Mustapha who I asked to provide information security and communication strategy in the just-concluded NBA Election; however, on Monday, June 27, 2022, Mr Mustapha declined my offer as a result of conflict of interest because he had earlier applied to the ECNBA to act as a consultant. After declining my request, Mr Mustapha informed me that although he had applied to be a consultant to the ECNBA before the deadline, the ECNBA did not list his company as one that had applied; rather only two companies were listed before one was selected to provide the consultancy. The two referenced letters are attached.

Also attached to this release are: (i) the notice released by the ECNBA asking for proposals for a technical consultant titled ‘Request for Proposal for Technical Support Consultant to the ECNBA – Submission Reminder Notice’, (ii) acknowledged copy of the bid by Mr Mustapha titled ‘Re: Request for Proposal for Technical Support Consultant to the ECNBA’ received by the ECNBA at 3:35 pm on 22/4/22, and (iii) the notice displaying companies that applied titled ‘Respondents to Request for Proposal for Technical Support Consultant’.

Conclusion
On the whole, and in view of the above facts and attached documents, it is clear that the technology adopted was highly vulnerable and most susceptible to electronic fraud, rigging and pre-programming of votes. I hereby call upon the ECNBA to allow an immediate audit of the election and server.

‘MAIKYAU, BALA, OTHERS WON’T BE SWORN IN IF…,’ SAYS APPEALS C’TE

The 2022 NBA Election Appeals Committee (NBA-NEAC)  has vowed that no elected candidate from the recent NBA Elections would be sworn in until it has decided any petition against the elected officer.

The NBA-NEAC stated this in its Guidelines for filing petitions on the elections.

According to the Committee, “The decision of the NBA-NEAC shall be rendered, and notified in writing to the Petitioner and the Respondents, before the swearing-in of the elected National Officers or before the
Representatives of the Association in the General Council of the Bar takes office.”

NBA-NEAC however stated that “whenever the circumstances dictate, the Committee may reserve its right to defer giving the full reasons for its decision to a later date.”

The statement reads: “As you already know, the election into the National Executive Committee of the Nigerian Bar Association (NBA) and the General Council of the Bar (GCB), took place on Saturday, the 16th day of July 2022. The result of the election was consequently announced on Sunday, the 17th day of July 2022.

“In line with the provisions of Section 14(1)(L) of the NBA Constitution 2015 (as amended in 2021), the NBA President, Mr. Olumide Akpata had set up the 2022 NBA Election Appeals Committee (NBA-NEAC) with the mandate to amongst other responsibilities, receive and determine complaints and disputes (Petition) from candidates who took part in the elections of National Officers and Representatives of the NBA in the GCB.

“It is expected that a Petitioner shall send his/her Petition with supporting documents to NBA-NEAC by email to electionappeal@nigerianbar.org.ng within Ten (10) days of the announcement of the election results by the ECNBA.”

‘YOUR ELECTION RESULTS ARE CREDIBLE,’ ELECTIONBUDDY TELLS NBA MEMBERS

ELECTIONBUDDY, the Edmonton, Canada based electronic voting platform, has validated the results of the recently concluded Nigerian Bar Association (NBA) Elections, saying the results were not tampered with.

In a letter addressed “To the members of the Nigerian Bar Association” and signed by its President, Mr. Dave Bodnarchuk, the company which was contracted by the Electoral Committee of the NBA (ECNBA) alongside INITS Limited as the ICT Service Provider, stated that “At the completion of the election, ElectionBuddy staff perform limited procedures which includes (sic) review of the voter list, voting process, examination of the results, and inquiries of management. We believe that the review and results of our procedures provide a reasonable basis to confirm our report.

“Based on our reviews, we are not aware of any modifications to the election that would materially impact the electoral outcomes.”

‘HOW MAIKYAU, BALA, OTHERS WON NBA ELECTIONS,’ BY ECNBA

The Electoral Committee of the Nigerian Bar Association (ECNBA) has given a blow-by-blow account of how the election was conducted.

The ECNBA Chairman, Mr. Ayodele Akintunde SAN at a press conference at exactly 8:23 am yesterday declared Abuja based senior lawyer and Chairman of the NBA Welfare Committee as the duly elected NBA President, even as it declared that the election was free and fair.

In his acceptance speech, Maikyau vowed to “tell truth to power,” adding that the NBA would remain a sentinel for the rule of law.

Aside from Maikyau, Linda Rose Bala was elected 1st Vice President while Mr. Clement Chukwuemeka was returned as 2nd Vice President. The post of 3rd Vice President went to AWLA President Amanda Asagba while former NBA Welfare Secretary, Mr. Adesina Adegbite won the hotly contested position of General Secretary.

The post of Treasurer was won by Craoline Anze-Bishop while Lagos lawyer Chinyere Obasi was returned as the Welfare Secretary. Former NBA Assistant Publicity Secretary, Mr. Habeeb Akorede Lawal clinched the post of Publicity Secretary while Mr. Daniel Ka-Ayii Kip won the post of Assistant General Secretary. Mr. Charles Ajiboye was elected as Assistant Publicity Secretary.

‘WHY MAIKYAU CAN’T BE SWORN-IN UNTIL ELECTION AUDIT,’ BY CAROL AJIE

Vocal Bar activist, Dame Carol Ajie has said that Nigerian Bar Association (NBA) President-elect, Mr. Yakubu Maikyau SAN cannot be sworn-in alongside other elected National Officers until the 2022 NBA Election is audited.

In a post made available to CITY LAWYER, Ajie canvassed that First Vice President Mrs Linda Bala should take over the mantle of leadership of the association until conclusion of the audit.

CITY LAWYER recalls that the agent of Chief Joe-Kyari Gadzama SAN at the just concluded election had written to the Electoral Committee of the NBA (ECNBA) urging it to audit the election. While the expectation from the Gadzama camp was that the audit would be concluded before announcement of the results, the Electoral Committee brushed aside the demand and proceeded to announce the election results.

Below is the full text of Ajie’s statement.

The Swearing-in is in five weeks. Gadzama SAN should not concern himself with any other office but that of the NBA President which he contested and is in contention.

Lessons from 2016, avoid possible prolongation of dispute by narrowing it to office of President

Electoral Notes:-

1) NBA should proceed on 26/8 as scheduled to swear in all newly elected officers but one that is the Office of the President.

2) The First Vice President Mrs Linda Bala and every other officer but President upon being sworn in Bala should step in for the President as Akpata terms out. No tenure elongation. Mrs Bala might find this task heavy but she has to learn to step in pending result of audit particularly as ECNBA is yet to ask NBA presidential candidates to nominate an audit firm each.

3) All three Presidential candidates will nominate one audit firm per candidate say in a day or two. All three audit firms will meet to review the process, 60,000 approximate voters accredited only 34,000 voted. Because they were denied access covertly or overtly. Why were inaccessible voting links sent to some targeted lawyers. Must resolve these once and for all.

4) In the event of the auditors finding fundamental irregularities, ElectionBuddy has to explain it. If not satisfactorily explained ECNBA ought to cancel the election result for the office of the President and conduct a credible election ASAP.

This is a struggle to save NBA.

The 2022 national election of the Nigerian Bar Association has come and gone and a new leadership that will pilot the affairs of our great Association for the next two years has been elected. We had offered ourself for service to the Bar in the capacity of General Secretary in the said election which offer was not accepted by majority of the votes of our members. We accept the decision and wish to congratulate all those that emerged as the choice of the majority of our members.

I want to give special gratitude to God Almighty for the grace, privilege and enablement to have participated in the process. It was indeed a daunting, tedious and time sapping venture. However, I must say that it was also a very worthwhile experience for me. It saw me meeting and making new friends and building networks of unquantifiable value both personally and professionally. I therefore have no regrets whatsoever in having been part of the process.

I congratulate very heartily all the newly elected national officers led by the President elect Mr Y.C Maikyau SAN, and especially my good friend and brother Adesina Adegbite the General Secretary elect against whom I ran. I wish you well my brother and do believe that you will deliver on your mandate and take our Secretariat to the next level in positive and progressive terms. Indeed the Bar is the ultimate winner.

I congratulate the Olu Akpata led administration for delivering a seamless transition process and for the enormous achievements the administration has recorded.

As your tenure gradually winds down, it is my sincere wish that the new and incoming leadership consolidates on the outstanding milestones that your administration has achieved and laid.

NBA ELECTIONS: WINNERS EMERGE, AS LAGOS, ABUJA LEAD BATTLEGROUND BRANCHES

The Nigerian Bar Association (NBA), Lagos Branch has maintained its ranking as the beautiful bride for candidates in NBA Elections, grossing 10,640 of the 59,393 eligible voters for the NBA 2022 Elections. The branch added 3,918 more voters to its 6,722 tally in the 2020 elections.

Meanwhile, barring any hitches, some of the candidates in the ongoing election are deemed already elected. These include incumbent NBA 1st Vice President, Mr. John Aikpokpo-Martins; incumbent NBA Welfare Secretary, Mr. Kunle Edun; Egbe Amofin O’odua chieftain, Prof. John Akintayo as well as Messrs Agbaga Dennis Ejakpovwere, Israel Solomon Lagbamue and Olalekan Idowu Oladapo.

The winners are all NBA Representatives to the General Council of the Bar (GCB, Western Zone) who are deemed automatically elected given that each zone must produce at least six NBA Representatives to the GCB. Only six persons filed nominations from the zone.

Aside from NBA Lagos Branch, Abuja Branch is another battleground for candidates, taking the second position on the log with 8,959 members on the voters list, up from 2,862 in year 2020.

Other branches with substantial members on the voters list are Ikeja Branch with 4,905 voters, up from 2,751 in 2020 and Port Harcourt Branch which jumped from 1,847 in 2020 to 3,297 voters, bringing up the Top Four branches that have remained dominant over the last four NBA Elections except in 2018 when Ikole Ekiti Branch sensationally upstaged Ikeja Branch to the third position. The branch posted a meagre 43 voters on the log this year as against its 917 tally during the 2018 NBA Elections.

Branches that also have significant members on the voters list include Ibadan Branch (1,863), Owerri Branch (1188), Enugu Branch (915), Ilorin Branch (814), Kano Branch (796), Asaba (736), Kaduna Branch (667), Onitsha Branch (665), and Yenagoa Branch (657). Others are Makurdi Branch with 591 voters, Aba Branch (567), Bwari Branch (518), and Minna Branch (421).

Among the lightweight branches on the voters list are Ogoja Branch with 60 voters, Offa Branch (55), Ikole Ekiti (43) and Maiduguri Branch (30).

EDITORIAL: NBA ELECTIONS 2022 – WHY WE MUST GET IT RIGHT

The ballot for the Nigerian Bar Association (NBA) Elections will open in a matter of hours to elect National Officers and NBA Representatives to the General Council of the Bar.

This year’s election is especially pivotal given the controversies that have trailed the last three efforts since the introduction of electronic voting and universal suffrage by the amended NBA Constitution 2015.

Since 2016, NBA Elections have spanned between a petition to the NBA Trustees to litigation and criminal prosecution of suspects accused of electoral malfeasance by the Economic and Financial Crimes Commission (EFCC). This has brought odium and discomfiture to NBA and its members.

While the allegations that trailed the 2016 and 2018 elections remain somewhat muted, the same cannot be said of the 2020 Election. While several commentators and stakeholders alleged that the election was fraught with sundry irregularities, Mr. Dele Adesina SAN, one of the presidential candidates in the election, accused the defunct Electoral Committee of the NBA (ECNBA) of data diddling, saying that “it is apparent that the data uploaded to the site was programmed and preconfigured to achieve a desired result in an obvious case of data diddling.”

The election was also bedeviled by the spectre of huge undelivered ballots, with Adesina again noting that the ElectionBuddy voting platform deployed for the election posted 14,879 total undelivered notices to prospective voters as at 2 pm on Election Day as against 29,635 total registered voters. He contended that “The inability to deliver 14,000 notices to prospective voters 13 hours after the commencement of the Election is not only evidence of lack of capacity on the part of the System but also a clear disenfranchisement of these prospective voters.” It is noteworthy that ElectionBuddy has been contracted by the current Electoral Committee alongside INITS Limited as the joint ICT Service Provider (ISP) for the 2022 NBA Elections.

If Adesina’s claims are deemed by critics as the vituperations of a sore loser, the verdict of the NBA Trustees on the election did not validate such an assertion. Instead, it gave vent to the perception that all was not well with the election.

In a letter dated 19th of August 2020 and authored by the Chairman of the Board of Trustees, Dr. Olisa Agbakoba, SAN, the Trustees said: “We note that the Elections were not perfect. We reviewed your Petition and note that it raises serious issues.”

The august body observed that “our elections continue to present challenges going back to 2016 and strongly recommend that a major transformation of our electoral process and framework must be undertaken and we are happy to be assigned this very important responsibility….”

In an earlier email by Agbakoba dated 17th August, 2020, the Trustees had stated emphatically that “The NBA 2020 Election was marred by irregularities. The ECNBA admitted that the election platform failed which is why they had to engage another I.T. Consultant. The ECNBA admitted that over 14,000 members could not vote which is an extremely high number. The ECNBA should have made provision to enable everyone to vote. This is an omission on their part.”

It was against this unflattering backdrop that NBA President, Mr. Olumide Akpata, himself a beneficiary of that flawed electoral process, vowed to redeem NBA election from the perennial odium that has enveloped it. He set up the Mr. Ayodele Akintunde SAN-led NBA Electoral Reform and Audit Committee to unravel the challenges besetting NBA elections and proffer solutions.

Instructively, the Audit Committee in its final report returned the same verdict as the NBA Trustees, saying: “Nigerian lawyers were again optimistic that the 2020 Elections would be seamless as all the challenges encountered in the 2016 and 2018 Elections would have been fully addressed.” It however asserted that “that was not the case; like the previous elections, the 2020 Elections was controversial and there were pre-election and post-election issues and challenges.”

Continuing, the Audit Committee said: “INITS’ report revealed that during the elections on the ElectionBuddy platform, there were two major challenges. The first challenge was that based on the traffic and requests for the results between the first and second hour of the elections, voters and viewers began experiencing service degradation.”

The committee also indicted INITS Limited, the defunct ECNBA’s Technical Support Consultant (TSC), noting that “The INITS’ report did not include a Vote-by-Vote Audit Report. The Committee requested for the Report but was not able to obtain it before the submission of this Final Report.” Like ElectionBuddy, INITS Limited has been retained by the Akintunde-led ECNBA as joint ICT Service Provider for the 2022 Election.

Aside from generating a reliable voters register, the transparency of the electoral process has been in issue. The same is true of the election management body. Many analysts believe that Akpata got it right when he appointed Akintunde to spearhead the 2022 Elections, citing his avowed integrity and track record in conducting rancour-free elections at NBA Lagos Branch.

The NBA President had while inaugurating the Audit Committee stated that it (committee) “is already in the process of recommending reform measures to ensure that complaints about the NBA electoral process are significantly minimised.” The NBA Trustees had also committed to oversight electoral reforms.

The NBA Elections 2022 offer an uncommon opportunity not only for the NBA Board of Trustees, Akpata and Akintunde to walk the talk, but for all stakeholders to exhibit candour and good faith in ensuring that the association redeems its unwholesome electoral odyssey. There is no alternative to this desirable prospect.

It is with a great sense of humility and commitment to the growth of the legal profession in Nigeria that I solicit your support in my quest to serve as a member of the General Council of the Bar.

As you may have known, the elections into the August Body, would coincide with the election for national officers of the Nigeria Bar Association on Saturday, 16th July, 2022.

The Legal Practitioners Act imposes a number of responsibilities on the General Council of the Bar and these includes;

A. General management of the affairs of Bar, subject to the limitations provided by the NBA Constitution
B. Powers to make rules of account to be kept by Legal Practitioners
C. Powers to make and revise rules of professional conduct etc.

Over the years, activities of the Body have been overshadowed by a number of factors, the bulk of which cannot be disconnected from administrative lapses and these lapses has reduced it to a Body that exists in principle in spite of the critical position it occupies in the pyramid of the legal profession in Nigeria.

To address this problem, there is the need for members of the Council to be committed persons who would drive it towards its statutory potentials and I believe I have what it takes to deliver in this regard.

I have been privileged to serve our Association in various capacities both at the National and branch level and my excellent records speak for itself.

By the special grace of God, I will be handing over the baton as your National Publicity Secretary at our forthcoming Annual General Conference and it was a great delight to serve the Bar.

I am convinced that service to the Bar in these capacities has afforded me the requisite skills and administrative know-how to partake in piloting the affairs of an auspicious organ such as the General Council of the Bar.

If you elect me as a member of the Body, I promise to leverage the experiences gathered from my years of service to assist in redirecting and refocusing the organization to its optimal height.

My name is Damian Onwubiko Nosike. I am a native of Umunehi Obiangwu in Ngor Okpala Local Government Area of Imo State. I am a reputable Owerri-based legal practitioner and an aspirant to the office of the 2nd Vice President of the Nigerian Bar Association.

I had my secondary education at Holy Ghost College, Owerri and obtained my Senior School Certificate Examination [SSCE] in 1988. I graduated from the Faculty of Law, Imo State University, Owerri in 1998 where I obtained my Bachelor of Laws Degree. I thereafter attended the Nigerian Law School, Abuja in 1999 and in the year 2000, I was called to the Nigerian Bar. In addition, I obtained a Certificate of Training and Proficiency in Alternative Dispute Resolution (ADR).

Since after my Call to the Bar, I have remained in active legal practice, with bias for litigation and commercial practice of law. During my National Youth Service between 2001 & 2002, I served as a Corps Counsel in the law firm of U. U. Chukwumaeze, SAN. & Co. Shortly after my service year, I joined the law firm of Ndukwe Nnawuchi, SAN. & Co. where I honed my professional skills between the year 2002 and 2017. During my pupillage at the law firm of Ndukwe Nnawuchi, SAN. & Co., I gradually rose through the ranks to become the Head of Chambers/Managing Partner. In the year 2017, I founded the law firm Damian O. Nosike & Co.(Chidindu Chambers) located in the heart of Owerri, precisely at 59, Njiribeako Street, Owerri where I am currently the Principal and Head of Practice. My practice of law is very robust and cuts across all strata of Courts in Nigeria.

I have selflessly served the Nigerian Bar Association in various capacities, at the local and national levels. I served as the Secretary, Welfare Committee, Nigerian Bar Association, Owerri 2007 – 2009; Secretary, NBA Owerri Bar Center Committee, 2012 – 2014; Imo State Representative, Eastern Bar Forum (EBF) 2015 – 2017; Assistant Secretary, Eastern Bar Forum (EBF) 2017 – 2019; Member, Board of Trustees, Imo State University Alumni Association, 2015 – 2021; Member, Administration of Criminal Justice Committee, 2016 – 2018; Member, Administration of Criminal Justice Law Drafting Committee of Imo State, 2019 – 2020; Chairman, Nigerian Bar Association, Owerri Branch, 2018 – 2020 and NEC Representative for Owerri Branch 2020 till date.

After intense and wide consultations, I, DAMIAN ONWUBIKO NOSIKE, ESQ., hereby present myself as an aspirant for the office of the Second Vice President of the Nigerian Bar Association in the forthcoming election slated to hold in July, 2022.

Our dear country is passing through a phase with unique and daunting challenges. These challenges inevitably affect our existence, our economy and our nascent democracy. In all of these, our profession and the rule of law is put to trial. Our dear Association is looked unto in this generational trial to play its role in protecting the rule of law.

Beyond the protection of the rule of law, the welfare of members of the NBA has now become a point of priority for our dear Association. All these and more are what leaders of the NBA will keep in focus while aspiring for any executive office of the Association. On my eligibility with the qualifying requirements of the Nigerian Bar Association Constitution 2015 [as amended in 2021], I am a full and financial member of the Association. I have been a member of the NBA National Executive Council for over 3 years; I am from the Eastern Zone to which the office of the Second Vice President has been zoned from August, 2022 to August, 2024. I am thus, eligible to contest for the said office.

The NBA Constitution by Section 9 (5) b, i – iv clearly provides for the duties of the Second Vice President. My mission is simple. It is to faithfully and diligently perform those duties assigned to the office of the Second Vice President. Those duties are expected to be performed in that capacity for purposes of assisting the office of the President and cooperating with other national officers of the Association. In compliance with the NBA Constitution, part of my mission are as follows:

1. In the absence of the President and First Vice President, I shall dutifully preside at all Meetings of the Association and make representations at events in which the President is empowered to preside or make representations by the provisions of the Constitution;

2. I shall coordinate the activities of all the Branches as may be assigned to the office of the Second Vice President by the National Executive Council or the President and I shall pay periodic visits as necessary and/or required, to the Branches so assigned to the office and shall make periodic reports to the National Executive Council on such visits and in addition, ensure the sustenance of unity among the assigned Branches;

3. I shall encourage and supervise the formation of new Branches within the zonal supervisory jurisdiction of the office in line with the guidelines set out in the NBA Constitution;

4. I shall perform all other duties as the office may be directed by the President or the National Executive Council or the Annual General Meeting or such other duties which the President is unable to perform owing to ill health, old age, absence from the country or any other reason at the material time.

Lawyers after payment of Bar Practice Fees (BPF) need not apply formally for STAMPS as this causes administrative bottlenecks resulting in avoidable delays.

Stamps should be produced by the National Secretariat on the confirmation of payment of the BPF and release in batches through registered courier companies to the branches, who will in turn release to members on confirmation of the payment of Branch dues.

In this case all lawyers will get their Stamps on or before the 31st day of March of every year or a week thereafter for those who pay on 31st March of every year.

This will guarantee a seamless stamps delivery process.

I will also give special attention to welfare of lawyers to earn decent means of livelihood.

There will also be the need to resuscitate and revitalize the Human Rights Institute of NBA for greater efficiency and to achieve the objectives of NBA.

As a team player, I am best suited for the position of 1st V.P because I am ready to bring in more innovations into NBA that will impact positively on Nigerian lawyers and by implication that of the administration of the next President of NBA.

ECNBA PUBLISHES ELECTION MAGAZINE, LINKS FOR PRESIDENTIAL DEBATE

The Electoral Committee of the Nigerian Bar Association (ECNBA) has released the Election Magazine for the 2022 NBA Elections.

This is in line with the Second Schedule to the NBA Constitution 2015 (as amended) which provides in Part IV Article 16 that “The Electoral Committee shall collate all materials, arrange them in alphabetical order without regard for the position being sought and publish them in an electronic Election Magazine to be hosted on the NBA website at least thirty (30) clear days before the election.”

It would however seem that the Electoral Committee has missed the 30-day constitutional requirement to publish the Election Magazine, given that the election is barely 10 days away.

The documents are published separately for candidates to be elected as National Officers and candidates for election as NBA Representatives to the General Council of the Bar (GCB).

Meanwhile, the committee has also released the links for the Manifesto Day & Presidential Debate scheduled to hold tomorrow at NBA House, Abuja.

A notice sighted by CITY LAWYER reads:

ECNBA’s Manifesto Day and Presidential Debate holds on Thursday, 7 July 2022 by 10am at the Auditorium, NBA House, Plot 1101 Cadastral Zone Central Business District, Abuja FCT. This is a hybrid event and as such, members of the NBA can attend physically or virtually.

“In ensuring that government officials are properly guided in their responsibilities, I will see to it that the leadership of the NBA work with the National Assembly to ensure that every government agency both at the Federal, State and Local levels, have an established legal department.

At these departments, qualified legal practitioners would properly advise government officials and ensure that all their actions are in conformity with the law.

In addition, this step will boost employment opportunities for lawyers as they would be gainfully employed through this avenue.
