EXCLUSIVE: NBA ASKS LPDC TO SANCTION OLANIPEKUN, PARTNERS OVER AJUMOGOBIA’S MISCONDUCT CLAIMS

The Nigerian Bar Association (NBA) has urged the Legal Practitioners Disciplinary Committee (LPDC) to sanction the Chairman of the Body of Benchers, Chief Wole Olanipekun, SAN and other partners in his leading law firm for professional misconduct, CITY LAWYER can authoritatively report.

In a petition, THE INCORPORATED TRUSTEES OF THE NIGERIAN BAR ASSOCIATION AND ADEKUNBI OGUNDE, ESQ. filed yesterday at the LPDC, NBA urged the LPDC to “consider whether the partners of the firm of Wole Olanipekun & Co. are not liable to be disciplined by this august body seeing that the Respondent has the ostensible authority to act as a partner, and indeed acted for and on behalf of the said firm.”

The association also dragged a Partner in the law firm, Ms. Adekunbi Ogunde to the committee over the controversial email she allegedly wrote to an international oil company seeking a brief.

CITY LAWYER had in an exclusive report cited a searing complaint by an apparently embittered senior lawyer and former Minister of Energy and Petroleum ministries, Mr. Odein Ajumogobia SAN where he referenced an email to the oil company from Ogunde and demanded an apology from the law firm. The firm apologized for the debacle and disowned the Partner.

In the petition obtained by CITY LAWYER and numbered as BB/LPDC/901/2022, NBA 1ST Vice President, Mr. John Aikpokpo-Martins stated that he was applying “on behalf of the Applicant that ADEKUNBI OGUNDE of WOLE OLANIPEKUN & CO of God’s Grace House, 5, Maple Close, Osborne Foreshore Estate Phase 11, Ikoyi, Lagos be required to answer to the allegations contained in the Statement/Affidavit which accompanies this Application and that such Order be made as the Committee shall think right.”

Filed on behalf of the Incorporated Trustees of the Nigerian Bar Association and dated July 19, 2022, the petition was titled “PETITION AGAINST ADEKUNBI OGUNDE, ESQ., A NIGERIAN LAWYER DULY CALLED TO THE NIGERIAN BAR WITH HER NAME ON THE ROLL OF LAWYERS KEPT IN THE SUPREME COURT FOR THE VIOLATION OF THE EXTANT RULES OF PROFESSIONAL CONDUCT FOR LEGAL PRACTITIONERS (RULE 1 OF THE RPC) BY SOLICITING FOR BRIEFS AND PEDDLING THE INFLUENCE OF THE PRINCIPAL PARTNER OF HER LAW FIRM CHIEF WOLE OLANIPEKUN, SAN AS HAVING THE ABILITY TO EXTRA-LEGALLY INFLUENCE DECISIONS OF COURTS IN NIGERIA BEING THE CHAIRMAN OF THE VERY DISTINGUISHED BODY OF BENCHERS THEREBY PUTTING THE ENTIRE LEGAL PROFESSION TO NATIONAL AND INTERNATIONAL PUBLIC RIDICULE AND ODIUM.”

In the Statement of Facts accompanying the application, NBA noted that Ogunde is “expected to exhibit and maintain a very high standard of conduct, professionalism, respect for the integrity of court and the judicial process when discharging her professional duties and responsibilities to clients, the legal profession and members of the general public.”

The Applicant however stated that “Sometime in the month of June 2022, members of the legal profession and indeed the general public were rudely confronted with unbelievable reports in the social media of a letter alleged to have originated from the very esteemed and revered office of Wole Olanipekun & Co and authored by the Respondent.”

Continuing, the Applicant stated that “In the said letter, the law firm of Wole Olanipekun & Co unprofessionally and surreptitiously solicited for a brief from Saipem SPA, an international conglomerate known (knowing that another firm of lawyers was handling the said brief in the court) and further shamelessly touted the supposed overriding influence of the principal partner of her firm, Chief Wole Olanipekun, SAN, the current chairman of the very revered and distinguished Body of Benchers, and a very respected past President of the Applicant herein.”

Citing the letter from Ogunde to Mr. Francesco Ciao of Saipem SPA, NBA stated that “Members of the legal profession particularly members of the Applicant were very disturbed by this infamous letter alleged to have originated from arguably one of the most successful, biggest, respected and most distinguished law firms in Nigeria,” adding that its hope that the allegations contained in the letter were “false, misleading and outright mischief orchestrated by some rabble-rousers” was dashed by letters from the law firm of Wole Olanipekun & Co apologizing for the action of the Respondent and disclaiming her.

According to NBA, “While the members of the legal profession in particular and the national and international public were attempting to come to terms with what has now obviously become the most infamous letter ever written by a lawyer and/or a law firm in the history of the legal profession in Nigeria, the respondent published a letter on the social media admitting the allegations, but sought only to exculpate her law firm from the now most infamous conduct allegations within the legal profession ever in Nigeria.”

Justifying the filing of the application, the NBA stated that “The entire members of the Applicant arising from their comments on the social media and calls to the President of the Nigerian Bar Association have been feverishly and fervently demanding and calling on the Applicant to rise up and refer the Respondent and the partners of Wole Olanipekun & Co. to the Legal Practitioners’ Disciplinary Committee for gross and grave professional misconduct that brought unprecedented shame, ridicule, opprobrium and odium on the entire administration of justice system and the legal profession in Nigeria.”

NBA urged the LPDC “to immediately commence the disciplinary process and prosecute ADEKUNBI OGUNDE Esq. for the violation of the sacred provisions of the Rules of Professional Conduct, particularly Rule 1 thereof.”

The NBA Trustees then asked the LPDC to “consider whether the partners of the firm of Wole Olanipekun & Co. are not liable to be disciplined by this august body seeing that the Respondent has the ostensible authority to act as a partner, and indeed acted for and on behalf of the said firm.”

Accompanied by a 16-paragraph “AFFIDAVIT OF FACTS IN RE: THE PETITION OF THE NBA AGAINST ADEKUNBI OGUNDE, ESQ.” dated July 19, 2022 and deposed by Aikpokpo-Martins, the Applicant urged “your quick consideration of this Petition.”

It is recalled that the Respondent had in a Press Release on the controversy titled “RE: CITY LAWYER MAGAZINE PUBLICATION WITH THE TITLE – AJUMOGOBIA ACCUSES OLANIPEKUN’S LAW FIRM OF MISCONDUCT; AND ALL OTHER RELATED PUBLICATIONS IN THE SOCIAL MEDIA” acquitted Olanipekun and the law firm from any blame.

It was unclear at press time whether the petition has been communicated to the Respondent.

The LPDC is a committee of the Body of Benchers.

CITY LAWYER recalls that the Olumide Akpata-led NBA had also dragged an unnamed Senior Advocate of Nigeria and six other lawyers to the LPDC over their alleged roles in a series of conflicting ex-parte court orders issued by some  courts.

‘10,877 DELEGATES HAVE REGISTERED FOR AGC,’ SAYS TOBENNA EROJIKWE

No less than 10,877 delegates have registered for the forthcoming Nigerian Bar Association Annual General Conference (NBA AGC) holding in Lagos next month.

According to a statement made available to CITY LAWYER, the figure has outstripped the total number of delegates for the same period in 2019 and 2021 conferences.

In an update on preparations for the Annual General Conference, the Chairman of the Technical Committee on Conference Planning (TCCP), Mr. Tobenna Erojikwe said: “For the 2019 NBA-AGC, by the end of the early bird registration window, which factored in a 1-week extension, 9,796 delegates had registered for the conference. For the 2021 NBA-AGC, this figure was 8,686 delegates also with a 1-week extension. However, by midnight on Monday 18th July 2022, after the early bird registration window closed, a total of 10,877 delegates had registered for the conference. Put differently, with a month to the conference, we have already exceeded the total number of delegates for the 2021 NBA-AGC. The numbers continue to rise notwithstanding the close of the early bird registration window.”

He ruled out extension of the Early Bird window, and warned that the committee may be forced to close registration as the conference is almost oversubscribed already, though the virtual option remains available. His words: “It is in light of the foregoing, dear colleagues, that it became impossible to extend the early bird registration window. Further and regrettably, there is serious likelihood that we might soon be constrained to close all registration outright as the conference spaces are almost oversubscribed.”

Below is the full text of the statement.

Dear Colleagues

1. It is exactly 30 days to the start of the 62nd Annual General Conference of the Nigerian Bar Association (NBA-AGC) billed to take place from 19th – 26th August 2022 at the Eko Atlantic City, Victoria Island Lagos State with the theme, ‘BOLD TRANSITIONS’.

2. I wish to commence this update by expressing, on behalf of the Technical Committee on Conference Planning (TCCP), our sincere gratitude to you for the overwhelming confidence that you have bestowed on us and the unprecedented interest you have shown in this year’s NBA-AGC as illustrated by the impressive registration figures recorded so far.

3. As you are all aware, on 12th June 2022, registration for the NBA-AGC commenced with an early bird registration which ended on 17th July 2022. The TCCP sincerely sympathises with our members who were, for various reasons, unable to take advantage of the early bird registration window to enjoy huge discounts in the registration fees. Although we received various genuine requests for extension, the TCCP carefully explored all possibilities to extend the window but, for the reasons provided below, it was logistically impossible to extend the window.

4. In fixing the early bird registration window, we took into account the fact that previous windows had historically been fixed for approximately 4 weeks with an extension typically lasting for 7 days. We therefore fixed an early bird registration window of 6 weeks to allow enough time for our members to take advantage of the discounted rates.

5. In terms of planning and logistics, we have been consistent in our communications that we anticipate an increase in the number of delegates for the 2022 NBA-AGC from circa 11,000 delegates to 13000 delegates physically present and unlimited virtual participants. It is on the basis of this figure that we have been planning this Conference. We also arrived at this figure of 13,0000 after considering various factors chief among which were historical attendance figures and of course conference costs.
6. By way of comparison, at the last NBA-AGC held in the pre-Covid era, in 2019, and incidentally in Lagos, there were a total of 11694 delegates without the option of virtual participation. For the 2021 NBA-AGC which held in Port Harcourt, a total of 10,147 delegates registered for the conference, inclusive of virtual delegates. It was for the above reason what we increased the capacity to 13,000 while also making adequate arrangements for virtual delegates to enjoy a similar experience from the comfort of their homes or offices.

7. As noted above, we anticipated an increase in the number of delegates that would be interested in physically attending this year’s conference due to a number of factors including perhaps the positive record and members-oriented programmes of the Olumide Akpata administration, the reduction of the conference fees, and the exciting line up of sessions and events for this year’s NBA-AGC. With the benefit of hindsight, I have to now admit that despite our most optimistic projections, we did not anticipate the huge spike in the figures.

8. For the 2019 NBA-AGC, by the end of the early bird registration window, which factored in a 1-week extension, 9,796 delegates had registered for the conference. For the 2021 NBA-AGC, this figure was 8,686 delegates also with a 1-week extension. However, by midnight on Monday 18th July 2022, after the early bird registration window closed, a total of 10,877 delegates had registered for the conference. Put differently, with a month to the conference, we have already exceeded the total number of delegates for the 2021 NBA-AGC. The numbers continue to rise notwithstanding the close of the early bird registration window.

9. The above numbers have not factored in the number of registration slots that we must of necessity allocate to our resource persons; our sponsors as part of the sponsorship package we already advertised and are duty bound to deliver; as well as our colleagues who are legal officers in the Ministries, Departments and Agencies of governments whose registration are usually delayed by the bureaucratic bottle-neck for which our various governments are notorious.

10. It is in light of the foregoing, dear colleagues, that it became impossible to extend the early bird registration window. Further and regrettably, there is serious likelihood that we might soon be constrained to close all registration outright as the conference spaces are almost oversubscribed. Consequently, while we are not oblivious to the harsh economic climate that pervades the country at this time, we must nevertheless call on our members who are desirous of attending the conference physically to endeavour to register for the conference in the coming days. I will endeavour to give one last notice before we hit our maximum capacity for the conference.

11. Nonetheless it is important to restate that we have made adequate arrangements for our members to take advantage of a virtual option and also enjoy a similar experience at the conference. The virtual platform has a capacity to accommodate 30,000 conference delegates and the window to register for the conference through the virtual option remains open until the eve of the conference.

12. In ending, let me once again thank you for your understanding and cooperation and look forward to a memorable 2022 NBA-AGC.

It is with a great sense of humility and commitment to the growth of the legal profession in Nigeria that I solicit your support in my quest to serve as a member of the General Council of the Bar.

As you may have known, the elections into the August Body, would coincide with the election for national officers of the Nigeria Bar Association on Saturday, 16th July, 2022.

The Legal Practitioners Act imposes a number of responsibilities on the General Council of the Bar and these includes;

A. General management of the affairs of Bar, subject to the limitations provided by the NBA Constitution
B. Powers to make rules of account to be kept by Legal Practitioners
C. Powers to make and revise rules of professional conduct etc.

Over the years, activities of the Body have been overshadowed by a number of factors, the bulk of which cannot be disconnected from administrative lapses and these lapses has reduced it to a Body that exists in principle in spite of the critical position it occupies in the pyramid of the legal profession in Nigeria.

To address this problem, there is the need for members of the Council to be committed persons who would drive it towards its statutory potentials and I believe I have what it takes to deliver in this regard.

I have been privileged to serve our Association in various capacities both at the National and branch level and my excellent records speak for itself.

By the special grace of God, I will be handing over the baton as your National Publicity Secretary at our forthcoming Annual General Conference and it was a great delight to serve the Bar.

I am convinced that service to the Bar in these capacities has afforded me the requisite skills and administrative know-how to partake in piloting the affairs of an auspicious organ such as the General Council of the Bar.

If you elect me as a member of the Body, I promise to leverage the experiences gathered from my years of service to assist in redirecting and refocusing the organization to its optimal height.

NBA AGC 2022: CHIMAMANDA ADICHIE IS KEYNOTE SPEAKER

The Nigerian Bar Association has announced Chimamanda Ngozi Adichie as Keynote Speaker at its forthcoming Annual General Conference in Lagos.

Adichie, author of Purple Hibiscus, Half of a Yellow Sun, Americanah, and several other works, will be speaking at the opening ceremony of the conference in August.

The conference, themed “Bold Transitions”, will take place at the Eko Atlantic City, Victoria Island, Lagos from 19th to 26th August, 2022. Registration for the conference is ongoing at www.nbaconference.com, with and early bird window which will run until 17th July.

Chimamanda Adichie was born in Enugu, Nigeria in 1977 and grew up on the campus of the University of Nigeria, Nsukka, where her father was a Professor and her mother was the first female Registrar.

She started out as a medical student at Nsukka before departing for the US where she took a different path, graduating summa cum laude from Eastern Connecticut State University with a degree in Communication and Political Science. She has a Master’s Degree in African Studies from Yale University, and a Master’s Degree in Creative Writing from Johns Hopkins University.

Ms. Adichie was awarded a Hodder fellowship at Princeton University for the 2005-2006 academic year, a MacArthur Fellowship in 2008, and a fellowship at the Radcliffe Institute of Harvard University for the 2011-2012 academic year.

She has received honorary doctorate degrees from Eastern Connecticut State University, Johns Hopkins University, Haverford College, Williams College, the University of Edinburgh, Duke University, Amherst College, Bowdoin College, SOAS University of London, American University, Georgetown University, Yale University, Rhode Island School of Design, Northwestern University, and University of Pennsylvania.

Ms. Adichie has delivered two landmark TED talks – her 2009 TED Talk ”The Danger of A Single Story” and her 2012 TEDx Euston Talk ”We Should All Be Feminists”, which was published as a book in 2014.

Adichie’s work has been translated into over 30 languages. Her first novel, Purple Hibiscus (2003), won the Commonwealth Writers’ Prize; her second novel, Half of a Yellow Sun (2006), won the Orange Prize; and her 2013 novel, Americanah, won the US National Book Critics Circle Award and was named one of The New York Times Top Ten Best Books of 2013. A story from her collection, The Thing Around Your Neck, was awarded the O Henry Prize.

Her other works include Dear Ijeawele, or a Feminist Manifesto in Fifteen Suggestions, published in March 2017, and Notes On Grief, an essay about losing her father, published in 2021.

A member of both the American Academy of Arts and Letters and the American Academy of Arts and Sciences, Ms. Adichie was named one of TIME Magazine’s 100 Most Influential People in the World in 2015, and in 2017, Fortune Magazine named her one of the World’s 50 Greatest Leaders.

The 2022 NBA Annual General Conference is expected to bring together thought leaders in the areas of justice delivery, technology, economy, politics, judicial reforms, human rights, and rule of law, said Tobenna Erojikwe, Chairman, Technical Committee on Conference Planning (TCCP).

“The aim is to have leading lawyers and thought leaders in the various fields to discuss and harmonise positions on the way forward on building a more effective Bar and a resilient country able to thrive amidst changing global dynamics,” Erojikwe said.

JOE-KYARI GADZAMA, SAN DELIVERS KEYNOTE ADDRESS AT THE OPENING CEREMONY OF THE 2022 LAW WEEK OF NBA, EKET BRANCH, AKWA IBOM STATE

On Wednesday, June 29, 2022, the NBA, Eket branch held the opening ceremony of its law week with the theme, “Nigerian State and the Crisis of Governance: What Hope for 2023 and Beyond” at Royalty Hotels & Recreation, Eket, Akwa Ibom State.

Devout Bar man, Chief Joe-Kyari Gadzama, SAN was recognized as the keynote speaker of the ceremony. The Chairman of the branch’s 2022 Bar week gave the welcome address and thanked the Learned Silk and other eminent guests present for attending the event. The chairman of of the occasion, Hon. Justice Ifiok Ukana (Rtd) noted that the theme of the event is very apt considering the current situation of things in the country. He also stated that the Learned Silk, Chief Joe-Kyari Gadzama is best suited to deliver the keynote address on the theme.

Hon. Justice Edem Akpan who represented the Chief Judge of Akwa Ibom State, Hon. Justice Ekaette F. Obot declared the law week of the branch open. Prior to that, he commended the leadership of the Bar and keyed into the perspective shared by the chairman of the occasion. He further stated that corruption has eaten deep into the fabrics of our society and therefore, impeded the growth of our nation.

“I am here to claim my birthright” the Learned Silk jokingly stated while informing all that he is also a son of Eket. In his usual manner, he rendered justice to the theme. During his keynote address, he enumerated the indices of both good and bad governance. He expressed his displeasure over the level of poverty and insecurity in the country. One major highlight from his keynote address was the fact that he stated that all stakeholders need to discuss on the roadblocks preventing the growth of the nation and the steps to take to advance our nation. This fact was also reiterated by Mr. Uko Essien Udom, SAN, the Attorney-General of the State while addressing the audience.

The opening ceremony of the branch’s law week was indeed indelible as it witnessed the launching of the branch’s Bar journal and an inflow of highly distinguished personalities in the legal profession ranging from present and past Justices of the High Court of the State to Learned Senior Advocates of Nigeria and then to leaders of the Bar and NBA branches in Akwa Ibom State. CHALLENGES AND REMEDIES

Section 5(g)( i- xiii) Constitution of the Nigerian Bar Association 2015( as amended in 2021) spells out the duties and from those duties, I won’t be wrong to say that the Treasurer has the highest duties to perform and therefore must have the capability and capacity to discharge the onerous task.

Challenges
1- ( Sec 5g- vi) we hardly see a report of Treasurer where it states what the Association has invested its money on in consistent with applicable laws.

Solution
Investment is my priority, this will be done by presenting some investment schemes to the President and the other NATIONAL officers for deliberations and decision making.
If you take time to read my Lectures on FINANCIAL INVESTMENT TITLED * THE THREE SERVANTS* which comes out in series everyday, you would know that the best thing you can do as a servant of the master is to increase the wealth committed into your hands.

2- Another challenge is that duty in Section 5g- v
Compilation and circulation of a list of members who have paid or are in default in respect of their Practicing Fees and take steps to circulate such list at the Annual General Meeting, the NEC, various Heads of Courts in the country, CAC and such statutory bodies…

Solution
It is only when you know the intention of the drafters of the Constitution that you would be able to know what this particular provision intends to achieve. However, I could deduce two purposes:

i. To generate more revenue for the Association because those that their names appeared in default list would most likely do the needful

ii. To disallow those that didn’t pay an audience at the various places mentioned for it to be circulated.

Solution
I could hear someone say * stamp and seal* has achieved that…
You are right to some extent it has increased the number of lawyers paying their Practicing Fees just but it has not REDUCED QUARKS MASQUERADING AS ADVOCATES…because we have fake stamp and seal all over…which is another challenge the Bar is facing.

* I would prefer a situation where such publication would be done on Website where the General Public will have access to information on list of lawyers who are dormant or inactive (not Certified to practice), suspended or struck off the Roll of Advocates and those who are active and Certified to practice EVERY YEAR.

My experience in KENYA and ETHIOPIA made me understand that publication in public domain informs the General Public on lawyers to deal with YEAR IN YEAR OUT, increase the revenue of the Law Societies and also help guard against the public falling into the hands ✋ of FAKE * LEARNED FRIENDS * IN corridors of Justice.

3- Section 5g-iv shall be in constant touch with the Branches to ensure that all members of the Branches pay their annual pf as and when due.

Solution
We are now in technology age where things are done seamlessly. A whatsapp group can be created for that purpose to achieve this duty that has so long been neglected, probably because they think, if you don’t pay, you loose the benefits but if done would create a kind of bonding and sense of belonging.

At this juncture, I must commend this administration for proper accounting of the Association’s funds which in my opinion the next administration could do better.

During his stay in Uyo, Akwa Ibom State, Chief Joe-Kyari Gadzama, SAN; Hon. The leadership and other members of the branch who were at the event welcomed and thanked the Learned Silk for gracing their town with his presence. Past chairmen of the NBA, Uyo branch, Aniekan Akpan and Ekanem Ekanem noted that the Learned Silk is a consummate Bar man who has diligently served the NBA in various capacities. Furthermore, the incumbent chairman of the branch, Ememobong Nicholas remarked that the Bar is in need of a leader who is ready and willing to take the Bar to its final destination. He informed all present that the Learned Silk is the change needed to redeem the Bar and he assured the Learned Silk of his support towards his presidential ambition.

The Attorney General and Commissioner for Justice, Akwa Ibom State who was also at the sit out noted that the Learned Silk is the most qualified candidate in terms of capacity and experience. He emphasized on the fact that the Learned Silk is presently the best choice for the Bar. Mr. Ndifreke Peter, YLF chairman of NBA, Uyo branch; Mrs. Maria Edet, Treasurer of NBA, Uyo branch and other members of the branch were also on ground to receive the Learned Silk.

The Learned Silk lauded the efforts of the branch towards his presidential ambition. He informed all that his presidential ambition was born out of his need to serve the Bar as he owes his success in life to God and the NBA. Also, he noted that in his capacity as the Chairman of the Mentorship Committee of the Body of Benchers, he will keep driving the need for adequate mentorship of young lawyers as it plays a significant role in the advancement of the legal profession.

Upon his arrival, the renowned Aniedi Akpabio, Esq. and his lovely wife, Mrs. Emem Akpabio heartily welcomed the Learned Silk and his guests to his private residence in Essien Udim LGA. Mr. David Ekpo, chairman of the NBA, Ikot Ekpene branch; Dame Helen Egube; Hon. Akan Udo; Mr. Nkereuwen Akpabio; Mr. Nsikan Ukpong; Ubong Atang, Publicity secretary of the branch and Albert Umoh, YLF secretary of the branch were also present to welcome the Learned Silk at the residence of Aniedi Akpabio, Esq.

The Learned Silk utilized this opportunity to reconnect with his friend and also, express his gratitude to other members of the Bar who have been the foot soldiers piloting and projecting his NBA presidential ambition. Mr. David Ekpo, the chairman of the NBA, Ikot Ekpene branch assured the Learned Silk of his undying support and noted that action plans have been drawn out to ensure that the Bar is delivered to the Learned Silk. ATTEMPT BY THE BODY OF BENCHERS TO CONTROL THE NBA THROUGH THE BACKDOOR; A RECIPE FOR UTTER CHAOS

The proposed amendment to the timeworn Legal Practitioners Act came as soothing news to progressive minds within the bar; finally we were going to do away with those inhibiting provisions which have outlived their usefulness.

Our joy was however cut short by the shocking revelation that the pristine bill intended for the National Assembly’s passage into law had been doctored with a view to circumventing, clandestinely, the sacrosanct powers and authority of the NBA. Some powers that be within the Body of Benchers had surreptitiously inserted a clause in the said bill, manifestly tampering with the descriptive standpoint of the NBA. The smuggled provision describes the NBA as follows:

“The Registered Trustees of the Nigerian Bar Association, and any other body incorporated for the governance and management of the Legal Profession”

Meanwhile, in the original bill the “NBA” was simply defined as the “Nigerian Bar Association”. The way it has always been.

This attempt by the Body of Benchers to hoodwink the NBA and forcefully take control of the NBA by doctoring the letters of the law is to say the least evil, by every standard. I make bold to state that this attempted coup is not unconnected to the emergence of a non- SAN as president of the NBA. Apparently, many oxen that were gored as a result, as well as sundry deflated bloated egos, remain wounded and unforgiving. This is an attempt to hold lawyers to ransom so that whenever certain powers-that-be are dissatisfied with the outcome of any NBA election, they can easily invoke this very divisive provision.

It is a recipe for anarchy, a foundation for complete uncertainty and distortion of established practices within the bar. It is mind-boggling trying to imagine a scenario where the doctored bill is passed into law and a furious NBA protests that same does not represent what was sent to the National Assembly even as the overlords within the Body of Benchers insists on the flawed bill – effectively dragging the legal profession to utter disrepute.

My question is; where would such an imbroglio leave young lawyers who are still trying to gain their footing in the profession, if they get caught up in such a web of authority tussle between the NBA and the Body of Benchers? Indeed, the possible number of bizarre eventualities that will confront us, where this evil provision to sail through, are endless. It is a good thing that the fraud was discovered and nipped in the bud.

May we never see the day where the collective will and progress of a collection of learned and noble minds are sacrificed on the altar of selfish and egoistic practices.

TOPIC: “Extra Judicial killings in Nigeria; any justification”?

Introduction

There is an upsurge in the rate of extra judicial killings in Nigeria. Thus there is a need to look into this. The authorities have either turned deaf ears to these happenings and by necessary implications promoted the breakdown of law and order in Nigeria.

Definition of Extra-judicial killing

Extra-judicial killings is said to be a killing done by government officials without judicial or legal process.

This happens when someone in an official position deliberately kills a person without any legal process.

Its a violation to right to life, designating killing of an individual by State agent without a judicial process.

This is because the law sees every human life to be a precious thing that needs to be cherished, even though the law gives exceptions to right to life, there’s still no justification for extra judicial killings.

There are several instances where extra judicial killings has taken place in Nigeria. For example police brutality on peaceful protesters.

The noxious trend recurred at Ota-Efun, Osogbo, the Osun State capital, early in December when a police sergeant, Moses Samuel, killed a rig operator, Kabiru Babai, during an altercation. The same officer, who is reportedly undergoing orderly room trial, also injured a truck driver, Harisu Musa. The real tragedy of that story is that Babai was protesting the shooting of Musa when he was killed by the officer.

Early in November 2021 a police officer that has yet to be named, killed a tricycle operator in Meiran, Lagos State, triggering the mayhem that eventually claimed three lives. That incident was sparked by a demand for a measly N100 bribe. In September, another officer reportedly shot dead a 29-year-old father of one identified only as Gift, who was marking his birthday in Obinomba, in the Ukwani Local Government Area of Delta State.

While engaged in extortion, power-drunk police officers kill innocent civilians with reckless abandon during disagreements over paltry sums. Rogue officers of the Nigeria Customs Service, especially under its current Comptroller-General, Hameed Ali, also kill recklessly. In July 2021, Customs officers invaded Igangan, Igboora, Ayete, and Tapa communities in the Ibarapa LGA of Oyo State. When the dust settled, three people lay dead. The NCS spokesman, Theophilus Duniya, alleged that the deceased were smugglers. This tenuous claim was dismissed by a federal lawmaker representing Ibarapa Central/North Federal Constituency, Oyo State, Muraina Ajibola, who argued that the communities were over 200 kilometres away from the nearest border post. In May, Customs officers had killed five people at Iseyin, in the same state. No law authorises the summary killing of smuggling suspects.

Killings that should qualify as crimes against humanity have also been perpetrated by the military. The massacre of members of the Islamic Movement in Nigeria by the Nigerian Army in December 2015, where no fewer than 347 persons were killed, is unforgettable. Not only were the Shiites killed, but they were also buried in mass graves. The recommendations of the Justice Mohammed Garba-led panel that those responsible for the killings should be prosecuted have been ignored. Human Rights Watch, Amnesty International, other NGOs and nations have continued to call for justice to no avail.

In the South-East, the military has been reportedly killing citizens on the pretext of waging war against the Indigenous People of Biafra separatists. Many residents have reportedly been murdered by bloodthirsty soldiers without any consequence. AI reported in August that 115 people were killed in four months by security forces across Imo, Anambra, and Abia states. Another gory report in The PUNCH detailed how corpses of victims of extrajudicial killings were piled on each other at the morgue of the Federal Medical Centre, Owerri, Imo State.

From January 2021, gunmen suspected to be ESN militants launched a series of attacks on government infrastructure, including prisons and public buildings, killing several police officers. Amnesty International, in their report, condemned these attacks and called on authorities to bring the perpetrators to justice.

Amnesty International in its report in 2021 stated that Nigerian security forces launched security operations in June, 2021, primarily targeting ESN militants or those perceived as such to decimate the group.

Amnesty International documented at least 115 persons killed by security forces between March and June 2021. Many relatives of the victims told Amnesty International that they were not part of the militants that were attacking security agents.

Many of the victims were deposited at government hospitals in Imo and Abia state. According to several hospital sources all the victims deposited by the police had bullet injuries.

For instance, in two of the cases documented by Amnesty international, the victims were targeted with no apparent justification:

Uguchi Unachukwu, a German-based businessman was killed by soldiers on 31 May 2021, at a checkpoint near Owerri airport on his way out of the country. The police are yet to investigate the crime.

Mathew Opara, a 45-year-old businessman, was shot by soldiers on 25 May 2021 in Orji, near Owerri. Witnesses told Amnesty International that he was returning from work when he ran into a team of soldiers in armoured vehicle and Hilux vans shooting at residents. He was shot in the chest and could not receive immediate medical help because of the violence. His family said the military acknowledged the killing but did not launch an investigation or offer any apology.

Certainly extra judicial killings are unlawful and should be condemned in all ramifications

Under the law there are exceptions to when an individual life can be taken and it won’t amount to unlawful killing.

According to Section 33 of the 1999 constitution of Nigeria , these are the exceptions to right to life; self defence, execution of a court sentence, to effect a lawful arrest, to suppress a riot, mutiny and insurrection.

However, it should be noted that under the law there is no justification for extra-judicial killing.

Unfortunately, it seems the political and security leadership in Nigeria think nothing of the high rate of killings by state actors.

It is on record that 99% of these unlawful killings go largely unpunished, thanks in part to Nigeria’s Force Order 237, which allows officers to use lethal force in ways that contravenes international law, and because of government corruption and a prevailing culture of impunity.”

Ordinarily Force Order 237 ought only to be applied when the life of a Police officer is in danger

Section 3 states as follows: A Police officer may use firearms under the following circumstances:
A. When attacked and his life is in danger and there is no other way of saving his life;

B. Where defending a person who is attacked and he believes on reasonable grounds, that he cannot otherwise protect that person attacked from death

C. Where necessary to disperse rioters to prevent them from committing serious offense

D. If he cannot by any other means arrest a person WHO BEING IN LAWFUL CUSTODY ESCAPES AND TAKES TO FLIGHT IN ORDER TO AVOID REARREST.

It partly explains the #EndSARS protest of 2020.

In Nigeria, security agents compete with blood tasty non-state actors like Boko Haram/ISWAP terrorist, bandits, and Fulani Herdsmen in massacring Nigerians.

Lawmakers have a crucial role to play. Where there are killings, the House of Representatives members and senators from the affected constituencies should take the heads of the concerned security units to task.

NBA AT BOTH NATIONAL, STATE AND BRA CH LEVELS SHOULD RISE TO THE DEFENSE OF HUMAN RIGHTS.

By regularly interrogating service chiefs and the police hierarchy, and ensuring proper accountability, sanity might return to the system. UNFORTUNATELY IN TODAYS NIGERIA THE LAW MAKERS WOULD INVITE THE SERVICE CHIEFS AND THEY WOULD REFUSE TO HONOR SUCH INVITATIONS AND NOTHING IS DONE AS A DETERRENT ON SUCH OBVIOUS MALADMINISTRATION.

The state governors have been negligent and uncaring. They rarely follow up when security agents kill people extra judicially in their domain.

This must change. In their utterances and interactions, governors must demonstrate that they value the lives of citizens.

A governor could demand the removal of a commissioner of police under whose watch there are extrajudicial killings.

For instance, the governor of Ogun State, Dapo Abiodun, should lead protests against the high rate of killings by Customs officers in Ogun.

Nigerians must also stand for their rights. Peaceful protest is a constitutional right of every Nigerian and must be responsibly deployed to decry the highhandedness of security agencies. Civil societies and rights groups should mobilize the citizenry to demand punishment for killer security personnel.

Aside from the dismissal and prosecution of the culprits, their supervising and commanding officers must not be spared.

The United States of America ??, United Kingdom and European countries’ citizens stage civil protests, sit-ins, petitions, and lawsuits to press for justice.

Liberty must be defended to be enjoyed.

The participation of the military in civil security in Nigeria is doing more harm than good. Therefore, the President, Major-General Muhammadu Buhari (retd.), should restrict the military to its primary constitutional role of fighting external aggression and reform the Customs.

Extrajudicial killings persist because there is little deterrence or consequence.

For a start, Nigerians must demand the implementation of the recommendations of the judicial panels of inquiries set up in the wake of the #EndSARS protest.

The security agents recommended for trial must be prosecuted.

Affected communities, individuals and families of victims should also seek justice through litigation.

An international Human Right non-governmental organization, has disclosed that not fewer than 122 cases of extra judicial killings were recorded in Nigeria between January and October 4, 2020.

We have international laws which kick against extra-judicial killings includes;

A. Universal Declaration of Human Rights (UDHR)

B. African Charter on Human and People’s Rights (ACHPR)

C. International Covenant on Civil and Political Rights (ICCPR)

D. Basic Principles on the Use of Force and Firms by Law Enforcement Officials (BPUFF).

E. United Nations Code of Conducts for Law Enforcement Officials (CLEO)

F. Principles on the Effective Prevention and Investigation of Extra-Legal, Arbitrary and Summary Executions, UN Model Protocol for a Legal Investigation of Extra -Legal, Arbitrary and summary execution.

In Nigeria we also have laws that kick against extra-judicial killings and they are;

1. The 1999 Constitution

2. Criminal Code and Criminal Procedure Act (both applicable in th Southern States in Nigeria),

3. Penal code and Criminal Procedure Code (both applicable in the Northern States in Nigeria),

4. Administration of Criminal Justice Act 2015 (ACJA) and

5. Administration of Criminal Justice Law (ACJL),

6. Nigeria Police Act and

7. Police Force and

8. Police Order 237.

Curbing extra judicial killing would be made easier if the revised force order 237 is effectively implemented.

The 2009 Amnesty report “killing at will: Extra-Judicial executions and other unlawful killings by the Nigerian Police” has given different areas that needs to be looked into when curbing extra-judicial.

A. The weak oversight mechanisms of the Nigeria Police force and

B. chronic lack of resources are some of the areas the 2009 Amnesty report.

General Legal Framework for Human Rights Protection The Chapter IV of the 1999 constitution of the Federal Republic of Nigeria, which Is a supreme law, sets out the fundamental human rights of the citizens of the Nigeria. The provisions of the Constitution are clearly against torture and killing and promote the right to life.

The Federal Government also established the National Human Rights Commission which is charged to deal with matters relating to the protection of human rights as guaranteed by the Constitution, the African Charter on Human and Peoples’ Rights, the United Nations Charter and the Universal Declaration on Human Rights and other International Treaties on human rights to which Nigeria is a signatory.

Although Nigeria has ratified the International Covenant on Civil and Political Rights (ICCPR) in 1993, the Convention against Torture (CAT) in 2001 and the Optional Protocol to the Convention against Torture (OPCAT) in 2009 they have not been integrated into the local laws.

Nigeria is also, yet to recognize the competence of the Committee against Torture to receive communications from individuals under article 22 of CAT.

Nigeria has established a National Committee on Torture as its National Preventive Mechanism (NPM) for the prevention of torture at the domestic level in accordance with the obligations of OPCAT.

The committee is charged with the duty to receive and consider complaints on torture; conduct visits to places of detention and examine allegations of torture, prevent torture by reviewing the treatment of persons.

Section 5 (a) National Human Rights Commissions Act put in place, a national anti-torture policy.

Nigeria is also a State Party to the African Charter on Human and Peoples Rights (ACHPR).

Though there are presently no legal provisions criminalizing torture or providing compensation to victims of torture in accordance with the UN Convention against Torture and extra judicial killings, it is believed that Chapter IV of the 1999 Constitution is encompassing, a notion that has been disproved by the prevalence of torture.

In March 2011, PRAWA carried out a research and monitoring exercise on cases of torture, cruel and inhuman and degrading punishment committed by law enforcement agents in Enugu state, Eastern part of Nigeria. This was done with a team of lawyers, psychologists and medical practitioners trained under the Torture Documentation and Redress Scheme (TDRS) Project.

The findings are as follows:

1. Statistics of the research indicated that out of the 176 victims interviewed, victims of torture ranged between the ages of 13 to 54 years, with young people between the ages of 26- 30 as the most frequent victims of torture in the state.

2. Out of 176 victims interviewed only 1 female was identified and interviewed. This was because the other female victims were not willing to reveal their ordeal in police custody.

3. Method of torture on the victims include prolonged detention in police custody, gunshot wounds 24.71%, severe beatings with police baton and other dangerous objects 36.21%, burning with hot objects 8.05%, squeezing of testicles and inserting objects into the penis, insertion of nails on feet 1.72%, electric shock, suspension on the tree in different positions 13.22%, cutting with cutlass 12.64% and other forms of torture. •

4. The Special Anti Robbery Squad (SARS) have police officers who are specially designated to torture crime suspects. Such police officers have an unofficial designation like “OC Torture” (Officer In Charge of Torture), and they have special skills in infringing various methods of torture on their victims.

The reason they were tortured was to obtain information or confessional statement from them before their trial.

Extrajudicial executions, other unlawful killings and enforced disappearances in Nigeria are not random.

In a country where bribes guarantee safety, those who cannot afford to pay are at risk of being shot or tortured to death by the police. The family of the victims often cannot afford to seek justice or redress, because they cannot pay for a lawyer or the court charges. In many cases, they cannot even afford to retrieve the body. In many cases, detainees wait for weeks or months in police custody to be charged and brought before a court.

Amnesty International recorded 29 cases of victims of enforced disappearances and extrajudicial executions who had never appeared before a judge.

Key issues of concern

a) Systematic torture in police and other centre of detention.

(b) Lack of adequate documentation and tracking of all tortured suspects upon reception in prison (from the police).

c) Lack of institutionalization mechanism for compulsory autopsy of all deaths in custody.

d) Lack of comprehensive database of all places of detention, their locations, addresses and the total number of persons in detention.

(e) Lack of adequate institutional process of internal and external monitoring and oversight of all detention facilities in Nigeria

(f) Torture and inhumane treatment of Mentally disabled person within the criminal justice delivery system including the detention and lack of psychiatric/medical treatment and review of the mentally disabled prisoners (including the ‘civil lunatics’ who have committed no crime and are only detained because of their mental state rather than being taken to mental health institutions).

g) Lack of provision of adequate rehabilitation services, care and treatment for torture victims by the State.

(h) Lack of reporting and documentation of all cases of Torture and Extra Judicial Killings.

There is no mechanism in place in the constitution or any other law to check and monitor the law enforcement agencies.

The absence of CCTV in the ‘questioning room’ has afforded the law enforcement agencies the luxury to get away with extra judicial killings and torture.

i) External Oversight of the Nigeria Police Force The NPF’s myriad failings—to prevent crime, to solve crime, to punish police.

The opening remarks were rendered by Mr. Mohammed Waziri, (Chairman Elect of NBA Minna Branch). In his address the Chairman Elect welcomed the Learned Silk, Chief Joe-Kyari Gadzama, SAN and his entourage. He commended the impeccable personality of the Learned Silk, saying that the Learned Silk has remained a true Patriot of the Nigerian Bar and had come not just as a visitor but as one of them to share his ideas with the NBA Minna Branch.

Thereafter, he ceded the floor to the anchor who introduced Mr. Mohammed Monguno to address the attendees. Mr. Mohammed Monguno speaking passionately about the Learned Silk Joe-Kyari Gadzama, SAN said he had known the Learned Silk for a long time; since they were students. He said, “I have known Chief Joe-Kyari Gadzama, SAN and I still know him. He is someone who is resolute hardworking and God-fearing. I believe he can take the NBA to greater heights because I have watched him through the help of God advance his career from the lowest point without the advantage of a silver spoon to the peak of professional achievements. That is why I can speak on his behalf. I urge you all to give him your utmost support”.

Addressing the attendees, Mr. Mark referred to the Learned Silk as one who was not just interested in the professional growth of lawyers under his employment but was also concerned about personal development. He said, the Learned Silk had overtime ensured that his Counsel in the office were sponsored from time to time to take several certifications. He also referred to the Learned Silk as a quintessential Bar Patriot and a father not just to his biological children but his professional children.

Rashidat Obamojure, Esq. buttressed the Learned Silk’s ingenuity and fairness in handling issues in the office, (J-K Gadzama LLP). She described the Learned Silk as one who was fair to all regardless of religion, tribe or gender. Finally, the Learned addressed the attendees thanking them for their patience and kind gesture in hosting and accepting him as one of them. COURT RULES BAN: AKPATA IN TALKS WITH ABIA CHIEF JUDGE

• SIT-AT-HOME ORDER DISRUPTS NBA/CJ PARLEY

The Nigerian Bar Association (NBA) President, Mr. Olumide Akpata has waded into the brewing crisis in the Abia State Judiciary following a directive by the Abia State Chief Judge, Justice Onuoha Ogwe to bar lawyers from its courts.

Justice Ogwe had in a letter to NBA branches in the state informed them of his directive to judges to deny audience to lawyers without original copies of the controversial Abia State High Court (Practice and Procedure) Rules, 2021.

CITY LAWYER gathered from impeccable sources that NBA branches in the state are bracing for a battle with the state chief judge over the directive which a senior lawyer described as “insulting and degrading.”

But apparently to stave off a full-blown face-off with lawyers which may cause total shutdown of the court system, Akpata told CITY LAWYER that he has waded into the matter with a view to reaching a resolution.

Aside from engaging the embattled chief judge on the matter, the NBA President has also directed the chairmen of NBA Umuahia and Aba branches to meet with Justice Ogwe in order to hammer out a win-win solution to the debacle.

Akpata told CITY LAWYER that “I have reached out to the CJ and I have also asked the Chairmen of our Umuahia and Aba Branches to see him today.”

On the position of the NBA on the controversial directive, Akpata said: “This directive really is not tenable and I have told the CJ that much. Firstly, right of audience before a Court cannot be circumscribed except by virtue of clear statutory provisions in this regard. Secondly, in this day and age it is a bit strange to insist that every lawyer must possess a hard copy of the Rules when technology provides us with other alternatives.”

The NBA President was however confident that an amicable resolution would be reached on the face-off, saying: “I am hopeful that the matter will be resolved today after the meeting between the CJ and our Chairmen.”

However, there are strong indications that today’s meeting may not hold due to the weekly sit-at-home in the South East originally ordered by the pro-independence group, Indigenous People of Biafra (IPOB).

When CITY LAWYER contacted the chairman of NBA Umuahia Branch on whether the meeting was underway, he said: “The time of our meeting with the CJ is not yet settled. Today is sit-at-home in the East.”

CITY LAWYER recalls that the chief judge had in the letter observed that “lawyers have refused to purchase the new High Court Rules, while some photocopied the Rules for use in court.”

Dated June 16 and signed by the Chief Registrar of Abia State High Court, Mr. V. C. Okey-Nwokeukwu, the letter warned: “The Hon. Chief Judge directs that as from the date of this letter, any lawyer that appears in our High Court without his copy of the High Court Rules shall not be granted audience.”

But a senior lawyer who practices in the state told CITY LAWYER that many lawyers in the state are “agitated” by the directive, adding that they view it as “insulting and degrading.”

He said that while it is inappropriate for lawyers to photocopy the Rules as this may infringe copyright laws, “I can tell you that the directive will be ignored by most lawyers. Also, no judge can enforce that directive. On what basis will they do so? It is not compulsory for any lawyer to go to court with any Rules of court. It is optional. More importantly, it is payment of Bar Practising Fee that accords a lawyer audience in court, not possession of any court rules.”

Apart from Umuahia and Aba, the other NBA branches in Abia State are Isiala Ngwa, Ohafia, and Ukwa.

CITY LAWYER investigation shows that at least one jurist, Justice C. U. Okoroafor has refused to recognize the new Rules given that it bears the name of the former chief judge of the state as the signatory.

It was gathered that though the current chief judge had ‘corrected’ the defect through a Practice Direction, Justice Okoroafor does not permit the use of the Rules in his court, leading to a face-off with NBA Aba Branch which directed its members to boycott Justice Okoroafor’s court, citing “particularly his blatant refusal to use and or allow lawyers to rely on and or use the Abia State (Practice & procedure) Rules, 2021 in his court on the erroneous premise that there was no High Court Civil Procedure Rules in existence in Abia State.”

NBA BRANCHES SET TO BATTLE ABIA CJ OVER DIRECTIVE

A recent directive by the Chief Judge of Abia State, Justice Onuoha Ogwe to judges in the Abia State Judiciary to deny audience to lawyers without original copies of the new Abia State High Court (Practice and Procedure) Rules, 2021 may cause a fresh rift with Nigerian Bar Association (NBA) branches in the state.

The directive obtained by CITY LAWYER and addressed to Nigerian Bar Association branches in the state noted that “lawyers have refused to purchase the new High Court Rules, while some photocopied the Rules for use in court.”

On his part, the Chairman of NBA Umuahia Branch, Mr. Oliver Amuzie told CITY LAWYER that he is in receipt of the letter, adding that “I am aware that other branch chairmen in the state have just received their copies of the letter.”

He said that the branch chairmen would discuss the matter this weekend with a view to have a common position on it. “I am already reaching out to my brother-chairmen on the issue,” he said. “We have a common platform and we would soon arrive at a resolution on the matter.”

Apart from Umuahia and Aba, the other NBA branches in Abia State are Isiala Ngwa, Ohafia, and Ukwa.

CITY LAWYER gathered that the ongoing boycott of courts by lawyers under the aegis of NBA Aba Branch may not be unconnected with the controversy surrounding the new Rules.

It is recalled that the branch had in a resolution dated 10th June, 2022 and signed by Messrs Bertram Faotu and Chinedu Nwaozuzu, its Chairman and Secretary respectively, ordered its members to boycott the court of Justice C. U. Okoroafor.

The branch leadership said that “the resolution was arrived pursuant to the learned Justice’s continued show of absolute disdain for proper judicial conduct and particularly his blatant refusal to use and or allow lawyers to rely on and or use the Abia State (Practice & procedure) Rules, 2021 in his court on the erroneous premise that there was no High Court Civil Procedure Rules in existence in Abia State.”

CITY LAWYER investigation showed that the jurist had allegedly taken the position that the signing of the Abia State (Practice & procedure) Rules, 2021 was defective, given that it bears the name of the former chief judge of the state.

I met Mr. Clement Ugo Chukwuemeka, Esq. in 2020 when my brother and colleague, Mr. Benson Aigbojie, was physically assaulted by personnel of the Nigerian Police in the Federal Capital Territory, Abuja, while in pursuit of his professional duty as counsel to one of the Police detainees.

As soon as Mr. Clement Ugo Chukwuemeka got wind of the indecent treatment of our colleague by personnel of the Nigerian Police, kabusa Police station to be precise in Abuja, he headed straight for the Police station where this assault took place. He immediately contacted the then President of the Nigerian Bar Association, Mr. Paul Usoro, SAN. Whilst a wrong information was given as regards my brother ordeal. He deployed the totality of his arsenals in seeking the redress of Mr. Benson Aigbojie for the unprofessional conduct of the Police.

As the Chairman of the Bwari branch of the Nigerian Bar Association, he proved himself to be a servant-leader and this earned him the love, respect and admiration of members of the Bar in FCT and beyond. Ever since that time till now, he has remained a noble servant-leader and a rallying point for many members of the bar, regardless of their post call ranking. He has assisted me personally in ensuring that I excel in my practice as a courtroom advocate and in the legal profession in general. I am persuaded that Democrats as we fondly call him, is a “good product for the NBA market” and I urge all members of our noble Association (the NBA) to support his bid for the office of 2nd Vice President of the NBA in the forthcoming coming election as he contributed towards the love I have for NBA till date. Clement Ugo Chukwuemeka is indeed a sui generis undiluted Bar man.

OGUNJIDE EMERGES NBA GWAGWALADA CHAIR, VOWS INCLUSIVE BAR

Following the election of the Gwagwalada Branch of the Nigeria Bar Association conducted on Saturday, the 11th of June, 2022 , Mr. Emmanuel Tayo Ogunjide, popularly known as ETO, has emerged as the new Chairman after a keenly contested election. To emerge as the new Chairman, Mr. Ogunjide scored 102 votes to defeat his only contender for the position, Mr. David Ebosetale Aigbefoh who garnered 25 votes only.

The results of the election was openly announced by the Electoral Committee of the branch Chaired by Ashara Mohammed, Esq. Thereafter, Mr Ogunjide got sworn in as the new Chairman before an array of who is who from the Gwagwalada branch of the Bar.

In his maiden but brief remarks shortly after taking his oaths of office and allegiance as Chairman, Mr Ogunjide promised to live up to the expectations of the branch in line with his campaign promises while seeking for the position. The event which held at the Gwagwalada Division of the High Court of the Federal Capital Territory, Abuja, afforded the visibly elated Mr Ogunjide the opportunity to be thankful to God, elders of the Gwagwalada branch of NBA, the Electoral Committee, his campaign teams and others too numerous to mention who contributed in one way or the other to his emergence as the new helmsman of the Gwagwalada branch of NBA.

In his usual unassuming and modest nature which he exhibited throughout the period of the campaign, Mr Ogunjide was emphatic that though he won the election overwhelmingly, however, in a contest of that magnitude involving learned members of the Bar, there’s neither a victor nor vanquished. It was a remark which earned him a thunderous applause.

The new chairman alongside members of his new executives thereafter took a symbolic salutary bow before everybody to affirm their appreciation and readiness to set the ball rolling in serving the branch wholeheartedly.

Immediately he assumed office, the first assignment performed by the new Chairman was to seek for the ratification of the reconstitution of the Electoral Committee of the Branch which he accordingly announced will henceforth remain a standing committee in line with the Uniformed Bye Laws of the Nigeria Bar Association..All members at the Annual General Meeting collectively, without any hesitation, approved same.
Mr Tayo Ogunjide further informed members on the need to roll out the drums as the Gwagwalada branch of NBA now under his watch has attained 10 years of existence having been created in 2012. A Committee to that effect was again expressly approved by the members for the new Executive to set it up without much ado.

It later became an emotion laden gathering with full of gratitude to God as Mr Ogunjide openly used the opportunity to thank his wife, Magistrate Janada Balami-Ogunjide and his family members for their unflinching support before, during and after the electioneering campaigns.

The icing on the cake of his gratitude to God and humanity were members of his campaign team; ETOTRATIB/THINK TANK which he specially recognized and acknowledged as the solid rock of Gibraltar behind his success story as the new chairman, stressing that, for the rest of his life, he will always live to appreciate their love, support and magnanimity. He also acknowledged the spirit of his opponent Team ABTC.

Other members of the newly sworn in executive of the 10 year old Gwagwalada branch of NBA are Miss Onwubiko Barbara as Vice Chairman, Hassan Luqman Olayiwola, Esq. as Secretary, and Mr. Olusegun Richard Femi, Esq. as Publicity Secretary. Completing the list of the new Exco are: Mrs Gwary Tessy who was sworn in as Financial Secretary, Mrs. Ezegwu Emmanuela as Assistant Secretary, Mrs Esther Opeyemi Akinrinde as Treasurer,
Mrs. Oboh Christy as Welfare Secretary, Eze Friday Esq. as Social Secretary and the last but not the least member of the ETO led Exco is Mr Aliyu Zubairu Yakubu, Esq. as the provost of the team.

Dignitaries who attended the swearing in ceremony include Prof Mrs J. A . A Agbonika, (SAN), Alhaji I.G Haruna and A. A Mohammed, Esq. among others too numerous to mention, who, one after the other prayed to God to grant newly elected Executive members of the Eagle Bar the necessary wisdom, knowledge, grace and tenacity of purpose to be able to soar like an eagle while carrying out the enormous tasks ahead of them.

My name is Wale Adegoke, Esq. I am a Legal Practitioner, Chartered Arbitrator, and the current Vice Chairman of the Nigeria Bar association (NBA) and the Chairman, Human Right Committee.

Hearing about the interest of Isaac Omuta Ogbah, FICMC in contesting for the position of 3rd Vice President of the NBA, I know that the time has come for the real change to galvanize the legacies of the Olumide Akpata administration.

I have known Ogbah for a very long time precisely around 2004-2005 when we worked together as Counsel in the Law Firm of Punuka Chambers at Lake Street, Apongbon, Lagos State. His passion for law is contagious. No wonder he excelled at the interview and was hired. All through the period we were together, he performed creditably and was a model of diligence and discipline.

After his exit from the firm, he had carved numerous niche for himself including setting up of the ‘Erudite Judgements of the Supreme Court’ and publication of several legal texts including the one in intellectual property.

He is a social activist and a voice to the voiceless on critical social issues.

Subsequently, he became the Vice Chairman of the Utter Bar between the periods of 2016–2018 and served as the Chairman from 2018-2020. His administration came out to be trail blazing and standards. He launched the Utter Bar into national prominence and Bar consciousness that catapulted our Branch to the 5th position out of the 125 branches nationwide as at the time.

Isaac Omuta Ogbah, FICMC work ethics is second to none and has the unique skills of innovation, communication, relationship building and philanthropy as his great strengths which will come in handy in his role as the 3rd Vice President [when elected]. He has single handedly spearheaded public/bar related projects without expectation of rewards.

More than Ten thought provoking decisions were reached at this NEC held in Ilorin, the creation of additional branches in FCT , Abuja to solve the lingering problem manufactured by the enemies of the Bar, instituting about 8 disciplinary cases against senior lawyers of the bar, and above all institutionalizing of compulsory written contract between counsel and law-firms etc. It was indeed a good way to end a tenure . I hereby urge NEC members especially the Branch chairmen and their Excos to institutionalize peace and harmony in their branches . We can not be hosted by a state of harmony without imbibing it as a culture in our daily lives . Safe journey NEC members .

The servants’ knowledge of the long-term investment, time horizon, confirmed by the master’s journey, combined with the act of immediately investing the talents indicates their understanding of the time value of money.

The servants went about investing according to their abilities, undoubtedly with different strategies, and among the different asset classes.

Lesson: A servant must understand the time value of money for example, the dollar had an average inflation rate of 5.6% per year between 2020 and today, producing a cumulative price increase of 11.71%.

The owner of the talents demonstrates trust in his servants and in the principles of modern portfolio theory already at work in the first century. Effective management includes allocation, diversification, and weighting of the talents among different strategies and asset classes.

The owner, preparing for a journey, maintained investment goals for his talents. He must have been familiar with his servants’ work, knew their track record, and trusted them accordingly with his property.

The owner selected three stewards and weighted the talents investment according to the stewards’ abilities: e.g 62.5% to the lead servant, 25% to the second, and 12.5% to the third respectively.

The servants diversified the talents through investing, trading, and in savings.

Lesson: The owner of talents must be familiar with his servants’ work, know their track record and must be able to trust them accordingly with his property.

OWO KILLINGS: ‘TIME TO OVERHAUL NIGERIA’S SECURITY SYSTEM,’ SAYS TAIDI

The Owo Attack and Security Agencies in Nigeria

The attack on the Catholic Church Owo, Ondo State, where scores of worshippers were killed and several others wounded has again been greeted with the usual “condemnation” from various quarters – as if such a response is enough to avert future occurrences of similar or worse attacks.

The dastardly act has again exposed the ineptitude of our security agencies whose score card has certainly fallen below zero in intelligence gathering. The whole thing was made even more odious by the complete lack of response from the police, or the motley number of uniformed agencies that are sworn to defend the people, thus making it easy for the attackers to operate maximally and flee without any intervention or interception.

The inability of various security agencies to device effective intelligence gathering is responsible for the calamities that befall us in various locations and at varying shades of vileness.

Our security agencies, despite the huge allocation of scarce resources, are constantly caught sleeping on duty and this has become a running national embarrassment.

Again, we must insist that the time has come to re-examine the nation’s security architecture, to overhaul and upgrade the detecting arm of all the security forces and to recalibrate our surveillance systems to meet modern methods of investigating crime. We have been locked in an obsolete system where we spend money on men, rather than on sophisticated materials and scientific methods.
At this point, a national summit on security will not be out of place because the brains currently manning our forces appeared tired, and posses neither the enthusiasm for crime fighting nor the innovative skills required to succeed at such an enterprise.

I condole with the families of the victims as well as the Catholic community over this avoidable loss of innocent lives and pray for the repose of the souls of those whose lives have been so brutally cut short.

I hope those whose duty it is to arrest and prosecute the criminals responsible for this mayhem will, for once, do their job swiftly and effectively in order to bring closure to the families of the bereaved and the rest of our anxious nation.

Remember the lesson in part 2 is that you should not give your talent to someone that will do nothing with it.

The severe consequences to the unproductive servant, far beyond anything triggered by mere business mediocrity, tell us that we are to invest our talents and, not waste them.

The particular talent invested in the parable is money.
It depicts investing, not hoarding, as a godly thing to do if it accomplishes godly purposes in a godly manner.
In the end, the master praises the two trustworthy servants with the words, “Well done, good and trustworthy slave”
In these words, we see that the master cares about the results (“well done”), the methods (“good”), and the motivation (“trustworthy”).

He assesses the stewardship of his servants. He evaluates them according to how faithful each was in making wise investments of his money to obtain profit.

Lesson: master is interested in making wise investments of his money to obtain profit.

RE: THE NBA ACCESS TO FINANCE SCHEME COMMENCING

On Monday, May 23, 2022, and Friday, May 27, 2022, the NBA, ably and amiably led by Mr. Olumide Akpata, signed a Memorandum of Understanding (MoU) with First Bank Ltd and Access Bank Plc respectively, as it relates to the framework regulating the NBA Access to Finance Scheme.

The imperative of the instant pilot scheme of the NBA, created for lawyers who may require loans for their working capital, operational needs and sundry purposes, cannot be overemphasized. This is especially true given that lawyers who meet the prescribed eligibility criteria can now access up to N2 Million at a single-digit interest rate.

This is indeed a huge milestone for the NBA community and a further testament to the waves of other lofty welfare initiatives of this present administration. I cannot but wholeheartedly commend this initiative and urge every and any eligible member to key into the many benefits the scheme affords.

As one of my focal areas of interest is to promote viable fiscal policies that enable the financial security, growth and stability of legal practitioners across Nigeria, it is a desire of mine, as a matter of urgency, to see that this instant scheme grows, thrives, and impacts the quality and development of the practice of law and the legal profession in Nigeria through financial empowerment.

‘WE NEED LAWYERS TO SPEAK TRUTH TO POWER,’ CLEMENT CHUKWUEMEKA TELLS NBA BWARI

Special Goodwill Message To My Branch, NBA Bwari Branch (Cradle Bar) On The Occasion of her Annual Law Week, 2022

There is always joy when you look back and discover that , your foundational Branch remains a key player in the Bar community.

The topic and the keynote speaker must have been chosen by the wisest men in this legal profession. I, Clement Ugo Chukwuemeka am not surprised to see the quality and caliber of discussants.

Bwari Branch, in the last Ten years has demonstrated capacity of standing amongst the oldest branches of NBA, chilling comfortably with the big boys branches in area of advocacy.

The above is demonstrated in the novel and epoch Theme chosen for this year’s law week. While lawyers are running away from condemnation , responsibility and blames, the leadership under the captainship of the pilot, Monday Adjeh refused to exonerate lawyers in the problem bedeviling the Nigeria space, hence the choice of the law week topic across the NBA community: THE STATE OF THE NATION, Where are the lawyers?

Lawyers in Nigeria have disappointed the Nigerian society; I can attribute all these to the lackadaisical approach of lawyers towards human rights abuses, exoneration of being the chief pressure group in the land and above all, reluctance in holding leaders accountable to their disrespect to rule of law and protection of life and property, not leaving out the religiosity monster amongst colleagues.

You can not be a judge of a court without firstly, being a lawyer! The Bench and the Bar must agree that lawyers have failed this nation and begin to thinker very quickly the solution and mechanisms as the way forward for Nigeria .

The sub-theme of the event can be seen as catalyst towards achieving a state of the nation where all amenities for survival abound. Can the lawyers perform optimally without first imbibing the ethics of the profession? Can we actualize a good state of the nation without proper administration of justice founded on the principle of rule of law? The absence of the above can never guarantee us the Dinner topic which is Unity In diversity ! We must act now.

The topic no doubt will keep all Nigerians, especially lawyers in a state of reclaiming our nation . We lawyers are responsible to the woes of this nation and it is high time we began in earnest to tell ourselves the truth about our responsibility as the soul of the nation. If we rise up today to say bad governance shall be over , it shall be so.

It is so because , the leaders of the nation submits to us to adjudicate on their existence . We owe the society a duty to do justice and when we begin to deliver meritorious judgement and lawyers that appear before the Judex maintains a high moral standard for the good of the nation , be rest assured the bad state of the nation shall be eroded and the new order of goodness shall be our portion moving forward .

In conclusion, I must thank the organizers and I sincerely felicitate with the NBA Bwari Branch as it holds her Law week. I appreciate the leadership for choosing a Democrat like me, Senator SHEHU SANI to be the keynote speaker. I cannot thank the Chairman enough for this wonderful topic, coming at a time where ethical value of a lawyer before the society is eroding by the day.

Lawyers must lead this discussion and reclaim our lost glory. In the next one month, lawyers shall be electing their leaders; we owe ourselves the duty to look inward and vote for the right candidates that could look the government of day in the face and speak truth to power as well as activate the pressure group mantra to salvage our nation.

May I wish the Chairman, Branch Executives and members of the Branch a successful Law Week.

I, Clement Ugo Chukwuemeka felicitate the NBA Makurdi Branch as it holds her Law Week themed “Democracy, Electoral Process & The Paradigm Of Change In Nigeria”, from the 3rd to 5th of June, 2022.

The choice of topic is apt , coming at a time we are presently. Democratic tenets must be enshrined in our whole life circle and the umpire of our electoral system must as a matter of urgency democratize their policies for us to attain a clear paradigm shift from the usual.

AMANDA ASAGBA: A PROFILE IN BAR SERVICE EXCELLENCE

Justina Ego Amanda Demechi Asagba is a detribalized, courageous, passionate, dependable and Result oriented, Nigerian lawyer, Human Rights Activist, Private Prosecutor, Mediator and Notary Public. She graduated from the Ambrose Ali University Ekpoma (formerly Bendel State University) and was called to the Nigerian Bar in 1990. She is a woman of many parts who sees law as a tool for social engineering for national development particularly as it relates to access to justice, eradication of injustice, corruption, poverty and inequality. ISAAC OGBAH EXTOLS NBA KADUNA ON LAW WEEK

ISAAC OMUTA OGBAH felicitates with the Chairman, leadership and members of NBA Kaduna Branch on their 2022 Law Week activities.

The theme ” Expanding The Frontiers of Legal Practice” of the Kaduna Branch Law Week is a topic of the season as most lawyers are still recovering from the pandemic, and there need to be a way out for lawyers to get back on their feet.

The Legal profession over the years has grown so wide into different aspects of Law and we as Lawyers shouldn’t just stereotype ourselves to Litigation, drafting of Deeds alone. There are so many untapped resources in this business of law which legal practitioners should be averting their eyes to and which can be a gold mine if properly utilized.  

As Napoleon Hill said in one of his famous quotes, “The way of success is the way of continuous pursuit of Knowledge.” 

I celebrate the leadership and members of NBA Kaduna Branch in the occassion of their Law week. I wish each members a fruitful deliberations even as I pray for peace and security within and outside Kaduna State.

‘WHY WE DID NOT DISQUALIFY MAIKYAU’ – ECNBA

The Electoral Committee of the Nigerian Bar Association (ECNBA) has given reasons why it did not disqualify one of the leading presidential candidates, Mr. Yakubu Maikyau SAN from contesting the forthcoming NBA Elections.

In a letter obtained by CITY LAWYER and addressed to embattled Bar aspirant, Mr. Kayode Bello who wrote a petition to the electoral committee seeking the disqualification of the senior lawyer, the ECNBA ruled that it “has no jurisdiction over the complaint, as the subject matter of the petition is pending before the Legal Practitioners Disciplinary Committee (“LPDC”) the competent statutory body for adjudication.”

Dated May 27, 2022 and titled “2022 ELECTIONS OF NATIONAL OFFICERS OF THE NBA – RESOLUTION OF PETITION DATED 2 MAY 2022,” the electoral committee referred to Bello’s petition dated May 2, 2022 “and the response to the petition received from Mr. Yakubu Chonoko Maikyau, SAN, FCIArb (“the Respondent”) dated 12 May 2022.”

In the letter which was copied to Maikyau, the electoral umpire noted that Bello had “requested that the ECNBA disqualifies the Respondent from contesting for the office of the President of the Nigerian Bar Association (NBA).”

The ECNBA stated that it “has considered the petition and the response to same,” adding that aside from the jurisdictional hurdle which it was unable to surmount, “the power of the ECNBA to disqualify a person who wishes to contest for an office shall only crystallizes (sic) after a conviction of crime by a court of competent jurisdiction or if the candidate is found guilty of misconduct or professional impropriety by the LPDC by virtue of Part VII(e) and (f) Second Schedule of the Constitution.”

Sounding the death knell on Bello’s petition, the electoral committee wrote: “Consequently, your petition fails.”

In a petition addressed to the ECNBA Secretary and copied to CITY LAWYER, Bello had urged the ECNBA “to suspend the candidature of Mr. Y. C. Maikyau as the NBA presidential Aspirant, pending the determination of the disciplinary case against him at the Legal Practitioners Privileges Committee (LPPC) for his misconduct.”

Restating his grouse, Bello wrote: “In summary, Mr. Y.C. Maikyau who stands as presidential aspirant for the office of the NBA President in the forthcoming NBA election has lied to the LPPC that I did not show up at the Nigerian Law School for my Bar Final examination and he has used his office and position as the Senior Advocate of Nigeria to frustrate the reconciliation process between the Council of Legal Education and myself (Kayode Bello).

“The fact that Mr. Y.C. Maikyau lied to the LPPC that I did not or refused to show up for my Bar final examination in 2017 is/was tantamount to perverting justice and conspiracy to disobey the order of the Court.”

Maikyau however denied all the allegations in his response to the electoral body.

‘REVERSE MY UNREASONABLE DISQUALIFICATION,’ ASHIMOLE BEGS APPEAL C’TE

RE: 2022 ELECTIONS OF NATIONAL OFFICERS OF THE NBA AND NBA REPRESENTATIVES TO THE GENERAL COUNCIL OF THE BAR – NOTICE OF DISQUALIFICATION.

1. The email of disqualification was received in my spam today, 28th day of May 2022.

2. That I am contesting for the office of Publicity Secretary and duly completed a nomination form in that respect and not the office of Assistant General Secretary as indicated in the disqualification letter.

3. That on May 10th May, 2022, I was invited for a Zoom meeting for further screening. At this Zoom meeting, I did not meet any Committee member but was interrogated by two ladies, who told me that my sealed form had been opened in my absence, no video of the opening made or shown to me.

4. They informed me that 2021 Local Due Receipt of my 1st nominator, Mr. Mohammed lyorember Tsav, the immediate past chairman of NBA Bwari, my Branch, did not attach local Branch Due of 2021.

5. That my response was that I am shocked at this and asked the ladies, what should I do in the circumstance? They told me that the Committee will get back to me.

6. That I re-sent the said mysteriously missing due to the Committee via info@ecnba.ng. The copy of the email is annexed as F1.

7. That ECNBA did not reply my email, did not send me any letter, did not send any SMS or WhatsApp message to me.

8. That ECNBA instead forwarded me a petition by one Mr. Kayode Bello, a law school drop out. I responded to the said petition but ECNBA, did not communicate to me the outcome of my response to Mr. Bello’s petition.

9. That I never received any letter of disqualification from ECNBA when other candidates received or were cleared.

10. That on 27th May,2022, I sent an email to ECNBA asking what is my status, whether I am qualified or not, having not received any letter from ECNBA.

11. ECNBA merely sent me a copy of the reply they sent to Mr. Bello telling him that his petition had no merit and was dismissed.

12. That today 28th May, 2022 after I wrote to ECNBA on 27th May, complaining of the list “List of Properly Nominated Candidates” ECNBA sent me an email, of notice of disqualification for the office of Assistant General Secretary, dated 20th May, 2022, giving me 7 days to appeal to Appeal Committee.

Dear Sir, It is against equity and good conscience to disqualify me as Assistant General Secretary contender instead of the post of Publicity Secretary, which I am eminently qualified for.

13. That the disqualification sent to me is mischievous and not in compliance with the NBA Constitution and Electoral Guidelines published by ECNBA. That the non-submission of receipt of a nominator who paid is not a constitutional condition to disqualify me as my nominator paid as when due like me.

14. I hereby humbly pray to you the Appeal Committee, to reverse this unjustifiable, uncalled for, unreasonable decision of ECNBA to disqualify me for an office I did not apply for.

15. I further pray that you compel ECNBA to declare me as qualified, fit and proper candidate for the office of Publicity Secretary and not Assistant General Secretary as contained in the letter of disqualification sent to me, having met all requirements and re-submitted Mr. Mohammed lyorember Tsav’s mysteriously 2021 local due, which I duly submitted along with other documents in a properly sealed envelope.
