AKINTOLA VS AKPATA: ‘HOW EGBE AMOFIN SEALED BOYCOTT PACT,’ BY OLAWALE

RE: CHIEF NIYI AKINTOLA SAN & MR. OLUMIDE AKPATA: MERE WITHDRAWAL OF SUPPORT AND NOT “DISTABILIZATION” OF ADMINISTRATION

I have decided to open my diary for the purpose of setting the record straight. I also wish to drive home the point that we are not cowards that run from their shadows. We are old and bold enough to say the truth as it is in order to shame those who distort the truth for personal gain.

On 7th September, 2019, less than a year to NBA 2020 general election, Egbe Amofin held a general meeting at the Aare Afe Babalola Bar Center Ibadan, Oyo State. One of the items on the meeting agenda was to consider presenting one candidate for the position of NBA president. We had 5 notable lawyers of Yoruba extraction with aspiration to the post then. At the meeting, one of the aspirants stepped down his ambition, leaving Dr. Babatunde Ajibade SAN, Deacon Dele Adesina SAN, Mr. Olumiyiwa Akinboro SAN and a former Chairman of NBA Osogbo branch in the race. The general meeting set up a committee whose terms of reference, among others was to assess the 4 aspirants and present the most suitable to Egbe for endorsement. The adhoc committee saddled with this task consists of all branch chairmen of South Western Nigeria who, of course, were Yorubas. Chief Niyi Akintola SAN was appointed at the general meeting to chair the committee while Dr. Oluwole Akintayo (now a Professor) who was then the chairman of NBA Ibadan branch was to serve as secretary.

Meanwhile, another team was set up with the mandate of reaching out to our learned brothers and colleagues under the umbrella of Mid – Western Bar Forum. The idea was to “activate” the proposal of rotational NBA presidency between the two blocks (sic) whenever it was the turn of Southwest NBA to occupy the seat. The team consisted of elders and revered seniors of Egbe Amofin who were mostly Senior Advocates of Nigeria.

It was at our first committee meeting which held on 12/09/2019 at the same Aare Afe Babalola Bar Center Ibadan that modalities and yardsticks for assessment of aspirants was agreed upon. Such yardsticks included but not limited to years of call of aspirants, involvement and participation in NBA activities, past contributions to development/unity of NBA and its members, manifestos and vision for the Bar, general acceptability of aspirants across all NBA branches in the country etc.

Committee agreed and indeed sent letters to the 4 aspirants, requesting them to send in their curriculum vitae and memorandum, showcasing what put them ahead of others under the yardsticks outlined.

When the committee reconvened few weeks thereafter, it was discovered that only 3 of the aspirants sent in their CVs and memorandum. Dr. Babatunde Ajibade SAN did not send a CV or memo.

After critical consideration by committee members of documents sent in, a consensus candidate was not arrived at. Hence, all branch chairmen present put the issue to vote. Secret ballot was conducted after which Deacon Dele Adesina SAN scored the highest vote.

Amongst branch chairmen present and voting on that day was Olayemi Akangbe of Lagos branch, Charles Ajiboye of Ikeja branch, Dr. Oluwole Akintayo of Ibadan branch, Emmanuel Alade of Abeokuta branch, Omololu Bagbe of Okitipupa branch, Olakanmi Falade of Ado-Ekiti branch, Bode Adeniji of Ondo branch, Oludayo Olorunfemi (my good friend) of Ikere-Ekiti branch and Lanre Okeyinka of Oyo branch. Chairmen of Ife, Ikirun, Iwo, Ilesa, Offa, Ijebu Ode, Ogbomoso were all in attendance and voting. Chief Niyi Akintola SAN who was the committee chairman did not vote.

It was at this meeting consisting of NBA branch chairmen that we made a pact; a resolution for ourselves and as representatives of various branches of the NBA of Yoruba extraction, to join hands in working for the emergence of our endorsed candidate. We agreed to support and work with such person if eventually sworn in as NBA president. We also agreed not to support any other. We agreed not to support any other candidate because at that period in time, information had been received that our brothers under the umbrella of Midwest Forum of the NBA had rebuffed Egbe’s hand of fellowship to work together as one.

The general assembly of Egbe Amofin, at a later general meeting, received and ratified the committee’s report in toto.

Chief Niyi Akintola SAN was later betrayed despite his good motive. The Learned Silk was first betrayed by insiders within the committee. He was also betrayed by those whom the committee’s report did not go down well with. Chief Akintola SAN was betrayed by those who seek favour and crumbs from the administration of Mr. Olumide Akpata.

Despite my closeness to Mr. Olumide Akpata who attended branch activities organised by me as chairman in Akure (he even donated the sum of N1m towards building our Bar Center), I was bound by collective agreement reached by Egbe Amofin. I immediately informed Mr. Akpata of my decision not to support him as NBA president. I never for once put him in doubt of where I stand. No one planned or worked towards “distabilizing” NBA under the presidency of Mr. Olumide Akpata. We merely withdrew our support.

We cannot deny what we did as representatives of those who gave us their mandates to serve as branch chairmen. We cannot deny what we did as members of Egbe Amofin. I, for one, cannot deny what I did in the best interest of the Bar to which I was called about two decades ago.

Chief Joe-Kyari Gadzama, SAN on Tuesday, June 14, 2022 paid a courtesy visit to the Honourable Attorney General and Commissioner for Justice of Lagos State, Mr. Moyosore Onigbanjo, SAN at the Lagos State Ministry of Justice, Alausa Secretariat.

The visit of the foremost Senior Advocate to the Lagos State Ministry of Justice is one of his consultations and familiarizations tour to all stakeholders as NBA prepares for her general elections next month. Whilst making his remark, Chief Gadzama, SAN reiterated the need for the Bar to be alive to its duties as enshrined in the NBA Constitution, observe the tenets of the Constitution of the Federal Republic of Nigeria 1999 (as amended) and see to the welfare of all members of the Bar. He stated that the Bar needs a leader who understands the challenges of the Bar and has the capacity, experience and will to tackle them headlong.

Whilst restating his vision to lift the Bar to a higher standard, Chief Gadzama, SAN said the visit is necessary for him to present himself as a candidate for the post of the NBA President and it is important to formally inform the Honourable Attorney General and the entire management of the Ministry of Justice. In his words, “I have the requisite experience to lead the Bar having served the NBA in various capacities; a pioneer Council Member of NBA Section on Business Law (NBA-SBL) under the chairmanship of Mr. George Etomi, a pioneer vice-chairman of NBA Section on Legal Practice (NBA-SLP) under the chairmanship of Mallam Yusuf Ali, SAN and a Pioneer Chairman of NBA Section on Public Interest and Development Law (NBA-SPIDEL) now being ably led by Dr. Monday O. Ubani, a former Chairman of NBA Abuja (Unity) Branch and due to my passion for mentorship and professional training for young lawyers, I was appointed as the Chairman, Mentorship Committee of the Body of Benchers for Young Lawyers due to the annual mentorship programme I organize for young lawyers. I have a moot Courtroom in my head office in Abuja purposely built to expose Law School Externs and University undergraduates to Courtroom advocacy. I am a bridge builder between the older lawyers and young colleagues, I am physically fit, mentally, emotionally and spiritually prepared for the task of leading the Bar.”

Speaking on behalf of the Ministry of Justice, the Honourable Attorney General commended Chief Gadzama, SAN for all his contributions to the Bar and development of law in Nigeria, he assured him that it is customary for the Ministry to welcome all candidates vying for one position or the other in the NBA and the doors of the Ministry is open to Chief Gadzama, SAN. Present at the meeting include some top management members of staff including Mr. S. A Quadri, Mrs. Abiola Olayinka, Mrs. Adenike Oluwafemi, Mrs. Folasade Tugbiyele, Kehinde Taiwo, Bose Fasinde and other State Counsel.

Chief Gadzama appreciated the AG for the audience and warm reception and promised, as the time permits, to reschedule his visit to address all lawyers in the Ministry. NBA PRESIDENCY: GADZAMA SUBMITS NOMINATION FORM AMID CHEERS

The Chairman of the Nigerian Bar Association Security Agencies Relations Committee (NBA-SARC), Chief Joe-Kyari Gadzama SAN has submitted his nomination form and accompanying documents for the coveted position of NBA President in the forthcoming NBA National Officers Election.

A statement made available to CITY LAWYER shows that the former Chairman of the NBA Section on Public Interest and Development Law (NBA-SPIDEL) arrived the Electoral Committee of the NBA (ECNBA) Secretariat at about 3:42 pm yesterday to submit the form in compliance with the Electoral Guidelines. The statement noted that many admirers of the leading litigator accompanied and cheered him on during the submission exercise.

According to the statement, “The Learned Silk giving his final remarks further appreciated the presence of teeming supporters and jokingly closed with a teaser, saying that, although the discussion had ended, just like the Honda Car, the discussion would continue. As usual, the jovial Bar Patriot elicited hearty laughs from all who were present amidst cheers of approval and accolades.

“Whilst exiting the premises, the Learned Silk was excused for an exclusive interview wherein he reiterated the importance of a good, all-inclusive and focused visionary leadership of the Bar.” He added that “We must live up to our roles as the watchdog of the society, the eyes of the blind, the eardrums of the deaf and the mouthpiece of the dumb. Our electoral process must set the pace and trend for the political class of our society to emulate… And this is our dream and vision, because life is not how much you acquire or own but how much impact you’re able to make on the lives of others.”

The Director-General of Vox Populi Foundation for Leadership, Chief Prince Chukwudi Oli thanked the supporters “who took out time from their busy schedules to support the vision of the Learned Silk.”

‘WHY I SHUNNED KLIEGLIGHTS TO SUBMIT NBA PRESIDENCY FORM,’ BY TAIDI

An aspirant for the post of Nigerian Bar Association (NBA) Presidency and former NBA General Secretary, Mr. Jonathan Taidi has said that the submission of his nomination form and accompanying documents was shorn of any razzmatazz in deference to the “tenor of the times.”

Speaking to CITY LAWYER, Taidi also stated that “to lead the Bar at this time requires deep commitment,” adding that “conduct throughout the NBA electioneering process ought to be solemn and dignified, without razzmatazz.”

His words: “Nigeria is troubled, to put it mildly, and to lead the Bar at this time requires deep commitment – not the usual sort of grandstanding. As a result, after deep reflection, I decided to submit my nomination forms to contest for the President of the Bar. However, cognizant of the spirit of the times, I decided to submit my application solo; no photos, no videos, plain and unaccompanied. For me, conduct throughout the NBA electioneering process ought to be solemn and dignified, without razzmatazz, and I hope that considering the tenor of the times, this becomes a template for other professional bodies and the country as a whole.”

CITY LAWYER recalls that the Electoral Committee of the NBA (ECNBA) had slated 4 pm today as deadline for submission of nomination form and accompanying documents. The election to fill the positions in the NBA National Executive Council holds on July 16, 2022.

NBA PRESIDENCY: GADZAMA, MAIKYAU, TAIDI SET FOR BATTLE, SUBMIT NOMINATION FORMS

Bar Leaders, Chief Joe-Kyari Gadzama SAN, Mr. Yakubu Chonoko Maikyau SAN and Mr. Jonathan Gunu Taidi have thrown their hats into the ring to battle for the presidency of the Nigerian Bar Association (NBA) in the forthcoming National Officers Election, CITY LAWYER can authoritatively report.

This confirms CITY LAWYER report that the three gladiators plan to vie for the position of NBA President. The election is slated for July 16, 2022.

While Gadzama and Maikyau stormed the Electoral Committee of the NBA (ECNBA) office with a retinue of supporters, Taidi told CITY LAWYER that he went “unaccompanied.” His words: “No photos, no video, unaccompanied. For me, conduct throughout the NBA electioneering process should be a template for other professional bodies and the country.”

In an interview after submitting his Nomination Form and accompanying documents, Gadzama said: “We must live up to our roles as the watchdog of the society, the eyes of the blind, the eardrums of the deaf and the mouthpiece of the dumb.”

Accompanied by about 77 supporters, Maikyau said in a video sighted by CITY LAWYER: “You know, Sani is my imam. And so we know without a doubt, because what we brought is coming from those that are blessed and is being received by one who is blessed. There is nothing short of victory to come out of it.”

The ECNBA has set 4 pm today as the deadline for submission of nomination forms.

NBA ELECTION: MAIKYAU, TAIDI’S FATE HANGS IN BALANCE AS LAWYER ‘PETITIONS’ ECNBA

The reported ambition of two leading contenders for the Nigerian Bar Association (NBA) presidency may be in jeopardy as a senior lawyer has demanded interpretation of the NBA Constitution from the Electoral Committee of the NBA (ECNBA).

According to a letter obtained by CITY LAWYER and dated January 25, 2022, former Secretary of the NBA Constitution Review Committee, Mr. Olasupo Ojo has asked the recently inaugurated committee to interpret especially Section 9(3) of the recently amended NBA Constitution.

Meanwhile, Ojo confirmed to CITY LAWYER that he has delivered the letter to the committee, saying: “Yes. It is already delivered to the Chairman and some members. They acknowledged.” On his part, ECNBA Chairman, Mr. Richard Akintunde SAN also told CITY LAWYER that the committee is in receipt of the letter, adding that it would respond in due course.

In the letter addressed to ECNBA Chairman and marked “URGENT” with reference number OO/ECNBA/ABJ/ECNBA/02/22, Ojo wrote: “In the main, I write to formally seek the attention of the ECNBA, for the proper interpretation of the mandatory provisions of section 9(3) of the NBA Constitution as well as paragraphs 2.2(b) and 2.2(d) of the second schedule in light of the forthcoming 2022 NBA National Officers’ election.”

Continuing, the fiery senior lawyer said: “Pursuant to the dictates of section 9(3) of NBA Constitution and paragraphs 2.2(b) and 2.2(d) of the second schedule, the rotation of the candidacy for the office of the presidency amongst different groups/sections in the geographical zones created by the NBA Constitution has been and is an intrinsic provision of the NBA Constitution; which has since been endorsed by the 2020 Electoral Reform and Audit Committee which recommended inter alia that same;

                  “…should be strictly adhered to in order to ensure that no group and/or section in a geographical zone is                         marginalized and the unity of the bar is preserved.”

“This report and recommendation was also given imprimatur by its subsequent adoption by the NBA NEC as contained in the communiqué issued by the President and General Secretary of the Association on March 18, 2021. Kindly find attached the relevant pages of the report, NEC minutes of meeting and communiqué for ease of reference.”

He noted that section 9(3) of the NBA Constitution provides that the country shall be divided into three zones as set out in the Second Schedule for the purposes of election into national offices.

Quoting Paragraph 2.2(b) of the second schedule to the NBA Constitution, Ojo identified the geographical zones as Northern, Eastern and Western Zones, adding that “what constitutes different groups or sections in the NBA Constitution is akin to the geopolitical zones within the geographical zones.”

Ojo noted that Paragraph 2.2(d) of the Second Schedule to the NBA Constitution provides that “Where a position is zoned to any particular geographical zone, the position shall be rotated and held in turn by the different groups and/or sections in the geographical zone.”

According to Ojo, “Having due regard to paragraph 2.2(d) of the second schedule to the NBA Constitution reproduced above, an aspirant to the Office of the Presidency of the NBA has to be from a section/geo-political zone in the geographical zone where the Presidency is zoned, in this case the North for 2022 NBA election, in compliance with the constitutional rotation requirement. This rotation within the geographical zones also applies to the positions of 1st Vice President, 2nd Vice President, 3rd Vice President and General Secretary which have all been zoned to specific geographical zones for the purposes of the 2022 NBA elections as pointed out above. That is to say that within the Western zone, the rotational principle will apply in view of the different sections/groups which are mid-west and south-west while in the Eastern Zone; rotation is to be between the south-south and south-east. In the same vein, the rotation is to be amongst the North-Central, North-West and North-East geopolitical zones within the Northern zone.”

He noted that following the build-up to the 2022 NBA election which has been zoned to the North, “there are several prospective aspirants for the position of the NBA President from the Northern Zone, many of whom have consulted me in respect thereof.

“I seek the clarification and/or confirmation of the ECNBA as to the import of section 9(3) of the NBA Constitution and paragraph 2.2(d) of the second schedule of the NBA Constitution on the 2022 NBA general election in the determination of the issue as to the eligibility status of aspirants emerging from the sub-zones from the North, West and East geopolitical zones respectively with respect to the offices zoned to them.. In my humble view the need for this clarification now is germane to the transparency and fairness of the electoral process and clearly represents the clear and mandatory provision of the just amended NBA Constitution and should ideally therefore be expressly indicated in the guidelines that will be issued and published by the ECNBA in due course.”

Concluding, Ojo wrote: “In the circumstances, I seek the required clarification as it relates to the rotation amongst the various sections/groups within the respective zones that are to produce the next NBA President, General Secretary and Vice Presidents in order to be properly guided as a voter and key stakeholder of the Bar. This is more so as consultations are ongoing and I intend to possibly contest or play key roles in the electioneering process at the appropriate time. I humbly entreat you to treat this matter with utmost fairness, transparency, justice and strict adherence to the rule of law as it is a sensitive issue touching on the future of the Nigerian Bar. I await your prompt response on this matter so that I can be guided accordingly.”

Watchers of NBA politics believe that the petition may affect the political fortunes of two leading contenders for the NBA Presidency, namely Mr. Yakubu Maikyau SAN and immediate past NBA General Secretary, Mr. Jonathan Taidi, leaving the coast clear for another strong contender, Chief Joe-Kyari Gadzama SAN.

While Maikyau is from Kebbi State in the North West Zone, Taidi is from Niger State in the North Central Zone. Gadzama is from Borno State in the North East. It is believed that while the North Central has produced former NBA presidents, Chief Bayo Ojo SAN and Mr. Joseph Daudu SAN both from Kogi State, the North West has produced former NBA President, Mr. Abubakar Mahmoud SAN from Kano State. On the other hand, the North East is yet to produce an NBA President.

It is unclear at press time whether the two leading aspirants are aware of the letter to ECNBA, as they are yet to react to the development.

EX NBA PRESIDENTIAL CANDIDATE, ARTHUR OBI-OKAFOR LOSES MUM

A former Nigerian Bar Association (NBA) presidential candidate, Chief Arthur Obi-Okafor SAN has lost his mother, Iyom Roseline Chika Ijenwa Okafor (DMA).

Iyom Okafor reportedly died on March 24, 2021. A native of Enu Ogbu, Ogbu Abatete in Idemili North Local Government Area of Anambra State, Iyom Okafor was until her death a prominent community leader who also held several positions in the church.

A recipient of the “Diocesan Merit Award” of the Anglican Church of the Niger Diocese, Iyom Okafor was a member of the Niger Diocesan Board of the Niger Diocese of the Anglican Church. She also served as the Treasurer of St. Christopher’s Church, Onitsha and President of Abatete Anglican Church Women (home and abroad) among other positions.

She will be buried on May 21, 2021 at Abatete, Anambra State. She is survived by children, grand-children, sister, cousins, brother-in-law, sister-in-laws and other relations among whom is her eldest Son, Chief Arthur Obi-Okafor (SAN, FCIArb).

ADEGBORUWA OKAYS ADESINA, AJIBADE, AKPATA FOR NBA PRESIDENCY

Firebrand human rights activist, Mr. Ebun-Olu Adegboruwa SAN has declared that the three presidential candidates in the race for the coveted NBA Presidency are qualified to mount the saddle.

In a statement released today titled “NBA ELECTIONS 2020,” the prominent senior lawyer therefore urged eligible voters to vote “purely in the fear of God and according to your conscience.”

A leading presidential candidate in the forthcoming Nigerian Bar Association (NBA) National Elections, Mr. Dele Adesina SAN has received double endorsements by key senior lawyers, including a former Attorney General & Minister of Justice.

I knew Dele Adesina SAN a long time ago. How did we meet each-other? We appeared against each-other in a matter at the Federal High Court. About four Senior Advocates were involved in that matter.

Heated and prolonged arguments had taken place at two different court sessions. At the end of each session, Mr. Adesina and I will appreciate each other for the candour and passion demonstrated in the course of advancing our respective client’s interest in court. One thing led to the other, we became close friends and of course we started paying attention to each-other’s advancement in the Profession.

I found in him a strong and assertive personality. A passionate human being with demonstrable commitment to whatever he believes in. Mr Adesina is a Bar man per excellence, a gentleman to the core. As Chairman, he raised the bar of NBA Ikeja Branch to an unprecedented level.

As General Secretary of the Bar, during the Presidency of Chief Wole Olanipekun SAN OFR, the Executive left a foot-print and verifiable legacy for the Bar. As the Chairman of the Nigerian Bar Association, Rule of Law Action Committee during Okey Wali’s Presidency, he brought tremendous focus and attention into the issues of Rule of Law in the nation.

NBA ELECTORAL COMMITTEE FINALLY DISQUALIFIES OGUNLANA

Controversial NBA presidential aspirant, Mr. Adesina Ogunlana finally been  disqualified from contesting the forthcoming Nigerian Bar Association (NBA) Elections, CITY LAWYER can authoritatively report.

Confirming the incident to CITY LAWYER, a close aide of Ogunlana, Mr. Ayo Ademiluyi however said the former NBA Ikeja Branch Chairman will “definitely” head to court to challenge his disqualification. He said Ogunlana will soon issue a statement on his disqualification.

He said that the Electoral Committee of the NBA (ECNBA) hinged its decision on lack of a Letter of Good Standing from the branch chairman as well as the report of the committee allegedly indicting Ogunlana on the branch insurance funds. Ogunlana has argued that the committee report was not an indictment but merely asked him to account for about N12 million of the branch insurance fund.

Other aspirants whose appeals were also unsuccessful include incumbent NBA Second Assistant Secretary Chinyere Obasi, Messrs S. O. K. Shillings and Promise Wobo Iwezor.

Confirming her disqualification in an online post to her supporters, Obasi said: “Good morning my people. I regret to inform you all that the appeal was refused. ECNBA still stood on sec 8(3) of the NBA constitution 2015 i.e. not being a NEC member for two years before the close of nomination. I thank you all for your support and prayers thus far.”

SANship: AKPATA, OGUNLANA FAULT AWOMOLO, ADESINA SPEAKS

More aspirants have condemned the call by Bar leader, Chief Adegboyega Awomolo SAN that the next president of the Nigerian Bar Association (NBA) should be sourced from the rank of senior advocates.

Awomolo had in a letter to former NBA President, Chief Onomigbo Okpoko SAN stated that “It will be a great failure of leadership for the senior advocates to surrender leadership to the outer bar when there are willing and able senior advocates,” urging him to convene a meeting of the Body of Senior Advocates of Nigeria (BOSAN) to deliberate on the matter. Okpoko is yet to respond to the leaked letter.

One of the presidential aspirants, Dr. Babatunde Ajibade SAN had earlier dissociated himself from the call, saying that “The focus should be on the character, capacity and antecedents of persons who aspire to lead our profession and not on their title or rank.”

While Mr. Dele Adesina SAN did not issue any direct response to the controversial letter, he had prior to the publication of the letter and as a part of his law series, written an article which spoke to the issue. Titled “Insights: A Bar For All,” he wrote: “As a firm believer in the objectives of the Nigerian Bar Association and the role it plays to its members and the community, I believe our Association is at a critical point in history where unity of purpose and synergy among lawyers is in desperate need.

“As such it is not a time for members to instigate division either among the senior members of the Bar and juniors or among the Senior Advocates and Non – Senior Advocates. I believe as members of the NBA, the Association is for the benefit of all members irrespective of position or ilk.

“The Leadership of NBA must always ensure strategic collaboration between the NBA, its Sections, Forums and other bodies such as the Body of Senior Advocates of Nigeria, Law Officers Association of Nigeria, Law Teachers Association of Nigeria, Association of Lawyers with Disabilities in Nigeria, Christian Lawyers Fellowship of Nigeria (CLASFON), Muslim Lawyers Association of Nigeria (MULAN) and ‘Federación Internacional dé Abogadas’ a.k.a. ‘International Federation of Women Lawyers’, Capital Markets Solicitors, and any other interest groups among us.

“Our Association must continue to be a pillar of support and strength for the specialised bodies and individuals in pursuit of their goals and objectives. We must also resist any and all efforts to cause a division among our ranks, if the NBA must remain relevant, active and successful in its role.”

In a terse response on his verified Twitter handle, another presidential aspirant, Mr. Olumide Akpata said: “I have a lot of respect for the rank of SAN & I encourage those who aspire to it. But this letter by Awomolo SAN is a disservice to all lawyers who want a better Bar.” 

On his part, Mr. Adesina Ogunlana, another presidential aspirant who was disqualified by the Electoral Committee of the NBA (ECNBA), in a broadcast on his verified Facebook handle described the letter as “extremely amusing,” adding however that the Bar leader “is entitled to his opinion.” Ogunlana has petitioned the ECNBA over his disqualification.

Hinting that the kernel of Awomolo’s “lamentations” is a quest to “protect the interest of his class”, he stated that Awomolo’s era “generally have failed this country. They have not added value most of the time – good value. They have failed us; it is a failed generation. They are used to privilege. He has not advanced merit in canvassing (Chief) T. J. O. Okpoko.”

He discredited Awomolo’s assertion that all NBA presidents since its rebirth from the 1992 Port Harcourt debacle have all been senior advocates, noting that Chief Lanke Odogiyan completed the tenure of Chief Bayo Ojo SAN.

He said that Awomolo has “exposed the inner thinking, inner workings and the pains and anguish of people they call Body of Senior Advocates of Nigeria, that there is a concerted effort to keep the leadership and all the things that connect to that leadership of the NBA in their ranks.”

Saying that this may explain why all the NBA committees at the national level are headed by SANs, Ogunlana added that “There is a clear intention given by the monopolistic hold of the senior advocates on the NBA that they are the repository of wisdom, that they are the repository of intellectual knowledge.”

He distinguished between the association and the profession, adding that the Bar leader has not only shown that he “is not a democrat,” but is advocating gerontocracy and plutocracy. Describing the rank of senior advocate as “fraudulent,” he stated that any move to amend the NBA Constitution to reserve the position of NBA president for only senior advocates “will be resisted.”

He stated that the issue of leadership of the association “should not be whether the aspirant is a senior advocate or not. “It should be, is this person competent? Does he have the know-how? What is the programme and what can he do? That is the issue?” He stated that voters should cast their ballots for either SANs or non-SANs based on their competence.

Describing Awomolo’s letter as “a gross insult to himself,” Ogunlana stated that the Bar leader has “betrayed that he doesn’t understand and accept democracy for what it is.”

Awomolo’s letter read: “Since you (Okpoko) became the president of the reformed NBA in 1998, and to avoid what happened in Port Harcourt in 1992, all successors to the office of the president have been senior advocates of Nigeria.”

“With respect, I believe you need to urgently call a meeting of the past presidents of the NBA and do all within your powers to preserve the integrity, honour and respectability of the office of the president of the NBA,” Awomolo said.

“What I hear is an unannounced but powerful and potent revolutionary move by our junior colleagues who are very much in larger numbers to wrestle the office of the NBA from the rank of SAN.

“That, in my view will be unfortunate for the rank. To the members of the public a ridicule of the rank and office of the president of the NBA.”

One of the leading aspirants for the presidency of the Nigerian Bar Association (NBA), Mr. Babatunde Ajibade SAN has disagreed sharply with the position of Chief Adegboyega Awomolo SAN on his call for position to be retained within the rank of senior advocates.

Awomolo had in a letter to former NBA President, Chief Onomigbo Okpoko SAN called for a meeting of the Body of Senior Advocates of Nigeria (BOSAN) to deliberate on the matter.

But in a trending post on social media, Ajibade, a senior advocate, disagreed, saying that “The focus should be on the character, capacity and antecedents of persons who aspire to lead our profession and not on their title or rank.”

THE OFFICE OF PRESIDENT OF THE NIGERIAN BAR ASSOCIATION IS NOT THE EXCLUSIVE PRESERVE OF SENIOR ADVOCATES OF NIGERIA – DR. BABATUNDE AJIBADE, SAN

My attention has been drawn to a statement made by Asiwaju Adegboyega Awomolo, SAN in which he suggests that the office of President of the Nigerian Bar Association is the exclusive preserve of Senior Advocates of Nigeria (SANs).

I respectfully disagree with this position. There is nothing contained in the Nigerian Bar Association (NBA) Constitution or in the history of the NBA to support this assertion.

There is near unanimous agreement that one of the most popular and effective Presidents the NBA has had is Late Alao Aka-Basorun and the NBA has had other non-SAN Presidents since.

The focus should be on the character, capacity and antecedents of persons who aspire to lead our profession and not on their title or rank.

There are serious challenges facing the profession at this time and we need to unite the profession in order to effectively address them.

Leading corporate lawyer, Dr. Babatunde Ajibade has joined the race to succeed Mr. Paul Usoro SAN as Nigerian Bar Association (NBA) President, CITY LAWYER can authoritatively report.

The entry of the cerebral lawyer into the already crowded field has thrown spanner in the works, as many consider him a serious contender for the coveted seat. In fact, asked what Ajibade’s chances are to clinch the sought-after seat, a former NBA chieftain told CITY LAWYER that Ajibade is a “potential NBA President.”

Though seemingly a late entrant into the presidential race given that some of the aspirants have been making discreet moves for several months now to push their ambitions, CITY LAWYER gathered at the weekend that Ajibade is not leaving anything to chance in his quest to win the NBA Presidency.

A source close to the NBA Section on Business Law (NBA-SBL) Advisor told CITY LAWYER that Ajibade has commenced aggressive consultations to intimate especially Bar Leaders on his ambition. Although a familiar face in the continuing legal education circuit where he is routinely engaged as a facilitator, there are strong indications that the recently concluded International Bar Association (IBA) conference in Seoul, South Korea may have offered Ajibade a platform to sell his candidacy.

To put the matter of his quest beyond debate, CITY LAWYER gathered from unimpeachable sources that the highly successful corporate lawyer has started telephoning and visiting key Bar Leaders to formally intimate them on his ambition. At least two Bar Leaders confirmed to CITY LAWYER that Ajibade spoke to them on his desire to lead the Bar while a former NBA chieftain said that Ajibade contacted him through a proxy.

In line with the NBA Constitution 2015 (as amended), the next NBA President will emerge from the South West Zone comprising. According to Article 2.2(b) of the Second Schedule to the amended NBA Constitution dealing with ‘Election of National Officers,’ “The positions of the President, 1st Vice President, 2nd Vice President, 3rd Vice President and General Secretary shall rotate among the three zones. In determining the eligibility of a candidate to contest for any of the rotated offices, regard shall be had to a candidate’s Geographical Zone of origin and not the geographical Zone where he/she carries on legal practice.” On the other hand, Article 2.2(e)(iii) lists the States under “Western Zone” as Delta, Edo, Ekiti, Lagos, Ogun, Ondo, Osun and Oyo.

Other aspirants who have been touted for the post of NBA President are another leading and successful corporate lawyer, Mr. Olumide Akpata; former presidential candidate and NBA General Secretary, Mr. Dele Adesina SAN and another erstwhile NBA General Secretary, Mr. Olumuyiwa Akinboro SAN.

Ajibade’s entry into the race has substantially altered the political dynamics for the NBA Presidency race. Aside from being a hugely successful corporate lawyer, Ajibade, like Akpata, is also from NBA Lagos Branch which has always had the largest bloc of votes in NBA elections. Though some question his credentials as a “Bar-man,” many view him as highly cerebral, self-effacing and not having any integrity deficit.

Several Bar Leaders who responded to CITY LAWYER enquiries on his candidacy stated that he is not only eminently qualified for the position but must be seen as a serious contender, adding that other aspirants would ignore him at their own political peril.

While Akpata was before now seen as perhaps the ‘anointed candidate’ of NBA House, impeccable sources told CITY LAWYER that his campaign may have suffered some reversals lately. CITY LAWYER reliably gathered that there is a major schism in Akpata’s camp, with speculations that a major power broker and backer may be having a serious rethink on his support for the highly successful corporate lawyer, immediate past Chairman of the NBA-SBL and Co-Chair of the recently concluded NBA Annual General Conference (AGC). Unless the rift which a source close to the power broker described as having “far reaching consequences” is resolved prior to the opening of ballot, it may eclipse a major support base for Akpata.

Like Alegeh, he is also from Edo State. This is seen as perhaps his biggest hurdle. What is more, Article 2.2(d) of the Second Schedule to the NBA Constitution provides that “Where a position is zoned to any particular geographical zone, the position shall be rotated and held in turn by the different groups and/or sections in the geographical zone.” Akpata is seen as having the brightest chance to wrestle the NBA Presidency from the rank of Senior Advocates of Nigeria who have dominated the post for a long time. A similar potent quest by fiery former NBA General Secretary, Mr. Afam Osigwe was aborted midstream, as he was disqualified by the electoral body. He however blames his ‘political detractors’ for his fate.

Bar watchers told CITY LAWYER at the weekend that unless both Ajibade and Akpata are able to reach an understanding before the elections, they are bound to split their key support base – NBA Lagos Branch – down the middle. Usoro is a member of the branch. Ajibade’s emergence on the scene may have put him in a quandary, even as speculations are rife on whether the NBA President is privy to his quest.

Ajibade’s emergence has also seemingly torpedoed several permutations. A source close to the Legal Practitioners Disciplinary Committee (LPDC), Lagos Zone Chairman told CITY LAWYER thus: “You will know that he would not have resolved to run for NBA Presidency without the support of past and present Bar Leaders.”

Some analysts however argue that his entry into the race has only given additional boost to Akpata’s quest, adding that the Bar is set for a repeat of the 2014 NBA presidential race when three core South West candidates ran against former NBA President, Mr. Augustine Alegeh SAN. With the three candidates – Mrs. Funke Adekoya SAN, Chief Adeniyi Akintola SAN and Mr. Dele Adesina SAN – splitting the South West votes, Alegeh coasted to victory with a total of 691 votes. His runner-up, Adesina, SAN polled 370 votes, Adekoya garnered 255 votes, Akintola received 126 votes while Osas Erhabor brought the rear with 17 votes. The three core South West candidates polled 751 votes, 60 votes more than Alegeh’s.

Some analysts also argue that Ajibade is not a ‘Bar-man,’ adding that his candidacy is not materially different from Akpata’s since they are both successful commercial lawyers from the “Corporate Bloc” of the NBA. But his camp disagrees, saying that his litany of services to the Bar is there for all to see.

The advent of Alegeh has led to a string of successive NBA Presidents emerging from the corporate bloc or ‘big law firms.’ Feelers by CITY LAWYER at the weekend indicate that the face-off between the ‘corporate’ and ‘Bar-men’ blocs will continue and intensify in the forthcoming elections, as the ‘Bar-men’ are desperate to wrest power from their heavy spending corporate counterparts.

A veteran of sorts in the NBA Presidency race, Adesina has his major support base in Ikeja Branch where he held several posts. Ditto for Akinboro who is also a czar of sorts in the Abuja Bar circles. Both are seen as no push-overs in the forthcoming NBA Elections, though some Bar watchers contend that there are a few chinks in their armours which would become apparent as the campaigns heat up.

Ajibade is touted as a go-to lawyer by several international rating agencies including Who is Who Legal, Chambers Global and IFLR 1000. According to a biography by Who is Who Legal, Ajibade is the Managing Partner of SPA Ajibade & Co, a leading corporate and commercial law firm with offices in Lagos, Ibadan and Abuja, Nigeria.

“Babatunde is a dispute resolution specialist and has substantial expertise in international commercial arbitration, especially in the fields of company law, energy law, labour law, hospitality law and investment treaty law. He has acted as counsel in arbitration proceedings involving complicated shareholder disputes arising from alleged breaches of restrictive pre-emptive rights and damages claims arising from alleged breaches of hotel development and management contracts. He has also conducted several ad hoc references and is currently coordinating an investment treaty arbitration claim against a host state. Babatunde also sits as an arbitrator and is currently presiding as sole arbitrator in an international commercial arbitration with its seat in Lagos involving alleged breaches of the terms of an international executive employment contract and as a co-arbitrator in a complicated energy dispute involving crude oil handling, also with its seat in Lagos.

“Babatunde also has extensive experience in all aspects of corporate and commercial litigation. He has prosecuted and defended numerous claims relating to corporate disputes acting on the instructions of shareholders, directors or their companies. He has also prosecuted and defended several claims on behalf of and against banks and insurance companies. He has a firm grasp of the commercial issues involved in such litigation.

“Babatunde is a vice president of the ICC Arbitration Commission’s steering committee, a member of the ICC’s Africa Commission, a director of the Lagos Chamber of Commerce International Arbitration Centre (LACIAC), a member of the LCIA’s African Users Council, a member of the Lagos Court of Arbitration and the Chartered Institute of Arbitrators (UK) Nigeria branch.

“Babatunde was called to the Nigerian Bar in 1989. He obtained a LLM degree in corporate and commercial law in 1990 and a PhD in private international law in 1996, both from King’s College London. He was elevated to the rank of senior advocate of Nigeria in December 2007. He was awarded the International Practice Fellowship of the International Bar Association in Madrid in October 2009 and he became a fellow of the Chartered Institute of Arbitrators UK in January 2015.”
