GADZAMA ASSURES LAWYERS OF OPEN-DOOR POLICY

The Chairman of the Body of Benchers Mentoring Committee for Young Lawyers, Chief Joe-Kyari Gadzama SAN has assured the Nigerian Bar Association (NBA) members that he would operate an open-door policy if elected President.

Gadzama made this promise while addressing NBA Sokoto Branch members at the Amma Hall, Dankani Guest Inn, Sokoto on Friday, May 20, 2022.

A statement on the visit reads:

The learned silk while recounting his vast experiences, said he is more morally, mentally, physically, psychologically and professionally qualified to be the next NBA President. He stated that the Profession of Law made him what he is and that he is ready to give back to the Bar. “I will listen to you, I will give you your dues, I will carry everyone along. I only fear God, I fear no man, I respect every man and I will rebrand the sleeping Giant”. He said.

His Excellency, Alh. Garba Gajam, former Nigerian Ambassador to Kuwait and a two-time Attorney-General of Zamfara state, while giving his speech stated that the only person capable of sustaining what the Current NBA President, Olumide Akpata has done or even better is J-K Gadzama, SAN. He talked about the competence, capacity and capability of JK Gadzama, SAN to be the next NBA President as well as the importance of ensuring J-K Gadzama’s success in the election.

In her welcome address, Soffyah Mohammed Esq., Chairperson, NBA Sokoto Branch, welcomed the Learned silk and his esteemed entourage.

In his goodwill message, The Hon. Attorney-General of Sokoto State, Mr. Suleiman Usman, SAN, stated that Chief J-K Gadzama is a man of many facets, a Bar man who has gained experiences in all areas of Law within and outside of Nigeria and advised Sokoto Lawyers to do the needful in the coming NBA election.

Chief Jacob Enunwe Ochidi, SAN, former Chairman of the Caliphate Bar, while giving his goodwill message, stated that he regretted not voting for J-K Gadzama in times past but said he will do the needful this time around. “I present to you J-K Gadzama, I commend him to you, vote with your conscience and I assure you he will not disappoint us.” He said.

In their individual goodwill messages, Prof Ibrahim Abdulahi, SAN and A. Y. Abubakar Esq. pledged their support and wish J-K. Gadzama, SAN success in the forthcoming 2022 NBA National Election.

Lastly, Junaidu Abubakar Esq. Chairman, NBA Gusau Branch, thanked the Governor of Sokoto State, His Excellency, Rt. Hon Aminu Waziri Tambuwal and the Hon. Attorney-General of Sokoto State, Suleiman Usman, SAN for hosting J-K Gadzama and his entourage.

ECNBA HAMMERS 3 NBA VP ASPIRANTS, AKPATA SETS UP APPEALS C’TES

At least three aspirants vying for the posts of Nigerian Bar Association (NBA) First and Second Vice President have been disqualified from contesting the forthcoming NBA Elections.

CITY LAWYER gathered that several reasons were given by the Electoral Committee of the NBA (ECNBA) from bringing its hammer down on the aspirants.

Meanwhile, NBA President, Mr. Olumide Akpata has set up both national and branch appeals committees to resolve appeals that may arise from disqualification of the aspirants.

The nine-member NBA 2022 National Election Appeals Committee (NNEACO) has renowned chartered arbitrator Funmi Roberts as Chairperson with Mr. Austin Ajineh of NBA Warri Branch as Secretary. 

Three NBA 2022 Branch Election Appeals Committees were also established for the three zones, namely East, West and North.

However, at least one aspirant has kicked against his disqualification. In a trending post on his dedicated WhatsApp platform, Mr. Muhammad Idris Doko of NBA Lagos Branch challenged his disqualification, saying the ECNBA decision “came to me as a rude shock.”

Giving more details on his disqualification, he wrote: “The reason for this is that one of my nominators, a Senior Advocate of Nigeria, is a member of a political party and into active politics. In addition to that, the ECNBA also claimed they could not find evidence of his membership of the National Executive Committee.

“This has come to me as a rude shock but I feel i owe you all a duty to inform you of the present state of things. Your unflinching support over the past few weeks has motivated me so much on this journey and I am forever indebted to you all.”

He vowed to “consider the available options open to me which includes appealing the decision of the ECNBA,” while urging his supporters to “remain calm and steadfast in your support for this project and I promise to inform you of any developments.”

CITY LAWYER gathered that the ECNBA hammer fell on the aspirant as his seconder, Mr. Mohammed Nadayako SAN is a card-carrying member of the Peoples Democratic Party (PDP).

The aspirants were given seven days to appeal the ECNBA decision. In an ECNBA disqualification notice sighted by CITY LAWYER, it wrote: “PLEASE NOTE that by virtue of Part IX, Second Schedule of the Constitution you can appeal to the Election Appeal Committee at e lectionappeal@nigerianbar.org.ng wihtin seven days of the communication of this decision to you.”

MAXIMUS UGWUOKE VISITS NBA LAGOS, IKEJA, IKORODU, VOWS TO END LAWYER BRUTALITY

An aspirant for the post of Nigerian Bar Association (NBA) Welfare Secretary, Mr. Maximus Ugwuoke has visited NBA Lagos, Ikeja and Ikorodu branches where he vowed to end security agencies brutality on lawyers while urging all NBA branches to emulate NBA Lagos Branch by introducing health checks for members.

Below are the statements made available to CITY LAWYER:

“I HAVE THE VISION TO END BRUTALITY ON LAWYERS BY SECURITY AGENTS”- SAYS MAXIMUS UGWUOKE AS HE COMMENDS NBA IKEJA BRANCH.

Frontline aspirant to the office of National Welfare Secretary of Nigeria Bar Association (NBA) Ikechukwu Maximus Ugwuoke has commended the NBA Ikeja Branch for the qualities that make them the Tiger Bar.
Ugwuoke made the observation in his greeting to the Branch during their monthly meeting held yesterday. In his words,

“I thank the Ikeja Branch of the NBA ably led by Bartholomew Aguegbodo Esq for the opportunity given to me to address the members of the branch and interact with them during their monthly meeting held on 9th May 2022 at the branch Secretariat Ikeja. I seized the opportunity to inform the members of the branch that I have successfully submitted my nomination form for the office of National Welfare Secretary of the NBA. I also informed them that what informed my decision to take the step was the good vision I have for the bar which has made some members of the bar to refer to me as Maximus for Maximum Welfare , and which vision I will be sharing with them when the right time for campaign comes.

“I was particularly touched by the case of police brutality and ordeal of a lawyer from Oji River Branch of NBA in Ikeja which formed part of the chairman’s remarks during the meeting . My concern for the report was not only because the Oji River bar is a child of the Enugu Bar where I come from but also because I am a lawyer of human right breed who apart from being a support Lawyer to an international Human Rights NGO, Avocats Sans Frontieres France (ASFF) a.k.a Lawyers without Borders, I am also serving my branch as alternate chairman of the human rights committee. I commend the Chairman of Ikeja Branch for the steps they are taking in the circumstance.

“The issue of brutality on lawyers in the course of their work by security agents call for a common concern to all and I have a vision of how we can put this to a stop as part of my manifesto which I will be unveiling at the appropriate time.

“I was impressed by the massive turn out of members at the meeting, the rich magazine-like package of the minutes of their meetings, the orderly recording of attendance according to call categories of members, the issues discussed during the meetings and the general conduct of her members which indeed qualified the Ikeja branch as the Tiger Bar.”

INTRODUCE ROUTINE HEALTH CHECK FOR LAWYERS DURING MEETINGS – MAXIMUS UGWUOKE CHARGES ALL BRANCHES OF NBA, COMMENDS LAGOS BAR

Ikechukwu Maximus Ugwuoke, a leading aspirant for the office of National Welfare of the Nigeria Bar Association has identified lack of routine health checks by lawyers as one of the major causes of untimely death for lawyers. He made this observation in his commendation message to the Lagos branch of the NBA that held their monthly meeting yesterday which he participated in. In his message Ugwuoke said:

“It was my great pleasure to have participated in Lagos Branch meeting of the NBA held on 9th of May 2022. The Ikechukwu Uwana led executive of the branch was in control all through the meeting which was punctuated with incisive lectures. The health check on members during the meeting which I also witnessed portrays the premium and level of attachment the branch has for the health of her members, a gesture from welfare committee of the branch which indeed excited me for being in line with the NBA of my dream. I charge other branches of the bar to emulate such program of health checks for members during the Branch meeting which is part of the vision I have the bar . This is imperative as Lawyers are prone to some illnesses resulting from the stress associated with the profession and yet they are always too busy to subject themselves to routine health checks. This has resulted to avoidable untimely death of some members of the profession.

“The atmosphere of conviviality and fraternal decorum that enveloped the cocktail party which followed the end of the meeting was impressive and this afforded me the opportunity to meet, connect and network with friends and colleagues at the meeting. I thank the branch for such privilege I had during the meeting.

“LAWYERS ARE TRUE NATION BUILDERS” – MAXIMUS UGWUOKE COMMENDS NBA IKORODU BRANCH.

Ikechukwu Maximus Ugwuoke, frontline aspirant to National Welfare Secretary of the Nigerian Bar Association, has decribed lawyers are True Nation buiders. He made this observation in his commendation message to Ikorodu Branch of NBA in there ongoing law week programme themed “Nation Building : Our collective responsibility “.

According to Ugwuoke, “The theme of the Law week reminds me of the popular poem of Henry Barlow (Uganda) titled “Building the Nation” and the very first stanza of the poem that reads:

‘Today I did my share
In building the nation.
I drove a Permanent Secretary
To an important, urgent function
In fact, to a luncheon at the Vic’

In the same vein, I joined the Ikorodu Branch of the NBA to do our own share of building the nation. I was privileged to be part of the activities of the first day of their law week taking place from 11th to 16th of May 2022. I was privileged to witness their press conference, I interacted with the executives of the branch and the branch Fida executives. I also participated in their road walk against domestic violence. The placards used during the road walk which read ‘NBA say no to drug abuse, NBA say no to Pornography, NBA say no to Domestic Child Labour’ etc were used to drive the messages home as we walked round the streets of Ikorodu.

Lawyers are indeed true nation builders, their contributions to nation building through their services to the nation are unequalled. This is underscored in the following words of Fred Rodell; ‘It is the lawyers who run our civilization for us — our governments, our business, our private lives. Most legislators are lawyers; they make our laws. Most presidents, governors, commissioners, along with their advisers and brain-trusters are lawyers; they administer our laws. All the judges are lawyers; they interpret and enforce our laws. There is no separation of powers where the lawyers are concerned. There is only a concentration of all government power — in the lawyers.’

LAWYER ASKS OONI TO REFUND CLIENTS’ N12M OVER FAILED PROPERTY DEAL

A human rights activist and the Lead Partner at Newworth LLP, Mr. Ayo Ademiluyi has urged the Ooni of Ife, His Royal Majesty, Ooni Enitan Ogunwusi to “direct the refund of the amount owed our clients with interest which has accumulated over the years as our clients are going through hardships.”

In a press statement made available to CITY LAWYER, Ademiluyi whose law firm are solicitors to the alleged victims of the failed property deal, said that Noel Unekwu Abdullahi and Onyeji Johnbosco were approached by a limited liability company, Gran Imperio, a real estate company sometime in 2015 to buy 3 bedroom apartment at Golden Park Estate, Lekki for N20 million respectively.

According to the statement, “NOEL paid the 6.139,800 million naira while JOHNBOSCO paid 6million naira. After several months of waiting, nothing was built. The duo wrote to the Company to refund their money but to no avail.”

BEING TEXT OF A PRESS CONFERENCE HELD AT NEWWORTH LLP, 17, AJASA STREET, LAGOS ISLAND, LAGOS STATE ON THURSDAY, 21ST APRIL, 2022

We are Solicitors to the duo of NOEL UNEKWU ABDULLAHI and ONYEJI JOHNBOSCO (“our clients”) .

The instructions of our clients are that a limited liability company, Gran Imperio, a real estate company approached NOEL and JOHNBOSCO, sometime in 2015 to buy 3 bedroom apartment at Golden Park Estate, Lekki for 20 million naira, respectively.

The Company agreed that they pay in tranches starting with 6million each, as first deposit while they construct the apartment in phases as well and within a given time frame.

NOEL paid the 6.139,800 million naira while JOHNBOSCO paid 6million naira. After several months of waiting, nothing was built. The duo wrote to the Company to refund their money but to no avail.

We conducted a search of Gran Imperio Limited and Metropole Interprojects Limited, we found out that the person of OONIRISA ADEYEYE ENITAN OGUNWUSI is a Director in both companies .

The previous Counsel to our clients contacted the lawyer to the Gran Imperio Group of Companies named Lanre Jolaoso Esq., who afforded the previous Counsel the new Manager’s number, Mr Akin.

Yet, despite correspondences and calls by the previous Counsel with Manager, it has not yielded any fruit since 2020.

The previous counsel sent correspondences to the Palace through UPS courier and through a friend who traveled all the way from Lagos and to the Palace to serve demand notice to his majesty along with an application letter see his majesty.

Equally, calls made by the previous Counsel to the Palace Secretary on same, yielded no fruit whatsoever and howsoever.

We are constrained to make a dispassionate appeal to the esteemed Ooni of Ife, OONIRISA ADEYEYE ENITAN OGUNWUSI as a Director in these companies to direct the refund of the amount owed our clients with interest which has accumulated over the years as our clients are going through hardships.

Former Nigerian Bar Assocaition (NBA) Assistant Publicity Secretary, Mr. Chukwuemeka Mbamala has hailed Catholic mothers on the occasion of their Mothering Sunday.

It is not in doubt that the death of a loved one creates a void and vacuum which only God, the eternal creator can fill. It is my prayer that God Almighty will continue to uphold our dear Dr. Monday Ubani and the entire family in this moment of grief.

I also wish to pray that God will grant journey mercies to all friends and associates of Dr. Ubani who will be travelling to Abia State for the burial ceremony. ‘WHY NBA ABUJA BRANCH CRISIS PERSISTS,’ BY TAIDI

Former Nigerian Bar Association (NBA) General Secretary, Mr. Jonathan Gunu Taidi has identified quest for relevance by some Senior Advocates of Nigeria as the reason for the continued crisis in NBA Abuja Branch.

Speaking on the theme, “Projecting the Future” at the NBA Makurdi Branch Young Lawyers Forum (YLF) Summit, Taidi revealed that while he had the mandate of then NBA leadership to bring peace to the troubled branch, “regrettably some of the senior members of the Inner Bar hijacked the process and thus frustrated our mandate.”

According to Taidi, who is believed to be eyeing the NBA Presidency in the forthcoming National Officers Election, “It is unhealthy to see some senior members of the Inner Bar competing for relevance with the leadership of the Bar. Those efforts are required in the areas of mentorship of our young colleagues who are now in their huge numbers. Indeed, the President of the Bar is president of all whether from the Inner or Outer Bar and there is no room for power or relevance tussle with him.”

REMARKS AT NBA MAKURDI BRANCH YOUNG LAWYERS FORUM SUMMIT ON THE THEME: “PROJECTING THE FUTURE” HELD ON 8TH APRIL, 2022

I am grateful to the Planning Committee for inviting me to chair the session on “Widening Window on Medical Law Practice in Nigeria” and glad that we have on the panel Dr. Ushakuma Anenger who is the Chairman of Association of Resident Doctors in Benue State and our colleague Cleopatra Atsor.

Permit me to congratulate the Chairman and Members of YLF of this branch who have taken this bold initiative of exploring the means through which we can finally widen the opportunities in medical practice for legal practitioners. For me, such an initiative coming from this branch is a wake-up call to other YLF branches yet to catch up with the need to stem the tide of migratory practice that has overburdened our urban branches. I will in particular commend this kind of programme to my home branch, bearing in mind the hydro-electric industry for which Niger State is well known with a view to exploring opportunities in Energy Law practice.

One of the reasons programmes like this are springing up is because of the enabling environment provided for branches of our association by the leadership of President Olumide Akpata. I am proud that he is one of us at the Outer Bar who has performed beyond our expectations.

Under his leadership, our branches are experiencing zero crisis. Of course, the lingering situation in Dutse and Abuja branches were legacy matters that were inherited. While the situation is under control in Dutse Branch, that of Abuja persists largely due to the needless interference of some senior members of the Inner Bar who instigated the crises in the first place.

I chaired a team as General Secretary sometime in the first quarter of 2020 with the sole mandate of conducting unified election for the branch, but regrettably some of the senior members of the Inner Bar hijacked the process and thus frustrated our mandate.

It is unhealthy to see some senior members of the Inner Bar competing for relevance with the leadership of the Bar. Those efforts are required in the areas of mentorship of our young colleagues who are now in their huge numbers. Indeed, the President of the Bar is president of all whether from the Inner or Outer Bar and there is no room for power or relevance tussle with him. I again commend the doggedness of Mr. Akpata who has no rank baggage which would have impeded his ability to confront the issues that have arisen under his leadership.

I am a little ashamed that other professional associations such as the Nigerian Medical Association, Pharmaceutical Society of Nigeria and Nigerian Society of Engineers have long moved away from the teething issues that we continue to grapple with in the legal profession.

On this note, it is my honor to invite Prof. Agbo J. Madaki to speak to his 19-page presentation which has been circulated.

JANADA INTERNATIONAL CENTRE FOR ARBITRATION HOLDS TRAINING

The Janada International Centre for Arbitration and Mediation (JICAM) last Friday commenced the maiden edition of its 2-Day Hybrid Intensive Arbitration Training Program aimed at educating trainees on the rudiments and key elements of Arbitration as well as setting the course for a career pathway in Arbitration and Mediation.

The training program was anchored by the JICAM Governing Council/Faculty Members including Hon. Justice Ibrahim Auta (Rtd) OFR, (Chairman, Governing Council), Chief Joe-Kyari Gadzama SAN, C.Arb, Prof. Paul Idornigie SAN C.Arb, Mrs. Diane Okoko FCIArb.(UK), Prof. Ike Ehiribe FCIArb., Dr. Fidele Masengo PhD and Mr. Samuel Kayode Fagade, MCIArb. (Registrar, Governing Council). Participants included aspirants to the Nigerian Bar, young lawyers, non-lawyers and entrepreneurs who attended both virtually and in-person at the venue, J-K Gadzama Court.

JICAM, an initiative pioneered by the renowned Chief Joe-Kyari Gadzama, SAN, (Chairman, Board of Trustees), had before now been engaged in the following services exclusively: Appointing Authority, Secretarial and Administrative Services, Hearings, Video Conferencing, Transcription, Recording Service, Case Management and Fund Management.

However, with the launch of its maiden edition of the Arbitration Training Program, the institution has expanded its scope from being strictly an Arbitration Centre to a learning portal, having acquired the relevant training license and being constituted with qualified professionals in the field.

According to the centre, “This first edition has so far been an immense success seeing the participation of attendees from different jurisdictions. It is a laudable initiative which offers a golden opportunity to persons desirous of having knowledge in the field of Arbitration.”

In an exclusive interview with the General Manager, Mr. Samuel Fagade, he explained the need for knowledge of Arbitration as the times are changing and disputants seeking more proactive means of resolving disputes. CAC, AMCON, BRIPAN PARTNER TO BOOST SERVICES

The Business Recovery and Insolvency Practitioners Association of Nigeria (BRIPAN) has met with the management of Asset Management Corporation of Nigeria (AMCON) towards improving the insolvency practice and licensing in the country.

The President of BRIPAN, Mr. Ayodele Akintunde, SAN, who led the delegation to AMCON office in Abuja, said the agency had done a good job in trying to stabilise the banking system by ensuring that debts are taken care of.

“The debt recovery regime in Nigeria is still a work in progress such that law reform, training and necessary support are needed to ensure that recovery of debt and sales of assets are easily achievable,” he said.

He said the idea of the visit was to partner with the agency towards improving the insolvency practice and business rescue mechanism available in Nigeria, adding that it was also to improve the training of insolvency practitioners.

The Managing Director of AMCON, Ahmed Kuru, said that the corporation had recovered a debt of N1 trillion since inception “and has anchored a lot of businesses that are presently running.” Kuru said that the corporation had resolved more than four to five thousand business relationships.

He explained that the organisation is not a hospital where if businesses fail, you just walk in and AMCON takes over. According to him, that is a very wrong impression of the corporation. “We don’t take, have not taken and will not take any case like that. AMCON is still battling with the ones taken during the global financial crisis,” he said.

“AMCON is created to buy non-performing loans, resuscitate the non-performing loans even though some of these non-performing loans have been with these banks for more than 10 to 15 years before being transferred to AMCON. AMCON has been able to resolve quite a lot of those transactions and in doing that, it has recovered a lot of funds.”

Also in a visit to the Corporate Affairs Commission (CAC), Akintunde said the essence was to engage with the Registrar-General and his executive team to explore further areas of cooperation.

“As you all know, CAC is a regulator of insolvency practice in Nigeria,” he said. “And as the leading provider of insolvency training and certification in Nigeria, we have come to have a useful discussion with the registrar-general about improving the practice of insolvency, improving the licensing of insolvency, improving training and capacity building even within the CAC and among practitioners.”

Responding, the Registrar-General, Alhaji Garba Abubakar assured BRIPAN of his support in the improvement of insolvency regime in Nigeria.

TAIDI CONDOLES NBA OVER TRAIN ATTACK, ASKS FG TO ACT

The immediate past Nigerian Bar Association (NBA) General Secretary, Mr. Jonathan Taidi has condoled the NBA leadership on the death of some lawyers in the attack on the Abuja-Kaduna train.

Extending his condolence message to the Chairman and members of NBA Kaduna Branch in particular over the loss of three of its members, Taidi said: “My deepest sympathy is with all the families who lost their loved ones on board the train as I join my voice to those who demand that the government immediately accounts for those whose whereabouts are still unknown.”

He urged the Federal Government to act fast to arrest the spate of attacks across the country, adding: “I hereby call on the Federal Government to stop the foot dragging, the feckless reassurances, and the crocodile tears, and actually make drastic changes to the current methodology of crime fighting. It is obvious that whatever it has done till now has not worked and had instead emboldened the bandits to perpetuate even worse atrocities.”

TIME TO OVERHAUL NIGERIA’S SECURITY ARCHITECTURE

INCESSANT INSECURITY: THE FEDERAL GOVERNMENT MUST ACT NOW TO END THESE SENSELESS KILLINGS

The recent twin-attack on the popular Abuja – Kaduna rail line which killed a score of passengers, and left many more wounded or unaccounted for is proof that the Federal Government of Nigeria is sleeping on duty. The second attack actually came within 24 hours of the first and both came only a year after a similar attack was launched on the railway last year shortly after the route became popular as a result of the incessant kidnappings and killings along the Abuja- Kaduna road which made the rail a safer alternative.

Now the bandits have taken away that alternative and we are forced to live like people under permanent siege.

It is impossible to excuse the kind of incompetence that is at work here. At every election we see a massive deployment of security personnel, in their tens of thousands, outside their places of primary assignment, drafted to police the polls, so the question is: why are we not seeing the same kind of commitment now when there is a clear and present danger to the lives of our people traveling this route?

It seems that as far as the government is concerned, winning elections takes precedence over the sacred duty of protecting the lives and property of the people, which is universally acknowledged as the first function of government.

For how long shall we continue to mourn and grieve the loss of our loved ones, colleagues and compatriots while also living in fear for our lives because we know that no one is safe anymore in this country?

I hereby call on the Federal Government to stop the foot dragging, the feckless reassurances, and the crocodile tears, and actually make drastic changes to the current methodology of crime fighting. It is obvious that whatever it has done till now has not worked and had instead emboldened the bandits to perpetuate even worse atrocities.

May I use this medium to commiserate with the president and members of the Nigerian Bar Association in general and the Chairman and Members of NBA Kaduna Branch in particular over the loss of three of its members. My deepest sympathy is with all the families who lost their loved ones on board the train as I join my voice to those who demand that the government immediately accounts for those whose whereabouts are still unknown.

EASTERN BAR FORUM CHIEFTAIN HAILS GADZAMA AT YLF PARLEY

Former Eastern Bar Forum (EBF) Governor, Mr. Soseipriye Long Williams has commended the Chairman of Nigerian Bar Association Security Agencies Relations Committee (NBA-SARC), Chief Joe-Kyari Gadzama SAN on his role as Keynote Speaker at the just concluded Annual Summit of NBA Port Harcourt Branch Young Lawyers Forum (YLF).

Reviewing Gadzama’s speech at the summit, Williams said it was not only in tune with the times but had nuggets that especially young lawyers can deploy to foster their practice. Aligning with the speech, the former EBF helmsman said: “Chief J-K Gadzama has said it all.”

Speaking earlier on the theme, “The New Age: Governance, Technology and Law,” Gadzama admonished young lawyers to embrace the positive impact of science and technology in legal practice. He stated that although the legal industry is faced with challenges of transitioning from analogue to a digitized legal practice, “the future is bright for the Nigerian legal system due to the embrace of legal technology to solve a wide range of legal problems occasioned by globalization.”

The leading litigator challenged young lawyers, who he referred to as the future of the legal profession, to brace up to modern trends across the world as they venture into their legal careers. He hinted that the industry has vast opportunities both in the legal service market and the legal talent market, and urged young lawyers and law students to embrace science and technology in order not to be left behind.

The panel session was chaired by a renowned jurist, Hon. Justice Adolphus Enebeli of the High Court of Rivers State while the panelists included Mr. George Etomi, a leading commercial lawyer; Hon. Justice E. N. Thompson of the High Court of Rivers State and Chairman, Rivers State Judiciary ICT Committee; Professor O. W. Igwe of the Rivers State University, Port Harcourt; Mrs. Inemesit Dike, Founder, Legal X App and CEO Legal Concierge, and Hon. Justice Gbasam Okogbule.

BRIPAN TO PARTNER CAC, OTHERS FOR BETTER SERVICES

The Business Recovery and Insolvency Practitioners Association of Nigeria (BRIPAN) says it is poised to bolster its engagement with the Corporate Affairs Commission (CAC) for improved service delivery.

The newly sworn-in President of BRIPAN, Mr. Ayodele Akintunde, SAN, made the remark during the inauguration of the 2022-2023 executive members in Lagos.

Akintunde assured that the new leadership would continue to constructively engage with the regulatory agencies to ensure better synergy in the interest of its members and the country. “These engagements will help improve the customer experience of our members at the CAC and their overall experience when handling insolvency matters in the Federal High Court,” he said.

He stressed that strategic collaborations and partnerships would be the focus of the new leadership, saying: “In the past, we have partnered with the Nigerian Stock Exchange (NSE), Securities and Exchange Commission (SEC), Asset Management Corporation of Nigeria (AMCON) and Nigeria Deposit Insurance Corporation (NDIC).

“We have also partnered with the INSOL International (International Association of Restructuring, Insolvency & Bankruptcy Professionals), Africa Roundtable, Developmental Agencies and even CAC in the areas of training and policy development in the insolvency space in Nigeria and Africa.

“The new exco will continue to forge better relationships with these organisations as well as with the Nigerian Bar Association (NBA) and the Institute of Chartered Accountants of Nigeria (ICAN) which most of our members belong to.”

According to Akintunde, “The recognition of BRIPAN as the foremost body of business rescue and insolvency professionals in Nigeria by Companies and Allied Matters Act (CAMA) 2020 has thrust a lot of responsibility on us and we must continue to improve the theory and practice of insolvency.

“We should jealously guard our recognition as the best trainers of insolvency professionals in Nigeria. We must all work to consolidate this milestone achievement by making BRIPAN stronger, more effective and more responsive in the business rescue and insolvency space in Nigeria.”

He said BRIPAN would not rest on its oars but will continue to engage key stakeholders such as the judiciary, CAC and SEC to facilitate the requisite reforms.

NDDC SCHOLARS SEND ‘SOS’ TO BUHARI

Many beneficiaries of the (Niger Delta Development Commission) NDDC International Postgraduate Scholarship scheme have urged President Muhammadu Buhari to intervene and save them from being thrown out of school due to non-payment of tuition fees among others.

In two letters made available to CITY LAWYER, the PHD scholars who are studying in Russia and the United Kingdom stated that “our sponsor has again defaulted in remitting our tuition and upkeep overdue for payment since May 2021, thus leaving us destitute and in severe suffering, as well as exposing us to danger especially given the COVID-19 pandemic times that we currently live in.”

They also noted that “Previous payments only came in after your timely intervention through a presidential order after series of protests in the United Kingdom by scholars, and we still have a few number of us whose payments were omitted.”

Titled “REQUEST FOR YOUR FATHERLY INTERVENTION ON THE PAYMENT OF OUR TUITION AND UPKEEP GRANT,” the letter read: “We the awardees of NDDC international postgraduate scholarship in the UK and across the world, in pursuit of doctoral research in various field of study, sincerely thank you for availing us with the opportunity to be international scholars under your immeasurable leadership. We are not oblivious of your immerse (sic) and timely intervention in August, 2020 which led to the payments of a-year overdue tuition and stipends to majority MSc and PhD Scholars who were hitherto abandoned, we are eternally grateful and appreciate you for all your efforts in handling the numerous challenges threatening to divide our nation.”

According to the scholars, “In the light of the withdrawal letters issued to 5 PhD scholars by their schools and the present inhumane conditions such a few of us have been subjected to across the various universities due to default in the payment of our tuition/upkeeps by the commission. We hereby, in humility of heart submit this letter to appeal for your fatherly intervention on our behalf. The scholarship is valued at $30,000 (Thirty Thousand U.S. Dollars) only per year which covers tuition, accommodation and living expenses and is supposed to be paid out annually for a maximum of 3 years for all Ph.D. scholars.”

Noting that the 2018 awardees “should be submitting thesis early next year,” the stranded students said: “We are in a very desperate situation as our schools are on our necks to pay our tuition, yet we can barely feed and settle basic bills. We have had to reach out to charity organizations for help and beg our schools’ officials and landlords to give us more time. So, we use this medium to appeal to you sir, as the father of the nation Nigeria, to please intervene on our matter and see to the full funding of our scholarship. It is abnormal for NDDC to be waiting for its scholars to embark on protests in embassies and high commissions overseas before it settles fees of scholars sent abroad for the good of the country and region.”

The letter was copied to the Secretary to the Government of the Federation (SGF) of Nigeria, Mr. Boss Mustapha; Senate President, Senator Ahmed Lawal; Speaker, House of Representatives, Hon. Femi Gbajabiamila and Minister of Niger Delta Affairs, Senator Godswill Akpabio.

It is recalled that the Niger Delta Students Association recently staged a protest in Port Harcourt in solidarity with the stranded scholars.

Following an earlier protest, NDDC’s Corporate Affairs Director, Mr. Charles Odili had said, “In keeping with our commitment to funding the Niger Delta Development Commission, NDDC, Foreign Scholarship Programme, the Interim Management Committee, IMC, has paid $5,910,000 to 197 scholarship beneficiaries of 2019, while payment processes for 94 beneficiaries of 2018 are ongoing.

“Among the 197 beneficiaries are 43 scholars for Doctor of Philosophy, PhD, comprising 12 for 2016 and 31 for 2019. This category got $30,000 each, amounting to $1,290,000. The Masters category has 154 MSC beneficiaries of 2019, who were paid $30,000 each, amounting to $4, 420,000. The payment processes for 94 beneficiaries of 2018; 40 for Ph.D. and 54 for MSC, are ongoing.”

CABLE TV PROFITEERING MUST CEASE NOW – ADEGBORUWA

In this article, leading human rights activist, By Ebun-Olu Adegboruwa, SAN argues that cable television service providers must change their billing system to a more humane model, urging the National Broadcasting Commission (NBC) to wake up to its regulatory duties.

It was like a movie, watching the proceedings of the Ad Hoc Committee set up by the House of Representatives, to probe the hike of subscription rates by cable television service providers. The Chairman of the said Committee, Hon Unyime Idem, took me back to my Aluta days at Obafemi Awolowo University (Great Ife), roaring like a lion and reeling out the will of the people of Nigeria with such vehemence, on these shylock entities called cable television companies. The Committee had summoned the lameduck Nigeria Broadcasting Commission, NBC, which has for years unleashed a monopoly upon Nigerians, to milk us dry, without effective statutory regulation. NBC was asked to explain why DSTV and other cable service providers have blatantly and arrogantly refused to introduce pay as you view to their customers. For the avoidance of any doubt whatsoever, let me restate the status quo of this broadcasting brouhaha.

The cable television service providers force their customers into a monthly regime of subscription, irrespective of the conditions of viewing, the quality of the service or even its availability. So, you pay for DSTV in your house for a whole month or a whole year, you pay for DSTV in your office, you pay for DSTV in your village, you pay for DSTV in your guest house in Abuja or anywhere else you have some presence. The cable television company keeps collecting money for dormant viewing or no viewing and keeps smiling to the bank everyday, upon the sweat and suffering of its customers. Not being God with the capacity to be omnipresent, a human being can only be at a single location at a given time. Whilst your television in the office is off at night or anytime you are not there, you keep paying for viewing nothing; when you travel outside Nigeria or you are away from your house or your office, you keep servicing the empty apartment through monthly or yearly payment. When you happen to pop in and you are ready to watch the television just may be once in a month, it would suddenly go off, due to bad weather, poor connection, thunderstorm or common rainfall, but you have paid to the company and you must keep paying. Thus, the situation with many Nigerians is that we are forced to subsidize the greed of the cable television service providers, which profit from services not rendered and they are not willing to change, taking this as some kind of windfall.

“All people of good conscience must commend the House of Representatives for this bold initiative, while we urge the Senate to join the crusade to free us from this commercial exploitation. How many more years does DSTV require to recoup capital since these many decades of extortion? This must not be another flash in the pan, or the usual noise-making gathering, that will be swept under the dirty Nigerian carpet.”

The National Broadcasting Commission Act is very clear, in terms of the powers vested upon the NBC to regulate the broadcasting industry in Nigeria, especially in section 2 thereof. The NBC is empowered to regulate and control the broadcasting industry, to investigate complaints regarding the contents of a broadcast and the conduct of broadcasting stations and upholding the principles of equity and fairness in broadcasting, etc. As you would well agree with me, the NBC has so far turned a blind eye to the exploitative tendencies of the cable television service providers, with scant regard for the onerous responsibility imposed upon it by law to ensure “strict adherence to the national laws, rules and regulations relating to the participation of foreign capital in relation to local capital in broadcasting”.Nigerians have before now protested, they have filed cases in court and they have written several complaints to the National Assembly, all to no avail, as the service providers have insisted on maximum profit, without regard for the satisfaction or plight of their customers. And the questions keep popping up all the time: why is there only one company in a country of about two hundred million people, providing cable television service? Why DSTV only? Why has NBC become so weak and dysfunctional to become totally incapable of protecting the people that it was set up to serve? When will the exploitation end? Why is it impossible to hold DSTV accountable to the same pay per view policy that the same company is implementing in its home country and indeed other African countries? So many questions indeed.

If your subscription to cable television expires, you are disconnected instantly and automatically, but when you renew it, you have to call customer service to get reconnected, going through all manner of manipulative regimes that may cause you days of inactive service despite payment which is already running. What has NBC done, to advocate for extension of viewing time to correspond to the period of inactive service after payment? How do you allow a company floated by private individuals for their own personal profit, to ride roughshod over a whole nation, rendering all of us helpless and exploited? During the initial life of GSM service providers in Nigeria, we heard all manner of stories and arguments why it was impossible to provide calls per second, until another network came on board and revolutionized GSM in Nigeria, thus freeing us from the commercial bondage. It is the same story with DSTV and other cable television service providers. Attempts have been made in the past to compete with DSTV and break its monopoly, through HITV and lately TSTV, all of which did not materialize. Why? Only NBC can answer that question successfully.

This was the scenario until June 25, 2020, when the House of Representatives through its Ad Hoc Committee gave a marching order to DSTV and other cable television service providers to begin the implementation of the pay per view policy immediately.There had been a debate on the floor of the House earlier, when Honourable Idem and other members took up this challenge. Let us go through the newsreport of the proceedings of the House:

“DSTV and other Direct-to-home service providers have deliberately refused to implement the pay as you go plan but rather charge users on a fixed monthly tariff plan, unlike what is obtained outside Nigeria.”

He also explained that Nigeria constitutes over 40% of the total subscribers of DSTV, adding that Nigerians do not get to use the monthly subscription due to one reason or another. Also speaking in support of the motion, Aminu Suleiman called for an end to the monopoly enjoyed by DSTV.

“I have attempted for over a year now to sponsor a motion on the inhuman treatment the DSTV is dishing out to TV watchers in Nigeria. I say that because it is not only in Kenya that DSTV is operating the Pay-As-You view. It is just an abuse and playing with the intelligence of Nigerians. And the monopoly they enjoy contributes to this fact. We will have to encourage NCC to unbundle the entire process and allow investors to come in. They are South African companies, and they don’t do this general viewing to the South African viewers.”

This was the background, when the cable television companies met with the Ad Hoc Committee of the House on June 25, 2020. The Committee did not mince words at all, as it thundered and roared, very loud and clear. The Committee Chairman, Honourable Idem, stated in no uncertain terms that there will be no way for the companies to maneuver the system this time around, as a decision had been taken already, to ensure pay per view. It is for the companies to go back and fine tune the process of implementation, he said. I was moved to tears watching the proceedings of the Committee. I mean this is why we elected them in the first place, or else why should we all become so helpless to continue to tolerate the insensitivity of just one company, for these many years? When there is a power outage and your television and cable network are not powered, you are still paying for viewing nothing! Come on DSTV, this profiteering must come to an end! It is sheer wickedness and economic witchcraft, to continue to insist on the regime of monthly subscription; indeed it is ungodly, especially when this is not the practice in the home country of your company, South Africa. How do we allow a foreign investor, in the name of recouping capital, to invade our land with a shylock policy that it would dare not implement in its own country? How do people take us for granted in this way, if not for the active collusion of our citizens who have been entrusted with power to regulate but have surrendered themselves to be regulated instead?

All people of good conscience must commend the House of Representatives for this bold initiative, while we urge the Senate to join the crusade to free us from this commercial exploitation. This must not be another flash in the pan, or the usual noise-making gathering, that will be swept under the dirty Nigerian carpet. No, we must follow up with this to ensure it is implemented to the letter. The NBC must wake up and assert its authority on behalf of the people of Nigeria, to implement the pay per view policy, by all means necessary. Our representatives in the National Assembly have spoken our minds and there is no further assurance than the words spoken at the proceedings of the Ad Hoc Committee of the House of Representatives. Enough is enough. Do I hear your loud voice in support, roaring like thunder!

CLAMPDOWN: AUTO DEALERS TO SUE CUSTOMS

A group of automobile dealers in Lagos State has threatened to drag the Nigerian Customs Service to court over the sealing of their business premises.

In a letter to the Comptroller General of Nigeria Customs Service through the law firm of Ubani & Co, the group condemned the September 30, 2019 raid and sealing of their offices by customs operatives, saying that the action of the agency was “a demonstration of gross irresponsibility, unprecedented impunity and abuse of power.” They also noted that all the cars in their business premises were duly cleared and appropriate duties paid to the Federal Government.

The group in the letter which was also forward to the Senate President, Speaker of House of Representatives and Attorney General of the Federation, warned that if their business premises were not opened in the next 14 days with a compensation of N10 billion for businesses losses during the period of closure, they would have no other option than to approach the court for redress.

Part of the letter which also serves as a pre-action notice reads:

“We must state here with all sense of responsibility and patriotism that the action of Nigeria custom officers in this regard is a demonstration of gross irresponsibility, unprecedented impunity and abuse of power.

“Though the Nigerian Customs & Excise Management Act gives you the power to examine, mark, seal and take account of any goods …, in this case, you did not examine, mark, seal and take account of the particular vehicles identified as not being properly cleared, but rather sealed up the entire premises without any form of examination or inspection of papers.

” This very act of yours has no protection under the Act, but smacks of impunity, illegality and flagrant abuse of executive power.

“No law under our law books, including the Customs & Excise Management Act, empowers you to take the steps you have taken in the manner you have taken it.

“The action of the Nigerian Customs is not only lawless but very oppressive. The moment when Nigerian Government agencies elevate the pursuit of revenue above the right and welfare of the citizens, Nigeria is doomed, but God forbid that things degenerate to that level.

“Take notice therefore that you have 14 days from the day you receive this letter to unseal all our Client’s members’ business premises to enable them carry out their lawful businesses as Nigerian citizens.

“Take further notice that you have a period of 30 days from the date you receive this letter to pay a compensation of N10Billion to our Clients for the severe hardship, suffering, embarrassment, loss of business, physical, mental and psychological torture and trauma your arbitrary, lawless and inconsiderate action has caused our clients and their families failing which our Client shall be left with no other option than to seek redress through a competent court of law.”
